`Sec.1201.Circumventionofcopyrightprotectionsystems

`(a)VIOLATIONSREGARDINGCIRCUMVENTIONOFTECHNOLOGICALMEASURES-(1)(A)Nopersonshallcircumventatechnologicalmeasurethateffectivelycontrolsaccesstoaworkprotectedunderthistitle.Theprohibitioncontainedintheprecedingsentenceshalltakeeffectattheendofthe2-yearperiodbeginningonthedateoftheenactmentofthischapter.

`(B)Theprohibitioncontainedinsubparagraph(A)shallnotapplytopersonswhoareusersofacopyrightedworkwhichisinaparticularclassofworks,ifsuchpersonsare,orarelikelytobeinthesucceeding3-yearperiod,adverselyaffectedbyvirtueofsuchprohibitionintheirabilitytomakenoninfringingusesofthatparticularclassofworksunderthistitle,asdeterminedundersubparagraph(C).

`(C)Duringthe2-yearperioddescribedinsubparagraph(A),andduringeachsucceeding3-yearperiod,theLibrarianofCongress,upontherecommendationoftheRegisterofCopyrights,whoshallconsultwiththeAssistantSecretaryforCommunicationsandInformationoftheDepartmentofCommerceandreportandcommentonhisorherviewsinmakingsuchrecommendation,shallmakethedeterminationinarulemakingproceedingontherecordforpurposesofsubparagraph(B)ofwhetherpersonswhoareusersofacopyrightedworkare,orarelikelytobeinthesucceeding3-yearperiod,adverselyaffectedbytheprohibitionundersubparagraph(A)intheirabilitytomakenoninfringingusesunderthistitleofaparticularclassofcopyrightedworks.Inconductingsuchrulemaking,theLibrarianshallexamine--

`(i)theavailabilityforuseofcopyrightedworks;

`(ii)theavailabilityforuseofworksfornonprofitarchival,preservation,andeducationalpurposes;

`(iii)theimpactthattheprohibitiononthecircumventionoftechnologicalmeasuresappliedtocopyrightedworkshasoncriticism,comment,newsreporting,teaching,scholarship,orresearch;

`(iv)theeffectofcircumventionoftechnologicalmeasuresonthemarketfororvalueofcopyrightedworks;and

`(v)suchotherfactorsastheLibrarianconsidersappropriate.

`(D)TheLibrarianshallpublishanyclassofcopyrightedworksforwhichtheLibrarianhasdetermined,pursuanttotherulemakingconductedundersubparagraph(C),thatnoninfringingusesbypersonswhoareusersofacopyrightedworkare,orarelikelytobe,adverselyaffected,andtheprohibitioncontainedinsubparagraph(A)shallnotapplytosuchuserswithrespecttosuchclassofworksfortheensuing3-yearperiod.

`(E)Neithertheexceptionundersubparagraph(B)fromtheapplicabilityoftheprohibitioncontainedinsubparagraph(A),noranydeterminationmadeinarulemakingconductedundersubparagraph(C),maybeusedasadefenseinanyactiontoenforceanyprovisionofthistitleotherthanthisparagraph.

`(2)Nopersonshallmanufacture,import,offertothepublic,provide,orotherwisetrafficinanytechnology,product,service,device,component,orpartthereof,that--

`(A)isprimarilydesignedorproducedforthepurposeofcircumventingatechnologicalmeasurethateffectivelycontrolsaccesstoaworkprotectedunderthistitle;

`(B)hasonlylimitedcommerciallysignificantpurposeoruseotherthantocircumventatechnologicalmeasurethateffectivelycontrolsaccesstoaworkprotectedunderthistitle;or

`(C)ismarketedbythatpersonoranotheractinginconcertwiththatpersonwiththatperson'sknowledgeforuseincircumventingatechnologicalmeasurethateffectivelycontrolsaccesstoaworkprotectedunderthistitle.

`(3)Asusedinthissubsection--

`(A)to`circumventatechnologicalmeasure'meanstodescrambleascrambledwork,todecryptanencryptedwork,orotherwisetoavoid,bypass,remove,deactivate,orimpairatechnologicalmeasure,withouttheauthorityofthecopyrightowner;and

`(B)atechnologicalmeasure`effectivelycontrolsaccesstoawork'ifthemeasure,intheordinarycourseofitsoperation,requirestheapplicationofinformation,oraprocessoratreatment,withtheauthorityofthecopyrightowner,togainaccesstothework.

`(b)ADDITIONALVIOLATIONS-(1)Nopersonshallmanufacture,import,offertothepublic,provide,orotherwisetrafficinanytechnology,product,service,device,component,orpartthereof,that--

`(A)isprimarilydesignedorproducedforthepurposeofcircumventingprotectionaffordedbyatechnologicalmeasurethateffectivelyprotectsarightofacopyrightownerunderthistitleinaworkoraportionthereof;

`(B)hasonlylimitedcommerciallysignificantpurposeoruseotherthantocircumventprotectionaffordedbyatechnologicalmeasurethateffectivelyprotectsarightofacopyrightownerunderthistitleinaworkoraportionthereof;or

`(C)ismarketedbythatpersonoranotheractinginconcertwiththatpersonwiththatperson'sknowledgeforuseincircumventingprotectionaffordedbyatechnologicalmeasurethateffectivelyprotectsarightofacopyrightownerunderthistitleinaworkoraportionthereof.

`(2)Asusedinthissubsection--

`(A)to`circumventprotectionaffordedbyatechnologicalmeasure'meansavoiding,bypassing,removing,deactivating,orotherwiseimpairingatechnologicalmeasure;and

`(B)atechnologicalmeasure`effectivelyprotectsarightofacopyrightownerunderthistitle'ifthemeasure,intheordinarycourseofitsoperation,prevents,restricts,orotherwiselimitstheexerciseofarightofacopyrightownerunderthistitle.

`(c)OTHERRIGHTS,ETC.,NOTAFFECTED-(1)Nothinginthissectionshallaffectrights,remedies,limitations,ordefensestocopyrightinfringement,includingfairuse,underthistitle.

`(2)Nothinginthissectionshallenlargeordiminishvicariousorcontributoryliabilityforcopyrightinfringementinconnectionwithanytechnology,product,service,device,component,orpartthereof.

`(3)Nothinginthissectionshallrequirethatthedesignof,ordesignandselectionofpartsandcomponentsfor,aconsumerelectronics,telecommunications,orcomputingproductprovideforaresponsetoanyparticulartechnologicalmeasure,solongassuchpartorcomponent,ortheproductinwhichsuchpartorcomponentisintegrated,doesnototherwisefallwithintheprohibitionsofsubsection(a)(2)or(b)(1).

`(4)Nothinginthissectionshallenlargeordiminishanyrightsoffreespeechorthepressforactivitiesusingconsumerelectronics,telecommunications,orcomputingproducts.

`(d)EXEMPTIONFORNONPROFITLIBRARIES,ARCHIVES,ANDEDUCATIONALINSTITUTIONS-(1)Anonprofitlibrary,archives,oreducationalinstitutionwhichgainsaccesstoacommerciallyexploitedcopyrightedworksolelyinordertomakeagoodfaithdeterminationofwhethertoacquireacopyofthatworkforthesolepurposeofengaginginconductpermittedunderthistitleshallnotbeinviolationofsubsection(a)(1)(A).Acopyofaworktowhichaccesshasbeengainedunderthisparagraph--

`(A)maynotberetainedlongerthannecessarytomakesuchgoodfaithdetermination;and

`(B)maynotbeusedforanyotherpurpose.

`(2)Theexemptionmadeavailableunderparagraph(1)shallonlyapplywithrespecttoaworkwhenanidenticalcopyofthatworkisnotreasonablyavailableinanotherform.

`(3)Anonprofitlibrary,archives,oreducationalinstitutionthatwillfullyforthepurposeofcommercialadvantageorfinancialgainviolatesparagraph(1)--

`Sec.512.Limitationsonliabilityrelatingtomaterialonline

`(a)TRANSITORYDIGITALNETWORKCOMMUNICATIONS-Aserviceprovidershallnotbeliableformonetaryrelief,or,exceptasprovidedinsubsection(j),forinjunctiveorotherequitablerelief,forinfringementofcopyrightbyreasonoftheprovider'stransmitting,routing,orprovidingconnectionsfor,materialthroughasystemornetworkcontrolledoroperatedbyorfortheserviceprovider,orbyreasonoftheintermediateandtransientstorageofthatmaterialinthecourseofsuchtransmitting,routing,orprovidingconnections,if--

`(1)thetransmissionofthematerialwasinitiatedbyoratthedirectionofapersonotherthantheserviceprovider;

`(2)thetransmission,routing,provisionofconnections,orstorageiscarriedoutthroughanautomatictechnicalprocesswithoutselectionofthematerialbytheserviceprovider;

`(3)theserviceproviderdoesnotselecttherecipientsofthematerialexceptasanautomaticresponsetotherequestofanotherperson;

`(4)nocopyofthematerialmadebytheserviceproviderinthecourseofsuchintermediateortransientstorageismaintainedonthesystemornetworkinamannerordinarilyaccessibletoanyoneotherthananticipatedrecipients,andnosuchcopyismaintainedonthesystemornetworkinamannerordinarilyaccessibletosuchanticipatedrecipientsforalongerperiodthanisreasonablynecessaryforthetransmission,routing,orprovisionofconnections;and

`(5)thematerialistransmittedthroughthesystemornetworkwithoutmodificationofitscontent.

`(b)SYSTEMCACHING-

`(1)LIMITATIONONLIABILITY-Aserviceprovidershallnotbeliableformonetaryrelief,or,exceptasprovidedinsubsection(j),forinjunctiveorotherequitablerelief,forinfringementofcopyrightbyreasonoftheintermediateandtemporarystorageofmaterialonasystemornetworkcontrolledoroperatedbyorfortheserviceproviderinacaseinwhich--

`(A)thematerialismadeavailableonlinebyapersonotherthantheserviceprovider;

`(B)thematerialistransmittedfromthepersondescribedinsubparagraph(A)throughthesystemornetworktoapersonotherthanthepersondescribedinsubparagraph(A)atthedirectionofthatotherperson;and

`(C)thestorageiscarriedoutthroughanautomatictechnicalprocessforthepurposeofmakingthematerialavailabletousersofthesystemornetworkwho,afterthematerialistransmittedasdescribedinsubparagraph(B),requestaccesstothematerialfromthepersondescribedinsubparagraph(A),

iftheconditionssetforthinparagraph(2)aremet.

(2)CONDITIONS-Theconditionsreferredtoinparagraph(1)arethat--

`(A)thematerialdescribedinparagraph(1)istransmittedtothesubsequentusersdescribedinparagraph(1)(C)withoutmodificationtoitscontentfromthemannerinwhichthematerialwastransmittedfromthepersondescribedinparagraph(1)(A);

`(B)theserviceproviderdescribedinparagraph(1)complieswithrulesconcerningtherefreshing,reloading,orotherupdatingofthematerialwhenspecifiedbythepersonmakingthematerialavailableonlineinaccordancewithagenerallyacceptedindustrystandarddatacommunicationsprotocolforthesystemornetworkthroughwhichthatpersonmakesthematerialavailable,exceptthatthissubparagraphappliesonlyifthoserulesarenotusedbythepersondescribedinparagraph(1)(A)topreventorunreasonablyimpairtheintermediatestoragetowhichthissubsectionapplies;

`(C)theserviceproviderdoesnotinterferewiththeabilityoftechnologyassociatedwiththematerialtoreturntothepersondescribedinparagraph(1)(A)theinformationthatwouldhavebeenavailabletothatpersonifthematerialhadbeenobtainedbythesubsequentusersdescribedinparagraph(1)(C)directlyfromthatperson,exceptthatthissubparagraphappliesonlyifthattechnology--

`(i)doesnotsignificantlyinterferewiththeperformanceoftheprovider'ssystemornetworkorwiththeintermediatestorageofthematerial;

`(ii)isconsistentwithgenerallyacceptedindustrystandardcommunicationsprotocols;and

`(iii)doesnotextractinformationfromtheprovider'ssystemornetworkotherthantheinformationthatwouldhavebeenavailabletothepersondescribedinparagraph(1)(A)ifthesubsequentusershadgainedaccesstothematerialdirectlyfromthatperson;

`(D)ifthepersondescribedinparagraph(1)(A)hasineffectaconditionthatapersonmustmeetpriortohavingaccesstothematerial,suchasaconditionbasedonpaymentofafeeorprovisionofapasswordorotherinformation,theserviceproviderpermitsaccesstothestoredmaterialinsignificantpartonlytousersofitssystemornetworkthathavemetthoseconditionsandonlyinaccordancewiththoseconditions;and

`(E)ifthepersondescribedinparagraph(1)(A)makesthatmaterialavailableonlinewithouttheauthorizationofthecopyrightownerofthematerial,theserviceproviderrespondsexpeditiouslytoremove,ordisableaccessto,thematerialthatisclaimedtobeinfringinguponnotificationofclaimedinfringementasdescribedinsubsection(c)(3),exceptthatthissubparagraphappliesonlyif--

`(i)thematerialhaspreviouslybeenremovedfromtheoriginatingsiteoraccesstoithasbeendisabled,oracourthasorderedthatthematerialberemovedfromtheoriginatingsiteorthataccesstothematerialontheoriginatingsitebedisabled;and

`(ii)thepartygivingthenotificationincludesinthenotificationastatementconfirmingthatthematerialhasbeenremovedfromtheoriginatingsiteoraccesstoithasbeendisabledorthatacourthasorderedthatthematerialberemovedfromtheoriginatingsiteorthataccesstothematerialontheoriginatingsitebedisabled.

`(c)INFORMATIONRESIDINGONSYSTEMSORNETWORKSATDIRECTIONOFUSERS-

`(1)INGENERAL-Aserviceprovidershallnotbeliableformonetaryrelief,or,exceptasprovidedinsubsection(j),forinjunctiveorotherequitablerelief,forinfringementofcopyrightbyreasonofthestorageatthedirectionofauserofmaterialthatresidesonasystemornetworkcontrolledoroperatedbyorfortheserviceprovider,iftheserviceprovider--

`(A)(i)doesnothaveactualknowledgethatthematerialoranactivityusingthematerialonthesystemornetworkisinfringing;

`(ii)intheabsenceofsuchactualknowledge,isnotawareoffactsorcircumstancesfromwhichinfringingactivityisapparent;or

`(iii)uponobtainingsuchknowledgeorawareness,actsexpeditiouslytoremove,ordisableaccessto,thematerial;

`(B)doesnotreceiveafinancialbenefitdirectlyattributabletotheinfringingactivity,inacaseinwhichtheserviceproviderhastherightandabilitytocontrolsuchactivity;and

`(C)uponnotificationofclaimedinfringementasdescribedinparagraph(3),respondsexpeditiouslytoremove,ordisableaccessto,thematerialthatisclaimedtobeinfringingortobethesubjectofinfringingactivity.

`(2)DESIGNATEDAGENT-Thelimitationsonliabilityestablishedinthissubsectionapplytoaserviceprovideronlyiftheserviceproviderhasdesignatedanagenttoreceivenotificationsofclaimedinfringementdescribedinparagraph(3),bymakingavailablethroughitsservice,includingonitswebsiteinalocationaccessibletothepublic,andbyprovidingtotheCopyrightOffice,substantiallythefollowinginformation:

`(A)thename,address,phonenumber,andelectronicmailaddressoftheagent.

`(B)othercontactinformationwhichtheRegisterofCopyrightsmaydeemappropriate.

TheRegisterofCopyrightsshallmaintainacurrentdirectoryofagentsavailabletothepublicforinspection,includingthroughtheInternet,inbothelectronicandhardcopyformats,andmayrequirepaymentofafeebyserviceproviderstocoverthecostsofmaintainingthedirectory.

`(3)ELEMENTSOFNOTIFICATION-

`(A)Tobeeffectiveunderthissubsection,anotificationofclaimedinfringementmustbeawrittencommunicationprovidedtothedesignatedagentofaserviceproviderthatincludessubstantiallythefollowing:

`(i)Aphysicalorelectronicsignatureofapersonauthorizedtoactonbehalfoftheownerofanexclusiverightthatisallegedlyinfringed.

`(ii)Identificationofthecopyrightedworkclaimedtohavebeeninfringed,or,ifmultiplecopyrightedworksatasingleonlinesitearecoveredbyasinglenotification,arepresentativelistofsuchworksatthatsite.

`(iii)Identificationofthematerialthatisclaimedtobeinfringingortobethesubjectofinfringingactivityandthatistoberemovedoraccesstowhichistobedisabled,andinformationreasonablysufficienttopermittheserviceprovidertolocatethematerial.

`(iv)Informationreasonablysufficienttopermittheserviceprovidertocontactthecomplainingparty,suchasanaddress,telephonenumber,and,ifavailable,anelectronicmailaddressatwhichthecomplainingpartymaybecontacted.

`(v)Astatementthatthecomplainingpartyhasagoodfaithbeliefthatuseofthematerialinthemannercomplainedofisnotauthorizedbythecopyrightowner,itsagent,orthelaw.

`(vi)Astatementthattheinformationinthenotificationisaccurate,andunderpenaltyofperjury,thatthecomplainingpartyisauthorizedtoactonbehalfoftheownerofanexclusiverightthatisallegedlyinfringed.

`(B)(i)Subjecttoclause(ii),anotificationfromacopyrightownerorfromapersonauthorizedtoactonbehalfofthecopyrightownerthatfailstocomplysubstantiallywiththeprovisionsofsubparagraph(A)shallnotbeconsideredunderparagraph(1)(A)indeterminingwhetheraserviceproviderhasactualknowledgeorisawareoffactsorcircumstancesfromwhichinfringingactivityisapparent.

`(ii)Inacaseinwhichthenotificationthatisprovidedtotheserviceprovider'sdesignatedagentfailstocomplysubstantiallywithalltheprovisionsofsubparagraph(A)butsubstantiallycomplieswithclauses(ii),(iii),and(iv)ofsubparagraph(A),clause(i)ofthissubparagraph
