业。但是,在该日期之前但在第41.1条所要求的过驳作业计划经主管机关批准之后进行的过驳作业应尽可能符合过驳作业计划。Theregulationscontainedinthischapterapplytooiltankersof150grosstonnageandaboveengagedinthetransferofoilcargobetweenoiltankersatsea(STSoperations)andtheirSTSoperationsconductedonorafter1April2012.However,STSoperationsconductedbeforethatdatebutaftertheapprovaloftheAdministrationofSTSoperationsPlanrequiredunderregulation41.1shallbeinaccordancewiththeSTSoperationsPlanasfaraspossible.本章中的规定不适用于包括钻井平台的固定或浮动平台;用于近岸石油生产和储存的浮式生产、存储和卸载设施(FPSO);和用于近海储存已开采石油的浮式储油装置(FSU)1 经修订的《防污公约》附则I第7章(第MEPC.117(52)决议)和《联合国海洋法公约第56条适用并针对这些操作。RevisedAnnexIofMARPOL,chapter7(resolutionMEPC.117(52))andUNCLOSarticle56areapplicableandaddresstheseoperations.Theregulationscontainedinthischaptershallnotapplytooiltransferoperationsassociatedwithfixedorfloatingplatformsincludingdrillingrigs;floatingproduction,storageandoffloadingfacilities(FPSOs)usedfortheoffshoreproductionandstorageofoil;andfloatingstorageunits(FSUs)usedfortheoffshorestorageofproducedoil1.3.本章中的规定不适用于船舶加装燃油作业。Theregulationscontainedinthischaptershallnotapplytobunkeringoperations.4.本章中的规定条款不适用于为保障船舶安全或海上人命救助,或为应对具体污染事故以最大华洋海事中心HMCSHIPTOSHIPOPERATIONSPLAN限度减少污染损害而进行的过驳作业。TheregulationscontainedinthischaptershallnotapplytoSTSoperationsnecessaryforthepurposeofsecuringthesafetyofashiporsavinglifeatsea,orforcombatingspecificpollutionincidentsinordertominimizethedamagefrompollution.5.本章中的规定不适用于其中一条船为军舰、海军辅助船舶或者其他由国家拥有或经营并在当时仅用于政府非商业服务的船舶的过驳作业。但是,各国应通过采取不妨害此类船舶操作或操作能力的适当措施确保过驳作业的方式尽可能实际合理地符合本章的要求。TheregulationscontainedinthischaptershallnotapplytoSTSoperationswhereeitheroftheshipsinvolvedisawarship,navalauxiliaryorothershipownedoroperatedbyaStateandused,forthetimebeing,onlyongovernmentnon-commercialservice.However,eachStateshallensure,bytheadoptionofappropriatemeasuresnotimpairingoperationsoroperationalcapabilitiesofsuchshipsthattheSTSoperationsareconductedinamannerconsistent,sofarasisreasonableandpracticable,withthischapter.第41条关于安全与环境保护的一般规定Regulation41GeneralRulesonsafetyandenvironmentalprotection任何从事过驳作业的油轮均须在不晚于2011年1月1日或以后进行的第一次年度、中期或换证检验时,随船携带一份规定如何进行过驳作业的计划(过驳作业计划)。每艘油轮的过驳作业计划应经主管机关批准。过驳作业计划应用船上工作语言写成。AnyoiltankerinvolvedinSTSoperationsshallcarryonboardaPlanprescribinghowtoconductSTSoperations(STSoperationsPlan)notlaterthanthedateofthefirstannual,intermediateorrenewalsurveyoftheshiptobecarriedoutonorafter1January2011.Eachoiltanker’sSTSoperationsPlanshallbeapprovedbytheAdministration.TheSTSoperationsPlanshallbewrittenintheworkinglanguageoftheship.过驳作业计划的编写应考虑到本组织所确定的过驳作业最佳实践导则22 国际海事组织经修订的“油污手册,第一部分:预防”,以及国际航运公会和石油公司国际海事论坛的“船到船过驳指南:石油”,2005年第四版。IMO’s“ManualonOilPollution,SectionI,Prevention”asamended,andtheICSandOCIMF“Shipto-shipTransferGuide,Petroleum”,fourthedition,2005.TheSTSoperationsPlanshallbedevelopedtakingintoaccounttheinformationcontainedinthebestpracticeguidelinesforSTSoperationsidentifiedbytheOrganization2.TheSTSoperationsPlanmaybeincorporatedintoanexistingSafetyManagementSystemrequiredbychapterIXoftheInternationalConventionfortheSafetyofLifeatSea,1974,asamended,ifthatrequirementisapplicabletotheoiltankerinquestion.任何适用本章规定并从事过驳作业的油轮须遵守其过驳作业计划。AnyoiltankersubjecttothischapterandengagedinSTSoperationsshallcomplywithitsSTSoperationsPlan.华洋海事中心HMCSHIPTOSHIPOPERATIONSPLAN全面掌控过驳作业的人员应具备履行所有相关职责的资格,这些资格应考虑到本组织所确定的过驳作业最佳实践导则中的资格3 3 国际海事组织经修订的“油污手册,第一部分:预防”,以及国际航运公会和石油公司国际海事论坛的“船到船过驳指南:石油”,2005年第四版。IMO’s“ManualonOilPollution,SectionI,Prevention”asamended,andtheICSandOCIMFShipto-shipTransferGuide,Petroleum”,fourthedition,2005.ThepersoninoveralladvisorycontrolofSTSoperationsshallbequalifiedtoperformallrelevantduties,takingintoaccountthequalificationscontainedinthebestpracticeguidelinesforSTSoperationsidentifiedbytheOrganization3.过驳作业的记录4 4 经修订的《防污公约》附则I第3和4章(第MEPC.117(52)号决议);关于在《油类记录簿》中记载燃油加装和货油过驳作业的要求,以及过驳作业计划中要求的任何记录。RevisedAnnexIofMARPOLchapters3and4(resolutionMEPC.117(52));requirementsforrecordingbunkeringandoilcargotransferoperationsintheOilRecordBook,andanyrecordsrequiredbytheSTSoperationsPlan.Records4ofSTSoperationsshallberetainedonboardforthreeyearsandbereadilyavailableforinspectionbyaPartytothepresentConvention.第42条通知Regulation42Notification本章所适用的每艘油轮,如计划在本公约当事国的领海或专属经济区进行过驳作业,应至少在计划进行过驳作业的48小时之前通知该当事国。在特殊情况下,如果第2段中规定的所有信息无法提前48小时得到,卸载货油的邮轮须至少提前48小时通知本公约的当事国将要进行过驳作业并且第2款中规定的信息将尽早地向该当事国提供。EachoiltankersubjecttothischapterthatplansSTSoperationswithintheterritorialsea,ortheexclusiveeconomiczoneofaPartytothepresentConventionshallnotifythatPartynotlessthan48hoursinadvanceofthescheduledSTSoperations.Where,inanexceptionalcase,alloftheinformationspecifiedinparagraph2isnotavailablenotlessthan48hoursinadvance,theoiltankerdischargingtheoilcargoshallnotifythePartytothepresentConvention,notlessthan48hoursinadvancethatanSTSoperationwilloccurandtheinformationspecifiedinparagraph2shallbeprovidedtothePartyattheearliestopportunity.本条5 2007年12月31日的第MSC-MEPC.6/Circ.4号通函或其后续修正案中列出的国家操作层联络点。ThenationaloperationalcontactpointaslistedindocumentMSC-MEPC.6/Circ.4of31December2007oritssubsequentmendmentsThenotificationspecifiedinparagraph1ofthisregulation5shallincludeatleastthefollowing:.1参与过驳作业的油轮的船名、船旗、呼号、IMO编号和预计抵达时间;name,flag,callsign,IMONumberandestimatedtimeofarrivaloftheoiltankersinvolvedintheSTSoperations;.2计划过驳作业开始的日期、时间和地理位置;华洋海事中心HMCSHIPTOSHIPOPERATIONSPLANdate,timeandgeographicallocationatthecommencementoftheplannedSTSoperations;.3过驳作业是在锚泊时进行还是在行驶中进行;whetherSTSoperationsaretobeconductedatanchororunderway;.4油的类型和数量;oiltypeandquantity;.5过驳作业的计划持续时间;planneddurationoftheSTSoperations;.6过驳作业服务提供者或全面掌控人员的身份和联络信息;以及identificationofSTSoperationsserviceproviderorpersoninoveralladvisorycontrolandcontactinformation;and.7确认油轮上有满足第41条要求的过驳作业计划。aconfirmationthattheoiltankerhasonboardanSTSoperationsPlanmeetingtherequirementsofregulation41.如果油轮预计抵达进行过驳作业地点或区域的时间改变超过6个小时,该油轮的船长、船东或代理须向本条第1款规定的本公约当事国提供一份修改后的预计抵达时间。IftheestimatedtimeofarrivalofanoiltankeratthelocationorareafortheSTSoperationschangesbymorethansixhours,themaster,owneroragentofthatoiltankershallprovidearevisedestimatedtimeofarrivaltothePartytothepresentConventionspecifiedinparagraph1ofthisregulation.”2在表格B油轮构造与设备记录中新增第8A节如下:IntheRecordofConstructionandEquipmentforOilTankers,FormB,newsection8Aisaddedasfollows:“8A 油轮上备有一份符合第41条的过驳作业计划。8A.1TheoiltankerisprovidedwithanSTSoperationsPlanincompliancewithregulation41.”***华洋海事中心HMCSHIPTOSHIPOPERATIONSPLAN简介INTRODUCTION《油船过驳操作计划》是根据MARPOL公约附则IMEPC.186(59)决议第八章的40、41、42条要求编制的,其目的是防止海上油轮过驳作业中发生污染。TheSTSTransferOperationsPlan(STSPlan)hasbeendevelopedinaccordancewiththestandardsdescribeinMARPOLAnnexI,asamendedbyResolutionMEPC.186(59),Chapter8:PreventionofPollutionduringTransferofOilCargobetweenOilTankersatSea,Regulations40,41,42.《油船过驳操作计划》的编写已经充分考虑了本组织所确定的过驳作业最佳实践导则中所包含的信息,如果经修订的《1974年国际海上人命安全公约》第IX章的要求适用于该油轮,过驳作业计划可以合并到该章所要求的现行安全管理系统中。TheSTSPlanhasbeendevelopedtakingintoaccounttheinformationcontainedinthebestpracticeguidelinesforSTSoperationsasidentifiedbytheInternationalMaritimeOrganization(IMO).TheSTSoperationsPlanmaybeincorporatedintoanexistingSafetyManagementSystemrequiredbyChapterIXoftheInternationalConventionfortheSafetyofLifeatSea,1974,asamended,ifthatrequirementisapplicabletotheoiltankerinquestion.AnyoiltankersubjecttothischapterandengagedinSTSoperationsshallcomplywithitsSTSPlan.本计划的目标是为直接参与过驳操作的船长和高级船员提供当进行过驳作业时可以逐步遵循指导。ThepurposeoftheplanistoprovideguidancetotheMasterandofficersdirectlyinvolvedinShiptoShipTransfer(STS)Operationswithrespecttothestepstobefollowedwhenthisoperationislikelytooccur.附录的变更不需要任何检验。附录应该由船东,船舶经营人,船舶经理等人保持更新。ChangestotheAppendiceswillnotberequiredtobeapproved.TheAppendicesshouldbemaintaineduptodatebythevessel'smanagers,ownersandoperators.船上的日常演习训练不仅仅保证船上人员熟悉他们的职责,且应有助于组建一支有足够能力高效应对各种污染事故的专业团队。Routinedrillsconductedonboardwillnotonlyensurethattheship’sstaffarefamiliarwiththeirdutiesbutwillassistinformingaproficientteamtocombatallpollutionincidentsinanefficientmanner.ThepurposeofthisSTSoperationsplanistoprovideguidancetothemasterandorSTSoperatoronboardtheshipinconductingthetransferinasafeandefficientmanner.油船过驳操作分成五个阶段:抵达前的计划,抵达,靠泊,货物过驳和离泊。在每个操作阶段都有不同的程序需要遵循并完成对应的检查表。在开始操作之前应该进行风险评估并备妥一份处置突发紧急情况的应急计划。TheSTSoperationaredividedintofivephases;Pre-ArrivalPlanning,Arrival,Berthing,CargoTransferandDeparture.Duringeachphaseoftheoperationtherearedifferentprocedurestofollowandcheck-liststocomplete.Ariskassessmentshouldbecarriedoutbeforeoperationscommenceandacontingencyplanshouldbeputinplacetodealwithemergencies.华洋海事中心HMCSHIPTOSHIPOPERATIONSPLAN适用范围SCOPE每一条参与过驳操作的油轮都应该在船上备有一本指导如何进行船靠船过驳操作的计划。EachoiltankerinvolvedinthecargotransferoperationshouldhaveonboardaplanprescribinghowtoconductSTStransferoperations《油船过驳操作计划》应该用船长和高级船员的工作语言编写而成,如果船长和高级船员的工作语言不是英语、法语、或西班牙语中的一种,则本计划应该包含上述三种语言中的其中一种的译文。TheManualshouldbewrittenintheworkinglanguageofthemasterandofficersand,iftheworkinglanguageofthemasterandofficersisnotEnglish,French,orSpanish,includeatranslationintooneoftheselanguages.每一条油轮都应该在以下位置备有一册《油船过驳操作计划》AcopyoftheSTSPlanshouldbeavailableatthefollowinglocationsoneachoiltanker:驾驶台thebridge;货物控制室(台,站);和thecargotransfercontrolstation;and机控室theengine-room.3.抵达前的计划PRE-ARRIVALPLANNING3.1条件和要求CONDITIONSANDREQUIREMENTS3.1.1船舶的兼容性ShipCompatibility应该确保(进行船对船过驳操作的)船舶在设计和设备上是协调的;即,它们都满足本计划中包含的各种建议;系泊操作、货物软管操作以及通信都能够安全有效地进行。有关船舶的全型尺寸、干舷高度、货管出口阀的位置、系泊设施导向和碰垫等信息必须传递给参加操作的所有船长和船舶,这一点是非常重要的。Itshouldbeensuredthattheshipsarecompatibleindesignandequipment;thattheycomplywiththevariousrecommendationsincludedinthisplan;andthatmooringoperations,hosehandlingandcommunicationscanbeconductedsafelyandefficiently.Itisessentialthatinformationrelatingtotheoveralldimensions,freeboard,positionofmanifolds,mooringpointsandfendersshouldbepassedtotheMastersoftheships.建议那些船舶驾驶台两翼宽度超出船舶最大宽度的船舶不要用来进行船靠船过驳操作。华洋海事中心HMCSHIPTOSHIPOPERATIONSPLANItisrecommendedthatshipswithbridgewingsthatextendbeyondtheship’smaximumbreadtharenotusedforSTStransferoperations.在靠泊作业之前应该确定一下各项Thefollowingshouldbedeterminedpriortoberthing:货物操作的相容性CARGOHANDLINGCOMPATIBILITY1即将使用的出口阀的尺寸和数量。Thesizeandnumberofmanifoldstobeused.2预计在过驳过程中出口阀距水面的最小和最大高度,和过驳过程中干舷的变化量。Theminimumandmaximumexpectedheightofthemanifoldabovethewaterlineduringthetransferoperation,andthefreeboarddifferencesduringthecargotransfer(seeSection5.2,figure5).3船上的货物操作吊杆或起重机是否处于满意的状态和具有适配的安全工作负荷量。Whetherthecargocranesorderricksareinsatisfactoryconditionandofsuitablesafeworkingload(SWL).4船边货物软管的支撑构件足可以防止货物软管因摩擦而损坏。Thehosesupportsattheship’ssidearetheadequatetopreventdamagetothehosethroughchafing5参与过驳的两条船的出口阀都满足OCIMF组织的《油船管汇合附属设备的建议》。ThatbothshipshavemanifoldsthatcomplywithOCIMFRecommendationsforOilTankerManifoldsandAssociatedEquipment.Table1:Cargohandlingcompatibility3.1.2全程咨询控制人PersoninOverallAdvisoryControl(POAC)每一船靠船的过驳操作都应该在一个指定的全程咨询控制人(POAC)的建议性控制下进行。POAC可以是和操作相关船舶的船长中的一个或者是STS的操作主管,驳运协调员或者由STS资源提供方雇佣的系泊主管,但是POAC并不意味着在某种程度上解除了船长义务,责任和对船长的相关要求。Aship-to-shiptransferoperationshouldbeundertheadvisorycontrolofadesignatedPersoninOverallAdvisoryControl(POAC).ThePOACwilleitherbeoneoftheMastersofthevesselsconcernedoranSTSSuperintendent,LighteringCoordinatororMooringMasteremployedbyanSTSResourceProvider.ItisnotintendedthatthePOACinanywayrelievestheships’Mastersofanyoftheirduties,requirementsorresponsibilities.管理者,货主或油轮经营者应该统一意见并指定POAC,POAC应具备以下基本资格:TheAdministration,cargoownersoroiltanker'soperatorsshouldagreeanddesignatethePOACwhoshouldhaveatleastthefollowingqualifications:具备一本相适用的操作水准的驾驶类执照或证书,此证书须满足STCW国际发证标准以及华洋海事中心HMCSHIPTOSHIPOPERATIONSPLAN危险货物背书的最新要求,且同时也适用于参与STS操作的船舶。Anappropriatemanagementleveldecklicenseorcertificatemeetinginternationalcertificationstandards,withallSTCWanddangerouscargoendorsementsuptodateandappropriatefortheshipsengagedintheSTSoperation;参加过相应的船舶操纵培训课程Attendanceatsuitableship-handlingcourse;执行过相当次数的类似船舶在类似环境下的靠、离泊操作Conductofasuitablenumberofmooring/unmooringoperationsinsimilarcircumstancesandwithsimilarvessels;具有油轮的货物装卸经验Experienceinoiltankercargoloadingandunloading;十分熟悉过驳操作海域以及周围的区域和地理环境Athoroughknowledgeofthegeographictransferareaandsurroundingareas;具备溢油清除技术方面的知识,包括熟悉STS应急计划中可用的设备和资源。Knowledgeofspillclean-uptechniques,includingfamiliaritywiththeequipmentandresourcesavailableintheSTScontingencyplan;充分了解《油船过驳操作计划》ThoroughknowledgeoftheSTSPlan.全程咨询控制人应:ThePOACshould:确保货物过驳、系泊和离泊操作按照《油船过驳操作计划》手册中本章要求的STS计划,且充分考虑行业出版物中《船对船过驳指南》中所包含的建议。Ensurethatthecargotransfer,mooringandunmooringoperationsareconductedinaccordancewiththerequiredSTSplan,thecontentsofthischapteroftheManualandtakeintoaccounttherecommendationscontainedintheindustrypublication"ShiptoShipTransferGuide–Petroleum";对货物过驳、系泊、离泊操作中的关键阶段给船长建议和指导。AdvisetheMaster(s)ofthecriticalphasesofthecargotransfer,mooringandunmooringoperation;确保在溢漏事故发生时应急反应计划中的规定条款的实施。Ensuretheprovisionsofthecontingencyplanarecarriedoutintheeventofaspill;确保所有必需的报告递交给相关的主管机构。Ensurethatallrequiredreportsaremadetotheappropriateauthorities;确保所有参与各方面操作的船员已经得到了适当的摘要简介并明白它们的职责。华洋海事中心HMCSHIPTOSHIPOPERATIONSPLANEnsurethatcrewmembersinvolvedineachaspectoftheoperationareproperlybriefedandunderstandtheirresponsibilities;确保在两条油轮之间在建立起有效地通信和所有相关的检查完成之前不进行靠近和系泊的尝试Ensurethatapproachandmooringoperationsarenotattempteduntilpropereffectivecommunicationhasbeenconfirmedbetweenthetwooiltankersandappropriatecheckshavebeencompleted;确保按照公认的行业指南中采纳的船对船过驳作业前的安全检查的执行;且Ensurethatapre-transferSTSsafetycheckisundertakeninaccordancewithacceptedindustryguidance;and确保离泊作业前执行了相应的检查。Ensurethatappropriatechecksareundertakenpriortounmooring.POAC应该有权建议:ThePOACshouldhavetheauthoritytoadvise:延缓或终止过驳作业。Suspendorterminatethetransferoperation;由于特殊的操作修正过驳计划。Amendthetransferplanfortheparticularoperation.记录和检查表Recordingandchecklists船对船过驳操作应按照货物转载和压载水操作的要求记录在油类记录簿的第二部分,检查表包含在ICS出版的《船对船过驳指南》的附录A中,且在进行船对船作业时应遵照执行并填写好。TheSTSoperationshouldberecordedintheOilRecordBookPartII,asrequiredforalloilcargotransferandballastoperations.ThechecklistscontainedinAppendixA.1ofShiptoShipTransferGuide–Petroleum(ICS),shouldbefollowedandfilledoutconcurrentlywiththeSTSoperation.所有记录应在船保留至少三年。Allrecordsshouldberetainedonboardforatleastthreeyears.主管机关认可ApprovalfromAuthorities当过驳作业处于某个国家的领海或专属经济区时,应遵守该当事国的和本地的法律法规且应得到相应的批准和许可。负责人应通知相应的主管机关过驳作业将在过驳区域内进行WhentheSTStransferisperformedwithintheterritorialwatersorExclusiveEconomicalZoneofacountry,localandnationalregulationsshouldbecheckedandappropriateapprovalsobtained.TheresponsiblepersonshouldinformtheappropriateauthoritiesofSTStransferoperationstobe华洋海事中心HMCSHIPTOSHIPOPERATIONSPLANconductedinthelighteringarea.至少提前48小时通知有关主管机关Minimum48hoursinadvanceNOTICETOAUTHORITIES1参与过驳作业的油轮的船名、船旗、呼号、IMO编号和预计抵达时间;Name,flag,callsign,IMONumberandestimatedtimeofarrivaloftheoiltankersinvolvedintheSTSoperations.2计划过驳作业开始的日期、时间和地理位置;Date,timeandgeographicallocationatthecommencementoftheplannedSTSoperations.3过驳作业是在锚泊时进行还是在行驶中进行;WhetherSTSoperationsaretobeconductedatanchororunderway.4油的类型和数量;Oiltypeandquantity.5过驳作业的计划持续时间;PlanneddurationoftheSTSoperations.6过驳作业服务提供者或全面掌控人员的身份和联络信息;以及IdentificationofSTSoperationsserviceproviderorpersoninoveralladvisorycontrolandcontactinformation.7确认油轮上有满足第41条要求的过驳作业计划。ConfirmationthattheoiltankerhasonboardanSTSoperationsplanmeetingtherequirementsofMARPOLAnnexI,Chapter8,Regulation41,42&43.Table2:AdvanceNoticetoAuthorities在特殊情况下,如果上述规定的所有信息无法提前48小时得到,卸载货油的油轮须至少提前48小时通知本公约的当事国将要进行过驳作业并且上述规定的信息将尽早地向该当事国提供。Where,inanexceptionalcase,alltheinformationspecifiedaboveisnotavailablemorethan48hoursbeforetheSTSoperationsaretotakeplace,theoiltankerdischargingtheoilcargoshallnotifytheauthoritiesnotlessthan48hoursinadvancethatanSTSoperationwilloccur.Theinformationspecifiedaboveshallbeprovidedtotheauthoritiesattheearliestopportunity.最初的预计抵达报告一旦发送,如果可能,则应在上次发送的预计抵达时间偏差超过两小时以上时发送更新报告。OncetheinitialreportforanyETAhasbeenmade,itshould,ifpossible,beupdatedwhenavarianceofmorethantwohoursisexpectedfromthetimegiveninthelatestreport.过驳区域TransferArea过驳区域应该为了安全操作慎重选择,并和相关主管机关进行协调。在选择过驳区域时应慎重华洋海事中心HMCSHIPTOSHIPOPERATIONSPLAN考量每一个关键点。TheSTStransferareashouldbespeciallyselectedforsafeoperations,inco-ordinationwithappropriateauthorities.Pointstobeconsideredwhenselectingthetransferarea:过驳区域TRANSFERAREA1通知相应的沿岸主管机关并得到其许可。Notifyandobtainagreementfromtheapplicablecoastalauthority.2天气的遮蔽处所,尤其是海浪和涌浪的遮蔽处所。Theshelterprovidedfromtheweather,particularlyfromseaandswell.3目前和预见的天气状况Presentandforecastweatherconditions.4潮汐,流的状况Tidalcurrentconditions.5与沿岸设施的安全距离Safedistancesfromoffshoreinstallatio
