工程合同中承包人的义务条款中英文对照版工程合同中承包人的义务条款TERMSOFCONTRACTOR’SGENERALOBLIGATIONS承包人在履行合同过程中应遵守法律和工程建设标准规范，并履行以下义务：Thecontractorshouldinthecourseoftheperformancehereofcomplywiththelawsandthestandards/normsrespectingtoengineeringconstructioninadditiontotheperformanceoffollowingobligations:（1）办理法律规定应由承包人办理的许可和批准，并将办理结果书面报送发包人留存；Effecttheproceduresforapprovalandsanction,whichshouldbeeffectedbythecontractorundertheprovisionoflawandsubmittheresultofproceduretotheemployerinwritingforitsdepositiononfile.（2）按法律规定和合同约定完成工程，并在保修期内承担保修义务；Effectthecompletionofworkspursuanttolegalregulationsandcontractagreementinadditiontoassumethewarrantyliabilitieswithinthemaintenanceperiod.（3）按法律规定和合同约定采取施工安全和环境保护措施，办理工伤保险，确保工程及人员、材料、设备和设施的安全；Shallpursuanttolegalregulationsandcontractagreementtakethemeasuresofconstructionsafetyandenvironmentprotection,processthework’sinjuryinsurancesoastoensurethesafetyofengineeringandpersonnel,materials,equipmentandfacilities.（4）按合同约定的工作内容和施工进度要求，编制施工组织设计和施工措施计划，并对所有施工作业和施工方法的完备性和安全可靠性负责；Shallsubjecttothework’scontentsstipulatedincontractandtherequirementofengineeringprogress,preparetheconstructionorganizationdesignandmeasuresplan,takeliabilitiesforthecompleteness,safetyandreliabilityofalloperationsandwork’smethods.（5）在进行合同约定的各项工作时，不得侵害发包人与他人使用公用道路、水源、市政管网等公共设施的权利，避免对邻近的公共设施产生干扰。承包人占用或使用他人的施工场地，影响他人作业或生活的，应承担相应责任；Intheperiodofcarryingoutanyandallworks,shouldnotinfringetheemployer’srightsofusingwithotherpublicroads,watersources,municipalpipelines,etc.andavoidinterferencetoadjacentpublicfacilities.Thecontractorshouldassumecorrespondingliabilitiesforoccupationofother’swork’ssiteandaffectother’sworksorlife.承包人应对基于发包人按照第2.4.3项〔提供基础资料〕提交的基础资料所做出的解释和推断负责，但因基础资料存在错误、遗漏导致承包人解释或推断失实的，由发包人承担责任。Thecontractorshallberesponsibleforhisexplanationanddeductionwhichareproducedonthebasisofthebasicmaterialswhichsubmittedbytheemployerinaccordancewithparagraph2.4.3[ProvisionofBasicData]hereof,howeverifbasicdata’serror,omissionwhichleadtothecontractor’sexplanationordeductioninaccurate,theresponsibilitytherefromshallbebornbytheemployer.承包人应对施工现场和施工条件进行查勘，并充分了解工程所在地的气象条件、交通条件、风俗习惯以及其他与完成合同工作有关的其他资料。因承包人未能充分查勘、了解前述情况或未能充分估计前述情况所可能产生后果的，承包人承担由此增加的费用和（或）延误的工期。Thecontractorshouldmadethesurveyontheworksiteandconstructionconditions,andbecomeacquaintedwiththeprojectsite’sconditionsofweather,traffic,socialcustomsandhabitsinadditiontoothermaterialswhicharerelationtothecompletionofcontractproject.Providedthatifthecontractor’sfailureoffullsurvey,comprehensionoftheforegoingsituationorfullestimationofthepossibleconsequenceswhichariseoutofforegoingsituation,thecontractorwillassumetheaddedcosttherefromand/ordelayedterm.承包商应按照合同设计、实施和完成工程，并修补工程中的任何缺陷。完成后，工程应能满足合同规定的工程预期目的。TheContractorshalldesign,executeandcompletetheWorksinaccordancewiththeContract,andshallremedyanydefectsintheWorks.Whencompleted,theWorksshallbefitforthepurposesforwhichtheWorksareintendedasdefinedintheContract.承包商应提供合同规定的生产设备和承包商文件，以及设计、施工、竣工和修补缺陷所需的所有临时性或永久性的承包商人员、货物、消耗品及其他物品和服务。TheContractorshallprovidethePlantandContractor’sDocumentsspecifiedintheContract,andallcontractor’sPersonnel,Goods,consumablesandotherthingsandservices,whetherofatemporaryorpermanentnature,requiredinandforthisdesign,execution,completionandremedyingofdefects.承包商应对所有现场作业、所有施工方法和全部工程的完备性、稳定性和安全性承担责任。TheContractorshallberesponsiblefortheadequacy,stabilityandsafetyofallSiteoperations,ofallmethodsofconstructionandofalltheWorks.当雇主提出要求时，承包商应提交其建议采用的工程施工安排和方法的细节。事先未通知雇主，对这些安排和方法不得做重要改变。TheContractorshall,wheneverrequiredbytheEmployer,submitdetailsofthearrangementsandmethodswhichtheContractorproposestoadoptfortheexecutionoftheWorks.NosignificantalterationtothesearrangementsandmethodsshallbemadewithoutthishavingpreviouslybeennotifiedtotheEmployer.乙方按合同条款约定的内容和时间完成以下工作：PartyBshallfinishthefollowingjobaspertheagreement:（1）乙方应根据甲方代表提供的施工图纸施工，做好竣工图。ToconstructaspertheconstructiondrawingsprovidedbyPartyA’srepresentativeandpreparetheas-builtdrawings;（2）向甲方代表提供工程进度计划及收款计划；ToprovideconstructionprogressandpaymentscheduletoPartyA’srepresentative;（3）根据工程需要厂房内围挡、保洁工作；Toaprontheconstructionareaandkeeptheactiveplantareacleanandfromtheimpactoftheconstruction;（4）已竣工工程未交付甲方之前，乙方按合同条款约定负责已完工程的保护工作，保护期间发生损坏，乙方自费予以修复；甲方要求乙方采取特殊措施保护的工程部位和相应的追加合同价款，双方在合同条款内约定；ToprotectthecompletedpartoftheprojectaspertheagreementbeforesubmittingtoPartyAforfinalinspection;incaseanydamageoccursduringtheprotection,PartyBshallrepairtoresumeitatitsowncost;forthepartthatneedspecialprotectionandthecorrespondingadditionalcontractvalue,bothpartiesshallagreeinthecontract;TheContractorshallcompletethefollowingworkswithin14days.承包人应在14天内完成以下工作：(1)AccordingtotheEmployer’sentrustment,completethedesignoftheaccessoriestotheProjectandassisttheEmployerinhandlingthenecessaryexaminationandapprovalprocedures.根据发包人委托，完成与工程配套的设计，并协助发包人办理必要的审批手续。(2)BeresponsibleforcleaningtheSiteaftertheconstructionSiteishandedovertoitbytheEmployer.在发包人向其交付施工场地后，负责清理现场。(3)PresenttheEngineerstheweeklyandmonthlyprogressscheduleandrelevantprogressstatistics.向工程师提供周以及月工程进度计划及相应进度统计报表。(4)Supplyandmainta
