TABLEOFCONTENTS目录ARTICLE1-GENERALPROVISIONSANDGOVERNINGLAW第一条总则和适用法律ARTICLE2-TERMOFCONTRAC第二条劳动合同期限ARTICLE3-PROBATIONARYPERIO第三条试用期ARTICLE4-APPOINTMENTANDDUTIES四条岗位和职责ARTICLE5-WORKINGHOURS,STATUTORYHOLIDAYSANDOTHERLEAVES第五条工作时间、法定的假日和其它休假ARTICLE6-LABORCOMPENSATION第六条劳动报酬ARTICLE7-TRAINI第七条培训ARTICLE8-WORKINGCONDITION第八条工作条件ARTICLE9-DISCIPLINEANDINTERNALR第九条纪律和规章制度ARTICLE10-DISCHARGEANDTERMINATIONOFCONTRACT第十条合同的解除与终止ARTICLE11-LIABILITYFORBREACHOFCONT第十—条违约责任ARTICLE12-LABORDISPUT第+二条劳动争议ARTICLE13-CONFIDENTIAL]第十三条保密ARTICLE14-NON-COMPETITIO第十四条不竞争ARTICLE15-MISCELLANEOUS十五条其它规定SIGNATURES签名PRELIMINARYSTATEMENT前言ThepartiesherebyagreethattheCompanyshallemploytheEmployeeaccordingtothefollowingprovisions:双方特此同意公司按照下列条款雇佣员工:ARTICLE1-GENERALPROVISIONSANDGOVERNINGLAW第一条总则和适用法律1.01ThiscontractshallbesubjecttoandgovernedbytheLaborContractLa'wsofthePeopleRepublicofChinaandtheRegulationsofShanghaiMunicipalitoynLaborContractsandotherpublishedandpubliclyavailablelawsandregulationsapplicabletoforeigninvestmententerprisinShanghaiMunicipality,PRC.1.01本合同须遵守《中华人民共和国劳动合同法》、《上海市劳动合同条例》及在中华人民共和国上海市公开发布的有关外商投资企业的法律和法规并受其管辖。ARTICLE2-TERMOFCONTRACT第二条劳动合同期限2.01ThisContractwil3beforatermof_yearsmencingon_unlearlieterminatedinaccordancewithprovisionsofthisContract,providedthatthisContractshallnotbecomeeffectiveunlessanduntilallthefollowingconditionsaresatisfied:本合同从一日起生效,为期—年。按照本合同有关条款,可以提前解除合同,但本合同须在下列条件全部满足后才能生效。ptehresonnelfileoftheEmployeehasbeenreceivedbytheCompanyortheinstitutiondesignatedbytheCompany;and公司或公司指定的机构已收到员工的人事档案,及theEmployeecompletesasatisfactorymedicalexaminationatahospital/clinicdesignatedbytheCompany.员工已在公司指定的医院/诊所完成体检,且体检结果令人满意。2.02ThisContractmayberenewedifbothPartiesagreetotherenewalandsignanewlaborcontractwithinthirty(30)daysbeforetheexpiryofthisContract.IntheabsenceofanewemploymentcontractdulysignedbybothParties,thisContractshallterminateautomaticallyuponitsexpiration.在本合同期满之前30天内,经双方一致同意后,本合同可以续订并由双方签署一个新的劳动合同。如果双方没有签署新的雇佣合同,则本合同于期满时自动失效。ARTICLE3-PROBATIONARYPERIOD第三条试用期3.01TheEmployeewillserveaprobationaryperiodof_month.Attheendofthisperiod,theCompanywillappraisehis/herperformance,andsubjecttogoodconductandperformance,his/heremploymentwillcontinuewiththeCompany.员工试用期为_个月。试用期期满,公司对员工进行业绩评估,在符合行为和业绩良好的前提下,该员工将由公司继续雇佣。3.02Duringtheprobationaryperiod,theCompanyhastherighttoterminatethisContractiftheEmployeeisdeemedunqualifiedongivingwrittennoticeofseven(7)workingdays,orbythepaymentofseven(7)days'wagesinlieuofnotice.在试用期内,如果公司认为员工不符合录用资格,公司有权解除本合同。(公司可提前七⑺个工作日书面通知员工,或支付员工七(7)天工资代替通知。〕ARTICLE4-APPOINTMENTANDDUTIES第四条岗位和职责4.01TheEmployeeduringthetermofemploymenthereundershallservetheCompanyinthepositionofToiletEngineerandshallperformthedutiesspecifiedbytheCompanyandanyadditionaldutiesassignedtohim/herbytheCompanytimebytime.在本合同期间,员工在岗位工作。员工应履行公司具体分配的职责以及公司不时分配的任何额外职务。4.02TheCompanyshallhavetherightto,uponagreementbetweentheParties,re-deploytheEmployeetoworkinanotherpositionand/ortovarythedutiesandpowersassignedtohim/herbyCompanybasedonthebusinessrequirementsoftheCompanyandhis/herperformance.经过双方同意,根据公司的业务需要和员工的业绩,公司有权重新安排员工的工作岗位和/或改变公司分配给该员工的职责和权力。4.03TheEmployeeshalldevotehis/herfullworkingtimeandattentiontotheperformanceofhis/herduties.Duringthetermofemploymenthereunder,he/sheshallnotbeemployedbyorengagedinanybusinessactivitiesofanyotherentityorpersonwithoutthepriorwrittenconsentoftheCompany.TheEmployeeshallbesubjecttoimmediatedismissalforanyviolationoftheseobligations.员工应投入其全部的工作时间和注意力履行其职责。在本合同规定的受雇期内,在未得到公司书面同意之前,员工不得受雇于其它单位或个人或从事任何其它单位或人的任何商业活动。违反该规定的员工将被立即解雇。4.04TheEmployeerepresentsandwarrantsthatattheeffectivedateofthisContract,he/sheisnotemployedbyanyotherentityorperson,thathis/heremploymentbytheCompanyunderthisContractdoesnotviolateanycontractualorstatutoryobligationspertainingtohim/herandthathe/shehasfullcapacitytoenterintothisContract.TheEmployeeshallcompensatetheCompanyforallexpensesthattheCompanymayincurifthisContractviolatesanycontractualorstatutoryobligationsoftheEmployee.员工声明和保证,从本合同生效之日起,他/她没有受雇于其它单位和个人;他/她根据本合同受雇于公司没有违反他/她负有的契约或法定义务;他/她具有充分的行为能力履行本合同。如果公司因本合同违反员工负有的契约义务或法定义务而发生任何费用,员工应向公司赔偿所有上述费用。4.05TheEmployeeshallatalltimesduringthetermofthisContractcomplywithanylawsandregulationsconcerninghis/heremploymentbytheCompany,including(butnotlimitedto)requirementsconcerningworkpermits,householdregistration,paymentofindividualincometax,socialsecuritypremiumsandothertaxesandfeespayablebytheEmployee.在本合同期限内,员工应该始终遵守与公司雇佣该员工有关的法律和法规,包括(但不限于)有关工作许可证、户口登记、缴付个人所得税、社会保险费及其它应由员工支付的税金和费用方面的规定。4.06TheEmployeeshallusehis/herbestendeavorstoensurethathis/herpersonnelfileistransferredtotheCompanynolaterthanthirty(30)daysafterthedateofthisContract.员工应尽最大的努力确保他/她的人事档案在本合同生效日起三十(30)天内转入公司。ARTICLE5-WORKINGHOURS,STATUTORYHOLIDAYSANDOTHERLEAVES第五条工作时间、法定休假日和其它休假5.01TheCompanyshallimplementaworkinghoursystemofeight(8)workinghoursperdayandforty(40)hoursperweekwithtwo(2)restdaysperweek.MealtimeisexcludedfromtheworkinghoursystemandshallbearrangedbythedepartmentheadoftheEmployee.公司实行每日工作时间八(8)小时,每周工作时间四十(40)小时和每周休息二(2)天的工时制度。用餐时间不包括在工时制度中,具体就餐时间由部门主管安排。5.02TheEmployeeisentitledtoallstatutoryholidays,maternityleave,weddingleaveandcondolenceleaveinaccordancewithrelevantPRClawsandregulations.员工根据中华人民共和国相关法律法规享有法定休假日、产假、婚假和丧假的休假。5.03ApaidannualleaveshallbegiventotheEmployeeas_workingdays.TheannualleaveshallincludeallhomeleavetowhichtheEmployeemaybeentitled.Annualleaveandhomeleavemaynotbecarriedforwardtothenextyear.员工享有带薪年假,每年_天。年假应包括员工可能有权享受的所有探亲假。年假和探亲假不能推迟到下一年使用。5.04UnauthorizedleavetakenbytheEmployeeshallbesubjecttodisciplinarymeasuressetoutintheEmployeeHandbook.员工未经许可休假,将按《员工手册》处以纪律处分。ARTICLE6-LABORCOMPENSATIONS第六条劳动报酬6.01TheEmployeeshallbepaidamonthlynetwageof100,000.00RMB,Themonthlywageshallbepaidintheendofmonth,individualincometaxwillbepaidbytheCompany.Thismonthlysalaryincludetheovertimepay(itany)already.Foreachyearthecompanywillpay13monthssalarybytheendofyear.员工工资将按月支付,每月税后工资为人民币100,000.00元。公司将支付员工的个人所得税、本工资已经包括了员工的加班费用(如果有的话)。每年公司支付13个月的工资。6.02ThebasicwageoftheEmployeemaybeadjustedbasedonthebusinessperformanceoftheCompany,his/herpromotions(ifany)andtheCompany'sannualreviewoftheEmployee'sindividualperformance.根据公司的业务经营状况,员工职务的提升(如果有的话)及公司每年对员工的业绩评估结果,公司可以对员工的基本工资做出调整。6.03InadditiontothebasicwagetobepaidtotheEmployee,theCompanymaypaytheEmployeeadiscretionarybonusdependentupontheEmployee'sperformanceandtheCompany'sfinancialsituation.除基本工资之外,公司还可根据员工的业绩和公司的财政状况,发放不固定的奖金。6.04TheCompanyshallmakeallsocialinsurancepaymentsimposedontheCompanyandshallprovidetheEmployeewithwelfarebenefitsinaccordancewithrequirementsofrelevantPRClawsandregulations.公司将支付公司应付的一切社会保险费,并按中华人民共和国的有关法律和法规规定为员工提供福利。6.05TheEmployeeisentitledto1roundtripvacationairticketsperyear6.06Otherbenefits:rent,utilities,mobilephonebillsandhealthinsurance,Annualmedicalanddentalcheckup.Intheeventofterminationofemploymentforwhateverreason,theemployershallprovidetheemployeeaone-waytickettohiscountryoforigin.其他福利包括房租费,水电费,所有电话费,人寿保险和一年一次的体检。不论什么原因造成本合同终止,公司都将为员工支付一张回其原籍的单程机票.6.07Incaseofdiseaseorinjurynotcausedofwork,thesickleavesalary,diseaseallowanceandmedicalallowanceshouldbepaidaccordingtorelevantnationalrulesandlocalrulesofShanghai.Incaseofdiseaseorinjurycausedofwork,thesalaryandmedicalallowanceshouldbepaidaccordingtorelevantnationalrulesandlocalrulesofShanghai.员工患病或非因工负伤,其病假工资、疾病救济费和医疗待遇等按照国家和本市有关规定执行。员工患职业病或因工负伤的工资和工伤保险待遇按国家和本市有关规定执行。ARTICLE7TRAINING第七条培训7.01TheCompanyshallprovidenecessarytrainingfortheEmployeeasrequiredfortheEmployeetodischargethedutieshereunder.公司应为员工提供必要的培训,使员工能履行本合同项下的职责。ARTICLE8-WORKINGCONDITIONS第八条工作条件8.01ThehealthandsafetyofallEmployeesisoftheCompany'shighestpriority.Insofaraspossible,theCompanyshallprovidetotheEmployeeasafeandhygienicworkingenvironmentinaccordancewithapplicablePRClawsandregulations.全体员工的安全和健康是公司最优先考虑的事情。公司将尽可能根据中华人民共和国的有关法律和法规,为员工提供一个安全卫生的工作环境。ARTICLE9-DISCIPLINEANDINTERNALRULES第九条纪律和内部规章制度9.01TheEmployeeshallstrictlyobserveandimplementalltherulesandregulationsintheEmployeeHandbookorotherdocumentsprovidedtotheEmployeebytheCompanyfromtimetotime.Anymisconductwillleadtofines,verbalwarning,writtenwarning,anddismissalwithoutcompensation.DetaileddisciplinaryproceduresaresetforthintheEmployeeHandbook.员工应严格遵守和执行《员工手册》或,公司不时提供给雇员的(其他)文件中的一切规章制度。员工的任何行为不当将使其遭受罚款、口头警告、书面警告和解雇而不给予补偿。ARTICLE10-DISCHARGE&TERMINATIONOFCONTRACT第十条合同的解除和中止10.01ThisContractshallbedischargedunderanyofthefollowingcircumstances:本合同在下列任何一种情况下解除:ifthePartiesdischargedthisContractbymutualconsentexpressedinwriting;双方以书面形式同意解除合同;iftheCompanydischargesthisContractpursuanttotheprovisionsofArticle10.02hereof;or公司根据本合同第10.02条的规定解除本合同;或iftheEmployeedischargesthisContractpursuanttotheprovisionsofArticle10.05hereof.员工根据本合同第10.05条的规定解除本合同。10.02TheCompanymaydischargethisContractunderanyofthefollowingcircumstances:有下列情况之一的,公司可以解除本合同:whentheEmployee,whosuffersfromsicknessornon-workrelatedinjury,cannotbeengagedinhis/heroriginalworkorotherworkreasonablyarrangedbytheCompanyafteraprescribedmedicaltreatmentperiodaccordingtorelevantPRClawsandregulations;根据中华人民共和国有关法律和法规,员工患病或者非因工负伤,医疗期满后,不能从事原工作或由公司合理安排的其它工作;whentheEmployeeisdeemedbytheCompanytobeincompetentinapositiontowhichhe/shehasbeenassignedandremainsincompetentafterreceivingtrainingorbeingassignedtoanotherexistingposition;公司认为员工不能胜任其被分配的工作,在培训后或者调整工作岗位后,仍然不能胜任工作的;whentheperformanceofthisContractbecomesimpossibleduetoamajorchangeintheobjectivecircumstancesuponwhichthisContractwasbasedatthetimeofitsconclusionandthePartiesfailtoagreeonanyamendmentofthisContract;本合同订立时所依据的客观情况发生重大变化,致使本合同无法履行,并且双方不能就变更本合同达成协议;whentheEmployeeviolatesanyPRClawsorregulationspursuanttowhichtheCompanyisentitledtoterminatetheemploymentoftheEmployee;员工违反中华人民共和国的任何法律和法规,而根据该等法律法规,公司有权终止与员工的雇佣关系;whentheEmployeeissubjecttocriminalprosecution;or员工被追究刑事责任的;或whentheEmployeeisinseriousviolationoflabordisciplineasdefinedintheEmployeeHandbook.员工严重违反《员工手册》规定的劳动纪律。WhentheEmployeecausesanyseveredamagetotheCompanyduetohisgravenegligencetohisdutiesorseekingprivatebenefits;员工严重失职,营私舞弊,给公司造成重大损害的;(viii)whentheEmployeeestablishesalaborrelationshipwithotheremployersallthesametimeandmayseriouslyinfluencehiscompletionofhisworksintheCompany,orherefusestomakeacorrectioneventhoughtheCompanyhaspointeditout员工同时与其他用人单位建立劳动关系,对完成本公司的工作任务造成严重影响,或者经本公司提出,拒不改正的;10.03TheCompanymaynotterminatethisContractanddismisstheEmployeeunderanyofthefollowingcircumstances:有下列情况之一的,公司不得解除本合同和解雇员工:iftheEmployeesuffersfromoccupationaldiseaseorworkrelatedinjury,andisconfirmedbytherelevantauthoritiestohavelostorpartiallylosttheabilitytowork;员工患职业病或者因工负伤并被确认丧失或者部分丧失劳动能力的;duringtheperiodofmedicaltreatmentstipulatedinArticle10.02(i)aboveforanon-work-relatedillnesscontractedorinjurysufferedbytheEmployee;or员工非患职业病或者非因工负伤但在以上第10.02条(i)款规定的医疗期内的;或whentheEmployee(iffemale)isinpregnancy,maternity,ornursingperiod.女员工在孕期,产期,哺乳期内的。10.04TheCompanymaysuspendthedutiesoftheEmployeewhenhe/sheissubjecttoaninvestigationofanydisciplinarymatter.IftheinvestigationrevealsthattheEmployeehascommittedanyoffence,theCompanyshallbeentitledtoterminatethisContractpursuanttoArticle10.02(iv),(v)or(vii).如果员工正在接受纪律调查,公司可以暂停员工职务。如果调查证明该员工确实犯罪,公司有权根据本合同第10.02条(iv)、(v)或(vii)款解除本合同。10.05DuringthetermofthisContracttheEmployeemaydischargethisContractunderanyofthefollowingcircumstances:在本合同期限内,有下列情况之一的,员工有权辞职或解除本合同:whentheEmployeeiscoercedintoworkingbytheCompanybymeansofviolence,threatorillegallimitationofpersonalfreedom;or公司以暴力、威胁或者非法限制人身自由的手段强迫劳动;或whentheCompanyhasfailedtopaytheEmployee'swageinaccordancewiththisContract;公司未按照劳动合同约定支付员工的工资;theCompanyhasfailedtopaysocialsecuritypremiumsfortheEmployeeaccordingtothelaw;公司未依法为员工缴纳社会保险费的;therulesandregulationsoftheCompanyareinconsistentwithanylawandimpairtheEmployee'srightsandinterests.公司的规章制度违反法律、法规的规定,损害员工权益的。10.06IftheCompanyterminatesthisContractpursuanttothecircumstancesstipulatedinArticle10.02(i),(ii),(iii),(vi)or(viii)itshallgiveone(1)month'spriorwrittennoticetotheEmployeeandhis/herlaborunionorpaytheEmployeeonemonth'sbasicwageinlieuofsuchnoticetotheEmployee如果公司在第10.02条(i),(ii),(iii),(vi)或(viii)款规定的情况下解除本合同,应提前一(1)个月以书面形式通知员工和他/她的工会,或支付员工一个月基本工资代替该通知。10.07IftheEmployeeterminatesthisContractpursuanttocircumstancesotherthanthosestipulatedinArticle10.05(i),or(ii)above,he/sheshallgivetheCompanyone(1)month'spriorwrittennotice.如果员工在以上第10.05条(i)、或(ii)款规定以外的情况下解除本合同,他/她应向公司发出提前一(1)个月的书面通。10.08IftheEmployeeresignsorterminatesthisContractpursuanttocircumstancesotherthanthosestipulatedinArticle10.05(i),or(ii)aboveandifhe/shehasreceivedtrainingattheCompany'sexpensewithinthree(3)yearspriortotheresignationordischarge,theCompanyshallhavetherighttorequiretheEmployeetoreimbursethetrainingfeeandexpensesinthemannersetforthintheEmployeeHandbook.如果接受过由公司承担费用的培训的员工,在三年服务期内,在以上第10.05条(i)、或(ii)款规定的情况以外辞职或解除本合同的,公司有权按《员工手册》规定的方式要求员工偿付培训费用和开支。10.09Incaseofanysituationasfollows,thecontractshallbeterminated:有下列情形之一,本合同终止:Thetermofthiscontracthasexpired;本合同期满的;TheEmployeehasbeguntoenjoythebasicold-ageinsurancetreatments;员工开始依法享受基本养老保险待遇的;TheEmployeeisdeceased,orisdeadormissingasannouncedbythecourt;员工死亡,或者被人民法院宣告死亡或者宣告失踪的;Theemployerisannouncedbankruptaccordingtolaw;公司被依法宣告破产的;Theemployerisrevokedofbusinesslicensethereof,orisorderedtoclosedownorisdischarged,oritdeterminestogotoliquidationbeforetheschedule.公司被吊销营业执照、责令关闭、撤销或者公司决定提前解散的。10.10Incaseofthefollowingsituation,thecompanyhastopaycompensationtotheEmployee.有下列情形之一,公司应当向员工支付经济补偿:theEmployeedischargedthecontractaccordingtoArticle10.05员工根据10.05的约定解除本合同的;theCompanyandtheEmployeeagreetodischargethecontract;公司与员工协商一致解除本合同的;theCompanydischargedthecontractaccordingtoArticle10.02(i),(ii),(iii);公司依照10.02(i)、(ii)、(iii)约定解除本合同的;thecontractexpired,exceptthattheEmployeedisagreestorenewthecontracteventhoughtheconditionsofferedbytheCompanyarethesameasorbetterthanthosestipulatedinthecurrentcontract;除公司维持或者提高本合同约定条件续订合同,员工不同意续订的情形外,本合同期满的;thecontractterminatedaccordingtoArticle10.09(iv),(v。依照10.09(iv)、(v)终止本合同的。ARTICLE11-LIABILITYFORBREACHOFCONTRACT第^一条违约责任11.01IfeitherPartycommitsabreachofthisContractthatresultsineconomiclossestotheotherParty,he/she/itshallbeliablefordamagestotheextentofsuchlossesandhis/her/itsresponsibilityforthebreach.如果一方违反本合同造成另一方的经济损失,他/她/应在该损失及其违约责任范围内承担损害赔偿责任。ARTICLE12-LABORDISPUTES第十二条劳动争议12.01IfanylabordisputearisesbetweentheCompanyandtheEmployee,thePartiesshallattemptinthefirstinstancetoresolvesuchdisputethroughfriendlyconsultations.Labordisputeswhicharenotresolvedwithinten(10)daysafteraPartyservestheotherPartyawrittennoticerequestingthecommencementofconsultationswillbesettledbytheproceduressetforthinArticle12.02below.公司与员工如发生任何劳动争议,双方应首先通过友好协商解决争议。一方书面要求另一方进行协商解决,在书面通知之日起十(10)天内没有解决的劳动争议,将按照本合同以下第12.02条所规定的程序解决。12.02LabordisputesthatarenotresolvedthroughfriendlyconsultationsinaccordancewithArticle12.01aboveshallbesettledaccordingtothefollowingprocedures:劳动争议根据以上第12.01条无法通过友好协商解决的,应按照下列程序解决:eitherPartymayapplytotheShanghaiMunicipalLaborDisputeArbitrationTribunalforadjudication;and任何一方可以向上海市劳动争议仲裁委员会申请仲裁;和ifanyPartydoesnotagreewiththeadjudicationoftheShanghaiMunicipalLaborDisputeArbitrationTribunal,itmayinstitutelegalproceedingsatthelocalPeople'sCourtwithinfifteen(15)daysafterreceivingtheShanghaiMunicipalLaborDisputeArbitrationTribuna'lsruling.任何一方对上海市劳动争议仲裁委员会的仲裁决不服的,在接到上海市劳动争议仲裁委员会的裁决之日起十五(15)天内,可以向当地人民法院起诉。ThePartiesherebywaivetherighttomediatelabordisputes.双方特此放弃调解劳动争议的权利。ARTICLE13-CONFIDENTIALITY第十三条保密13.01TheEmployeeagreesatalltimesduringthetermoftheEmployee'semploymentandthereaftertoholdinstrictestconfidence,andnottouse,exceptforthebenefitoftheCompany,ordisclosetoanyperson,firmorcorporationwithoutwrittenauthorizationoftheCompany,anytradesecrets,confidentialknowledge,dataorotherproprietaryinformationrelatingtoproducts,processes,know-how,designs,formulas,developmentalorexperimentalwork,computerprograms,databases,financialinformationoranyothersubjectmatterpertainingtoanybusinessoftheCompanyoranyofitsclients,consultantsorlicensees.TheobligationssetforthinthisArticle13.01shallremaineffectiveforaperiodoftwoyearsfollowingtheexpirationorterminationofthisContract.TheEmployeeshallberesponsibleforalllegalconsequencesofanyviolationoftheseobligations,includingpaymentofcompensationtotheCompanyforanyfinanciallosssuffered.员工同意在员工受雇期限内及之后的一切时候均对以下各项严格保密,并且未经公司书面授权,除为公司利益外,不使用或向任何人、商行或公司泄露以下各项:与公司或其任何客户、顾问或被许可人的业务有关的任何商业秘密、保密资料、数据或其它关于产品、工艺、诀窍、设计、配方、开发研究工作、计算机程序、数据库、财务资料的专有信息或任何其它题材。本第13.01条规定的义务在本合同期满或解除后继续有效为期二年。员工违反任何上述义务的,应承担一切法律后果,包括赔偿公司遭受的任何经济损失。13.02TheEmployeeacknowledgesthattheremunerationreceivedfromtheCompanyinthecourseofhis/heremploymentconstitutessufficientrewardandremunerationforhis/herinvolvementinthecreationordevelopmentofanyinvention(ifany).TheEmployeeshallhavenoclaimwhatsoeverforanyadditionalrewardorremunerationinrespectofsuchinvolvementandtheCompany'sexploitationofsuchinvention.员工承认,在雇佣期间,公司向他/她支付的薪酬包含了由于他/她参与公司任何发明(如有的话)的创造或开发而获得的充分报酬。员工无权就参
