(Purpose)

Article1ThepurposeofthisActistopromoteimprovementinthestabilityofthelivesofthepeopleandthesounddevelopmentofthenationaleconomythroughcomprehensiveandsystematicimplementationofpoliciesontransportation,coupledwiththeBasicActonTrafficSafetyMeasures(ActNo.110of1970),bymeansofestablishingfundamentalprinciplesandbasicmatterstoputsuchfundamentalprinciplesintopractice,andbyclarifyingtheresponsibilitiesofthestateandlocalgovernments.

Article2Inlightofthefactthattransportationfunctionstoensuretheindependentdailylivesandsociallivesofthepeople,activeinter-regionalandinternationalexchange,aswellasthesmoothdistributionofgoods,andisindispensableforpromotingimprovementinthestabilityofthelivesofthepeopleandthesounddevelopmentofthenationaleconomy,policiesontransportationmustbepromotedunderthebasicrecognitionthatitisimportanttoappropriatelysatisfythebasictransportationdemandsofthepeopleandotherpersons(hereinafterreferredtoas"thePublic")byallowingsaidtransportationtofunctiontoitsfullpotentialintothefuture.

Article3(1)Inlightofthefactthattransportationisthefoundationforthedailylivesandsociallivesofthepeople,playsanimportantroleinthepositiveparticipationofthepeopleinsocioeconomicactivities,andisthefoundationforeconomicactivity,policiesontransportationmustbepromotedwiththeobjectiveofensuringandimprovingthefunctionalityoftransportationsoastoallowtransportationtocontributetotherealizationofprosperouslivesofthepeople,aswellastocontributetoenhancementoftheinternationalcompetitivenessofJapan'sindustries,tourism,etc.,andtheinvigorationoflocalregions,includingstimulationoflocaleconomies,whilecopingwithsocioeconomicchangesinJapansuchastherecentrapidprogressionofanagingpopulationcombinedwithalowbirthrate.

(2)Inensuringandimprovingthefunctionalityoftransportation,everypossibleconsiderationmustbegiventofacilitatingmitigationofthereductionofthefunctionalityoftransportationandquickrecoveryfromsuchreductionintheeventofalarge-scaledisaster,aswellastoenablingittoappropriatelyhandleevacuationmovementintheeventofsaiddisaster,inlightoftheimportanceofmaintainingthefunctionalityoftransportationandsmoothmovementforevacuationintheeventofsaiddisaster.

Article4Inlightofthefactthatmaintainingthesoundandrichconditionoftheenvironmentisindispensabletothehealthyandculturedlivesofpeople,aswellastheimpactoftransportationontheenvironment,policiesontransportationmustbepromotedwiththeobjectiveofreducingtheenvironmentalburdencausedbytrafficsothatthepeoplemayenjoythebenefitsofasoundandrichenvironmentintothefuture.

(AppropriateRole-SharingandOrganicandEfficientCoordinationamongModesofTransportation)

Article5Policiesontransportationmustbepromotedwithaviewtoachievingappropriaterole-sharingaswellasorganicandefficientcoordinationamongmodesoftransportationsuchaswalking,bicycles,vehicles,railwayvehicles,marinevessels,andaircraft,takingintoconsiderationcompetitionintheselectionofmodesoftransportation(whichincludetransportationfacilitiesandtransportationservices;thesameshallapplyhereinafter)andfreechoiceofthePublic,inaccordancewiththecharacteristicsofeachmodeoftransportation.

Article6Fromtheperspectiveoftowndevelopment,developingJapanasatourism-orientedcountry,etc.,policiesontransportationmustbepromotedundercoordinationandcooperationamongthestate,localgovernments,operatorsoftransportationundertakingsorothertransportation-relatedundertakings(hereinafterreferredtoas"Transportation-RelatedBusinesses"),partieswhomanagetrafficfacilities(hereinafterreferredtoas"TrafficFacilitiesAdministrators"),residents,andotherrelevantparties,in

coordinationbetweensaidpolicies,aswellaswithotherrelevantpolicies.

(EnsuringTrafficSafety)

Article7(1)PoliciesonensuringtrafficsafetyshallbegovernedbytheTrafficSafetyPoliciesBasicActandotherrelevantActs,inlightofthefactthatsaidpoliciesshallplayanimportantroleinprotectingthelives,personsandpropertyofthePublic.

(2)Inpromotingpoliciesontransportation,sufficientcoordinationwithpoliciesonensuringtrafficsafetythatshallbeimplementedinaccordancewithwhatisprovidedforintheprecedingparagraphmustbeassured.

(ResponsibilitiesoftheState)

Article8(1)ThestateshallberesponsibleforcomprehensivelyandsystematicallyestablishingandimplementingpoliciesontransportationinaccordancewiththefundamentalprinciplesofthepoliciesprescribedinArticles2to6(hereinaftersimplyreferredtoas"FundamentalPrinciples").

(2)ThestatemustendeavortodeepenPublicunderstandingoftheFundamentalPrinciplesandtoobtaintheircooperationthroughactivitiessuchasprovidingrelevantinformation.

(ResponsibilitiesofLocalGovernments)

Article9(1)Localgovernmentsshallberesponsibleforformulatingandimplementingpoliciesontransportationinaccordancewiththenaturalandsocioeconomiccharacteristicsoftheirdomain,inaccordancewiththeFundamentalPrinciplesandbasedontheappropriatesharingofroleswiththestate.

(2)LocalgovernmentsmustendeavortodeepenPublicunderstandingoftheFundamentalPrinciplesandtoobtaintheircooperationthroughactivitiessuchasprovidingrelevantinformation.

(ResponsibilitiesofTransportation-RelatedBusinessesandTrafficFacilitiesAdministrators)

Article10(1)Transportation-RelatedBusinessesandTrafficFacilitiesAdministratorsshallendeavortoconducttheirbusinessappropriatelyandcooperatewithpoliciesontransportationimplementedbythestateorlocalgovernments,inlightofthefactthattheyhaveanimportantroleinrealizingtheFundamentalPrinciples.

(2)Inadditiontowhatisprovidedforintheprecedingparagraph,Transportation-RelatedBusinessesandTrafficFacilitiesAdministratorsshallendeavortoprovidecorrectandappropriateinformationrelevanttotheirbusinessinaccordancewiththeFundamentalPrinciples.

Article11ThePublicshallplayaproactiveroleinbringingabouttheFundamentalPrinciplesthroughendeavoringtogainabetterunderstandingofsaidFundamentalPrinciplesthroughactivelyundertakingactivitiestheycanhandleindependentlyinordertoimprovesaidunderstanding,andendeavoringtocooperatewiththestateandlocalgovernmentsontheimplementationoftheirpolicies.

(CoordinationandCooperationamongRelevantParties)

Thestate,localgovernments,Transportation-RelatedBusinesses,TrafficFacilitiesAdministrators,residents,andotherrelevantpartiesshallendeavortocoordinateandcooperatewitheachothertowardrealizationoftheFundamentalPrinciples.

(LegislativeMeasures)

TheGovernmentshalltakelegislative,financialandothermeasuresthatarenecessarytoimplementpoliciesontransportation.

(AnnualReports)

(1)TheGovernmentmustannuallysubmittotheDietareportontransportationtrendsandimplementedtransportationmeasures.

(2)TheGovernmentmustannuallyprepareandsubmittotheDietdocumentsexplainingthepoliciesthattheGovernmentisgoingtoimplementinviewofthereportpertainingtotransportationtrendsintheprecedingparagraph.

ChapterIIBasicPoliciesonTransportation

Section1BasicPlanonTransportationPolicies

Article15(1)TheGovernmentmustestablishabasicplanontransportationpolicies(hereinafterreferredtoasthe"BasicPlanonTransportationPolicy")forthecomprehensiveandsystematicpromotionoftransportationpolicies.

TheBasicPlanonTransportationPolicyshallsetforththefollowing:

thebasicdirectionoftransportationpolicies;

targetsoftransportationpolicies;

measuresontransportationthattheGovernmentshallimplementcomprehensivelyandsystematically;

inadditiontowhatislistedintheprecedingthreeitems,mattersnecessaryforthecomprehensiveandsystematicpromotionoftransportationpolicies.

TheBasicPlanonTransportationPoliciesmustbeinconformitywith

nationalplansforcomprehensiveutilization,developmentandconservationofnationalland,andnationalbasicplansforpreservationoftheenvironment.

ThePrimeMinister,theMinisterofEconomy,TradeandIndustry,andtheMinisterofLand,Infrastructure,TransportationandTourismmustprepareadraftoftheBasicPlanonTransportationPolicyandseekacabinetdecisiononsaidpolicy.

BeforepreparingadraftoftheBasicPlanonTransportationPolicypursuanttotheprovisionoftheprecedingparagraph,thePrimeMinister,theMinisterofEconomy,TradeandIndustry,andtheMinisterofLand,Infrastructure,TransportationandTourismmustpublicizeanoutline,thecontent,andothernecessaryinformationrelatedtotheplan,andbroadlyseektheopinionofthePublic.

BeforepreparingadraftoftheBasicPlanonTransportationPolicypursuanttotheprovisionoftheparagraph(4),theMinisterofLand,Infrastructure,TransportationandTourismmustseektheopinionsoftheCouncilofTransportationPolicyandthePanelonInfrastructureDevelopment.

BeforepreparingadraftoftheBasicPlanonTransportationPolicypursuanttotheprovisionoftheparagraph(4),thePrimeMinister,theMinisterofEconomy,TradeandIndustry,andtheMinisterofLand,Infrastructure,TransportationandTourismmust,consultwiththeMinisterofEnvironmentfromregardingenvironmentalpreservation.

WhentheBasicPlanonTransportationPolicyisestablishedtheGovernmentmustreportthistotheDietandmakesaidpolicypublicwithoutdelay.

Theprovisionsoftheparagraph(4)totheprecedingparagraphofthisArticleshallapplymutatismutandistochangestotheBasicPlanonTransportationPolicy.

Section2StatePolicies

(EnsuringMeansofTransportationIndispensableforDailyLife)

Article16Thestateshalltakenecessarymeasuressuchasensuringdifferentmeansoftransportation,whiletakingintoaccountthetrafficsituationonisolatedislandsandothernaturalandsocioeconomicconditionsoflocalregions,inordertomakethesmoothtransportationofpeoplecommutingtowork,travelingtoschool,visitinghospital,aswellasthesmoothtransportationofotherpeopleandgoodsconsideredindispensableforthedailylivesandsociallivesofthepeoplepossible.

(PoliciesfortheSmoothTransportationofElderlyPersons,PersonswithDisabilities,andPregnantWomen)

Article17Thestateshalltakenecessarymeasuressuchaspromotionof

improvementsinthestructureandfeaturesofvehicles,railwayvehicles,marinevessels,aircraft,passengerfacilities,roads,andparkinglotsinordertoenablesmoothtransportationinthedailylivesandsociallivesofelderlypersons,personswithdisabilities,pregnantwomen,andotherswhosedailylivesorsociallivesarerestrictedduetophysicallimitations,aswellaspeoplewhoareaccompaniedbyinfants.

(ImprovementoftheConvenience,SmoothnessandEfficiencyofTransportation)

Article18InadditiontowhatisprovidedforintheprecedingtwoArticles,inordertoproperlysatisfythebasicdemandsofthePublicfortransportationintheirdailylivesorsociallives,thestateshalltakenecessarymeasurestoimprovetheconvenience,smoothnessandefficiencyoftransportationservices,includingensuringpunctuality(meaningtooperateinaccordancewithsetdepartureandarrivaltimes),improvingspeed(meaningtoshortenthetimerequiredtoreachadestination),ensuringcomfort,facilitatingconnectionsbetweentransportationservicesorupgradingthefunctionalityofconnectingtransportationservicesbyothermeans(meaningtoupgradethefunctionalityofconnectionsbetweentwoormoremodesoftransportation,addressingthetransportationofnumbersofpassengersthroughtransportationfacilitiesandsurroundingfacilities)andstreamliningtransportationservices.

(PoliciesNecessarytoEnhanceInternationalCompetitiveness)

Article19Thestateshalltakenecessarymeasuressuchasforminginternationalmaritimetransportationnetworksandinternationalaviationtransportationnetworks,developingseaportsandairportsthatarehubsfortheseinternationaltransportationnetworks,andstrengtheningthefunctionalityofconnectionsbetweentheseinternationaltransportationnetworksandnationwidedomestictransportationnetworks,inordertoenhancetheinternationalcompetitivenessoftheindustries,tourism,etc.,ofourcountry.

(PoliciesNecessarytoRevitalizeLocalRegions)

Article20Thestateshalltakenecessarymeasures,suchasformingdomestictransportationnetworksandtransportationhubsthatfacilitatepromotionoftheestablishmentofenterprisesiteswithinlocalregionsaswellascommunicationandtheexchangeofgoodswithinandbetweenlocalregions.

Article21Thestateshalltakenecessarymeasuressuchasenhancingbusiness

foundationsanddevelopinghumanresourcesforpromotingthesounddevelopmentoftransportationundertakingsandothertransportation-relatedundertakings,inlightofthefactthatstableoperationsofthesebusinessesfacilitateensuringandimprovingthefunctionalityoftransportation.

(PoliciesNecessarytoMitigateReductionofTransportationFunctionalityandQuicklyRecoverfromReductionintheEventofaLarge-ScaleDisaster)

Article22Thestateshalltakenecessarymeasuressuchasimprovingthesafetyoftransportationfacilitiesagainstearthquakes,ensuringmutuallyalternativemeansoftransportation,ensuringcoordinationbetweenrelevantpartiesforquickrecoveryoftransportationfunctionality,anddevelopingmeansoftransportationtakingintoaccountthatmovementforevacuationbynumbersofpeoplemaytakeplacesimultaneouslyintheeventofalarge-scaledisaster,inordertomitigatereductionoftransportationfunctionalityandquicklyrecoverfromsuchreductionintheeventofsaiddisaster,andtoensuresmoothtransportationforevacuationfromsaiddisaster.

(PoliciesNecessarytoReducetheEnvironmentalBurdenAssociatedwithTraffic)

Article23Inordertoachieveareductionoftheenvironmentalburdenassociatedwithtraffic,includingmitigationofgreenhousegasemissionsandpreventionofairpollution,marinepollution,andnoise,thestateshalltakenecessarymeasuressuchaspromotingthedevelopment,diffusionandproperusageofvehiclesandothertransportationmachineryandequipmentthatfacilitatingmitigationofgreenhousegasemissionsandemissionsofothersubstancesthatcauseenvironmentalburden,aswellasfurtheringthesmoothingoftrafficflow,promotingashifttorailandseafreightoroptimizingthemovementofgoodsbyothermeans,increasingtheconvenienceofpublictransportationforpassengers,preventingthedischargeofwastefrommarinevesselsintotheocean,andpreventingnoisecausedbyaircraft.

(DevelopmentofaComprehensiveTransportationSystem)

Article24(1)Thestateshalltakenecessarymeasurestodevelopacomprehensivetransportationsystemsuchaspromotingtheenhancementofcoordinationbetweenroadtraffic,railwaytraffic,marinetraffic,andairtrafficaswellasmutualcoordinationbetweenpublictransportationservices,consideringthatappropriaterole-sharingamongmodesoftransportationsuchaswalking,bicycles,vehicles,railwayvehicles,marinevessels,andaircraftinaccordancewiththecharacteristicsofeachmodeoftransportationisrequired,aswellasformingorganicandefficienttransportationnetworks.

(2)Thestateshalltakenecessarymeasurestointensively,effectivelyand

efficientlypromotethedevelopmentofmeansoftransportationunderthecoordinationprovidedforintheprecedingparagraph,whiletakingintoaccounttrendsinthedemandfortransportationandthestateofdeteriorationoftransportationfacilities,aswellasothercircumstances.

(PromotionofPoliciesfromthePerspectiveofTownPlanning)

Article25Thestateshalltakenecessarymeasuresfromtheperspectiveoftownplanningsothatlocalgovernmentpoliciesontransportationcanbepromotedundercoordinationandcooperationwiththestate,Transportation-RelatedBusinesses,TrafficFacilitiesAdministrators,residents,andotherrelevantparties,basedoncomprehensiveplansonland-use,andotherrelevantmatters.Inthiscase,thestateshallendeavortohavethedemandsofresidentsfortransportationandothercircumstancesbeconsideredforsaidcoordinationandcooperation.

(PromotionofPoliciesfromthePerspectiveofDevelopingJapanasaTourism-OrientedCountry)

Article26InlightofthefactthatdevelopingJapanasatourism-orientedcountryisvitalfortheJapan'ssocioeconomicdevelopment,andthatpromotingtouristtravelhelpsimprovethestabilityofthelivesofthepeopleandthesounddevelopmentofthenationaleconomyaswellascontributestoincreasinginternationalmutualunderstandingthroughtheexpansionofinter-regionalandinternationalexchange,thestateshalltakenecessarymeasuresrelatedtotransportationtopromotetouristtravelsuchaspromotingtheprovisionofthenecessarymeansoftransportationtotouriststhatsmooththeflowoftouristtraffic,promotingtheprovisionofinformationtoforeigntouristsusingforeignlanguagesorothermeasuresregardingvehicles,railwayvehicles,marinevessels,aircraft,passengerfacilities,androads.

Article27Thestateshalltakenecessarymeasurestopromotemutualcoordinationandcooperationbetweenrelevantpartiessuchaspromotingconferencesbetweenthestate,localgovernments,Transportation-RelatedBusinesses,TrafficFacilitiesAdministrators,residents,andotherrelevantpartiesinlightofthefactthatmutualcoordinationandcooperationamongthesepartiesenablethepoliciesontransportationtobeeffectivelypromoted.

(ResearchandStudy)

Article28Thestateshallpromotenecessaryresearchandstudy,suchasthatoftransportationtrends,toformulatepoliciesontransportation.
