UnderTitleIX,the1972lawthatbannedsexdiscriminationineducationalinstitutionsthatreceivefederalfunds,single-sexclassesandextracurricularactivitiesarelargelylimitedtophysicaleducationclassesthatincludecontactsportsandtosexeducation.

Toopenschoolsexclusivelyforboysorgirls,adistricthasuntilnowhadtoshowa"compellingreason",forexample,thatitwasactingtoremedypastdiscrimination.

Butanewattitudebegantotake'holdwiththepassageoftheNoChildLeftBehindLawin2002whenwomensenatorsfrombothpartiescameoutinsupportofsame-sexeducationandaskedtheEducationDepartmenttodraftguidelinestopermittheirgrowth.

Thenewrules,firstproposedbytheEducationDepartmentin2004,aredesignedtobringTitleIXintoconformitywithasectionoftheNoChildLeftBehindLawthatcalledonthedepartmenttopromotesingle-sexschools.
