Introduction:
OnApril29,2010,U.S.EPAproposedinterrelatedrulesregardingsolidwastes,boilers/processheaters,andcommercialandinstitutionalsolidwasteincinerators(CISWI).Thesewagesludgeincineration(SSI)rulewasproposedonOctober14,2010.
Thefinaldecisiononthenonhazardoussolidwastedefinitionwilldeterminewhetheragivenfacilityisregulatedasaboilerorasawastecombustor.InJune2007,theU.S.CourtofAppealsrejectedEPA’sstandards,citingCAAlanguagethat“anyfacilityburninganysolidwaste”istoberegulatedasawastecombustor,notaboiler.Thelegalrequirementsundertheproposedboilerandwastecombustorrulesdifferandmayresultindifferentairpollutioncontrolrequirements.
Sincethecourtvacaturoftheserulesin2007,U.S.EPArequestedinformationfromapproximately3,000boilerand500suspectedCISWIunitsandconductedemissionstestingatafractionofthesefacilities.SomeboilerselectedtoceaseburningsecondarymaterialstoavoidbeingclassifiedasasolidwastecombustorundertheproposedCISWIrule.Thedatafromtheemissionstestingwasevaluatedtodeterminealevelofcontrolfortheproposedstandards.
TheCleanAirAct(CAA)createdtwodifferentrequirementsforboilers(sec.112)andcommercialandindustrialsolidwasteincineration(CISWI)units(sec.129).Undersection112oftheCAA,boilersarecategorizedasmajorandareasources.Majorsourcesincludethosethatemit10tonsperyearofanyoneairtoxicor25tonsperyearofallairtoxics.MaximumAchievableControlTechnology(MACT)standardsmustbesetforallemittedtoxicairpollutants.Areasourcesincludesourcesthatemitlessthanthe10/25tonsperyearthresholdforairtoxicsemissions,andthesesourcesmayberegulatedbasedonthelessstringentGenerallyAchievableControlTechnologystandards(GACT).However,certainpollutants(e.g.,mercuryandpolycyclicorganicmatter)mustberegulatedbasedonMACTstandardsfromthesesources.CISWIunitsareregulatedundersection129oftheCAAandstandardshavebeensetfor9specificairpollutants.ThereisnoprovisionunderthissectionoftheCAAwhichauthorizesGACTforsmallersources.
Emissionlimitsfortheserulesarebasedonthe“maximumachievablecontroltechnology”(MACT)withlaterevaluationsofremainingriskleadingtostricterstandardsifneeded.Newsourcestandardsfortheseproposedrulesreflectwhatiscurrentlyachievedbythebestcontrolledsimilarsource.Existingsourcestandardsreflectwhatisachievedbytheaverageofthebest12%ofexistingsources.
OnFebruary21,2011U.S.EPAissuedfinalrulesthatwillreduceemissionsofairpollutantsfromexistingandnewboilers/processheaters,CISWIunits,andSSIunits.
ReconsiderationoftheEmissionStandardsforMajorBoilersandProcessHeaters,AreaSourceBoilers,andCISWIUnits
U.S.EPAisintheprocessofdevelopingareconsiderationnoticethatidentifiesthespecificelementsintheruleswhichrequirefurtherpubliccommentandmodifications.
Threerulesareimpacted:

BoilerMajorSourceRule(40CFR63subpartDDDDD)
BoilerAreaSourceRule(40CFR63subpartJJJJJJ)
Forthepurposesofthissummary,onlytheboilerruleswillbecovered.

Thisruleidentifiestherequirementsandproceduresfortheidentificationofsolidwastesusedasfuelsoringredientsincombustionunitsundersection1004oftheResourceConservationandRecoveryAct(RCRA)andsection129oftheCleanAirAct(CAA).Thedefinitiondefinesnon-hazardoussecondarymaterialsthatarecombustedaswaste(theburningofwhichwouldmakeacombustionunitasolidwasteincinerationunit)andothersassecondarymaterials(theburningofwhichwouldnotcauseacombustionunittobeconsideredasolidwasteincinerationunit).OnepotentialimplicationoftheproposeddefinitionofsolidwasteisthatsomecombustionunitscurrentlyconsideredboilerswouldbesubjecttotheproposedCISWIstandardsintheenergyrecoveryunitsubcategoryiftheycontinuedtocombustsolidwaste.ThisrulewillhelpapplicablefacilitiesdeterminewhetherairrequirementsundertheCAAsection112orCAAsection129applytothem.

Importanttermstokeepinmind:
Asecondarymaterialisanymaterialthatisnotaprimaryproductofamanufacturingorcommercialprocess.Thesematerialscanincludepost-consumermaterials,off-specificationcommercialchemicalproducts,manufacturingchemicalintermediates,post-industrialmaterial,andscrap.
Solidwasteisdefinedas“anygarbage,orrefuse,sludgefromawastewatertreatmentplant,watersupplytreatmentplant,orairpollutioncontrolfacilityandotherdiscardedmaterial,includingsolid,liquid,semi-solid,orcontainedgaseousmaterialresultingfromindustrial,commercial,mining,andagriculturaloperations,andfromcommunityactivities,butdoesnotincludesolidordissolvedmaterialsindomesticsewage,orsolidordissolvedmaterialsinirrigationreturnflowsorindustrialdischargesthatarepointsourcessubjecttopermitunder33U.S.C.1342,orsource,specialnuclear,orby-productmaterialasdefinedbytheAtomicEnergyActof1954,asamended(68Stat.923).”
Contaminantsunderthisruleareconsideredtobeanyconstituentinnon-hazardoussecondarymaterialsthatwillresultinemissionsofanypollutantsidentifiedinCAAsection112(b)andtheninepollutantslistedunderCAAsection129(a)(4).Emissionsresultwhensecondarymaterialsareburnedasfuelorusedasingredients,includingmaterialsthatcouldgenerateproductsofincompletecombustion.
Non-hazardoussecondarymaterialisasecondarymaterialthat,whendiscarded,wouldnotbeahazardouswaste.
Traditionalfuels:Definitionencompassestwocategories
Historicallymanagedfuels
“Alternative”fuelsthathavebeendevelopedfromvirginmaterials.Theseincludeadditionalmaterialsthatareeconomicallyviableandtobeusedasalternativetraditionalfuels.
Thesefuelsarenotsecondarymaterialsorsolidwastesunlessdiscarded.
Whatconstitutesasolidwaste?
U.S.EPAidentifiedtwokeyfactorsfordeterminingsolidwaste:
Hasthesecondarymaterialbeendiscarded?
Ifithasbeendiscarded,hasitbeensufficientlyprocessedtoproducealegitimatefuel.
Ingeneral,non-hazardoussecondarymaterialsaresolidwasteswhenburnedincombustionunits.
Whatisnotasolidwaste?
Non-hazardoussecondarymaterialsthatarenotconsideredasolidwastewhencombustedinclude:
Materialsthatremainwithinthecontrolofthegeneratorandusedasafuel
Scraptiresmanagedbyanestablishedtirecollectionprogramandusedasafuel
Resinatedwoodusedasafuel
Materialsusedasingredientsincombustionunitthatmeetthelegitimacycriteriaasdefinedinthisrule
Materialsthatarediscardedthathaveundergoneprocessingtoproducefueloringredientproductsandmeetthelegitimacycriteriaasdefinedinthisrule
Materialsthatareusedasfuelsforwhichanon-wastedeterminationhavebeengrantedbytheAdministrator
TheAdministratormaygrantanon-wastedeterminationthatanon-hazardoussecondarymaterialusedasafuelisnotdiscardedandthereforenotasolidwastewhencombusted.
Asecondarymaterialmustbelegitimatelyusedtobeconsideredanon-waste.Pleaserefertotheruleforspecificlegitimacycriteriafornon-hazardoussecondarymaterials(40CFR241.3(d)).Tomeetfuellegitimacycriteria,thenon-hazardoussecondarymaterialmustbemanagedasavaluablecommodity.Thismeansthatthematerialmusthaveameaningfulheatingvalueandbeusedasafuelinacombustionunitthatrecoversenergyandcontainscontaminantsatlevelscomparabletoorlowerthanthetraditionalfuelswhichthecombustionunitisdesignedtoburn.
Generally,non-hazardoussecondarymaterialsthatarediscardedinthefirstinstancewillstillbeconsideredasolidwasteeveniftheysatisfythelegitimacycriteria.

Background:
Thisfinalruleaddressesthecombustionofnon-solidwastematerialsinboilersandprocessheaterslocatedatmajorsourcesofHAPs.ICIboilersandprocessheaterslocatedatmajorsourcesofHAPsareregulatedbythisrule.Ifanowneroroperatorofanaffectedsourcesubjecttothesestandardsweretostartcombustingasolidwaste,theaffectedsourcewouldceasetobesubjecttothisactionandwouldbesubjecttotheregulationsunderCAAsection129.

Thisproposedrulewouldrequiremajorsourcesofindustrial,commercial,andinstitutionalboilersandprocessheaterstomeethazardousairpollutantemissionsstandardsbyreflectingtheapplicationofthemaximumachievablecontroltechnology(MACT).Thisruleisdirectedtoboilersandprocessheaterslocatedatmajorsources.
Hazardousairpollutantswillbereducedbythefollowingcontrolmethods:
Reducingtheemissionsofthehazardousairpollutantslistedinsection112(b)(1)oftheCAA
Existingmajorsourcefacilitieswithanaffectedboilerwillberequiredtoundergoanenergyassessmentontheboilersystemtoidentifycost-effectiveenergyconservationmeasures.
Theunitssubjecttothisruleincludethoseindustrial,commercial,orinstitutionalboilersandprocessheatersthatdonotcombustsolidwaste.
Whatisanaffectedsource(§63.7490and§63.7491)?
Boiler:anencloseddevicewhichusesflamecombustionandhastheprimarypurposeofrecoveringthermalenergyintheformofsteamorhotwater.Devicesthatcombustsolidwastearenotconsideredtobeboilersaccordingtothisrule.
Boilersystem:theboilerandassociatedcomponentssuchasthefeedwatersystems,thecombustionairsystem,thefuelsystem,blow-downsystem,combustioncontrolsystem,andenergyconsumingsystem.
Processheater:encloseddeviceusingacontrolledflameforwhichtheunit’sprimarypurposeistotransferheatindirectlytoaprocessmaterial.Combustiongasesdonotcomeintodirectcontactwiththeprocessmaterials.
AboilerorprocessheaterisnewifyoucommenceconstructionoftheboilerorprocessheaterafterJune4,2010.
AboilerorprocessheaterisreconstructedifyoumeetthereconstructioncriteriaandyoucommencereconstructionafterJune4,2010.

Biomass/bio-basedsolidfuel:biomass-basedsolidfuelthatisnotasolidwaste.Thiscouldincludewoodresidue,woodproducts,animalmanure,vegetativeagricultureandsilviculture,bagasse,orchardpruning,cornstalks,coffeebeanhullsandgrounds.
Blastfurnacegasfuel-firedboiler/processheater:unitsthatreceive90%ormoreoftheirtotalannualgasvolumefromblastfurnacegas.
Coal:allsolidfuelsclassifiableasanthracite,bituminous,sub-bituminous,orlignite,coalrefuse,andpetroleumcoke.Coalalsoincludessyntheticfuelsderivedfromcoal.
Fluidizedbedboiler:boilerutilizingafluidizedbedcombustionprocess
Fluidizedbedcombustion:processwherefuelisburnedinabedofgranulatedparticles,whicharemaintainedinamobilesuspensionbytheforwardflowofairandcombustionproducts
Gaseousfuel:naturalgas,processgas,landfillgas,coalderivedgas,refinerygas,andbiogas

Areviewofthefacility’senergymanagementpracticesandproviderecommendationsforimprovementsconsistentwiththedefinitionofenergymanagementpractices
Alistofmajorenergyconservationsmeasuresidentified
Listofenergysavingspotentialoftheenergyconservationmeasuresidentified
Comprehensivereportdetailingwaystoimproveefficiency
EnergyassessmentthatmeetsthecriterialistedaboveandhasbeenconductedonorafterJanuary1,2008meetstherequirementsintherule.

SubmittodelegatedauthorityanannualreportwhichcontainstheconcentrationofCO(ppmvd)ineffluentstreamandoxygen(percentdrybasis).Concentrationsshouldbemeasuredbeforeandafteradjustmentstotheboilerweremade.Also,thereportshouldincludeasummaryofcorrectiveactionstakenaspartofacombustionadjustment,andthetypeoffuelusedoverthe12monthspriortotheannualadjustment.
Also,ownersandoperatorsofmajorsourcefacilitiesmustsubmitdocumentationthatanenergyassessmentwasconducted.
Testing,FuelAnalysis,andInitialCompliance:
Initialcompliancedeadline(§63.7510):
Existingsourcesmustdemonstrateinitialcompliancenolaterthan180daysafterthecompliancedate.
New/ReconstructedsourcesthathadconstructionormodificationsafterJune4,2010mustdemonstrateinitialcompliancenolaterthanNovember16,2011.New/ReconstructedsourcescomplyingwithanemissionlimitinTable12mustdemonstratecompliancebySeptember17,2014.
InitialComplianceRequirements(§63.7510):
Forsourcesthatelecttodemonstratecompliancewithanyoftheapplicableemissionlimitsthroughperformancetesting,yourinitialcompliancerequirementsincludeconductingaperformancetest,conductingafuelanalysis,establishingoperatinglimits,andconductingCMSperformanceevaluations.Sourcesthatburnasinglefueltypeareexemptfromconductingafuelanalysis.SourcesthatdemonstratecompliancewithHClormercurylimitsthroughfuelanalysis,therequiredinitialcompliancedemonstrationistoconductafuelanalysisforeachtype.SourcessubjecttoCOlimitarerequiredtoconductaperformancetestforCOincludingaperformanceevaluationonthecontinuousoxygenmonitor.SourcessubjecttothePMlimitthathaveaheatinputcapacitygreaterthan250MMBtuperhourandcombustcoal,biomass,orresidualoilarerequiredtoconductaperformanceevaluationoftheircontinuousmonitoringsystemforPM.
WhenmustIconductsubsequenttests(§63.7515)?
Allapplicableperformancetests,exceptfordioxins/furans,mustbeconductedonanannualbasis.Annualperformancetestsmustbecompletednomorethan13monthsafterthepreviousperformancetest.Ifyouelecttodemonstratecompliancethroughemissionaveraging,youmustcontinuetoconductperformancetestsannually.
Scheduleforconductingperformancetests:
Youcanconductperformancetestslessoftenforagivenpollutantifyourperformancetestsfor2consecutiveyearsshowthatyouremissionsareatorbelow75%oftheemissionlimit.Inthiscase,youdonothavetoconductaperformancetestforthatpollutantforthenexttwoyears.
