仅供个人参考兼职协议 ：现住址presentaddress ：宅电hometelephone：手机号码mobilephonenumber ：紧急联络人emergencycontactperson ：与劳动者关系relationshipwithemergencycontactperson ：联系电话emergencycontactphonenumber ：不得用于商业用途仅供个人参考第三条本协议自_2011_年10_月_01_日起至_2012_年_09_月_30_日止。Thiscompactapplyduringtheperiodcommencingonthedateof2011-10-1andendingonthedateof2012-9-30.第四条根据甲方工作需要及任职要求，乙方同意以兼职形式为甲方提供如下服务：Baseontheneedsandrequirement offirstparty,second partyprovidepart-timeserviceasfollows:1，与甲方指定客户进行约见和面谈，依甲方要求、协助甲方处理相关事宜； meetappointedcostumers,accordingtotherequirementfromfirstparty,providecorrelativeassistance.2，根据甲方要求协助甲方处理紧急事件； Baseontheneedsoffirstparty,provideassistanceonemergency.3，作为培训讲师，为甲方培训提供培训支持工作。 Astrainer, provide assistance ontraining.第五条甲方每月8 日（公历，遇节假日顺延）支付乙方上月服务报酬 ,乙方服务报酬（税前）为：人民币 1000_元/次*天；大写：人民币 1000元/次*天。如服务时间不足半天服务费用以125元/小时计算。Bythe8thdayofeachmonth(theGregoriancalendar,postponeinthecaseofholidays)第六条甲方制定的劳动纪律和规章制度应当符合法律、 法规的规定，并向乙方公示，乙方应当在确认后遵照执行。Labordisciplines andregulations whichmadebyfirst partyshouldfulfill thelegal andregulatory requirement, andpublic notice secondparty whoshouldactonthiscompactafterconfirming.不得用于商业用途仅供个人参考第七条甲方有权根据规章制度对乙方进行奖惩， 当乙方严重违反甲方的规章制度时， compactwithouteconomiccompensationtosecondparty.第八条由于双方的劳动聘用关系，乙方将有机会了解并使用甲方的有关商业秘密 （包括但不限于经营策略、软件系统、薪酬系统、营销渠道、员工或客户资料、供应商、价格系统、知识产权等所有资料及文件），乙方有在协议期内及协议解除后保守甲方商业秘密不对外泄露的义务，也不能用于为自己谋取利益的经营活动中。 乙方不得将涉及甲方商业秘密的实物、文字材料、电子文档等以窃取、摘抄、复制、传真、拍照、电子邮件等方式占有、传播、出售、使用或允许他人使用甲方的商业秘密。本条款所规定行为，乙方如有违反，应向甲方支付违约金人民币壹拾万元。Becauseoftheemployer-employeerelationship,secondpartywouldknowandusethetradesecretfromfirstparty(includebutnotlimited tomarketing tactics 、software system、salary system、marketing channel、materialofemployeeandclient 、supplier 、pricesystem 、intellectualpropertyrightsandallsortofmaterialsanddocuments),secondpartyisindutyboundtonotdisclose thetrade secret offirst party, nortakeadvantageofcompany’strusttoseekprofitforone ’sown.Secondpartymustnotoccupy 、spread、sale、use、orletotherpeopleusethearticle 、writtenmaterials 、electronicdocumentbystealing 、extracting 、copying、faxing、photographing、emailing andothermethods.Alltheactionsunderthisclause,ifsecondpartycommittedthebreach,shouldpaypenalsumof100,000RMB.第九条乙方有下列情形之一的，甲方可以解除本协议，但是应当提前十日以书面形式通知乙方：First party could carry out rescission of compactin anyof the following不得用于商业用途仅供个人参考circumstances, however,shouldnotice secondparty bywritten form10daysearly.⑴ 患病或者非因工负伤，医疗期满后，不能从事原工作也不能从事由甲方另行安排的工作的；Inthecaseoffall ill orwoundinline ofduty, whenthemedicaltreatment expires,if notbeabletoparticipate formerworkorotherappointedworkfromfirst party;⑵ 不能胜任工作，经过培训或调岗，仍不能胜任工作的；Incompetent,aftertrainingortransfer-position,stillincompetent;⑶ 本协议订立时所依据的客观情况发生重大变化，致使协议无法履行，经甲乙双方协商不能就变更协议内容达成一致的；Duetoobjectivereasons,unabletofulfillcompact,moreover,cannotreachtoanagreementwithvariationoncontract.⑷ 法律、行政法规规定可以解除协议的。Rescissionofcompactisinaccordwithlawandadministrativeregulation.第十条乙方有下列情形之一的，甲方可以单方面随时解除协议，并对乙方不作任何经济补偿；乙方因下列行为给公司造成损害的，甲方有权要求乙方赔偿损失： Firstpartycouldcarry outrescission ofcompactinthefollowing circumstances atanytime,withoutmakinganycompensation;firstpartyhastherighttoletthesecondpartycompensateforlossinanyofthefollowingcircumstances.⑴在应聘过程中提供的个人证件、体检、简历等个人资料有欺诈行为的；Iftherewerefraudactsonpersonalpapers 、medicalcertificates 、resume;⑵按公司奖惩的有关规定，严重失职，工作不负责任，玩忽职守、消极懈怠给公司利益造成损害的；Inaccordancewithcorrelative provision ofreward/punish, grossneglect ofduty,irresponsible,listlessduringwork,resultlosstoprofitofcompany.⑶乙方盗窃公司、员工或客户财物的；报销费用时有虚报或假报金额等行为的；Secondpartystealpropertyfromcompanyoremployees;deceptionduring不得用于商业用途仅供个人参考theprocessofapplyingforreimbursement.⑷泄露公司商业秘密；利用职务以权谋私、损公肥私的； Breachofconfidence;takeadvantageofdutytoseekpersonprofit.⑸欺诈客户、公司，谋取私利的，私下从事同业工作的； Stingclient 、companytoseekpersonalprofit,participatesametypeofworkinsecret⑹结党营私、破坏员工关系，生活作风不端正的； Formcliques,wreckrelationshipsBetweenemployees,badlifestyle(immorallove).⑺违法行为或不良社会行为而给甲方形象造成巨大伤害的； unlawfulactorbadbehaviorwhichdiminishthereputationofTalent.⑻有赌博、吸毒等不良行为的； gamble、drugtakingorotherbadbehavior⑼被依法追究刑事责任或违法被处罚的； Beingundertakenforcriminalresponsibilityorpunishedforbreakingthelaw.⑽严重违反公司的劳动纪律、规章制度的；法律规定或双方约定的其它情形。Committingaserious breachofdiscipline 、regulation orother agreementbetweentwoparties.第十一条 乙方解除协议，应当提前三十日以书面形式通知甲方。 Secondpartymakeearlyrescissionofcompact ，shouldprovide30dayspriornoticetofirstparty.第十二条 甲乙双方约定无论何种情形解除协议， 乙方都对工作交接负有责任，须按甲方规定的程序进行工作交接。乙方不按甲方的规定交接工作的，甲方有权扣发乙方服务费；乙方不按规定交接工作致使甲方遭受损失时， 甲方将依法向乙方索赔。Nomatterwhattypetherescission ofcompactis, secondparty doeshavetheobligation ofcarryingoutthehandoverofhiswork,andfulfill it according totheappointed processfromfirstparty.Ifthesecondpartyfailedtodoso,thefirstpartyhastherighttodeductwagesofsecondparty;firstpartywouldasksecondpartyforcompensationifthenon-fulfillmentofsecondpartyledtoeconomiclossesof不得用于商业用途仅供个人参考firstparty.第十三条 特别约定：specialcompact⑴由于乙方为兼职人员，故甲方不需为乙方缴纳社会保险。 Secondpartyispart-timeJob,noneedtopaysocialinsurancefor.⑵ 乙方因病或非因工负伤医疗费用自行解决， 医疗期内甲方不支付报酬。Secondparty getsickorgetwoundednotinthelineofduty,secondpartyshouldpayhimself.⑷ 双方解除、终止本协议，甲方无需支付乙方任何经济补偿。 If compactwasdeterminedbytwoparties,firstpartydoesnothavetopaysecondpartycompensation.⑶ 其他：甲方如需乙方提供服务，需提前 1天书面通知乙方.Other: first party needstocontactsecondparty1dayearlywhenneedsthelatter.第十四条 协议约定内容与国家有关法律、法规、政策不一致的，依照国家规定执行。因本协议引的任何争议，均提请甲方所在地法院处理。
