OntheotherHand,作为合同乙方,Hereinaftercollectivelyreferredtoasthe “PARTIES”.甲方、乙方以下统称 “合同双方”。InaccordancewiththeLabourLaw,theProvisionsontheLabourAdministrationRegulationsforForeignInvestmentEnterprisesandotherrelevantlawsandregulationsofthePeople?sRepublicofChina,thePARTIEShaveconcludedthefollowinglabourcontract(hereinafterreferredtoasthe“CONTRAC”T)合同双方依照《中华人民共和国劳动法》、《外商投资企业劳动管理规定》以及中华人民共和国其它相关法律法规,共同约定以下劳动合同 (以下简称 “本合同”)。TheEMPLOYEEwillhavethefollowingposition:该员工将担任以下职务:XXXXXXThedutiesandresponsibilitiesoftheEMPLOYEEwillbe,butnotlimitedto:该员工的工作职责包括但不限于:XXXXXXXXXIfnecessaryduetothemanagementorganisationoftheCOMPANYandorthecompetenceandabilitiesoftheEMPLOYEEtheCOMPANYmayadjusttheposition,dutiesandresponsibilitiesoftheEMPLOYEE.若由于本公司管理编制的需要及/或由于该员工本人资格与能力的原因,本公司可在必要的情况下对该员工的职务和工若由于本公司管理编制的需要及作职责进行适当调整。ThetrialperiodwillstartonthedateofsignatureofthisCONTRACT.Thedurationofthetrialperiodisthree(3)months.DuringthetrialperiodtheEMPLOYEEwillbeboundbyallarticlesofthiscontract.试用期自本合同签署之日起开始,时间为三个月。在试用期间,该员工受本合同全部条款所约束。AfterthespecifiedtrialperiodandifnonoticeofterminationisgiventheEMPLOYEEautomaticallybecomesemployedunderthetermsandconditionsofthisCONTRACT.在约定的试用期内,若该员工没有收到关于解除劳动关系的通知,在试用期满后,该员工自动转为本公司正式员工,执行本合同规定的条款。3.1ThedurationofthisCONTRACTistwenty-sixth(26)months.本合同期限为26个月。ThisCONTRACTmaybeextendeduponagreementofbothPARTIES.AnextensiontothisCONTRACTshallcomeintoforceonlyafterawrittenagreementhasbeensignedbybothPARTIES.本合同经合同双方同意后可以续签。只有在合同双方签署书面协议后,续签的合同方能生效。TheCOMPANYshalldefineitsownsalarypolicyinaccordancewithregulationsstipulatedbythestateandmunicipalgovernment.TheCOMPANYshallensurethatthemonthlysalaryoftheEMPLOYEEisnotlessthantheminimumpaystandardsetbythelocalgovernment.本公司将依照中华人民共和国和北京市有关政策法规制定本公司的员工工资标准。本公司保证该员工的月工资将不低于当地政府规定的最低工资。TheEMPLOYEEwillreceiveagross口monthlyor口annualsalaryofXXXrenminbi(RMBXXX)andincreasethereafterthebasisofthestaffperformance,theeconomicdevelopmentoftheCOMPANYandaccordingtothesalarypolicyoftheCOMPANYapprovedbytheBoardofDirectorsoftheCOMPANY,andetc.该员工税前工资将为口每月或口每年XXX元人民币,今后将按照该员工的工作表现、本公司的经济效益以及由本公司制定并经董事会批准的工资标准每年递增。SuchsalaryshallbetransferredtothebankaccountdesignatedbytheEMPLOYEEbetweenthethirdandfifthdayofeachmonth.上述工资将于每月3号至5号期间汇入该员工所指定的银行账户。5.1AtthefulldiscretionoftheChiefExecutiveOfficerandbaseduponhis/hergeneralattitudeandtheresultofhis/herworkandfulfilmentofhis/herobjectivesdetailedwithhis/hermanagerandatthebeginningofeachcalendaryeartheEMPLOYEEwillbeentitledtoanannualbonusnotexceedingone(1)monthofsalaryandshallbepaidtotheEMPLOYEEforeachfullcalendaryearwhichtheEMPLOYEEworksfortheCOMPANYintwo(2)instalmentsthefollowingyear.经本公司首席执行官同意,并且根据该员工的工作态度、工作成果及其上级主管规定之工作目标的完成状况,该员工将有权在每个公历年初享受年终奖金(奖金总额不超过该员工的月工资)。员工为公司工作满一年时,奖金将于次年分两次发放给个人。TheEMPLOYEEshallpayindividualincometaxinaccordancewiththerelevantlawsandregulationsofthePeople?sRepublicofChina.TheCOMPANYshallwithholdsuchamountandpayittothecompetenttaxbureau.该员工须按照中华人民共和国相关法律法规缴纳个人所得税。本公司将为该员工代扣代徼个人所得税,并将应纳税款上交相应税务机关。篇二:英文英语版本正式劳动合同劳动合同LaborContract甲方(用人单位):PartyA(employer):性质:有限责任公司Property:LimitedLiabilityCompany地址:Address:乙方PartyB(劳动者 untilthetaskisfinished.二、工作内容和义务 JobContentandResponsibility1、乙方同意根据甲方工作需要,AccordingtoPartyA’sdemand,在部门,从事 (管理、销售、技术、生产、后勤等)工作,并遵守岗位工作制度与合理的工作安排(包括但不限于工作内容、工作地点)。PartyBagreestoengagein (management/sales/technology/manufacture/logisticsetc.)workinthedepartmentandabidebytheworksystemandreasonableworkarrangement.(Includedbutunlimitedtojobcontent&workingplace.)2、乙方应当按照甲方岗位职责要求,保质保量完成工作任务;AccordingtoPartyA’spostresponsibilityrequirement,PartyBshouldfinishworkingtaskwithqualityandquantityguaranteed.3、甲方本着“一专多能、一职多岗”的用人原则,可以根据经营需要及乙方的工作能力调整乙方的工作职务和岗位,乙方应服从安排。Basedontheprincipleof“oneskillwithmultipleability,onepostwithmultiplework”,andaccordingtothebusinessdemandandPartyB’scompetence,PartyAmayadjustPartyB’sdutyandpost,whilePartyBshouldobeytheadjustment.三、劳动保护和劳动条件 LaborProtection&LaborCondition1、甲方根据国家有关安全生产、劳动保护、职业卫生的规定,为乙方提供必要的工作条件和劳动保护设施,保障乙方的安全与健康;Accordingtotherelatedstipulationofsafetymanufacture/laborprotection/occupationalhealthfromthestate,PartyAprovidesnecessaryworkingconditionandlaborprotectionfacilities,insuringPartyB’ssafetyandhealth.2、甲方根据国家有关规定制定工时制度,乙方确因生产经营需要延时的,甲方应当依法安排乙方补休或支付相应的加班费;若乙方实行的是级别工资,则在当月的绩效考核中体现;Accordingtotherelevantregulationsofworkinghoursystem,ifPartyBneedstoextendtheworkinghoursduetotheneedofproductionandoperation,partyAshallarrangepartyBcompensatorytimeofforpayovertimesalaryinaccordancewiththelaw;IfpartyBisimplementedwagelevels,thecompensationshouldbereflectedintheperformanceappraisalforthemonth.3、甲方根据国家有关规定为孕期、产期、哺乳期的女职工提供劳动保护;PartyAshouldprovideprotectionforwomenworkersinpregnancy,childbirth,breastfeeding,inaccordancewiththerelevantprovisionsoftheState.4、甲方负责对乙方进行政治思想、职业道德、业务技术、劳动安全卫生及有关规章制度的告知、教育和培训。PartyAisresponsibletoprovidepoliticalideology,professionalethics,businesstechnology,laborsafetyandhygiene,andrelatedrules,educationandtrainingforPartyB.四、劳动报酬Laborremuneration根据“按劳分配”原则,实行同工同酬,乙方的报酬不得低于当地最低工资标准。具体薪酬标准、支付方式以及支付时间按公司制定的《薪酬管理制度》执行。Accordingtotheprincipleofdistribution,andequalpayforequalwork,remunerationofPartyBshallnotbelowerthanthelocalminimumwagestandard.Specificcompensationstandards,payment,andtimeissetbythe “thesystemofcompensationmanagement”bythecompany五、社会保险SocialInsurance甲方应按照国家有关社会保险的法律、法规和政策为乙方缴纳基本养老、基本医疗、失业、工伤、生育保险费用;社会保险费个人缴纳部分,甲方从乙方工资中代扣代缴。Inaccordancewithnationallaws,regulationsandpoliciesrelatingtosocialinsurance,PartyAshallpaythebasicpension,basicmedical,unemployment,workinjuryandmaternityinsurancecosts,forthePartyB;socialinsurancepremiumspaidbyindividualspartiswithholdwagesfromPartyB.六、劳动纪律和规章制度 Labordisciplineandregulations1、甲方依法制定的劳动纪律和规章制度,乙方有义务遵守;LabordisciplineandregulationslegallystipulatedbypartyA,partyBshallhavethedutytoabidebyit.2、签订本合同前,甲方已对乙方进行了劳动纪律、操作规程、管理制度等相应的培训;Beforesigningthiscontract,PartyAhastoprovidepartyBthelabordiscipline,operatingprocedures,managementsystemandthecorrespondingtraining乙方应当遵守甲方的工作操作规程,服从工作安排;PartyBshallabidebytheworkingprocedures,obeytheworkarrangementofpartyA.4、乙方违反劳动纪律或规章制度,甲方有权按本单位的规章制度,给予纪律处分,直至解除本合同。IfPartyBviolateslabordisciplineorregulations,PartyAisentitledbytherulesoftheunittogivePartyAdisciplinaryaction,uptoterminatethiscontract.七、劳动合同的变更 Thechangeoflaborcontract订立本合同所依据的客观情况发生重大变化,致使本合同无法继续履行的,经双方协商同意,予以变更劳动合同相关内容。Iftheobjectivesituationthiscontractbasedon,changessignificantly,toresultthecontractunabletoperform,bymutualconsent,relatedcontentinlaborcontractsshallbechanged.八、劳动合同的解除 Theremoveoflaborcontract双方协商一致,劳动合同可以解除。Thetwopartymayterminatethelaborcontractwithmutualagreement.乙方有下列情形之一的,甲方可以即行解除劳动合同:Ofanyofthefollowingcircumstances,partyAmayimmediatelyterminatethelaborcontract.在试用期内被证明不符合录用条件的;Beenprovennottomeettheconditionsofemploymentduringthetrialperiod.2、采取欺诈手段订立本合同的; Adoptedfraudulentmeanstoenterintothiscontract.3、严重违反劳动纪律或规章制度给甲方造成重大损害的;SeriouslyviolatedlabordisciplineorregulationstocausesignificantharmtothePartyA.4、严重失职、营私舞弊,或泄露甲方商业秘密,给甲方利益造成重大损失的;Grossnegligence,malpractice,ordisclosureoftradesecretsPartyA,tocauseheavylossestotheinterestsofthePartyA.5、乙方同时与其他用人单位建立劳动关系,对完成本单位的工作任务造成严重影响,或者经用人单位提出,拒不改正的;PartyAbuiltlaborrelationshipswithotherunit,tocauseaseriousimpactonthecompletionofthetasksoftheunit,orrefusedtocorrecttherulesmadebytheemployer6、被依法追究刑事责任的。Beinvestigatedforcriminalresponsibilityaccordingtolaw(三)有下列情形之一的,甲方可以提前30日以书面形式通知乙方解除劳动合同:Ofthefollowingcircumstances,PartyAcangivenoticetoinformPartyBtoterminatethelaborcontractaheadof30days.1、乙方不能胜任工作,经培训或调整工作岗位仍不能胜任工作的;PartyBisnotcompetentforwork,aftertrainingoradjustmentofjobs.2、乙方患病或者非因工负伤,医疗期满后,不能从事原工作,也不能从事甲方另行安排工作的;PartyBwasillorinjuredduetonon-workrelation,aftercompletionofmedical,PartAisnotcompetentforhisoriginalwork,oralternativearrangedjobs.3、劳动合同订立时所依据的客观情况发生重大变化,致使劳动合同无法履行,双方协商不能就变更劳动合同达成协议的。Iftheobjectivesituationthiscontractbasedon,changessignificantly,toresultthecontractunabletoperform,mutualconsentcannotbereached,inchangeofthislaborcontracts.(四)有下列情形之一的,甲方可以提前 30日通知工会,经工会同意后,与乙方解除劳动合同: Ofthefollowingcircumstances,PartyAcangivenoticeaheadof30days,toinformtheLaborUnion,afteragreement,PartyAmayterminatethelaborcontract.1、甲方依照企业破产法规定进行重整的;PartyArestructuredpursuanttotheEnterpriseBankruptcyLaw2、甲方生产经营发生严重困难的; ProductionandbusinessoperationofPartyAmetseriousdifficulties.3、甲方转产、重大技术革新或者经营方式调整,经变更劳动合同后,仍需裁减人员的;production,technologicalinnovationorbusinessmethodofPartyAadjusted,afterthechangeoflaborcontracts,stillneededtoreducestaff.4、其他因劳动合同订立时依据的客观经济情况发生重大变化,致使劳动合同无法履行的。Ifotherobjectivesituationthiscontractbasedon,changessignificantly,toresultthecontractunabletoperform.(五)乙方有下列情形之一的,甲方不得解除劳动合同:Ofanyofthefollowingcircumstances,partyAcannotterminatethelaborcontract.1、在本单位患职业病或者因工负伤并被确认丧失或者部分丧失劳动能力的;Injuredduetooccupationaldiseaseorwork-relatedreasons,andwasconfirmedashavinglostorpartiallylosttheabilitytowork.2、患病或者非因工负伤,在规定的医疗期内的; Illnessornon-workrelatedinjurywithintheprescribedperiodofmedicaltreatment.3、女职工在孕期、产期、哺乳期的;womenworkersinpregnancy,childbirth,breastfeeding.4、在本单位连续工作满十五年,且距法定退休年龄不足五年的;Workedcontinuouslyfor15yearsandlessthanfiveyearsawayfromhislegalretirementageInthisunit.5、法律、行政法规规定的其他情形。 Othercircumstancesstipulatedbylawsandadministrativeregulations.(六)乙方解除劳动合同,应当提前三十日(试用期内提前三日)以书面形式通知甲方,甲方在乙方完成业务以及清理完债权债务的情况下,可以解除劳动合同。Ofthefollowingcircumstances,PartyBshallgivenoticetoinformPartyAtoterminatethelaborcontractaheadof30daysaftercleaningupthecreditsanddebts.(七)有下列情形之一的,乙方可以通知甲方解除劳动合同:Ofthefollowingcircumstances,PartyBmaygivenoticetoinformPartyAtoterminatethelaborcontract.1、在试用期内的; Duringthetrialperiod.2、甲方以暴力、威胁或者非法限制人身自由的手段强迫劳动的;PartyAforcedPartyAtolaborbyviolence,threatorillegalrestrictionofpersonalfreedom.3、甲方未按劳动合同约定提供劳动保护和劳动条件的;PartyAfailedtoprovidethelaborprotectionandlaborconditions.4、甲方未按照劳动合同的约定支付工资报酬的; PartyAfailedtopaywagesinaccordancewiththelaborcontract.5、法律、行政法规规定劳动者可以解除劳动合同的其他情形。Othercircumstancesstipulatedbylaws,administrativeregulationsbywhichemployeemayterminatethelaborcontract.九、劳动合同的终止 Terminationoflaborcontracts(一)有下列情形之一的,劳动合同即行终止:Ofanyofthefollowingcircumstances,thelaborcontractmaybeimmediatelyterminate1、劳动合同期满的; Thelaborcontractexpired.2、劳动者开始依法享受养老保险待遇的; Workersbegantoenjoyendowmentinsurancetreatmentlawfully.3、劳动者死亡,或者被人民法院宣告死亡或者宣告失踪的;Laborerdied,orwasdeclareddeadormissingbythepeoplescourt.4、甲方被依法宣告破产的; PartyAwasdeclaredbankruptbythepeoplescourt5、甲方被吊销营业执照、责令关闭、撤销或者提前解散的;BusinesslicenseofPartyBwasrevoked,orderedtoclose,cancellationorearlydissolutionof.6、法律、行政法规规定的其他情形。 Othercircumstancesstipulatedbylaws,administrativeregulations.(二)乙方应在劳动合同期满前 30天通知甲方,甲方同意续订,乙方应及时申请办理续订手续;若甲方不同意续订,到期即办理终止合同手续。乙方未办理终止合同手续而离职的,甲方保留追究其法律责任的权利。PartyBshallgivenoticetoinformPartyAtorenewthelaborcontractaheadof30days.IfPartyAdisagreedtonewalease,thelaborcontractwouldgoexpire.IfPartyBleftwithouttheterminationprocedures,PartyAwouldretainrighttopursueitslegalresponsibility.篇三:完整公司劳动合同书英文版Translation:TheLaborContractAddressNameofPartyB(Employee):Sex:IDNo.AccordingtoLaborLawofPRCandrelevantregulations,throughconsultationonthebasisofequality,PartyAandPartyBvoluntarilysignthecontract.TermoftheLaborContractTermofthecontractValidperiodofthecontractisfromtoamongwhichbothpartiesagreetoadoptmonthsastheprobationperiod.WorkContentBytherequirementofPartyA,PartyBundertakesthepositionofsignedtospecifyindexandrequirementsofPartyA.Ifneeded,thePartyAcanalterthePartyBsjoborpositionthroughconsultationbetweenwithPartyA.WorkingProtection,WorkingConditionandJobTrainingPartyAshallprovidelaborconditionsofsafetyandhealthcompliedwithnationalstipulationsforpartyB;reasonablyequipwithfundamentalworkingtoolsnecessaryforworking;distributelaborprotectionproductsonscheduleastherequirementsofthepositionandthenation;implementspeciallaborprotectionforwomenlaborsandunderagelabors;offerhealthexaminationonscheduleforlaborswhoworkwithoccupationalhazard.PartyAshallberesponsibleforprovidingwitheducationandtrainingonpoliticalthought,occupationalethics,professionalskills,safelyproducingandlabordisciplines.PartyBworksnotexceeding8hoursadayand44hoursaweekandenjoysrestandholidaysasstipulatedbythenation.ResttimeisconductedasregulatedbypartyAandtheState.PartyBshallstrictlyabidebythearticlesofassociationofthework,keepsafety,preventaccident.LaborPayment,SocialSecurityandWelfarePartyAshouldpayPartyBmonthlysalaryaccordingtonational,municipalgovernmentandcompany’srelevantrequirement,aswellasPartyB’sposition,whichshouldnotlowerthanlocalminimumwagestandard.PartyAcangiverewardtoPartyBaccordingtotherelevantprovisionsofthestateandtheunitduetotheoutstandingcontributionsofPartyB.Asstipulatedbycentralgovernmentandautonomousregiongovernment,partyAshallpayapartofsocialsecurityfee,coveringunemployment,pension;PartyAkeepsthecustodyofinsurance,andreturntoPartyBwhensheleave.IfPartyBleavethepositionduetothedefault,PartyBhastherighttowithholdtheinsurancedocumentuntilPartyBfullycompensatealllosses.LaborDisciplinesPartyAshallsetupandimprovetheinternalregulationsandlabordisciplinesaccordingtothelaws,supervisePartyBaccordingtolaws.PartyBshallstrictlyabidebytheregulationsformulatedbyPartyA,andsubjecttoPartyA’smanagement.Clause6:Alteration,Dissolution,SuspensionandRenewalofContractBothpartiescouldchangethecontractafteragreementifanyofthefollowingisfound:OnmutualconsentonthechangeofthelineofproductionorbusinessscopeofPartyA;Thelaws,regulationsandpoliciesasstipulatedbeforehavebeenchanged;Theforcemajeureoramajorchangeintheobjectivecircumstancetakesplacebythetimeofsigningthecontractandthecontractcannotbeexecuted.IfanyofthefollowingisfoundtoPartyB,PartyAisentitledtocancelthecontract.PartyBisprovednotmeettheconditionsofemploymentduringtheprobationperiod.PartyBseriouslyviolateslabordisciplinesortherulesandregulationsmadebyPartyA.PartyBmakesseriousmistakesorengagesinmalpracticeforselfishendwhichisresultinggreatlossestoPartyA.PartyBmakesseriousbadinfluenceonthesocietyandthecompanyduetocriminalactionofPartyB.PartyBhastherightofinformingPartyAofterminatingthecontractatanytimeinthefollowingcase.partyBnoticesPartyAofterminatingthecontractinwrittenform30daysahead;Intheprobationperiod;Confirmedbyrelevantnationaldepartment,laborsafetyandhealthconditionsprovidedbypartyAaresopoorthatpartyB’ssafetyandhealthareseriouslyharmed;PartyAshallnotpayremuneration,socialinsuranceandwelfareagainstthecontract;PartyAgoesgainstthecontractandthreatenthelegalrightsofB;PartyBisadmittedtoh
