Employee’s

its
sole

change

working

at

the

who
works
overtime
and
follows

approval

personal
reasons
unless

by

Company’sprior
written
confirmation.

Employee

applies,

theCompany

approves
that,
the
Employee
needs
not

submit
written
letter(s)to
the
Company
in
terms
of
above
application(s).
Upon
termination
of
theemployment
relationship,
all
untaken
leave
shall
be
paid
by
cash
in
amount
of
theproduct
of
Employee’s
current
basic
salary
rate
with
the
due
multiplier
or
be
offsetby
arrangement
of
de
facto

belong
to
the
Company,
this
must
be
disclosed
to
the
Company

theCompany
shall

entitled
to
download
the
information
and/or
supervise
its
deletionfrom
the
computer
or
laptop

return

property

retain

copies

materials

request

Company
deliver

REPRESENTATION

with

trade
secrets

any

person

devote

whole

attention

shall
be

accordance

of

reason,
the
Employee

not
permitted

any
additional
work
whether
private
or
public,

the
Marketing
Manager

tothe

tangible
items

possession

controlbelonging

containing
any
confidential
information

other

promptly
disclose

Company

keep
confidential
alldiscoveries,
inventions,
processes,
improvements
to
an
existing
invention
or
process,systems,
formulas,
programs,
copyright
works,
designs
or
technical
know
howconceived
or
made
by
the
Employee
alone
or
with
others
in
the
course
of
theEmployee’s
employment.
The
Employee
will
hold
all
such
intellectual
property
intrust
for
the
Company
and
will
do
everything
necessary
or
desirable
at
our
expenseto
vest
the
intellectual
property
fully
in
the
Company
and/or
to
secure
anyappropriate
forms
of
protection
for
the
intellectual
property.
Decisions
as
to
theprotection
or
exploitation
of
any
intellectual
property
shall
be
in
the
absolutediscretion
of
the

guidelines
and
safety
operation
regulations
(hereinafter
collectively
as“Company
Rules”)
formulated
by
the
Company
as
at
the
date
of
this
Agreementbefore

commencement;

formal
undertakings

by

Company
Rules.
If
the
Employee
materially
and
severely
violates
suchCompany
Rules,
the
Company
shall
be
entitled
to
suspend
or
immediately
terminatethis
Agreement
without
any
severance

Employee
shall
fully
obey
the
labour
discipline
and
work
arrangement.
Providedthat
the
Employee
fails
to
meet
the
above
requirement
and
leads
to
labour
injuryand/or
labour
accident
to
him,
the
Company
may
reserve
the
right
not
tocompensate;
if
the
failure
of
performance
leads
to
damage
to
other
parties,
theEmployee
shall
undertake
all
corresponding
legal
liabilities
in
accordance
with
lawsand

LABOUR
PROTECTION
AND
WORKING
CONDITIONS

Company
shall
abide
by
the
relevant
laws
and
regulations,
and
provide
theEmployee
with
a
proper
work
environment,
and
take
protective
measures
toprevent
occupational
hazards
so
as
to
secure
the
Employee’s
safety
and
health
inthe

Company
shall
provide
the
Employee
with
necessary
labour
protectionequipment
according
to
the
actual
requirements
of
Employee’s
position
andrelevant
PRC
law.公司应根据员工岗位的实际需要和相关国家法律,提供员工必要的劳动保护设施。_____

law,
the
Company
shall
provide
special
labour
protection
foremployees
employed
in
positions
exposed
to
occupational
hazards,
and
to

education
and
trainingon
professional
ethics,
vocational
techniques,
and
rules
and
regulations
on
worksafety
and
occupational

on

actual
physical
requirements
of
the
position
of
the
Employee,
theCompany
may
annually
arrange
a
regular
physical
examination
for
the

TERMINATION
合同终止The
Company
may
terminate
this
Agreement
without
prior
notice
under
any
of
thefollowing
circumstances
when
the
Employee,
(i)
is
found
guilty
on
a
criminal
liabilitysuit;
(ii)
commits
a
serious
malpractice
or
negligence
which
results
in
a
significanteconomic
loss
of
the
Company.公司下列情况下无需提前通知员工即可与员工终止劳动合同:(1)员工被判决承担刑事责任;(2)员工有重大过失或失职行为,营私舞弊、使公司蒙受显著经济利益损失。17.2 The
Company
may
terminate
this
Agreement
after
giving
a
thirty
(30)
day
priorwritten
notice
or
by
paying
one
month
salary
in
lieu
of
notice
under
any
of
thefollowing
circumstances
when:在下列情况下,公司有权经提前30天通知、或无需提前
30日而支付一个月工资取代提前通知期,通知员工解除本协议。(i)
due
to
illness
or
non-work-related
injuries,
the
Employee
is
unable
to
performhis/her
original
work
or
is
unable
to
perform
alternative
duties
as
arranged
by
theCompany,
when
the
medical
treatment
period
ends;由于疾病或非因工受伤,医疗期结束后,员工仍无法继续履行本职工作也无法履行公司调岗后的工作。(ii)
the
Employee
is
unable
to
perform
his/her
duties
to
an
acceptable
standard,
evenafter
training
has
been
provided
or
adjustments
have
been
made
to
his/her
position;员工无法胜任本职工作,在接受培训和岗位调整后仍无法胜任的。(iii)
a
force
majeure
event
occurs
and
the
parties
are
unable
to
negotiate
and

wishes
to
terminate

Employee
agrees
that
the
Company
shall
be
entitled,
atits
sole
discretion,
to
waive
the
referenced
the
Employee
Notice
Period
and
toaccept
and
treat
the
Employee’s
notice
of
termination
as
an
immediate
terminationof
the
Agreement
by
the
Employee;
provided
that
if
such
waiver
occurs,
theEmployee
shall
be
entitled
to
receive
his/her
Salary
for
the
Employee
Notice
