1、合同书样本本海洋运输输货物保险险条款（附附英文）一、责任范范围本保险分为为平安险、水渍险及及一切险三三种。被保保险货物遭遭受损失时时，本保险险按照保险险单上订明明承保险别别的条款规规定，负赔赔偿责任。（一）平安安险本保险负责责赔偿：1、被保险险货物在运运输途中由由于恶劣气气候、雷电电、海啸、地震、洪洪水自然灾灾害造成整整批货物的的全部损失失或推定全全损。当被被保险人要要求赔付推推定全损时时，须将受受损货物及及其权利委委付给保险险公司。被被保险货物物用驳船运运往或运离离海轮的，每每一驳船所所装的货物物可视作一一个整批。推定全损损是指被保保险货物的的实际全损损已经不可可避免，或或者恢复、修复受损损

2、货物以及及运送货物物到原订目目的地的费费用超过该该目的地的的货物价值值。2、由于运运输工具遭遭受搁浅、触礁、沉沉没、互撞撞、与流冰冰或其他物物体碰撞以以及失火、爆炸意外外事故造成成货物的全全部或部份份损失。3、在运输输工具已经经发生搁浅浅、触礁、沉没、焚焚毁意外事事故的情况况下，货物物在此前后后又在海上上遭受恶劣劣气候、雷雷电、海啸啸等自然灾灾害所造成成的部份损损失。4、在装卸卸或转运时时由于一件件或数件整整件货物落落海造成的的全部或部部份损失。5、被保险险人对遭受受承保责任任内危险的的货物采取取抢救、防防止或减少少货损的措措施而支付付的合理费费用，但以以不超过该该批被救货货物的保险险金额为限

3、限。6、运输工工具遭遇海海难后，在在避难港由由于卸货所所引起的损损失以及在在中途港，避避难港由于于卸货，存存仓以及运运送货物所所产生的特特别费用。7、共同海海损的牺牲牲、分摊和和救助费用用。8、运输契契约订有“船舶互撞撞责任”条款，根根据该条款款规定应由由货方偿还还船方的损损失。（二）水渍渍险除包括上列列平安险的的各项责任任外，本保保险还负责责被保险货货物由于恶恶劣气候、雷电、海海啸、地震震、洪水自自然灾害所所造成的部部份损失。（三）一切切险除包括上列列平安险和和水渍险的的各项责任任外，本保保险还负责责被保险货货物在运输输途中由于于外来原因因所致的全全部或部分分损失。二、除外责责任本保险对下下

4、列损失不不负赔偿责责任：（一）被保保险人的故故意行为或或过失所造造成的损失失。（二）属于于发货人责责任所引起起的损失。（三）在保保险责任开开始前，被被保险货物物已存在的的品质不良良或数量短短差所造成成的损失。（四）被保保险货物的的自然损耗耗、本质缺缺陷、特性性以及市价价跌落；运运输迟延所所引起的损损失或费用用。（五）本公公司海洋运运输货物战战争险条款款和货物运运输罢工险险条款规定定的责任范范围和除外外责任。三、责任起起讫（一）本保保险负“仓至仓”责任，自自被保险货货物运离保保险单所载载明的起运运地仓库或或储存处所所开始运输输时生效，包包括正常运运输过程中中的海上、陆上、内内河和驳船船运输在内内

5、，直至该该项货物到到达保险单单所载明目目的地收货货人的最后后仓库或储储存处所或或被保险人人用作分配配、分派或或非正常运运输的其他他储存处所所为止。如如末抵达上上述仓库或或储存处所所，则以被被保险货物物在最后卸卸载港全部部卸离海轮轮后满六十十天为止。如在上述述六十天内内被保险货货物需转运运到非保险险单所载 明的目的的地时，则则以该项货货物开始转转运时终止止。（二）由于于被保险人人无法控制制的运输延延迟、绕道道、被迫卸卸货、重行行装载、转转载或承运运人运用运运输契约赋赋予的权限限所作的任任何航海上上的变更或或终止运输输契约，致致使被保险险货物运到到非保险单单所载明目目的地时，在在被保险人人及时将获

6、获知的情况况通知保险险人，并在在必要时加加缴保险费费的情况下下，本保险险仍继续有有效，保险险责任按下下列规定终终止。1、被保险险货物如在在非保险单单所载明的的目的地出出售，保险险责任至交交货时为止止，但不论论任何情况况下，均以以被保险货货物在卸载载港全部卸卸离海轮后后满六十天天为止。2、被保险险货物如在在上述六十十天期限内内继续运往往保险单所所载原目的的地或其他他目的地时时，保险责责任仍按上上述第（一一）款的规规定终止。四、被保险险人的义务务被保险人应应按照以下下规定的应应尽义务办办理有关事事项，如因因未履行规规定的义务务而影响保保险人利益益时，本公公司对有关关损失，有有权拒绝赔赔偿。（一）当

7、被被保险货物物运抵保险险单所载明明的目的港港（地）以以后，被保保险人应及及时提货，当当发现被保保险货物遭遭受任何损损失，应即即向保险单单上所载明明的检验、理赔代理理人申请检检验，如发发现被保险险货物整件件短少或有有明显残损损痕迹应即即向承运人人、受托人人或有关当当局（海关关、港务当当局等）索索取货损货货差证明。如果货损损货差是由由于承运人人、受托人人或其他有有关方面的的责任所造造成，并应应以书面方方式向他们们提出索赔赔，必要时时还须取得得延长时效效的认证。（二）对遭遭受承保责责任内危险险的货物，被被保险人和和本公司都都可迅速采采取合理的的抢救措施施，防止或或威少货物物的损失，被被保险人采采取此

8、项措措施，不应应视为放弃弃委付的表表示，本公公司采取此此项措施，也也不得视为为接受委付付的表示。（三）如遇遇航程变更更或发现保保险单所载载明的货物物、船名或或航程有遗遗漏或错误误时，被深深险人应在在获悉后立立即通知保保险人并在在必要时加加缴保险费费，本保险险才继续有有效。（四）在向向保险人索索赔时，必必须提供下下列单证：保险单正本本、提单、发票、装装箱单、磅磅码单、货货损货差证证明、检验验报告及索索赔清单。如涉及第第三者责任任，还须提提供向责任任方追偿的的有关函电电及其他必必要单证或或文件。（五）在获获悉有关运运输契约中中“船舶互携携责任”条款的实实际责任后后，应及时时通知保险险人。五、索赔期
