51、可归类为工程变更风险、市场价格风险、时效风险等。最高人民法院关于建设工程价款优先受偿权问题的批复对承包人行使工程款优先权设置了一定限制的条件：（1）消费者交付购买商品房的全部或者大部分款项后，承包人就该商品房享有的工程价款优先受偿权不得对抗买受人；（2）建筑工程价款包括承包人为建设工程应当支付的工作人员报酬、材料款等实际支出的费用，不包括承包人因发包人违约所造成的损失； （3）建设工程承包人行使优先权的期限为六个月，自建设工程竣工之日或者建设工程合同约定的竣工之日起计算。3工程技术、经济索赔等方面的风险：主要源于建设工程施工合同履行中有关工程本身而产生的风险，如工程技术变更引发的工程量的变化，
