3、ThesalaryoftheEmployeeshallbemonthlypaidbytheEmployerinaccordancewithapplicablelawsandregulationsofP.R.C.ItshallbepaidbylegaltenderandnotlessthanthestandardminimumsalaryinTianjin.b. ThesalaryoftheEmployeeisRMB$permonthintheprobationaryperiodandRMB$aftertheprobationaryperiod.c. Ifthedelayordefaultofs

4、alarytakesplace,theEmployershallpaytheeconomiccompensationexceptthesalaryitselfinaccordancewiththerelevantlawsandregulations.4.WorkingHours&Rest&Vocationa.ThenormalworkinghoursoftheEmployeeshallbeeighthourseachday,excludingmealsandrestforanaverageoffivedaysperweek,foranaverageoffortyhoursper

5、week.b.TheEmployeeisentitledtoalllegalholidaysandotherpaidleavesofabsenceinaccordancewiththelawsandregulationsofthePRCandthecompanysworkrules.c.TheEmployermayextendworkinghoursduetotherequirementsofitsproductionorbusinessafterconsultationwiththetradeunionandtheEmployee,buttheextendedworkinghourforad

6、ayshallgenerallynotexceedonehour;Ifsuchextensioniscalledforduetospecialreasons,theextendedhoursshallnotexceedthreehoursaday.However,thetotalextensioninamonthshallnotexceedthirty-sixhours.5.SocialSecurity&Welfarea.TheEmployerwillpayforallmandatorysocialsecurityprogramssuchpensioninsurance,unemplo

7、ymentinsurance,medicalinsuranceoftheEmployeeaccordingtotherelevantgovernmentandcityregulations.b.DuringtheperiodoftheContract,theEmployee'swelfareshallbeimplementedaccordancewiththelawsandrelevantregulationsofP.R.C.6 .WorkingProtection&WorkingConditionsa.TheEmployershouldprovidetheEmployeewi

8、thoccupationalsafetyandhealthconditionsconformingtotheprovisionsoftheStateandnecessaryarticlesoflaborprotectiontoguaranteethesafetyandhealthduringtheworkingprocess.b.TheEmployershouldprovidetheEmployeewithsafetyeducationandtechniquetraining;TheEmployeetobeengagedinspecializedoperationsshouldreceives

9、pecializedtrainingandacquirequalificationsforsuchspecialoperations.c.TheEmployeeshouldstrictlyabidebytherulesofsafeoperationintheprocessoftheirwork.7 .LabourDisciplinea.TheEmployermaydraftbylawsandlabourdisciplinesoftheCompany,Accordingtowhich,theEmployershallhavetherighttogiverewardsortakedisciplin

10、aryactionstotheEmployee;b.TheEmployeeshallcomplywiththemanagementdirectionsoftheEmployerandobeythebylawsandlabourdisciplinesoftheEmployer.c.TheEmployeeshallundertaketheobligationtokeepandnottodisclosethetradesecretfortheEmployerduringtheperiodofthisContract;Thisobligationofconfidentialityshallsurviv

11、etheterminationofthisContractforaperiodoftwo(2)years.8 .Termination,Modification,RenewandDischargeoftheContractthrougha.TherelevantclausesoftheContractmaybemodifiedbytheparties:i .Thespecificclauseisrequiredtobemodifiedbythepartiesconsultation;ii .Duetotheforcemajeure,theContractcannotbeexecuted;iii

12、 .TherelevantlawsandregulationshavebeenmodifiedorabolishedbythetimeofsigningtheContract.b.TheContractmaybeautomaticallyterminated:i) ThisContractisnotrenewedattheexpirationofthisContract;ii) TheEmployerislegallyannouncedtobebankruptcy,dismissed,orcanceled;iii)ThedeathoftheEmployeeoccurs;iv)Theforcem

13、ajeuretakesplace;v)TheconditionsofterminationagreedintheContractbythepartiesarise.c.TheContractmayberenewedattheexpirationthroughconsultationbythepartieswiththefulfillmentoftheprocedurewithin15daystotheexpiration;d.TheContractmaybedischargedthroughconsultationbytheparties;e.TheContractmaybedischarge

14、dbytheEmployerwithimmediateeffectandtheEmployeewillnotbecompensated:i .TheEmployeedoesnotmeetthejobrequirementsduringtheprobationaryperiod;ii .TheEmployeeseriouslyviolatesdisciplinesorbylawsoftheEmployer;iii .TheEmployeeseriouslyneglectshisduty,engagesinmalpracticeforselfishendsandbringssignificantl

15、osstotheEmployer;iv .TheEmployeeisbeingpunishedbyphysicallabourforitsmisfeasancev .TheEmployeeisbeingchargedwithcriminaloffences:f.TheContractmaybeterminatedbytheEmployerbygivingnoticeinwrittenform30(thirty)daysinadvance:i .TheEmployeefailsillorisinjuredto(otherthanduetowork)andaftercompletionofmedi

16、caltreatment,isnotabletoperformhispreviousfunctionoranyotherfunctiontheEmployerassignstohim;ii .TheEmployeedoesnotshowsatisfactoryperformanceandaftertrainingandadjustingmeasuresisstillnotabletoperformsatisfactorily;iii .ThecircumstanceshavemateriallychangedfromthedatethisContractwassignedtotheextent

17、thatitisimpossibletoexecutetheContractprovided,however,thatthepartiescannotreachanagreementtoamendthecontracttoreflectthechangedcircumstances.iv .TheEmployerisbeingconsolidatedinthelegalconsolidationperiodonthebrinkofbankruptcyorthesituationofbusinessisseriouslyintrouble,undersuchcondition,itisrequi

18、redtoreducetheemplouee.(inlegalprocedure)g.TheEmployeeshallnotbedismissed:i .TheContracthasneitherexpirednorconformedto8.d,8.e,8.f,8.g;ii .TheEmployeeisillwithoccupationaldiseaseorinjuredduetoworkandhasbeenauthenticatedfullyorpartlydisabledbytheLabourAuthenticationCommissioninBaodiCounty,Tianjin.iii

19、 .TheEmployeeisillorinjured(otherthanduetowork)andiswithintheperiodofmedicalleaveprovidedforbyapplicablePRClawandregulationsandCompanypolicy;iv .TheEmployeeiswomanwhoispregnant,onmaternityleave,ornursingababyunderoneyearofage;orv ii.TheapplicablePRClawsandregulationsotherwiseprohibittheterminationof

20、thisContract.h.TheContractmaybedichargedbytheEmployeebygivingnoticeinwrittenform30(thirty)daysinadvance.However,theEmployeemayinformtheEmployertodischargetheContractatrandomunderthefollowingoccasions:vi TheEmployeeisstillintheprobationaryperiod;vii TheEmployerforcetheEmployeetoworkbyviolence,duresso

21、rillegalrestrictiontophysicalfreedom;viii TheEmployerdoesnotpaytheremunerationoftheEmployeeaccordancewiththerelevantclauseintheContract;ix .TheEmployerviolatestherelevantregulationsofStateorTianjinforitsterriblesafeandhealthcondition,whichisharmfultotheEmployeeshealth.I.TheContractcannotbeterminated

22、bytheEmployeebeforetheexpirationifnotconformingto8.d,8.h,j.TheEmployershallpaytheeconomiccompensationtotheEmployeriftheContractisterminatedconformingto8.d,8.f,8.h.i-8.h.iv.AdditionalfeeformedicalallowanceshouldbepaidtotheEmployeeiftheContractisterminatedconformingto8.f.i.9.BreachLiabilitiesa. Duetoe

23、itherpartysfault,ifbreachingtheContract,thatpartyshallundertakethebreachliabilityaccordingtotheextenttotheperformanceoftheContract;ifthepartiesbothbreachtheContract,theyshallundertakeitsseparateliabilityaccordingtotheconcretesituation.b. Duetoeitherpartysfault,ifbreachingtheContracttodamagetheotherp

24、arty.ThedamageshouldbecompensatedbythefaultypartyaccordancewiththerelevantlawsandregulationsofPRC.c.Duetotheforcemajeure,causingthenon-performanceorthedamagestoeitherparty,theotherpartymaynotundertakethebreachliability;c.TheEmployeewantstoresignandhasreceivedtrainingprovidedbytheEmployer,theEmployee

25、shallcompensateforthetrainingcost.Themethodofcompensationshouldbefixedaccordingtotherelevantcompanyregulationsasfollows:TheEmployeeshallcompensateRMBwithin_year(s)intheCompanyiftheContractisterminatedbytheEmployeeathiscause;TheEmployeeshallcompensateRMBwithin_year(s)intheCompanyiftheContractisterminatedbytheEmployeeathiscause;TheEmployeeshallcompensateRMBwithin_year(s)intheCompanyiftheContractisterminatedbytheEmployeeathiscause;10 .LaborDisputesWherealabordisputebetweenthepartiestakesplaceduringtheperformanceofthisContract,thepartiesconcernedmayseek
