朝鲜商标申请指南

1、朝鲜商标申请指南根据朝鲜商标法，企业、个人、机关、团体均可以在朝鲜申请商标注册，外国人、外国企业在朝鲜申请商标注册的，按照所属国与朝鲜签订的协议或者共同参加的国际条约，或者按对等原则办理。朝鲜目前不接受韩国和日本申请人提交的申请。可以在朝鲜注册的商标包括：商品商标、服务商标、集体商标或者证明商标。申请注册的商标必须是可视性标志，即：文字、图形、字母、数字、三维标志、颜色组合，以及这些要素的组合。朝鲜采取强制商标注册制度。朝鲜注册商标的有效期为十年，有效期满需要继续使用的，应申请续展，每次续展的有效期为十年。办理商标注册申请需要的资料包括： 申请人名称、地址、国别，如有相应的朝鲜语译文须同时提供

2、； 商标图样10件，图样需不大于10×10厘米，不小于5×5厘米，如指定色彩，需提供彩色商标图样； 商标所使用的商品或服务项目名称； 申请人如为自然人需提供身份证复印件或护照复印件，并注明身份证号或者护照号；申请人如为法人或团体的，则需提供详细的商业登记证明或相应的资质证明的公证件； 由申请人签章的委托书； 如要求优先权，需指明初次申请的国别、申请日、申请号，并提供由初次申请国的商标主管部门出具的优先权证明文件。办理商标其他申请需要的资料一般有： 申请人名称、地址、国别，如有相应的朝鲜语译文须同时提供；申请人如为自然人需提供身份证复印件或护照复印件，并注明身份证号或者护照号

Any foreign person or foreign enterprise intending to apply for the registration of a trademark in North Korea shall file an application in accordance with any agreement concluded between the North Korea and the country to which the applicant belongs, or according to the intern

5、ational treaty to which both countries are parties, or on the basis of the principles of reciprocity. Presently, the North Korea does not accept the applications filed by the applicants from South Korea and Japan.The trademarks which can be registered in the North Korea include goods marks, service

6、marks, collective marks, or certificate marks. And the trademarks applying for registration must be visual signs, that is, word, design, letters of an alphabet, numerals, three-dimensional symbol, combinations of colours, and their combinations. Currently, the North Korea adopts the forced registrat

7、ion system for trademark. The period of validity of a registered trademark in the North Korea shall be ten years; where the registrant intends to continue to use the registered trademark beyond the expiration of the period of validity, an application for renewal of the registration shall be made; an

11、ed, the country, filing date and application number of the application document to be first filed shall be indicated; and the priority certification document issued by the trademark administration of the competent country in which the initial application is filled shall be submitted.
