22、epurposeofgivingeffecttotheinstructionsoftheprincipal,theremittingbankwillutilizethebanknominatedbytheprincipalasthecollectingbank.Intheabsenceofsuchnomination,theremittingbankwillutilizeanybankofitsown,oranotherbankschoiceinthecountryofpaymentoracceptanceorinthecountrywhereothertermsandconditionsha

23、vetobecompliedwith.e. Thedocumentsandcollectioninstructionmaybesentdirectlybytheremittingbanktothecollectingbankorthroughanotherbankasintermediary.f. Iftheremittingbankdoesnotnominateaspecificpresentingbank,thecollectingbankmayutilizeapresentingbankofitschoice.Article 6Sight/AcceptanceInthecaseofdoc

24、umentspayableatsightthepresentingbankmustmakepresentationforpaymentwithoutdelay.Inthecaseofdocumentspayableatatenorotherthansightthepresentingbankmust,whereacceptanceiscalledfor,makepresentationforacceptancewithoutdelay,andwherepaymentiscalledfor.makepresentationforpaymentnotlaterthantheappropriatem

25、aturitydate.Article 7ReleaseofCommercialDocumentsDocumentsAgainstAcceptance(D/A)vs.DocumentsAgainstPayment(D/P)shouldnotcontainbillsofexchangepayableatafuturedatewithinstructionthatcommercialdocumentsaretobedeliveredagainstpayment.b. Ifacollectioncontainsabillofexchangepayableatafuturedate,thecollec

26、tioninstructionshouldstatewhetherthecommercialdocumentsaretobereleasedtothedraweeagainstacceptance(D/A)oragainstpayment(D/P).Intheabsenceofsuchstatementcommercialdocumentswillbereleasedonlyagainstpaymentandthecollectingbankwillnotberesponsibleforanyconsequencesarisingoutofanydelayinthedeliveryofdocu

Ifacollectioncontainsabillofexchangepayableatafuturedateandthecollectioninstructionindicatesthatcommercialdocumentsaretobereleasedagainstpayment,documentswillbereleasedonlyagainstsuchpaymentandthecollectingbankwillnotberesponsibleforanyconsequencesarisingoutofanydelayinthedeliveryofdocument

28、s.Article 8CreationofDocumentsWheretheremittingbankinstructsthateitherthecollectingbankorthedraweeistocreatedocuments(billsofexchangepromissorynotes,trustreceiptsjettersofundertakingorotherdocuments)thatwerenotincludedinthecollection,theformandwordingofsuchdocumentsshallbeprovidedbytheremittingbank,

29、otherwisethecollectingbankshallnotbeliableorresponsiblefortheformandwordingofanysuchdocumentprovidedbythecollectingbankand/orthedrawee.C. LiabilitiesandResponsibilitiesArticle 9GoodfaithandReasonableCareBankswillactingoodfaithandexercisereasonablecare.Article 10Documentsvs.Goods/Services/Performance

30、sshouldnotbedispatcheddirectlytotheaddressofabankorconsignedtoortotheorderofabankwithoutprioragreementonthepartofthatbank.Nvertheless,intheeventthatgoodsaredispatcheddirectlytotheaddressofabankorconsignedtoortotheorderofabankforreleasetoadraweeagainstpaymentoracceptanceoruponothertermsandconditionsw

31、ithoutprioragreementonthepartofthatbank,suchbankshallhavenoobligationtotakedeliveryofthegoods,whichremainattheriskandresponsibilityofthepartydispatchingthegoods.b. Bankshavenoobligationtotakeanyactioninrespectofthegoodstowhichadocumentarycollectionrelates,includingstorageandinsuranceofthegoodsevenwh

32、enspecificinstructionsaregiventodoso.Bankswillonlytakesuchactionif,when,andtotheextentthattheyagreetodosoineachcase,notwithstandingtheprovisionsofsub-article1(c),thisnileappliesevenintheabsenceofanyspecificadvicetothiseffectbythecollectingbank.c. Nevertheless,inthecasethatbankstakeactionfortheprotec

33、tionofthegoods,whetherinstructedornot,theyassumenoliabilityorresponsibilitywithregardtothefateand/orconditionofthegoodsand/orforanyactsand/oromissionsonthepartofanythirdpartiesentrustedwiththecustodyand/orprotectionofthegoods.However,thecollectingbankmustadvisewithoutdelaythebankfromwhichthecollecti

34、oninstructionwasreceivedofanysuchactiontaken.d. Anychargesand/orexpensedincurredbybanksinconnectionwithanyactiontakentoprotectthegoodswillbefortheaccountofthepartyfromwhomtheyreceivedthecollection.e. i.Notwithstandingtheprovisionsofsub-article10(a),wherethegoodsareconsignedtoortheorderofthecollectin

35、gbankandthedraweehashonouredthecollectionbypayment,acceptanceorothertermsandconditions,andthecollectingbankarrangesfortheauthorizedthecollectingbanktodoso.acollectingbankontheinstructionsoftheremittingbankorintermsofsub-article10(e)i,arrangesforthereleaseofthegoods,theremittingbankshallindemnifysuch

36、collectingbankforalldamagesandexpensesincured.Article 11DisclaimerForActsofanInstructedPartya. Banksutilizingtheservicesofanotherbankorotherbanksforthepurposesofgivingeffecttotheinstnictionsoftheprincipal,dosofortheaccountandattheriskofsuchprincipal.b. Banksassumenoliabilityorresponsibilityshouldthe

37、instnictionstheytransmitnotbecarriedout,eveniftheyhavethemselvestakentheinitiativeinthechoiceofsuchotherbank(s).c. Apartyinstructinganotherpartytoperforinservicesshallbeboundbyandliabletoindemnifytheinstnictedpartyagainstallobligationsandresponsibilitiesimposedbyforeignlawsandusages.Article 12Discla

38、imeronDocumentsReceivedmustdeterminethatthedocumentsreceivedappeartobeaslistedinthecollectioninstructionandmustadvisebytelecom-municationonifthatisnotpossible,byotherexpeditiousmeans,withoutdelay,thepartyfromwhomthecollectioninstinctionwasreceivedofanydocumentsmissing,orfoundtbeotherthanlisted.Banks

39、havenofurtherobligationinthisrespect.b. Ifthedocumentsdonotappeartobelisted.theremittingbankshallbeprecludedfromdisputingthetypeandnumberofdocumentsreceivedbythecollectingbank.c. Subjecttosub-article5(c)andsub-article12(a)and12(b)above,bankswillpresentdocumentsasreceivedwithoutfurtherexamination.Art

40、icle 13DisclaimeronEffectivenessofDocumentsBanksassumenoliabilityorresponsibilityofrtheform,sufficiency,accuracy,genuineness,falsificationorlegaleffectofanydocument(s)orsuperimposedthereon;nordotheyassumeanyliability,condition.packing.delivery,valueofexistenceofthegoodsrepresentedbyanydocument(s),or
