1、商丘市梁园产业集聚区投资优惠政策 (摘 录 )Preferential Investment Policies OfShangqiuLiangyuan Industrial Cluster District(Extracted)土地使用 Land Usage1、符合产业集聚区主导产业的工业项目可依法优先取得土地使用权。 The industrial projects meeting the requirements of leading industrial project of the Industrial Agglomerations shall be preferentially arr
2、anged land according to regulations.2、投资兴办工业项目用地,经营期在10年以上,根据投资额度(平均每亩固定资产投资应不低于100万元,外汇投入按当时汇率折算,下同),投资者按规定交纳的土地有关税费,财政净收益按比例给予支持:固定资产投资5001000万元的支持30%;10005000万元的支持50%;超过5000万元的全额支持。If land used for investment on setting up industrial projects with operating period more than 10 years, the investor
3、s should pay relevant land Taxes and fees in accordance with the regulations, and according to investment amount (average investment in fixed assets not less than ONE million RMB per Mu, foreign exchange into the prevailing exchange rates, the same below), will get financial support in proportion to
4、 the net income: 30% supported with the investment sum in fixed assets of 510 million RMB; 50% supported with the investment sum in fixed assets of 1050 million RMB; and fully supported with the investment sum in fixed assets of more than 50 million RMB. 税费与财政支持 Tax and Financial Support Policies3.工
5、业企业新缴纳的所得税和增值税地方留成部分,从投产之日5年内,税收由税务部门依法征收,前2年由财政全额支持,后3年减半支持。The part of retention of income tax and VAT(value-added tax) newly handed over to the state by industrial enterprises will be collected by tax authorities according to laws and regulations within 5 years from the production date, with full
6、 financial support in the first 2 years and half support in the latter 3 years.4.20102012年,对入驻产业集聚区的项目,除中央规定的收费项目外,免收各项行政事业性费用,服务性行业收费按最低标准减半征收。From 2010 to 2012, the projects settled in the industrial cluster district shall be exempt from all varieties of administrative and institutional fees excep
7、t charges regulated by central government; and the service industry shall be subject to the reduced 50% according to the minimum standard.5.投资兴办固定资产1000万元以上的工业项目,所缴纳的契税由受益财政减半支持。投资者兴办高新技术项目缴纳的耕地占用税先征收后由受益财政全额支持。投资兴办学校、医院且符合城市规划布局的项目免征契税和耕地占用税。The industry projects with the investment amount in fixed

Land occupation tax of High-tech projects shall be first collected and then fully returned to enterprise by the financial benefits. 9、anning layout requirements shall be exempt fromdeedtax and land occupation tax.6.凡入驻的固定资产投资1000万元以上的工业企业,免收城市基础设施配套费、购置生产经营用房交易手续费和城市绿化费。对水资源费、墙体材料专项基金、散装水泥专项资金和人防易地建设费,先征收,再由财政支持50%。The settled industrial enterprises with the investment sum in fixed assets of over 10 million RMB shall be exempt fro
10、m city infrastructure costs, transaction fees of purchasing production and operation buildings as well as the urban green fees. Charges for water, wall materials and special fund of the bulk cement and Civil Air Defense transfer-construction costs will be first collected and then 50% returned with f
11、inancial support.7.对标准化厂房建设配套费实行优惠。对利用新增建设用地建设多层标准化厂房的建设配套费,一层全额征收,二层减半征收,三层以上免征;对利用存量建设用地建设多层标准化厂房的,免征建设配套费,将原有单层厂房改建成多层标准化厂房的,不再增缴建设配套费。Preferential policies put into practice on the fees of supporting measures for the standardized plantconstruction.And thisfees of using newly additional land to b

14、preferential terms as industrial projects enjoy.9.投资兴办房地产开发项目,房屋连片开发且建筑面积在10万平方米以上,旧城改造、经济适用房开发、城中河道改造开发且建筑面积5万平方米以上,减半征收城市基础设施配套费和达到城市绿化标准的城市绿化费。对水资源费、墙体材料专项基金、散装水泥专项资金和人防易地建设费,先征收再由财政支持50。Investment in real estate development projects with construction contiguous area of 100,000m2or more, or the u

16、and Civil Air Defense transfer-construction costs will be first collected and then 50% returned with financial support.10.产业集聚区内的企业优先安排省设立的农业产业化资金、工业结构调整资金、高新技术产业化资金、企业自主创新资金、中小企业发展资金等专项资金支持。对产业集聚区内建设的具有较强公益性和示范带动作用的服务业项目,按不超过项目投资总额的10%给予适当补贴。对使用中长期银行贷款投资的公益性项目,优先申请省财政贷款贴息。The enterprises settled in

20、ojects with actual amount in place more than 30 million U.S. dollars in this agglomeration region will be awarded a project funding of 0.5 10 million RMB.13.对产业转移入驻产业集聚区的出口企业,优先帮助申报中央及省鼓励外贸出口的各项资金,积极帮助申请上级有关资金支持;实行国内运费补贴政策,按每4元给予0.1元的运费补助。Export enterprises Settled in this agglomeration region becau

22、per 4 RMB freight.14.属于国家重点支持的高新技术领域的现代物流企业、服务企业,符合高新技术企业认定标准的,自认定(复审)合格的当年起可依照规定申请减按15%的税率征收企业所得税。The key high-tech modern logistics enterprises and service enterprises, supported by the state and meeting the identification standards of high-tech enterprises, can apply for the enterprise income tax
23、 with 15% reduced in accordance with the provisions since the very identified (review) year.15.在产业集聚区从事国家重点扶持的公共基础设施项目和污染减排、节能节水项目企业的所得,符合税法规定条件的,自项目取得第一笔生产经营收入所属纳税年度起,第一至第三年免征企业所得税,第四至第六年减半征收企业所得税。The projects meeting the given requirements for key state-supported public infrastructure, energy and
24、water saving as well as pollution reducing, shall be subject to the exemption of enterprise income tax from the first through the third profit year,and be subject to the reduced 50% enterprise income tax from the fourth through the sixth year.16.对入驻产业集聚区符合国家产业政策和区域节能减排要求、技术含量高的重点项目,特别是农副产品深加工业和扩大就业作
25、用大的工业项目,优先申报国家中小企业发展专项资金、企业创新基金。The key projects settled in this district with high technological content, meeting the requirements for national industrial policy, regional energy saving and emission reducing, especially the key industrial projects on deep-processing of agricultural and sideline pro
26、ducts as well as the expansion of employment industrial projects, shall be preferentially arranged to declare special state development funds for SME and the enterprise innovation funds.服务与权益保护Services and Rights Protection17.产业集聚区现有三家投资融资公司、三家贷款担保公司,可为入驻企业提供贷款担保,支持企业发展。 Three investment and financi
27、ng companies and three loan guarantee companies settled in the agglomeration can provide loan guarantees for development to the settled enterprises.18.支持创建各类民间小额信贷组织、行业信用担保协会、农民互助担保协会和村镇银行,支持成立企业贷款担保中心。对设立的民间贷款担保公司,经国家批准后免征3年营业税。同时,支持企业扩大直接融资规模,在培育上市企业和发行企业债券等方面积极为企业创造条件、提供便利。Encourage to establish

33、square meters. 二一年一月二十七日27th Jan. 2010 商丘市梁园产业集聚区项目入驻建设管理办法Construction management approach for the projects settled inShangqiu Liangyuan Industrial Cluster District 一、条件 Qualifications1.符合国家产业政策且符合梁园产业集聚区总体规划、产业发展规划和环保要求的农副产品深加工、铝加工、医药等项目。The agricultural and sideline products deep-processing proje
34、cts, aluminum processing projects, medicine and other items in accordance with the state industrial policy and in line with Liangyuan industrial cluster overall planning, industrial development planning and environmental requirements.2.按规定经投资主管部门审批、核准或备案。Required approval or filing by the investment
35、 authority.3.企业资信(按投资比例交纳项目建设保证金)。Enterprise credit (investment project construction bond paid by percentage).4.工业项目固定资产投资强度不低于150万元/亩,容积率不低于1.0。Industrial investment in fixed asset not less than 150 RMB /Mu, floor area ratio not less than 1.0. 二、程序 Procedures1.企业或项目法人向产业集聚区管委会提出进入集聚区书面申请,并提供以下材料:En
36、terprise or legal representative submits written application to the cluster district administrative committee to settle in the industrial cluster district and provides the following materials:(1) 项目法人代表身份证、营业执照、税务登记证。The ID card of the project legal representative, business license, tax registration
37、 certificate.(2) 金融部门对项目建设单位出具的资信证明。Financial certificate to the project construction unit by the related financial authority.(3) 提供项目可行性报告(项目建议书、用地平面图、厂区效果图等相关材料)。Provide project feasibility report (project proposals, site plans,Factory effectchartand other related materials).(4) 招商单位与企业签订的招商协议书。Si

40、e national industrial policy with the investment sum in fixed assets more than 50 million RMB and requires a separate land for industrial projects will be researched and decided by the construction leadership groups of the Cluster District.5.产业集聚区管委会与拟入区企业、项目的法人代表签订项目建设合同书。Signature of a Project Con
41、struction Contract between the Cluster District Administrative Committee and the proposed zone enterprises legal representative. 三、分类 Classification1.进驻标准化厂房区 Settled inStandardized Plants Area固定资产投资在1000万元以上的工业项目,可以入驻标准化厂房区。Industrial projects with the investment sum in fixed assets more than 10 mi
42、llion RMB can be settled in the standardized plant area.(1) 可以租赁、一次性买断或按照产业集聚区管委会提供的图纸自建标准化厂房。Enterprises can lease or a one-time buyout or self-build the standardized plant according to the construction graph submit to the management committee.(2) 租赁的期限在5年以下的工业项目,不享受税收优惠政策。Projects with the lease p
43、eriod less than 5 years do not enjoy preferential tax policies.(3) 租赁厂房的工业项目全免租金的,不享受税收优惠政策,租金由税收受益主体单位负责支付。Projects with exemption of rent do not enjoy preferential tax policies, and the tax benefit unit is responsible for the payments of rents.2.进驻企业孵化园区 Entered Enterprise Incubator Park固定资产投资在100
44、0万元以上、5000万元以下的工业项目,因项目设备或厂房结构原因,标准化厂房不能满足要求的,可进驻企业孵化园区。The projects with the investment sum in fixed assets of 1050 million RMB can settle intoEnterpriseIncubator Park if the standardized plant cannot meet the requirements because of the project equipment or plant structural reasons.3.单独选址进驻产业集聚区Se
45、ttlement in theDistrict with Signal Site固定资产投资在5000万元以上,符合企业入驻条件的工业项目可单独选址入驻产业集聚区。The industrial projects with the investment sum in fixed assets more than 50 million RMB and in line with settlement conditions can enter the cluster district with a separate site. 四、土地使用办法 Land-usage Practices1.入驻项目以出
46、让方式取得土地使用权,工业项目用地出让按商政【2007】45号文商丘市招商引资优惠办法执行。Settled projects to acquire land-usage rights through transfer mode, the project land adopts the implementation of【2007】45 Shangqiu Investment Invitation preferential practices .2工业项目用地办理土地手续时,土地出让金先按摘牌价交纳到市财政局土地专项账户,出让金优惠部分待市财政专项返还到梁园区财政后,7个工作日内以恰当的方式返还
47、企业。During the clearance of project land procedures, the land transfer bonds first handed over to the Land Special Accountof ShangqiuFinancialBureau according to the delisting price, and the Preferences section of the land transfer bonds will be returned to enterprise with 7 working days when City Fi
48、nance Bureau returns this money to the Liangyuan Finance.3.土地证办好后,由产业集聚区现场服务办公室负责保管,待企业达到合同固定资产投资额、建设容积率,企业投产后再交还给企业。The cluster district on-site service office is responsible for the custody of Land Certificate when approved and will return it to enterprise when the enterprise meets the contract in
49、vestment sum in fixed assets, construction floor area ratio and puts into operation. 五、项目规划和建设 Project Planning & Construction1.入驻产业集聚区的项目单位进地施工前,须向产业集聚区规划处报其项目的平面图、效果图,由规划处审验确认符合产业集聚区总体规划后,经批准后方可开工建设。The settled enterprise can only start construction with approval of District Planning Office after
50、inspection and verification on the project plans, renderings submitted by enterprises consistent with the overall planning of industrial clustering.2.产业集聚区内的项目围墙及固定建筑不得占压道路红线、河道蓝线、公共设施黄线、公共绿地绿线、文化保护紫线。在建筑施工放线时,应由规划处验线,签字确认符合规划设计后方可施工。The projects walls and fixed buildings in the Industry Cluster Dis
51、trict are not allowed to lie up the roads red line, river blue line, public facilities yellow line, public green Line or cultural preservation Purple Line. Construction can only be done with Planning Department inspection signature and approval when put in the line.3.沿路围墙为透空铁艺围墙,铁艺栏杆宽度不小于3.5厘米、厚度不小于
52、2厘米;基础墙为0.7米,墙体厚0.24米,墙垛不得高于2.5米;墙垛间距不大于6米。Walls along the road is iron railings with width not less than 3.5 cm, thickness not less than 2 cm; foundation wall of 70cmwidth, with thickness of 24cm, battlements height not more than 250cm, battlements spacing not more than 6m.4.钢构厂房高度不低于5米.Steel-struc
53、ture plant height not less than 5 meters.5.砖混或框架结构厂房要有外墙装饰。Brick or frame-structure plants must be with external decorations.6.大门及附属建筑为欧式或中式现代风格。Gates and ancillary buildings of the enterprises must be the European or Chinese Modern Style.7.标准化厂房上顶不得起脊,建有女儿墙,外墙颜色为上篮下白。No roof ridge on the standard f
54、actory, with parapet, and white color on the basket for the external wall.8.如项目需分期建设实施的,不能超过三期,上期完成与下期开工不得超过一年,固定资产投资1亿元以上的项目,三年内必须完成建设。厂区建设规划详图要注明每一期的建设内容。If project requires implementation phases on construction, the Construction phases should be not more than 3, and interval period between the fi
55、rst finishing and the next starting not more than a year; the projects with investment sum in fixed assets more than 100 million RMB should fully completes the construction within three years. Factory construction planning chart should indicate the detailed construction information of every phase.9.
56、项目建成后经评估、考核企业未达到合同固定资产投资额、建设容积率、厂区建设规划详图标准的,不享受产业集聚区的优惠办法,并补交土地出让金。If the completed projects cannot meet the regulations of contract investment sum in fixed-asset, floor area ratio, plant construction plan standards according to assessment and evaluation, the enterprises will not enjoy related prefe
57、rential policies of industrial cluster district, and must pay up the land transfer bonds.10.项目签订入驻合同后,具备进地条件的,三个月内必须开工建设。超过六个月没有开工的,土地由管委会收回,另行安排项目。After signature of the settled contract, projects with the conditions into the ground must begin construction within three months. If there was no const
58、ruction in six months or more, the land will be recovered by the Administrative Committee for alternative arrangements.11.项目开工后建设进度缓慢、未按合同要求进度实施或超过一年未投产的,土地由产业集聚区管委会收回另行安排项目,地上建筑物由管委会组织评估、处理。确有特殊原因的,企业向管委会提出申请,经批准后可适当延期。After the starting of construction, if the construction goes ahead slowly or failure of the implementation of contract requirements, or no production in more than one year, the land will be recovered by the Industrial Clustering Administrative Committee for alternative arrangements, and the
