1、聘(雇)用契约书_(以下简称甲方)为应业务需要,聘(雇)用_先生(女士)(以下简称乙方)为约聘(雇)人员,双方订立契约条款如下:一、聘(雇)用期间:自_年_月_日起至 _年 _月_日止。二、聘(雇)用报酬:甲方按月支给乙方报酬元)。三、工作内容(具体叙明):_。四、受聘(雇)责任:_薪点( _乙方受聘(雇)后须确保甲方公务机密,有保密期限者从其规定,无保密期限者自离职日起 _年为限(解聘(雇)者亦同)。乙方不得有不法行为或违背约定义务,如有违背者,除涉及民、刑事责任,由甲方依法追究外,并得随时解聘(雇)。在聘(雇)用期间,乙方愿接受与甲方约定之工作上的指派调遣,并遵守此工作上之相关规定。若乙方
2、违背上述相关规定确属情节重大,甲方得随时终止契约;甲、乙双方如因特别事故须提前终止契约时,应于一个月前提出预告,经甲、乙双方协议后乙方始得离职。乙方离职时,应先依照规定办妥离职手续。如有损害公物,或侵权情事(或违反甲方智能财产权规定),应负责赔偿。五、乙方在受聘(雇)用期间,除应遵守甲方一切行政法规之规定外,其假期、离职储金给与、劳工保险及全民健保等,依左列约定:假期核给:依 _办理。离职储金之扣缴及给与依_规定办理,按月扣缴储存生息,并于离职时依规定发给。按乙方每月支报酬之百分之_提存储金,其中百分之 _由乙方于每月报酬中扣缴作为自提储金,另百分之_由甲方提拨作为公提储金,并由甲方在金融机构
3、开立专户储存孳息,列帐管理。乙方因契约期满离职、或经甲方同意于契约期限届满前离职、或在职因公、因病或意外死亡者,发给公、自提储金本息。乙方因违反契约所定义务而经甲方予以解聘,或未经甲方同意而于契约期限届满前离职者,仅发给自提储金之本息。其余未尽事宜请参考 _有关规定。乙方受聘(雇)用期间,甲方应善尽投保劳工保险及全民健康保险之义务。六、乙方于受聘(雇)期间之著作或工作成果,如系于甲方企划下,或法定工作期间完成者,其所有权归属甲方。因前开著作或工作成果所生之智能财产权,应依本院之相关规定办理。七、本契约期间届满当然失效,如因业务需要须续聘时,另行签订新契约。八、本契约未订定事项,悉依聘用人员聘用

7、emain effectiveduring the period specified in the regulations or working rulesconcerned. In case that no time period is specified, it remainseffective for successive _ years' terms after B's terminationof this employment. In the event that B violates any law orregulation , or breaches this A
8、greement or working rules concerned,A may in its discretion reprimand B or terminate this Agreement. Aalso reserves the right to institute suit against B for civilcompensation or to impose criminal liability.4.2During the term of this Agreement, B shall comply with thedirections and instructions of
9、his/her supervisors, perform his/herduties in accordance with all regulations and relevant working rules.Where B violates any obligation specified in this paragraph and thecase is considered to be serious in nature, A may in its discretionterminate this Agreement. If at any time the parties intend t
10、oterminate this Agreement due to causes beyond the reasonable controlof such party , either shall give thirty (30) days' notice ofcancellation to the other party prior to the intended terminationdate. B shall vacate his/her office under and pursuant to thestipulations agreed upon by both parties
11、. B shall submit to theproceedings in prescribed manner as to be vacated of his/heroffice.In case of any one of the following conditions which is due toB's fault , B shall be responsible for compensation:(1) Where Binflicts damage to or excessively abuses machinery, equipment ,tools, raw materia
12、ls, products or other article belonging toAcademia Sinica ;(2) Where B commits torts;(3) Where B violates A'sownership of intellectual property rights.5. B shall comply with any administrative regulations and rulesprovided by A. In regard to the matters of absence on leave, "pay-as-you-go&q
13、uot; contribution benefit, labor insurance and national healthinsurance , the following terms and conditions shall be applicable.5.1 "Absence on leave " shall be operated pursuant to "Regulation ofAbsence on leave for Personnel served in all Executive Yuanorganizations under Civil Con
14、tractual Relationship".5.2 The deduction and grant of "pay-as-you-go" contribution benefitshall be operated pursuant to "Regulation of 'pay-as-you-go'contribution benefit for Personnel served in all organizations andschools under Civil Contractual Relationship". Cert
15、ain amount ofsalary shall be deducted per month and accrue on the financialinstitute over the term of this employment.5.2.1 An amount equal to seven percent ( 7) of the monthly salaryshall be contributed. Fifty percent ( 50) of the contribution shallbe drawn from B's monthly salary. ( hereinafte
16、r called "personalcontribution benefit") A shall provide the other fifty percent ( 50 )of the contribution ( hereinafter called "public contributionbenefit") , and shall open a special account on financial instituteas to accumulate and manage this contribution (personal plus publ
17、ic) .5.2.2 The total amount of the contribution benefits (personal pluspublic) shall be granted to B, if at any time (a) B leaves theoffice on the expiry of this Agreement, (b) B vacates the officeprior to the expiration date with the consent of A, and (c) Bdeceases due to undertaking of duty, illne
18、ss or accident.5.2.3 The amount of personal contribution benefits accumulated shallbe granted to B , if at any time (a) A terminates this Agreementinasmuch as B breaches any obligation, and (b) B resigns from theoffice prior to the expiration date without the consent of A.5.3 During the term of this
19、 Agreement , A shall insure B subject to the terms and conditions pursuant to labor insurance regulations and national health insurance regulations.6. Both parties agree that A shall own proprietary right pertaining to the literary works or achievements completed by B under the projects initiated or
20、 coordinated by A during the term of this Agreement. The ownership of intellectual property rights ( includingbut not limited to certain patents, trademarks , copyrights,technical information and know-how ) accrued from the literary works or achievements herein contained is subject to the relevant r
21、egulations and rules provided by A.7. ExpirationAt the expiration of the term of this agreement, the employmentrelationship shall automatically terminate without any condition. A new employment agreement shall be signed for the renewal andcontinuance of such relationship, if agreed to any by both pa
22、rties.8. Any matter or event not provided in the context of this Agreementshall be governed by and interpreted in accordance with "Employment Regulation for Personnel under Civil Contractual Relationship" (stipulated by Academia Sinica ) & "Employment Regulation for Personnel served in all Executive Yuan organizations under Civil Contractual Relationship".9. Governing LanguageThe Chinese text of this Agreement shall be deemed the original. In the event of any dispute or misunderstanding as to the interpretation of the language or terms of this Agreement, the
