26、craft, number of Bill ofLading/Air waybill, date of its departure and estimated date of arrival.9.2卖方同时应在装运后四十八(48)小时内将提单或空运单、发票、总装箱单和详细装箱单、原产 地证、熏蒸证明、三C证书以及其他相关单据传真给买方。卖方还应在货物装运后的三天内快递买方一整套正本单据。由于卖方未发装船通知传真而导致买方不能及时保险时，则所发生的一切损失均由卖方负责赔偿。The Bill of Ladi ng/Air waybill, in voice, overall packi ng li

40、cate;(c) 合同有关的技术文件一份副本 One copy of Technical Documentation for relevant Contract Equipment.10.5 若是集装箱运输，卖方应检查集装箱是否完好并适合设备装运。在集装箱内应使用支柱或木楔 防止设备移动。如果货物因包装不当或因未采取妥善的保护措施而发生损失或损坏，卖方应负 责更换或赔偿。此外卖方还应赔偿买方未得到保险公司全额索赔的损失 In case of container transportation, the Seller shall examine the conditions of the cont

41、ainers so that only those in good conditions shall be used for delivery of the Contract Product. Sufficient shores or chocks shall be provided in order to prevent the Contract Product from moving inside the containers. If the Goods are damaged or lost due to improper packing and/or inadequate protec

42、tive measures, the Seller shall be responsible replacement and/or compensation in accordance with the Contract. The Seller shall compensate the Buyer in the event the Buyer is not fully compensated by the Insurance Company.10.6 如果货物因包装不当或因未采取妥善的保护措施而发生损失或损坏，卖方应负责修理、更换或 赔偿。 如果货物因错误 /不明确的包装或唛头标识而发生的错发

Should the Contract Equipment be mis-transported due to mistake or ambiguousness in package and/or shipping

44、marks, the Seller shall bear additional expenses thus incurred除了上述原因外，如货物在运装运过程中有丢失或者损坏的，卖方应协助买方向保险公司办理 索偿， 并且有义务在事故发生后 30天内， 将丢失或者损坏的货物应买方的要求以原合同价格补 发该货物 .In case the Contract Equipment are lost and/or damaged in the course of transportation not for the A/M reasons, the Seller shall assist the Buye

45、r/the Purchaser to apply to the insurance company for compensation and shall be liable to make within 30 (thirty) days after the occurrence of the accident, supplementary supply of the lost and/or damaged equipment at the original Contract Price upon the Buyer / the Purchaser' s request.(d) 若卖方使

46、用木质包装，应使用无虫害的包装。所使用的木质材料，包括支撑物、系结物， 应当由出口国或地区政府植物检疫机构认可的企业按中国确认的检疫除害处理办法处理， 并在 木质包装显著位置 (至少应在相对的两面 ) 加施清晰易辨的 IPPC 专用标识 (标识避免使用红色 或橙色)。如果经中国检疫机构检疫发现木质包装无标识、标识不符合要求或截获活的有害生 物的，卖方应承担在卸货港对木质包装实施除害处理、销毁处理或作退运处理所发生的所有费 用，并赔偿买方因此遭受的所有损失和费用。If the Seller use wooden package, it shall be freefrom any insect i

48、 with legible special mark of IPPC(the use of red or orange avoided)i n the obvious place of wood packag ing (on at least two opposite sides). I n case the phytosanitary organization of PRC finds through quarantine measures that the wood packaging does not carry with the required mark, the mark does

49、 not meet the requireme nts or live pests are in tercepted, the Seller should pay for all the expe nsesat theport of uni oad ing of treatme nts to elim in ate the pests, destroy the packagi ng or tran sport back and shall compensate the Buyer for all the expenses , costs and damages thus in curred.1

50、0.7 卖方应将上述提及的证明或声明应在货物装船(装运)后尽快递交给买方，如果因卖方原因不能及时递交上述证明或声明，由此产生的所有费用和损失应由卖方承担。The above-mentionedcertificate or stateme nt shall be submitted by the Seller to the Buyer immediately after thegoods have been delivered on board of the vessel (flight). 51、 certificate or stateme nt in delay, the Seller shall compe nsate all the costs, expe nses and losses of the Buyer thus in curred.11. 迟交货及违约金 LATE DELIVERY AND PENALTY11.1除本合同规定的不可抗力原因外，如果卖方未能按照合同交货期交货，买方同意在卖方缴纳违约金的条件下延期交货，违约金在议付时由付款银行或从履约保函中扣除，违约金不能超 过迟交货物总额的 10 %，违约金按每七天货值的1 %计算，不足七天的按七天计算。当扣款达到最高

The rate of pen alty shall be charged at 1 % for every seve n days (less tha n seve n days should be coun ted as

I n case the maximum is reached or the Seller fails to make delivery ten (10) weeks later tha n the time of shipme nt as stipulated in the Con tract, the Buyer shall have the right to cancel the Con tract and the Seller. In spite of the term in ati on, shall still pay the aforesaid pe
