5、Article 2 Job Descriptio n. 6、司所有规章制度,按质、按量、按时完成其本职工作。Party B shall fulfill his job in a high-quality, quantitative and time-efficient manner and abide by all the compa ny rules.第三条工作时间和休息休假Article 3Worki ng Hours, Rest and Leave En titleme nts一. 工作时间按下列第1项确定:The work ing hours shall be determ ined as set forth in Item _ 1 below

7、:1. 实行标准工时制。乙方每日工作时间不超过8小时,每周工作时间不超过 40小时,每周至少休息一天。The normal working hour system shall be implemented. Party B shall work no more than 8 hours a day, and 40 hours a week, and shall have at least one day s rest each week.2. 实行经劳动保障行政部门批准实行的不定时工作制。A non-fixed worki ng hour system shall be impleme nte

8、d with the n ecessary approval from the releva nt labor adm ini strati on authorities.3. 综合计算工时工作制,即经劳动保障部门审批,乙方所在岗位实行综合计算工时工作制。Cumulative working hour system approved by the labor and social security department and the Calculati on period is.二. 甲方由于生产经营需要可以延长乙方正常工作日的工作时间及要求乙方休息日加班,因工作能 力或效力导致的加班属于正

Work overtime due to pers onal work ing ability or efficie ncy is con sidered as no rmal work ing hour.第四条劳动报酬及支付方式与时间Article 4Work ing Remun erati on, Payme nt Method and Date of

10、Payme nt一、甲方每月 日以货币的形式足额支付乙方上月税前工资。如遇节假日则相应顺延。Party A shall pay pretax salary of last month to Party B in curre ncy on theof every mon th, Incase of holiday is exte nded accord in gly.二、乙方月劳动报酬为基本工资 元,绩效工资及其他补助津贴按公司相关薪酬管理制度执行。The monthly remuneration for Party B shall be RMB. Performanee pay and all

11、owanee isimpleme nted accord ing to related remun erati on man ageme nt system.三、乙方工资的增减,奖金、津贴、补贴的发放,以及特殊情况下的工资支付等,均按相关法律法 规及甲方依法制定的规章制度执行。甲方支付给乙方的工资不得低于当地最低工资标准。Party B s wage increase/decrease, bonuses, allowances and subsidies, as well as the wage payment in special circumsta nces, shall be gover

The wages paid by Party A to Party B shall not be less than the minimum wage standard stipulated by the people s government where the employer is located.四、乙方在享受法定休假日以及依法参加社会活动期间,甲方应当依法支付工资。During any period when Par

13、ty B participates in any social activities which citizens are requested to perform for national or public interests, during statutory working hours, Party A shall pay wages to Party B accord ing to the law.五、甲乙双方对工资的其它约定:Other agreeme nts betwee n Party A and Party B:1. 甲方可根据实际经营状况、内部规章制度,对乙方的考核结果以及

14、乙方的工作年限、奖罚记录、岗位变化等,调整乙方的工资水平,但不可低于国家规定的最低工资标准;Party A is entitle to adjust salary of Party B if there are changes on actual operating condition, working period, reward and discipli nary record or positi on cha nge of Party B. But will not below the n ati onal minimum wage sta ndards.2. 因公司业务及行业需要可能超

15、时工作并且周六、周日需正常工作,员工每月工资总额中已包含 了超时工作及周六、周日的加班工资,法定节假日加班工资的计算以基本工资为计算依据。Work overtime as n eed. Mon thly employee payroll contain overtime wages, in cludi ng Saturday andSun day. Public holiday overtime pay is calculated on the basis of basic wage.第五条社会保险及福利待遇Article 5 Social In sura nee and Welfare一.

16、甲乙双方必须依法按国家及省、市有关规定参加社会保险,按月缴纳社会保险费。乙方缴纳部分,由甲方在乙方工资中代为扣缴。Party a and Party B must participate in social in sura nee and pay social in sura nee premiums on a monthly basis in accordanee with the national and provincial law. The amount payable by Party B shall be withheld by Party B from the Party A s

17、 monthly wages.二. 乙方患病或非因工负伤,甲方应按国家和省、市的有关规定给予乙方享受医疗期和医疗期待遇。Where Party B has con tracted an ill ness or susta ined a non-work-related injury, Party A should giveParty B medical treatme nt and medical leave accorda nee with Nati onal or provi ncial regulati on.三. 乙方患职业病、因工负伤的,甲方按职业病防治法 、工伤保险条例等有关法律法

18、规的规定执行。Where Party B has con tracted an occupati onal diseases or in dustrial injury, party A have to impleme nt related provisi ons accord ing to the occupati on disease preve nti on law, in dustrial injury in sura nee regulatio ns and other releva nt laws and regulati ons.四. 乙方依法享有法定节假日、年休假、婚假、产假、

19、丧假等假期。Party B shall have public holiday, Ann ual leave, Marriage leave, Mater nity leave and Compassi on ate leave accord ing to the Natio nal Law.第六条劳动保护、劳动条件和职业危害防护Article 6Labor Protectio n, Worki ng Con diti ons and Protectio ns aga inst Occupati onal Hazards一. 甲乙双方都必须严格执行国家有关安全生产、劳动保护、职业卫生等规定。有

20、职业危害的工种 应在合同约定中告知,甲方应为乙方的生产工作提供符合规定的劳动保护设施、劳动防护用品 及其他劳动保护条件。乙方应严格遵守各项安全操作规程。甲方必须自觉执行国家有关女职工 劳动保护和未成年工特殊保护规定。The Parties must strictly impleme nt releva nt n ati onal occupatio nal safety, labor protect ion and occupational sanitation procedures and standards. Any job exposed to occupational hazards

21、shall be specified in the con tract, and Party A shall provide Party B with work safety and hygie ne facilities, labor protecti on equipme nt and other n ecessary con diti ons for Party Bvities. Party B wost actistrictly comply with the work disciplines, operating procedures and safety rules set by

Party A must con scie ntiously carry out releva nt provisi ons formulated by the state for the protect ion of female and un der-aged employees.第七条规章制度Article 7 Regulati on and Rules一. 甲方依法制定的规章制度,应当告知乙方。Party A draw the regulation and rules up accordance to law and shall inform Party B.二. 乙

23、方应遵守国家和省、市有关法律法规和甲方依法制定的规章制度,按时完成工作任务,提高 职业技能,遵守安全操作规程和职业道德。Party B shall obey the related Law and the Regulation which is draw up by Party A; to complete task on time, comply with the safety rules and occupation moral.三. 乙方自觉遵守国家和省、市计划生育的有关规定。Party B shall comply with the Family Pla nning regulati

24、on accorda nce to the Law.第八条保密条款Article 8Con fide ntial Agreeme nt签订本合同之前甲乙双方已签署保密协议,乙方承诺同意并严格遵守保密协议中约定的义务。This con tract will be sig ned after theCon fide ntial Agreeme nt by both Parties, Party B promises toagree and strictly abide by the obligati ons agreed in Con fide ntial Agreeme nt.第九条合同的履行和

25、变更Article 9 Performa nee & Alter nati on of Con tract一. 甲方应按照约定为乙方提供适当的工作场所、劳动条件和工作岗位,并按时向乙方支付劳动报 酬。乙方应当认真履行自己的劳动职责,并亲自完成本合同约定的工作任务。Party A shall furnish Party B with proper work ing place, labor con diti ons and positi on, and shall also pay the remun erati on to Party B on time, con formi ng to th

Party B shall fulfill his resp on sibilities here in in due dilige nee.二. 甲乙双方经协商一致,可以变更合同。变更合同应采用书面形式。变更后的合同文本双方各执 一份。Both of Party A and Party B reach a consen sus on alterati on of con tract, which shall be in written form. Both parties shall keep a copy of revised con trac

27、t.第十条合同解除和终止Article 10Dissoluti on and Termin ati on of Con tract一. 甲乙双方协商一致,可以解除合同。Where Party A and Party B reach a consen sus, the con tract can be term in ated.二. 乙方提前三十日以书面形式通知甲方,可以解除劳动合同;乙方试用期内提前三日通知甲方, 可以解除劳动合同。To term in ate the con tract, Party B shall inform Party A in writte n no tice in

Party B in three days adva nee no tice to Party A in probati on period.三、乙方在工作期间需严格遵守中华人民共和国的法律法规、行政规章,因乙方违法律法规、行政 规章而受到法律的制裁及行政处罚,甲方有权解除本合同而无需支付任何补偿及赔偿。During work period, Party B is required to strictly comply with the Law and regulations, admi nistrative rules of P.R.C. In

29、 case Party B get legal pen alties and admi nistrative pen alties due to violatio n of laws and regulati ons. Party A is en titled to resci nd the con tract without any compe nsati on.四、合同解除和终止的其他条件和补偿按劳动合同法的有关规定执行。To term in ate the con tract, Party B shall inform Party A in writte n no tice in a t

Party B in three days adva nee no tice to Party A in probati on period.第十一条合同解除和终止手续Article 11Con tract Rescissi on and Termin ati on Procedures一.甲乙双方解除和终止本合同的,乙方应按双方约定,办理工作交接等手续。甲方应依法向乙方 出具书面证明,并在十五日内为乙方办理档案和社会保险关系转移手续。Whe n term in ate con tract by both parties, Party B shall

Party A shall issue a certificati on docume nts to Party B, and tran sfer files and social in sura nce relati on ship with in fiftee n days.第十二条争议处理Article 12Dispute Settleme nt甲乙双方协商解决。Any dispute shall be solved by n egotiatio n.甲乙双方协

32、商不成,可由争议的一方申请劳动仲裁。In case of un successful n egotiatio n, the contending party may apply for labor arbitratio n.第十三条双方需要约定的其他事项Article 13 Other matters con sidered n ecessary by the Parties一.甲方可根据工作需要及乙方的身体状况、工作能力和表现根据甲方的规章制度升、降乙方的职 务,乙方愿意服从甲方的安排;入职前,甲方已安排专职翻译向乙方详细翻译并解释了甲方的员工手册、薪酬管理制度等规章制度,乙方已熟知、理解、

33、并同意自觉遵守甲方的相 关规章制度。Where Party A is able to promote or demote Party B base on the n eeds of work, physical con diti on, ability and performance, which is according to the Company regulations. Party B is willing to accept Part A arrangement. Pre-commencement, Party A have arranged full-time translator

34、 to translate and explain the details of regulations and rules of Employee HandbookandRemuneration Rule.Party B should familiar with, un dersta nd, and agree to abide to Party A releva nt regulati on and rules.第十四条其他Article 14Miscella neous一. 本合同在履行中发生争议,任何一方均可向企业劳动争议调解委员会申请调解,也可向劳动争 议仲裁委员会申请仲裁。对仲裁裁决不服的,可以向人民法院起诉。If any dispute arises un der this Con tract, either Party may file an applicati on for mediatio n with theenterprise labor dispute mediation committee, or file an application for arbitration with the labor d
