3、y B will rent the house of Party A:一、出租房屋基本情况:(下称“该房屋”,实际情况以权属证明或相关法律文书 的记载内容为准)I. Date of delivery and term of leas ing3.1甲乙双方约定,甲方应于年月日之前向乙方交付该房屋。交付时甲、乙双方在丙方见证下签订本合同之附件二房屋交接书。3.1 Both P arties have agreed that P arty A shall hand over the p remises to P arty B before

Party B shallpay the rent before the day in the first month of every payment period. Incase of p ayme nt delay, the pen alty sha

9、n cludes 五、保证金(押金)和其他费用V. Guara ntee depo sit (security depo sit) and other fees5.1甲乙双方约定,在签订本合同时,乙方应向甲方支付房屋租赁保证金(押金),保证金(押金)为人民币 元(大写_元整)。甲方收取该保证金(押金)后应向乙方出具收款凭证。租赁关系终止时,甲方收取的房屋租赁保证金(押金) 除用于抵充本合同约定由乙方承担的费用外,剩余部分无息归还乙方。5.1 Both P arties have agreed that at the time of (Man dover of the p remises sig

Upon receiving theguara ntee dep osit (security dep osit), P arty A shall issue the rece ipt voucher to Party

At the time of the term in ati on of leas ing relati on, the guara ntee dep osit (security dep osit) collected by Party A shall be used to offset the fees un dertake n by Party B as agreed in this Con tract and the remai ning p orti on shall be returned to Party B without in terest.5.2租赁期间内发生的电费

12、、电话(通讯)费等房屋使用费用由乙方承担;物 业管理费由甲方承担。5.2 The cost aris ing from water, electricity, gas, tele phone call(com muni catio n) and TV and so on( etc.) duri ng the leas ing p eriod shall beun dertake n by P arty B; prop erty man ageme nt fee shall be un dertake n by (EPartyA EP arty B).六、房屋使用要求和维修责任VI. House

13、 use requireme nts and maintenance res pon sibility6.1租赁期间,乙方发现该房屋及其附属设施有损坏或故障时, 应及时通知甲方修 复;甲方应在接到乙方通知后的 _日内进行维修。逾期不维修的,乙方可代为维修, 费用由甲方承担。6.1 During the leas ing p eriod, if Party B discovers any damage or trouble withthe p remises and the accessory facilities, P arty B shall timely no tify P arty A

14、for rep air; Party A shall carry out the rep air within day(s) after recei ving theno tificati on. In case of delay of rep air, Party B may make the rep air in p lace of Party A at the cost of Party A.6.2租赁期间,乙方应合理使用并爱护该房屋及其附属设施。因乙方使用不当或不 合理使用,致使该房屋及其附属设施损坏或发生故障的,乙方应负责维修。乙方拒 不维修的,甲方可代为维修,费用由乙方承担。6.2

15、 During the leas ing p eriod, Party B shall make reas on able use of the p remises and the accessory facilities. Any damage or trouble aris ing from improper use or un reas on able use of the p remises and accessory facilities shall be rep aired by Party B. In the eve nt that Party B refuses the rep

16、 air, Party A may carry out the rep air in pl ace of P arty B at the cost of P arty B.6.3租赁期间,甲方应保证该房屋及其附属设施处于正常的可使用和安全的状态。 甲方对该房屋进行检查、养护,应提前 日通知乙方。检查养护时,乙方应予以 配合。甲方应减少对乙方使用该房屋的影响。6.3 During the leas ing p eriod, Party A shall en sure no rmal availability and safestatus of the p remises and accessor

17、y facilities. If Party A intends to carry out inspection and maintenance on the p remises, Party A shall no tify Party B days in adva nee. During the insp ecti on and maintenan ce, P arty B shall pro vide coord in ati on. Party A shall mini mize the in flue nee on the use of the p remises.6.4乙方需装修或者

18、增设附属设施和设备的,应事先征得甲方的书面同意,按规定 须向有关部门报批的,则应由甲方报请有关部门批准后,方可进行。乙方增设的附 属设施和设备的归属及其维修责任由甲、乙双方另行书面约定。6.4 In case that Party B intends to decorate the p remises or add accessoryfacilities and equipmen ts, Party B shall obtai n writte n p ermissi on from Party A in advanee; if it is required so,(Party A EPart

19、y B entrusted by Party A) shallsubmit such behavior to the comp ete nt dep artme nt for appro val before theimp leme ntatio n. The own ersh ip and maintenance of the accessory facilities and equipments added by P arty B shall be additi on ally agreed by both p arties in writte n form.七、房屋返还与续租VII. H

20、ouse retu rn and renting ren ewal7.1乙方应在本合同的租赁期限届满之后的 日内返还该房屋,未经甲方同意逾 期返还该房屋的,每逾期一日,乙方应以日租金向甲方支付该房屋占用期间的 使用费。7.1 Party B shall return the p remises within days after the term in ati on ofthe leas ing p eriod, and in case of any delay for the retu rn of the p remises withoutp ermissi on of P arty A,

21、P arty B shall pay P arty A the use fee of the p remises at the daily rate equivale nt to % of daily rent duri ng the occ up ati on of thep remises.7.2乙方如果需要续租的,应在租赁期限届满两个月之前向甲方提出,甲方同意的, 双方另行签订相关续租文书。乙方在同等条件下享有优先承租权。7.2 In case that Party B wan ts to renew the Con tract, Party B shall raise the ren

22、ewal inten ti on to Party A two mon ths before the term in ati on of the leas ingp eriod, and with the appro val of Party A, the ren ewal con tract will be additi on ally sig ned betwee n both p arties. Un der the equivale nt con diti on, P arty B shall have the p riority for obta ining the lease.7.

23、3租赁期限届满,甲乙双方未续签租赁合同,乙方继续支付租金,甲方未表示拒 绝的,则按法律相关规定,双方之间成立不定期租赁关系。在不定期租赁关系中, 甲方有权提前一个月通知乙方租赁关系终止。7.3 After the term in atio n of the leas ing p eriod, if no ren ewal con tract is sig ned by both p arties and P arty B con ti nues paying the rent, which is not refused by Party A, the non-fixed-term leas i

24、ng relati ons are established betwee n both p arties accordi ng to releva nt laws and regulati ons. During such non- fixed-term leas ing relati ons, Party A shall have the right to termi nate the leas ing relati ons byno tify ing Party B one (1) month in adva nee.7.4乙方返还该房屋应符合正常使用后的状态。返还时,应经甲方验收认可,并

25、相 互结清各自应当承担的费用。7.4 The P remises retu rned by P arty B shall be con siste nt with the status after no rmal use of the p remises. Upon retu rn of the p remises, P arty B shall inspect the p remises before its acce ptance and the releva nt fees for res pective p arties shall be settled.八、转租与转让VIII. Su

26、blease and tran sfer8.1除甲方已经在本合同中同意乙方转租外,乙方在租赁期限内,不可将该房屋部分或全部转租给他人。8.1 Exce pt that P arty A agrees in this Con tract that the p remises may be subleased by P arty B, P arty B shall not sublease part or all of the p remises to any other person with in the leas ing p eriod, without writte n p ermissi

27、 on of P arty A.An yhow one liv ing room in the orig inal household type shall not be sep arated for subleas ing.九、解除合同的条件IX. Con diti ons for con tract can celati on9.1甲乙双方同意在租赁期限内,有下列情形之一的,本合同终止,双方互不承担 责任:9.1 Both P arties agree that duri ng the leas ing p eriod, this Con tract shall be termin ate

28、d n either p arty n eed ing to assu ming any res pon sibility in case of any of the follow ing situati ons;(一) 该房地产占用范围内的土地使用权依法提前收回的;(1) The use right of the land occ up ied by the real estate has bee n legally retrieved;(二) 该房地产因社会公共利益被依法征用的;(2) The P remises are occ upied by means of legal requis

29、iti on due to social and p ublic in terests;(三) 该房地产因城市建设需要被依法列入房屋拆迁许可范围内的;(3) This real estate has to be legally put into the disma ntl ing range due to urba n con struct ion;(四) 该房屋毁损、灭失或者被鉴定为危险房屋的;(4) The P remises are damaged, destroyed or verified as dan gerous house;(五) 甲方已告知乙方该房屋出租前已设定抵押,现被处分

30、的;(5) P arty A has no tified P arty B that the p remises have bee n p ledged before leas ing and now has bee n dis posed;9.2甲乙双方同意,有下列情形之一的,一方可书面通知另一方解除本合同。违反 合同的一方,应向另一方按月租金的 倍支付违约金,给对方造成损失的,支付的违约金不足以抵付损失的,还应赔偿造成的损失与违约金的差额部分:9.2 Both P arties agree that either party may no tify the other party to c

31、an cel thisCon tract in writte n form in case of any of the followi ng situati on, and the party that breaches this Con tract shall pay the other party the liquidated damages equivale nt to time(s) of the mon thly rent, and in case that the losses in curredto both p arties cannot be offset by the li

32、quidated damages p aid by the breachi ng p arty, the breach ing party shall pay the differe nee betwee n the in curred losses and the liquidated damages;(一) 甲方未按时交付该房屋,经乙方催告后 日仍未交付的;(I) Party A fails to hand over the premises on time, and even days afterexige nt no tice of P arty B;(二) 甲方交付的该房屋不符合本合

33、同的约定,致使不能实现租赁目的的;或甲方 交付的房屋存在缺陷,危及乙方安全的;(II) The P remises han ded over by P arty A do not comply with the agreeme nt in this Con tract, which therefore makes it impo ssible to realize the leas ing purpo se; or the p remises han ded over by Party A have the defects endan geri ng the safety of Party B

34、;(三) 乙方在甲方按时交付该房屋的情形下,未能配合办理交房手续,经甲方催告后日仍未配合办理交房手续的;(III) In sp ite of the timely han dover of the p remises by Party A, Party B fails tocoop erate to go through the p rocedures for the han dover of the p remises days after the exige nt no tice of Party A;(四) 乙方未征得甲方书面同意改变该房屋用途,致使该房屋损坏的;(IV) Party B

35、 cha nged the use of the p remises without writte n p ermissi on of PartyA and therefore in curred the damage of the p remises;(五) 因乙方原因造成该房屋主体结构损坏的;(V) The mai n structure of the p remises is damaged due to the reas ons of Party B;(六) 乙方擅自转租该房屋或转让该房屋承租权的;(VI) P arty B subleases the p remises or tra

36、n sfers the leas ing right of the p remises without p ermissi on of Party A;(七) 乙方逾期不支付租金累计超过 天的;days;(VII) Party fails to pay the rent up to more tha n_十、违约责任X. Breach ing liability日内进行修复,逾期不修10.1该房屋交付时存在缺陷的,甲方应自交付日起 复的,甲方同意减少租金并变更有关租金条款。10.1 In case of any defect with the p remises at the time of

37、han dover, Party Ashall make the rep air with in days after the han dover, and if no rep air ismade eve n after the sti pu lated p eriod, P arty A agrees to reduce the rent and cha nge the clause related to the rent.10.2租赁期间,甲方不及时履行本合同约定的维修与养护责任,致使该房屋损坏,造成乙方财产损失或人身伤害的,甲方应承担赔偿责任。10.2 During the leas

38、ing p eriod, Party A fails to timely p erform the maintenance respon sibility of the p remises as agreed in the Con tract, which therefore hasin curred the damage of the p remises, the n any property loss or personal injury in curred upon P arty B shall be compen sated by P arty A.10.3租赁期间,非本合同规定的情况

39、,甲方擅自解除本合同,提前收回该房屋的, 甲方应按月租金的倍向乙方支付违约金。若违约金不足以抵付乙方损失的,甲 方还应负责赔偿。10.3 During the leas ing p eriod, Party A un laterally can celled this Con tract and took back the p remises in adva nee in case of the situati ons other tha n thosesti pu lated in the Con tract, Party A shall pay Party B the liquidated

40、 damages equivale nt to times of mon thly ren t. If the liquidated damages cannotcompen sate for the loss in curred upon Party B, Party A shall p rovide further compen sati on.10.4乙方未征得甲方书面同意或者超出甲方书面同意的范围和要求装修房屋或者 增设附属设施和设备的,甲方可以要求乙方恢复房屋原状或赔偿损失。10.4 If Party B decorates the premises or adds the acce

41、ssory facilities or equipments without writte n p ermissi on of P arty A or bey ond the scope and requireme nts agreed in writte n p ermissi on of Party A, Party A may require Party B to recover the p remises to the origi nal state, or compen sate for the loss.10.5租赁期间,非本合同规定的情况,乙方中途擅自退租的,乙方应按月租金的倍向

42、甲方支付违约金。若违约金不足以抵付甲方损失的,乙方还应负责赔偿。10.5 During the leas ing p eriod, in case of the situati on other tha n those sti pu lated in the Con tract, Party B stops the ren ti ng, Party B shall pay Party A the liquidated damages equivale nt to time(s) of mon thly ren t. If the rent is noteno ugh to offset the

43、 loss in curred upon P arty A, P arty B shall pro vide further compen sati on.十一、其他条款XI. Others11.1本合同及附件一自甲、乙双方于本合同签章处签字或签章后立即生效。11.1 This Con tract and its Appen dix I shall come into effect upon the sig natures or seal sta mping of P arties A and B .11.2本合同空格处填写文字与铅印文字具有同等法律效力,若填写文字与铅印文 字相冲突,以填写文字为准。若有未尽事宜,可签订补充协议进行约定,若补充协 议与本协议相冲突,以补充协议为准。11.2 The words filled and prin ted in the bla nk part of this Con tract shall
