摘要 经济全球化已经成为当今社会的发展趋势。作为经济文化交流 的必要手段，法律翻译是促进国家进步和实现社会繁荣的重要因 素。自中国2 0 0 1 年1 2 月1 1 日加入世贸细织以来，对法律翻译 的需求越来越大，要求越来越高。中国需要翻译大量的w t o 法律 文件，使其在履行国际义务的同时维护自身利益。此外，法律翻译 对某些新兴产业的生存和发展也至关重要。 然而，相对于文学翻译理论而言，法律翻译理论还非常欠缺。 尽管很多法律翻译者提出了各种具体的翻译方法，但没有一个可以 真正指导译者的理论体系。法律翻译有其自身的特殊性：它实际上 是一个不同法律体系问的交际过程。因此，法律翻译人员的工作不 仅包括语际转换，还包括法律思想和法律观念的交流。只有这样才 能准确传达源语法律文本所要表达的法律效果。 本论文介绍了法律语言的特点及法律翻译的目标，并把双重功 能对等理论作为理论基础。因为双重功能对等理论既考虑译语法律 文本的语言效果，又考虑了其法律效果。论文通过举例，说明了该 理论在法律翻译实践中的应用，也证明了其指导法律翻译的合理性 及适用性。 论文由三部分绍成；前言、正文及结论。 前言部分说明了本文的写作背景、指导理论和写作目的。 正文由两部分组成。笫一部分包括第一章和第二章，是论文的 概念基础；第二部分包括第三章和第四章，介绍了双重功能对等理 论及其应用。 第一章介绍了法律语言并从篇章、句法和词汇三个方面分析了 其特点。第二章简要介绍了法律翻译的历史以及法律翻译在中国加 入世贸组织后的重要地位，并分析了法律翻译的目标，即保留法律 文件的统一性。第三章阐述r 双重功能对等理论，包括该理论的本 质以及该理沦与其他理论的区别，即在翻译中实现语言和法律效果 的双重对等，并提出了译者运用该理论实现剞译目标! 西须具备的素
