In2022alone,over42,500liveswerelostincrashes.Anadditional2.38millionpeoplewere
injured.Theemotionaltollisimmeasurable,andthefinancialcostisstaggering,exceeding$400billionannually.
SomeminorprogressonthesetotalshasbeenmadeaccordingtotheconfirmeddatafromtheNationalHighwayTraffic
SafetyAdministration(NHTSA)in2022andearlyestimatesfrom2023.Additionally,aftermanyyearsofwork,Advocates
laudedNHTSA’sissuanceofaFinalRulerequiringautomaticemergencybraking(AEB)withpedestriandetectiononallnewpassengervehiclesandlighttrucksinApril2024.Byconservativeestimates,itwillpreventhundredsoffatalitiesandtensofthousandsofinjuriesandsaveover$5billioneachyear.Yet,movingforward,itshouldbestrengthenedtoincludedetectionofallvulnerableroadusers(VRUs),amongotherimprovements.
WecontinuetopressNHTSAtotakeimmediateactiononothersafetymeasuresmandatedbyCongress,somegrossly
overdue.TheseincludeissuingminimumperformancestandardsforAEBfortrucks,lanedeparturewarning(LDW),lane
keepingassist(LKA),impaireddrivingpreventiontechnology,frontpassengerandrearpassengerseatbeltremindersystems,anddetectionandalertsystemstopreventpediatrichotcarsincidents,amongotherlifesavingupgrades.
Atthestatelevelsomesuccesswasachievedin2024onchildpassengersafety,automatedenforcementandignition
interlockdevice(IID)lawupgrades.Yet,nostatehasenactedalltherecommendationsinthisreport,and533needtobeadvanced.
Thisyearweareaddingnewcriteriatoourstateratings.Nearly1,300peoplewerekilledincrashesthatinvolvedredlightrunningin2022,andmultiplestudieshavefoundsignificantreductionsinredlightviolationsandcrasheswhenproperlyimplementedsafetycameraprogramsareinuse.Assuch,weareratingstatesforhavinglawsthatallowfortheuseof
automatedredlightcameraenforcementandforusingthem.
Lastly,weextendourdeepestgratitudetothemanypartnerswhostandwithusinourmission—consumerandsafetyadvocates,medicalprofessionals,lawenforcement,emergencyresponders,publichealthofficials,insurersandthe

recentyearwithfinalizeddata.Thisamountedtoatollof42,514fatalitiesand2.38millioninjuries.Whilethesenumbershavedecreasedslightly,therewerenotableincreasesinthefatalityrateinseveralcategoriesfrom2021to2022,includingbicyclists(13%),motorcycleriders(1.2%)andpedestrians(0.7%).Fatalitiesinvolvinglargetrucksalsoincreased2%.
Thenumberoffatalitiesremainedhistoricallyhighin2023,asearlyestimatesshow40,990peoplewerekilledonU.S.roads,adecreaseof3.6%fromtheprioryear.
Speeding,impairment,distractionandnotbucklingupcontinuetobemajorfactorscontributingtocrashes.
THEIMPACT

foundtheU.S.tobeoneofonlyfivethatexperiencedanincreaseinroaddeathscomparedtothe2017-2019annualaverage.Ofthosefivecountries,theU.S.experiencedthethirdlargestpercentageincreaseinthenumberoffatalities,anincreaseof11.9%(nearly2,100morefatalities).
Inadditiontotheenormousphysicalandemotionalramificationsofmotorvehiclecrashes,theannualeconomiccostwas$340billionin2019dollars.Updatedforinflationonly,thatnumberrisesto$417billionin2024.Whenlossoflife,pain
anddecreasedqualityoflifeareaddedtoeconomiccosts,itisestimatedtoexceed$1.4trillion.Moreover,accordingtotheNetworkofEmployersforTrafficSafety(NETS),motorvehiclecrashescostemployers$72.2billionindirectcrash-relatedexpensesin2019.

THESOLUTIONS
Advocatespursuesacomprehensivestrategytoimprovesafety,whichincludes:
SAFEVEHICLES
Theavailabilityandefficacyofsafetytechnologiesto
preventormitigatecrashescausedbynumerousfactors
makesitatransformationaltimeinsurfacetransportation.TheInsuranceInstituteforHighwaySafety(IIHS)has
demonstratedtheeffectivenessofvehiclesafetytechnologiesincludingautomaticemergencybraking(AEB),rearAEB,
lanedeparturewarning(LDW),blindspotdetection(BSD)
andimpaireddrivingpreventiontechnologywhichmay
incorporatefeaturestoensuredrivercapabilityoftenreferredtoasdrivermonitoring.NHTSAhasestimatedthatover
600,000livesweresavedbymotorvehicletechnologiesbetween1960and2012.
AdvocatessupportsthevehiclesafetytechnologiesmandatedintheInfrastructureInvestmentandJobsAct(IIJA,Pub.
L.117-58),suchasAEB,LDW,impaireddrivingprevention
technologyandhotcarspreventionsystems.Welauded
theU.S.DOT’sissuanceofaFinalRuleforAEBandurge
themtoswiftlyissuetheotherpendingFinalRulesfor
safetytechnologiesandimprovements.Wealsosupport
newrequirementsforintelligentspeedassistance(ISA),
drivercapability/monitoringsystems,upgradestoprevent
frontoversandreduceinjuryfromhoods,bumpersandvehicleweight,andothersasstandardequipmentonnewvehicles.
Tremendousopportunityalsoexiststoimprovethesafetyofcommercialmotorvehicles(CMVs).SafetysystemssuchasAEB,speedlimitingsystemsandcomprehensiveunderrideguardsshouldbestandardonnewlargetrucks.Additionally,thesafetyofschoolbusesshouldbebolsteredthrough
technologyandseatbelts.
SAFEROADUSERS
Advocatesworkstoimprovetrafficsafetylawsinall50
statesandtheDistrictofColumbia(DC)whicharecriticaltokeepingallroadusersbothinsideandoutsideof
vehicles—drivers,passengers,motorcycleriders,bicyclists,pedestrians,micromobilityusers,wheelchairusersand
others—safe.Walking,bikingandrollingshouldbereliablemodesofsafetransportation.Basedongovernmentand
privateresearch,crashdataandstateexperience,weurgeallstatestoenacttheoptimallawsratedinthisreport
coveringoccupantprotection,childpassengersafety,teenandyoungadultnovicedrivers,impaireddriving,distracteddrivingandautomatedenforcementtocurbspeedingandredlightrunning.

Advocatesalsosupportsmeasurestospurstateaction
ontrafficsafetylawstoenhancesafetyforallroadusers
includingeffectivefederalincentivegrantprogramswith
accountabilityandoversight.Whenusedappropriately,thewithholdingofstatehighwayfundsforinactionalsohas
provensuccessfulinadvancinglifesavingupgradesincludingminimum21drinkingage,zerotoleranceforalcoholfor
youth,.08%bloodalcoholconcentration(BAC)limitandcommercialdriverlicensing.
Statetrafficsafetylawsfocusedoncurbingtheleadingcrashfactors,backedbyconsistent,clearandfairenforcement,havebeenshowntodeterdangerousdrivingandsavelives.
SAFEROADINFRASTRUCTURE
Preventingdangerousinteractionsandconflictsbetween
roadusers—drivers,bicyclists,pedestrians,micromobility
usersandwheelchairusers,amongothers—andreducingtheimpactofcrashestopreventfatalitiesandinjuriesrequiresafocusedapproachtoroadwayinfrastructuredesign,
safetyfeatures,maintenanceandoperations.PoliciesthattakethisapproachincludingaSafeSystemApproach(SSA)andCompleteStreetshavebeenshowntobeeffectiveasdemonstratedbyresearchandexperience.
Acknowledgingthatpeoplemakemistakesandthattheir
abilitytotolerateinjuryislimitedisthebasisoftheSSA.
Itfocusesonsixprinciples:deathsandseriousinjuriesare
unacceptable;humansmakemistakes;humansarevulnerable;responsibilityisshared;safetyisproactive;and,redundancyiscrucial.TheSSAfocusesonfiveelementsthroughwhich
criticalactionshouldbetaken:advancingsaferoadusers,safevehicles,safespeed,saferoadsandpost-crashcare.
Infrastructureimprovementswhichareconsistentwiththe
SSAandCompleteStreetsareessential.Measuressuchas
enhancingcrosswalkvisibility,addingmediansandpedestrianrefugeislands,andimplementingprotectedbikelanescan
helpensureeveryonecompletestheirtripsafely.Reducingspeedlimits,deterringspeedingandinfrastructure-based
strategies,suchasroaddiets,speedbumpsandrumble
strips,furthersupportsaferspeedsandcollisionreduction.Sinceitsfounding35yearsago,AdvocateshaschampionedthecoreprinciplesoftheSSAandpursuedacomprehensiveapproach.SSAadoptionbytheU.S.DOT,statesandlocalitiesandfundingforinfrastructureupgradesconsistentwiththeSSAandCompleteStreetsbringtheselife-savingsolutionsclosertowidespreadimplementationwiththeultimategoalofprotectingallroadusers.

awslistedbelowarecriticaltoreducingmotorvehicledeathsandinjuries.Forthepurposesofthisreport,statesare
onlygivencreditifthestatelawmeetstheoptimalsafetyprovisionsasdefinedbelow.Nocreditisgivenforlawsthatfailtofullymeetthecriteriainthisreport,noriscreditgivenforlawssubjecttosecondaryenforcement.Similarly,GDLlawsthatallowdrivereducationprogramstoreplacecompliancewithprovisionsdonotreceivecredit.
OccupantProtection
PrimaryEnforcementFrontSeatBeltLaw:Allowslawenforcementofficerstostopandissueaticketforaviolationoftheseatbeltlawforfrontseatoccupants.Nootherviolationneedoccurfirst.
PrimaryEnforcementRearSeatBeltLaw:Requiresthatalloccupantsintherearseatsofavehiclewearseat
beltsandallowslawenforcementofficerstostopandissueaticketforaviolationoftheseatbeltlaw.Nootherviolationneedoccurfirst.
All-RiderMotorcycleHelmetLaw:Requiresallmotorcycleriders,regardlessofage,touseahelmetthatmeetsU.S.DOTstandards.
ChildPassengerSafety(CPS)
RearFacingThroughAge2orOlderLaw:Requiresinfantsandtoddlerstoremaininarearfacingchildrestraintsystemintherearseatfrombirththroughagetwoorlonger.Afterthechildreachesthemaximumweightandheightlimitfortherearfacingsafetyseat,thechildmaybeplacedforwardfacinginaharness-equippedchildrestraintsystem.ThechildrestraintsystemshouldbecertifiedbythemanufacturertomeetU.S.DOTsafety
standards.
BoosterSeatLaw:Requiresthatchildrenwhohaveoutgrowntheheightandweightlimitofaforwardfacing
safetyseatbeplacedinaboosterseatthatshouldbeuseduntilthechildcanproperlyusethevehicle’sseatbeltinarearseat.Thisusuallyoccurswhenthechildreaches57inchesinheightandisolderthanageeight.The
boosterseatshouldbecertifiedbythemanufacturertomeetU.S.DOTsafetystandards.
RearSeatThroughAge12Law:Requireschildrenage12andyoungertobeproperlyrestrainedinarearseat.
YOUNGDRIVERS
GDLprogramsallowteendriverstolearntodriveunderlowerriskconditions,andconsistofalearner’sstage,thenanintermediatestage,beforebeinggrantedanunrestrictedlicense.Thelearner’sstagerequiresteendriversto
completeaminimumnumberofhoursofadult-superviseddrivinginordertomovetothenextphaseanddriveunsupervised.Theintermediatestagerestrictsteensfromdrivinginhigh-risksituationsforaspecifiedperiodoftimebeforereceivinganunrestrictedlicense.AdvocatesratesstateGDLlawsonfourkeysafetycomponentsalignedwiththeIIHSrecommendationsandidentifiedinresearchanddataanalysis:
MinimumAgesforLearner’sPermitandLicensing:Abeginningteendrivermustbeatleast16yearsoldtoobtainalearner’spermitand17yearsoldtoobtainanunrestrictedlicense.
70HoursofSupervisedDrivingProvision:Abeginningteendrivermustreceiveatleast70hoursofbehind-the-wheeltrainingwithanadultlicenseddriver.
NighttimeDrivingRestrictionProvision:Prohibitsunsuperviseddrivingstartingat8p.m.
PassengerRestrictionProvision:Prohibitsnon-familialteenpassengersfromridingwithateendriverwithoutadultsupervision.

All-OffenderIIDs:MandatestheinstallationofIIDsonthevehiclesofallconvicteddrunkdrivingoffenders.
OpenContainerLaw:Prohibitsopencontainersofalcoholinthepassengerareaofamotorvehicle.Tocomply
withfederalrequirements,thelawmust:prohibitbothpossessionofanyopenalcoholicbeveragecontainerandtheconsumptionofalcoholfromanopencontainer;applytotheentirepassengerareaofanymotorvehicle;applytoallvehicleoccupantsexceptforpassengersofbuses,taxicabs,limousinesorpersonsinthelivingquartersofmotorhomes;applytovehiclesontheshoulderofpublichighways;and,requireprimaryenforcementofthelaw.Statelawsarecountedinthisreportonlyiftheyareincompliancewiththefederallawandregulation,basedonannualdeterminationsmadebyU.S.DOT.

transportationreauthorization(theIIJAexpiresin2026).CongressionalcommitteesheldhearingsonIIJAoversight,DOTandNTSBfunding,roadwaysafetyandrelatedtechnologyforwhichAdvocatessubmittedletters.WeurgedswiftactionbytheU.S.DOTonIIJAmandatestoensurethesafetyofallroadusersisenhanced.AdvocatesalsopushedforCongressandthe
DOTtoadvanceprovensafetymeasuresandadoptsafeguardsfordevelopingtechnologyincludingAVsandAItoensureit
isdevelopedanddeployedtoupholdpublicsafety.Lookingforward,Advocateshasbeenproposing,draftingandgarneringsupportformanyofthelegislativeitemsthatwereleftonthe“cuttingroomfloor”duringfinalnegotiationsontheIIJAwithaneyetowardtheirinclusioninthesafetytitleinthenextone.WecontinuetosupportfundingforanddirectivestoimproveroadwayinfrastructuresafetyforthebenefitofallroadusersaswellasadequatefundingandresourcesfortheU.S.DOTtoensuretheagencyisabletomeetitssafetymissioneffectively.Moreover,Advocatesleadseffortsinoppositiontonumerousanti-safetyproposalstodegrade,rollbackorrepealexistinglegislativeandregulatoryprotections,manyofwhichtargetIIJAupgradesandlargetrucksafetyrules.

restrictuseofcellphonestoavertdistracteddriving,aswellasopposeweakeningorrepealsofsuchlaws.Wealsosupportedeffortsthatrequireroadwaysafetyupgradesasacomponentofinfrastructureplanning,maintenanceandbuilding.Our
effortsareincollaborationwithlocalandnationalcoalitions,organizationsandvictimandsurvivoradvocates.Manybillstakemulti-sessionadvocacybeforeadvancing.Inthoseinstances,Advocatesbuildsmomentumforsubsequentsessions.

federalgrantsandensuringrobustfundingforroadwaysafetyinfrastructureimprovementsconsistentwithComplete
StreetspolicyandtheSafeSystemApproachasdemonstratedbytheSafeStreetsandRoadsforAll(SS4A)grantprogram,amongothers.
