XXX公司内部作业程序InternalOperationProcedureTitle文件名事故管理程序IncidentManagementProcedure文件编号No.HR-Safety-SP-01版本号Rev1.0发布日期ReleasedDate页次PagePagePAGE2ofNUMPAGES7未经许可不得将本文件全部或部分内容透露予无权阅读本文件之机构或个人。Thisconfidentialinformationmustnotbedisclosedtootherswithoutpriorwrittenconsentof修订记录RevisionHistory编制人Author日期Date修订内容ChangeDescription版本号Rev批准Approval职位Title姓名Name签名Signature日期Date1,目的PURPOSE及时调查和处理工业安全事故,查清事故原因并彻底解决,防止同类事故再次发生,最大可能地降低事故发生的机率和可能造成的后果。按照国家法律和公司政策对工伤者进行适当的处理与补偿。Toensuretimelyandthoroughinvestigationonindustrialsafetyincidents,correctiveactionsbeingformulated;topreventre-occurrenceofsimilarincidentsandtoreduceincidentrateanddamagecaused.Theinjuredemployeeistreatedandcompensatedproperlyinaccordancewithnationallegalrequirementandcompanypolicy。2,范围SCOPE此程序适用于的工作相关的事故管理Theprocedureisapplicabletoworkrelatedincidentmanagement.3,定义DEFINITION3.1工伤Workrelatedinjuryandillness可被认为是工伤的情况可以<<工伤保险条例>>中找到Theinjuryandillnessthatmeetrequirementsof<<workrelatedinjuryandillnessinsuranceordinance>>willbeconsideredWorkrelatedinjuryandillness.3.2不可记录事故Non-recordableincidentorFirstAidCases是指所发生的伤害经过医药箱药物或公司医生处理后可继续原工作的事件.如轻微的擦伤,割伤,灼伤,毛刺等FACreferstocaseswheretheemployeecancontinuetodohis/heroriginalworkaftertheinjuryisbeingtreatedbycompanydoctorormedicinebeingapplied.likeminorscratches,cuts,burns,splinter,etc.3.3可记录工伤Recordableincident需要处方药品,医疗处理,或休息时间超过1天的工伤事故,包括损失工时、丧失意识,限制工作活动,转岗,骨折,致残、职业病,死亡中的一种或多种。Anyaccidentresultinginanemployeethatresultinuseofprescribemedicine,morethan1dayrestormedicaltreatmentencompassing1ormoreofthelosttime,lossofconsciousness,restrictedworkactivities,jobtransfer,fracture,disability,occupationaldiseaseFatality.3.4死亡事故Fatalincident是指一次事故中死亡职工1人及以下的事故。Fatalincidentreferstothedeathof1employeeoraboveinoneincident.3.5重大财产损失事故Majorpropertydamageincident财产损失超过100,000美元的事故。Theincidentthatresultinpropertydamageover$100,0003.6未遂事故NearMiss是指发生事故的条件已经具备,或虽然发生了事故,但未造成财物损失和人员伤亡的事故。Caseswhereallaspectsarepresentbutanaccidentdidnothappenortheoccurredincidentdidnotcauseanydamagetopersonnelandasset.4,职责RESPONSIBILITY4.1安全办Safetycouncilofficeisresponsiblefor4.1.1组织工伤事故的调查,填写事故调查报告,,监督改善措施的落实;Organizingrelatedpersonneltoconducttheincidentinvestigation,completingtheincidentinvestigationreportandsupervisingtheimplementationofthepreventiveandcorrectiveactionsfortheincident4.1.2事故统计分析,并向管理层汇报。Reportingtheincidentanalysisinformationtotopmanagement4.2人资部门HRDepartmentisresponsiblefor 4.2.1负责工伤保险及工伤认定和劳动能力鉴定。Workrelatedincidentinsurancecompensation,identificationofdegreeofinjuryandassessmentofinjuredsubject’sabilitytoworkfortheinjuredemployees.4.3各部门Individualdepartmentisresponsiblefor4.3.1负责事故的及时上报Reportingincidenttimely4.3.2内部事故的现场初步处理。Preliminaryinvestigationatthesceneofincident4.3.3事故发生部门负责填写“安全事故关闭报告”。DepartmentthattheincidenthasoccurredinisresponsibleforfillingoutIncidentClosureReport4.3.4支持和配合安全办进行工伤事故的调查、报告与处理;SupportandcooperatewithSafetyCouncilOfficetoconductworkrelatedaccidentinvestigation,reportandtreatmentissues.4.3.5Completingcorrectiveandpreventiveaction5,程序PROCEDURE5.1事故报告IncidentReporting5.1.1所有的事故包括未遂事故,财产损失事故,都必须上报安全办。.Allincidentsnomatterhowminorincludingnearmiss,propertydamageshouldbereportedtoSafetyCouncilOffice.5.1.2在工作中员工所遭受的任何伤害,无论多么轻微,必须立即汇报给直接主管,并引起注意和进行适当的治疗。Anyinjuryhappensintheworkplace,regardlessofthedegreeofinjury,shouldbereportedtothedirectsupervisorimmediatelyandgivenappropriatemedicaltreatment.5.1.3事故发生后当事人需立即向部门直接主管汇报,主管指导或现场协调事故的初步处理。Theinvolvedpartymustinformtohis/herdirectsupervisorimmediatelyaftertheincidenthappensandthesupervisorconductsorcoordinatesthepreliminaryprocessoftheincidentscene.5.1.4公司内部事故发生后当事人不具备汇报能力的,邻近岗位对事故的汇报负责。Iftheinvolvedpartyhaslosttheabilitytoreporttheincidentaftertheincidenthappensinthecompany,thenearestemployeepresentshouldberesponsibleforreportingtheincident.5.1.5发生工伤事故时受伤员工或证人要立即联络部门主管,经理,安全办或医生以便员工能得到及时的救治。具体的要求可参见急救管理办法。Theinjuredemployeeorwitnessshouldcontactthedirectsupervisor,manager,Safetyofficerordoctortoseekfirstaid.Therelatedrequirementscanbefoundinfirstaidworkinstruction.5.1.6部门主管接到事故报告后立即报告安全办.安全办应立即去事故现场开展调查。DepartmentsupervisorshouldreporttoSafetyCouncilOfficeimmediatelyafterreceivingtheincidentreporting。SafetyCouncilOfficeshallrushtotheincidentsceneforincidentinvestigation.5.1.7如果外来人员在我公司范围内发生伤亡事故,受伤人员,接待部门,目击者或访客要及时报告给安全办Iftheemployeeofsupplierorcontractor,visitorwasinjuryintheplant,theinjuredperson,thereceptiondepartmentorthewitnessshouldreporttoSafetyCouncilOfficeandtakefirstaidmeasureormedicaltreatmentimmediately.5.1.8安全办接到事故报告后在12小时内通过邮件或电话通知HR经理及公司高层。Afterreceivingtheincidentreporting,SafetyCouncilOfficeshouldreporttheincidenttoHRmanagerandtopmanagementwithin12hoursthroughe-mailorphone.5.1.9公司高层要在8小时内将重大财产损失事故上报集团安全健康总裁。MajorpropertydamageincidentshouldbereportedtoNewellRubbermaid’sCorporateDirectorofSafetyandHealthwithin8hoursaftertheincidentbytopmanagement5.1.10公司高层应在1小时将死亡事故上报当地有关的政府部门及集团安全健康总裁。FatalincidentshouldbereportedtolocalauthoritiesandNewellRubbermaid’sCorporateDirectorofSafetyandHealthwithin1houraftertheincidentbytopmanagement5.2事故调查Incidentinvestigation5.2.1所有的事故包括未遂事故,财产损失事故应该被调查以防止再发生。Allworkrelatedincidentnomatterhowminorincludingnearmiss,propertydamageshouldbeinvestigatedtopreventtherecurrencethesimilarincident.5.2.2安全办负责组织除死亡事故外的所有事故的调查,调查结果提交安全委员会讨论改善。SafetyCouncilOfficewillorganizeateamtoinvestigateintoallincidentsexpectforfatalincident.InvestigationresultsshouldbesubmittedtoSafety&healthcommitteefordiscussionofthepreventiveandcorrectiveactions.5.2.3死亡事故上报后由公司所在地的安全生产监督局组织调查。责任部门及安全办应配合安监局的调查。ThelocalWorkSafetySupervisionBureauwillinvestigateafatalincidentaftertheincidentsarereported.TheresponsibledepartmentandSafetyCouncilOfficeshouldcooperatewithWorkSafetySupervisionBureauinincidentinvestigation.5.2.4对于严重的伤亡事故,社保局会自动到公司进行现场调查,责任部门及安全办应配合政府的调查。Incaseofaseriousaccidentwithcasualty,SocialSecurityBureaumayconductanonsiteinvestigationautomatically.TheresponsibledepartmentandSafetyCouncilOfficeshouldcooperatewithSocialSecurityBureauinincidentinvestigation.5.2.5事故发生后,在保证事故当事人得到救护的情况下保护事故现场直到调查结束。Aftertheincidenthadhappened,theincidentscenemustbesecuredtilltheon-sceneinvestigationiscompletedprovidedthatthepartygetsmedicaltreatmentfirst.SafetyCouncilOfficehaspowertosealtheincidentsceneifneed.5.2.6事故现场必须及时处理的,事故部门负责拍摄事故发生状态照片,保存事故证据。Incidentsceneshouldbedealtwithtimelyandtheinvolveddepartmentisresponsiblefortakingphotosandsecuringtheevidence.5.2.7 Investigationteamshouldincludethefollowingmembersifpossiblea)公司高层Topmanagementb)安全主任SafetyOfficerc)部门经理及工程部经理DepartmentmanagerandEngineeringdepartmentmanagerd)设备操作、维修人员及工程师Facilityoperator,maintenancetechnicianorengineere)目击者Witnessf)受伤员工Injuredemployee5.2.8调查结束后安全主任编制“事故调查报告”,提交公司高层。Aftertheinvestigationworkiscompleted,SafetyCouncilOfficewillcompiletheIncidentReportandsubmittotopmanagementforapproval.5.2.9安全事故调查报告应于一周内完成。Incidentinvestigationreport”shouldbefinishedwithinaweekafterincident.5.3.事故处理AccidentHandling:5.3.1.事故发生部门按照事故调查报告所提出纠正预防措施进行整改Thedepartmentthataccidentoccurredisresponsibleforimplementingthepreventiveandcorrectivemeasuresputforwardbyincidentinvestigationteam.5.3.2..事故发生部门应在事故处理完后的提交事故关闭报告,安全办对落实的措施进行验证,确保措施的落实。TheconcerneddepartmentshouldsubmittheclosurereportfortheaccidenttoSafetyCouncilOffice.SafetyCouncilOfficeisresponsibleforidentifyingthepreventiveandcorrectivemeasuresandensuringthatthemeasuresfortheaccidenthasbeencompleted。5.3.3.对于任何有意谎报、不报或迟报工伤事故的,故意破坏事故现场,毁灭有关证据的,未及时消除安全隐患导致事故,违反操作规程,将追究责任人(包括受伤者本人)的责任,按公司纪律政策以相应的处分,触犯法律的,送交司法部门依法处理。Theresponsiblepersonwhoconcealtheincident,reportthefalseincidentonpurpose,delaytheincidentreport,ruintheincidentsceneonpurpose,destroytherelevantevidence,failtoeliminatethehiddendangertimelytoresultinincidentandisviolationofsafetyoperationrulemustbeartheresponsibilities.thepersonconcerned(includinginjuredemployee)shouldbepunishedaccordingtodisciplineofcompany.Ifbreakingcriminallaw,thepersonconcernedshouldbearcriminalliabilities.5.4.工伤保险及工伤认定WorkRelatedInjuryInsurancesandWorkRelatedInjuryIdentification5.4.1HR应及时向社保部门支付工伤保险费。所有在员工都应参加工伤保险,包括临时工HRdepartmentisresponsibleforpayingtheinsurancepremiumtolocalsocialsecuritybureauforallemployeesincludingtemporaryemployees.5.4.2发生的事故根据国家有关的法规属于工伤的,,由HR在事故发生日之日起30日内向社保部门申报工伤。Iftheincidentisconsideredasworkrelatedinjuryaccordingtoworkrelatedinjuryinsuranceordinance,HRdepartmentisresponsibleforapplicationforworkrelatedinjuryidentificationtolocalsocialsecuritybureauwithin30workdaysafteraccident5.4.3.经治疗后伤情相对稳定后存在残疾、影响劳动能力,需要进行劳动能力鉴定的,由HR部门或员工本人向当地劳动能力鉴定委员会提出鉴定申请。Theinjuredemployeeisfullrecoveredafterreceivingmedicaltreatmentbuthis/herabilitytoworkmaybeaffectedifneed,HRdepartmentortheinjuredemployeemaybeapplicationforworkcapacityassessmenttolocalcommitteeinchargeofworkcapacityappraisal.5.4.4致残工伤事故的残废等级由地方社保局评定。ThedisabilitycaseshallbeidentifiedandclassifiedbylocalSocialSecurityBureau5.4.5对于上报到社保局的工伤事故,通过社保局的最终鉴定后,将会从社保基金中按规定补偿有关的费用。IfaworkrelatedincidentthatisreportedtoSocialSecurityBureau,theSocialSecurityBureaushallcompensatetheinjuredemployeefortherel
