劳动协议英文版范本【篇一:英文英语版本正式劳动协议】劳动合同laborcontract甲方(用人单位):partya(employer):性质:有限责任公司property:limitedliabilitycompany地址:address:乙方partyb(劳动者laborer)姓名name______性别gender______年龄age______身份证号idno.______________________家庭住址homeadd.______________________联系电话contactno.______________________根据《劳动协议法》和国家有关规定,甲乙双方经平等协商一致,自愿签订本协议,共同遵守本协议条款:accordingtothelaborcontractlawandtherelevantprovisionsofthestate,throughequalconsultationbetweenbothparties’agreement,signthiscontractvoluntarily,abidebythetermsofthiscontract一、劳动协议期限termofthelaborcontract本协议期限类型为______期限协议thetypeofthecontractis___________contract(填“有固定或无固定”其中一项)(fulfillterminableordateless)。本协议期限为___年thetermofthecontractis_____years,自___年___月___日起至___年___月___日止。from____________to____________.双方约定的试用期至___年____月____日止,期限为3个月。thetwosidesagreedprobationperiodendson____________,3monthsduration.表现优异者,甲方可缩短试用期,但不能少于1个月。fortheoutstandinglaborer,theprobationperiodcanbeshortenedbypartya,butnolessthan1month.以完毕一定工作为期限:basedonafixedworkingterm:从___年___月___日起,到任务完毕时止。startingfrom_____________untilthetaskisfinished.二、工作内容和义务jobcontentandresponsibility1、乙方批准根据甲方工作需要,accordingtopartya’sdemand,在部门,从事______(管理、销售、技术、生产、后勤等)工作,并遵守岗位工作制度与合理的工作安排(涉及但不限于工作内容、工作地点)。partybagreestoengagein__________(management/sales/technology/manufacture/logisticsetc.)workinthedepartmentandabidebytheworksystemandreasonableworkarrangement.(includedbutunlimitedtojobcontentworkingplace.)2、乙方应当按照甲方岗位职责规定,保质保量完毕工作任务;accordingtopartya’spostresponsibilityrequirement,partybshouldfinishworkingtaskwithqualityandquantityguaranteed.3、甲方本着“一专多能、一职多岗”的用人原则,可以根据经营需要及乙方的工作能力调整乙方的工作职务和岗位,乙方应服从安排。basedontheprincipleof“oneskillwithmultipleability,onepostwithmultiplework”,andaccordingtothebusinessdemandandpartyb’scompetence,partyamayadjustpartyb’sdutyandpost,whilepartybshouldobeytheadjustment.三、劳动保护和劳动条件laborprotectionlaborcondition1、甲方根据国家有关安全生产、劳动保护、职业卫生的规定,为乙方提供必要的工作条件和劳动保护设施,保障乙方的安全与健康;accordingtotherelatedstipulationofsafetymanufacture/laborprotection/occupationalhealthfromthestate,partyaprovidesnecessaryworkingconditionandlaborprotectionfacilities,insuringpartyb’ssafetyandhealth.2、甲方根据国家有关规定制定工时制度,乙方确因生产经营需要延时的,甲方应当依法安排乙方补休或支付相应的加班费;若乙方实行的是级别工资,则在当月的绩效考核中体现;accordingtotherelevantregulationsofworkinghoursystem,ifpartybneedstoextendtheworkinghoursduetotheneedofproductionandoperation,partyashallarrangepartybcompensatorytimeofforpayovertimesalaryinaccordancewiththelaw;ifpartybisimplementedwagelevels,thecompensationshouldbereflectedintheperformanceappraisalforthemonth.3、甲方根据国家有关规定为孕期、产期、哺乳期的女职工提供劳动保护;partyashouldprovideprotectionforwomenworkersinpregnancy,childbirth,breastfeeding,inaccordancewiththerelevantprovisionsofthestate.4、甲方负责对乙方进行政治思想、职业道德、业务技术、劳动安全卫生及有关规章制度的告知、教育和培训。partyaisresponsibletoprovidepoliticalideology,professionalethics,businesstechnology,laborsafetyandhygiene,andrelatedrules,educationandtrainingforpartyb.四、劳动报酬laborremuneration根据“按劳分派”原则,实行同工同酬,乙方的报酬不得低于本地最低工资标准。具体薪酬标准、支付方式以及支付时间按公司制定的《薪酬管理制度》执行。accordingtotheprincipleofdistribution,andequalpayforequalwork,remunerationofpartybshallnotbelowerthanthelocalminimumwagestandard.specificcompensationstandards,payment,andtimeissetbythe“thesystemofcompensationmanagement”bythecompany五、社会保险socialinsurance甲方应按照国家有关社会保险的法律、法规和政策为乙方缴纳基本养老、基本医疗、失业、工伤、生育保险费用;社会保险费个人缴纳部分,甲方从乙方工资中代扣代缴。inaccordancewithnationallaws,regulationsandpoliciesrelatingtosocialinsurance,partyashallpaythebasicpension,basicmedical,unemployment,workinjuryandmaternityinsurancecosts,forthepartyb;socialinsurancepremiumspaidbyindividualspartiswithholdwagesfrompartyb.六、劳动纪律和规章制度labordisciplineandregulations1、甲方依法制定的劳动纪律和规章制度,乙方有义务遵守;labordisciplineandregulationslegallystipulatedbypartya,partybshallhavethedutytoabidebyit.2、签订本协议前,甲方已对乙方进行了劳动纪律、操作规程、管理制度等相应的培训;beforesigningthiscontract,partyahastoprovidepartybthelabordiscipline,operatingprocedures,managementsystemandthecorrespondingtraining3、乙方应当遵守甲方的工作操作规程,服从工作安排;partybshallabidebytheworkingprocedures,obeytheworkarrangementofpartya.4、乙方违反劳动纪律或规章制度,甲方有权按本单位的规章制度,给予纪律处分,直至解除本协议。ifpartybviolateslabordisciplineorregulations,partyaisentitledbytherulesoftheunittogivepartyadisciplinaryaction,uptoterminatethiscontract.七、劳动协议的变更thechangeoflaborcontract订立本协议所依据的客观情况发生重大变化,致使本协议无法继续履行的,经双方协商批准,予以变更劳动协议相关内容。iftheobjectivesituationthiscontractbasedon,changessignificantly,toresultthecontractunabletoperform,bymutualconsent,relatedcontentinlaborcontractsshallbechanged.八、劳动协议的解除theremoveoflaborcontract(一)双方协商一致,劳动协议可以解除。thetwopartymayterminatethelaborcontractwithmutualagreement.(二)乙方有下列情形之一的,甲方可以即行解除劳动协议:ofanyofthefollowingcircumstances,partyamayimmediatelyterminatethelaborcontract.1、在试用期内被证明不符合录用条件的;beenprovennottomeettheconditionsofemploymentduringthetrialperiod.2、采用欺诈手段订立本协议的;adoptedfraudulentmeanstoenterintothiscontract.3、严重违反劳动纪律或规章制度给甲方导致重大损害的;seriouslyviolatedlabordisciplineorregulationstocausesignificantharmtothepartya.4、严重失职、营私舞弊,或泄露甲方商业秘密,给甲方利益导致重大损失的;grossnegligence,malpractice,ordisclosureoftradesecretspartya,tocauseheavylossestotheinterestsofthepartya.5、乙方同时与其他用人单位建立劳动关系,对完毕本单位的工作任务导致严重影响,或者经用人单位提出,拒不改正的;partyabuiltlaborrelationshipswithotherunit,tocauseaseriousimpactonthecompletionofthetasksoftheunit,orrefusedtocorrecttherulesmadebytheemployer6、被依法追究刑事责任的。beinvestigatedforcriminalresponsibilityaccordingtolaw(三)有下列情形之一的,甲方可以提前30日以书面形式告知乙方解除劳动协议:ofthefollowingcircumstances,partyacangivenoticetoinformpartybtoterminatethelaborcontractaheadof30days.1、乙方不能胜任工作,经培训或调整工作岗位仍不能胜任工作的;partybisnotcompetentforwork,aftertrainingoradjustmentofjobs.3、劳动协议订立时所依据的客观情况发生重大变化,致使劳动协议无法履行,双方协商不能就变更劳动协议达成协议的。iftheobjectivesituationthiscontractbasedon,changessignificantly,toresultthecontractunabletoperform,mutualconsentcannotbereached,inchangeofthislaborcontracts.(四)有下列情形之一的,甲方可以提前30日告知工会,经工会批准后,与乙方解除劳动协议:ofthefollowingcircumstances,partyacangivenoticeaheadof30days,toinformthelaborunion,afteragreement,partyamayterminatethelaborcontract.1、甲方依照公司破产法规定进行重整的;partyarestructuredpursuanttotheenterprisebankruptcylaw2、甲方生产经营发生严重困难的;productionandbusinessoperationofpartyametseriousdifficulties.3、甲方转产、重大技术革新或者经营方式调整,经变更劳动协议后,仍需淘汰人员的;production,technologicalinnovationorbusinessmethodofpartyaadjusted,afterthechangeoflaborcontracts,stillneededtoreducestaff.4、其他因劳动协议订立时依据的客观经济情况发生重大变化,致使劳动协议无法履行的。ifotherobjectivesituationthiscontractbasedon,changessignificantly,toresultthecontractunabletoperform.(五)乙方有下列情形之一的,甲方不得解除劳动协议:ofanyofthefollowingcircumstances,partyacannotterminatethelaborcontract.1、在本单位患职业病或者因工负伤并被确认丧失或者部分丧失劳动能力的;injuredduetooccupationaldiseaseorwork-relatedreasons,andwasconfirmedashavinglostorpartiallylosttheabilitytowork.2、患病或者非因工负伤,在规定的医疗期内的;illnessornon-workrelatedinjurywithintheprescribedperiodofmedicaltreatment.3、女职工在孕期、产期、哺乳期的;womenworkersinpregnancy,childbirth,breastfeeding.4、在本单位连续工作满十五年,且距法定退休年龄局限性五年的;workedcontinuouslyfor15yearsandlessthanfiveyearsawayfromhislegalretirementageinthisunit.5、法律、行政法规规定的其他情形。othercircumstancesstipulatedbylawsandadministrativeregulations.(六)乙方解除劳动协议,应当提前三十日(试用期内提前三日)以书面形式告知甲方,甲方在乙方完毕业务以及清理完债权债务的情况下,可以解除劳动协议。ofthefollowingcircumstances,partybshallgivenoticetoinformpartyatoterminatethelaborcontractaheadof30daysaftercleaningupthecreditsanddebts.(七)有下列情形之一的,乙方可以告知甲方解除劳动协议:ofthefollowingcircumstances,partybmaygivenoticetoinformpartyatoterminatethelaborcontract.1、在试用期内的;duringthetrialperiod.2、甲方以暴力、威胁或者非法限制人身自由的手段逼迫劳动的;partyaforcedpartyatolaborbyviolence,threatorillegalrestrictionofpersonalfreedom.3、甲方未按劳动协议约定提供劳动保护和劳动条件的;partyafailedtoprovidethelaborprotectionandlaborconditions.4、甲方未按照劳动协议的约定支付工资报酬的;partyafailedtopaywagesinaccordancewiththelaborcontract.5、法律、行政法规规定劳动者可以解除劳动协议的其他情形。othercircumstancesstipulatedbylaws,administrativeregulationsbywhichemployeemayterminatethelaborcontract.九、劳动协议的终止terminationoflaborcontracts(一)有下列情形之一的,劳动协议即行终止:ofanyofthefollowingcircumstances,thelaborcontractmaybeimmediatelyterminate1、劳动协议期满的;thelaborcontractexpired.2、劳动者开始依法享受养老保险待遇的;workersbegantoenjoyendowmentinsurancetreatmentlawfully.3、劳动者死亡,或者被人民法院宣告死亡或者宣告失踪的;laborerdied,orwasdeclareddeadormissingbythepeoplescourt.4、甲方被依法宣告破产的;partyawasdeclaredbankruptbythepeoplescourt5、甲方被吊销营业执照、责令关闭、撤消或者提前解散的;businesslicenseofpartybwasrevoked,orderedtoclose,cancellationorearlydissolutionof.6、法律、行政法规规定的其他情形。othercircumstancesstipulatedbylaws,administrativeregulations.(二)乙方应在劳动协议期满前30天告知甲方,甲方批准续订,乙方应及时申请办理续订手续;若甲方不批准续订,到期即办理终止协议手续。乙方未办理终止协议手续而离职的,甲方保存追究其法律责任的权利。partybshallgivenoticetoinformpartyatorenewthelaborcontractaheadof30days.ifpartyadisagreedtonewalease,thelaborcontractwouldgoexpire.ifpartybleftwithouttheterminationprocedures,partyawouldretainrighttopursueitslegalresponsibility.【篇二:标准劳动协议(中英文版)】labourcontract劳动协议index目录positiontasksofwork职务及工作职责trialperiod试用期durationofthecontract协议期限salary工资premiumbonus奖金及分红personalincometax个人所得税training培训workinghours工作时间discipline劳动纪律sicknessinjuryleave病假及伤假laboursafetyhygiene劳动安全及劳动卫生保障socialinsurance社会保险holidays休假exclusivitynon-competition唯一性及非竞争协定confidentiality保密协定responsibilitiesoftheparties双方职责terminationofthecontract协议终止amendmentofthecontract协议修订applicablelaw合用法律settlementofdisputes争议的解决及解决miscellaneous其它事宜between由:,awhollyownedforeignenterpriseincorporatedunderthelawsofthepeople?srepublicofchinawithitsregisteredofficebeingat是一家依照中华人民共和国法律成立的外商独资公司,hereinafterreferredtoasthe“company”,以下简称“本公司”,ontheonehand,作为协议甲方,and和xx,personalidentificationnumber:xxxxx,身份证号:xxxxx,gender:xxxxx,性别:xxxxx,dateofbirth:xxxxx,出生日期:xxxhereinafterreferredtoasthe“employee”,以下简称“该员工”,ontheotherhand,作为协议乙方,hereinaftercollectivelyreferredtoasthe“parties”.甲方、乙方以下统称“协议双方”。inaccordancewiththelabourlaw,theprovisionsonthelabouradministrationregulationsforforeigninvestmententerprisesandotherrelevantlawsandregulationsofthepeople?srepublicofchina,thepartieshaveconcludedthefollowinglabourcontract(hereinafterreferredtoasthe“contract”)协议双方依照《中华人民共和国劳动法》、《外商投资公司劳动管理规定》以及中华人民共和国其它相关法律法规,共同约定以下劳动协议(以下简称“本协议”)。1.1.theemployeewillhavethefollowingposition:该员工将担任以下职务:xxxxxx1.2.thedutiesandresponsibilitiesoftheemployeewillbe,butnotlimitedto:该员工的工作职责涉及但不限于:a.xxxb.xxxc.xxx1.3.ifnecessaryduetothema
