租赁合同TenancyContract租赁合同TenancyContract出租方（甲方）：Landlord(PartyA):承租方（乙方）：Tenant(PartyB):甲、乙双方在自愿、平等、互利的基础上，经协商一致，就乙方承租甲方物业事宜，订立本协议。Havingreachedunanimitythroughconsultations,PartyAandPartyB,onthebasisofvoluntariness,equalityandmutualbenefit,haveenteredintothisContractinrespectofPartyAleasingthePremisestoPartyB.租赁物业LeasedPremises1.1甲方将坐落于(以下简称‘该物业’）出租给乙方使用，该物业建筑面积为平方米。 PartyAlets(hereinafterreferredtothePremises),toPartyB,andthesizeofthePremisesissquaremeters.1.2甲乙双方拟定该物业用途为住宅。BothPartyAandPartyBhaveconfirmedthatthePremisesshallbeforthepurposeofResidential.1.3该物业的家具、家电配置，见本协议附件一。Thefurniture&appliancesofthePremisespleaseseeAppendixI.租赁期LeasingTerm2.1本协议租赁期为个月，自年月日起至年月日止。Theleasingtermofthiscontractshallbecalendarmonths,commencingfromto.2.2租赁期满，甲方有权收回该物业，乙方应如期归还；乙方如规定续租，须在 4.1甲方须准时将出租物业及家具电器（见附件一）以良好的状态交付给乙方使用。PartyAshoulddeliveronscheduletheleasedpropertyandthefurnitureandappliances(refertoAppendixI)ingoodconditiontoPartyB. 甲方应保证或责成物业管理公司对物业及其公共设施进行定期维修保养，涉及但不限于物业内的空调、上下水管、电线电缆、煤气管道、通讯及有线电视等设施，使之处在正常的使用状态。PartyAshouldguaranteeororderthepropertymanagementcompanytocarryoutmaintenanceandrepairofthesaidpremisesandthefacilitiesingoodandproperoperationregularly,includingbutnotrestrictedtoair-conditions,waterpipelines,wiresandcables,gaspipelines,communicationandcableTVetc. 4.3 房屋基本设施和结构损坏时（不涉及乙方损坏的家具和器具），甲方必须在24 小时内提供维修服务或给予乙方答复，并承担相关的费用。Incaseofthebasicfacilitiesandstructureofthepremisesbeingdamaged(notincludingfurnitureandappliancesdamagedbyPartyB),PartyAshallrepairorrespondtoPartyB’scomplaintswithin24hours,andbearallcostsrelatedthereto.4.4 甲方在此声明及保证甲方为出租房屋的合法拥有人并有合法地位出租此房屋给乙方。就本协议及出租此房屋于乙方之事，甲方已取得所有有关机构的批准，涉及政府批准及抵押权人的批准。甲方于本协议所做出的声明与保证，如有错误或违反者，甲方须就因此而对乙方引起的任何损失、损害、支出及费用对乙方做出全额补偿。PartyAherebyrepresentsandwarrantsthatPartyAisthelegalowneroftheleasedpropertyandhasthenecessarycapacitytoleasethepropertytoPartyB.PartyAhasalsoobtainedallthenecessaryauthorizationsfromallrelevantauthoritiesinrespectofthisContractandtheleasingofthepropertytoPartyB,includinggovernmentapprovaland/ormortgageconsent.PartyAshallbeliabletokeepPartyBfullyindemnifiedagainstanycosts,expenses,lossesanddamagesincurredandsufferedbyPartyBasaresultofanybreachofPartyA’srepresentationsorwarrantiesherein.如在租赁期内，租赁房屋发生所有权所有或部分转移，和其它影响乙方权益的事情时，甲方应保证所有权人或其它影响乙方权益的第三人，能继续遵守本协议所有条款。如乙方于本协议下的权益受此等所有权人或第三者影响或损害，甲方应负责补偿乙方的所有损失、损害、支出及费用。Ifduringthetermofthetenancy,allorpartoftheleasedpropertyistransferredorPartyB’srighttouseleasedpropertyisaffected,PartyAshallensurethatsuchtransfereeorthirdpartyhavinganeffectonPartyB’srighttousetheleasedpropertywillcontinuetoabidebythetermsofthisContract.PartyAshallalsobeliabletokeepPartyBfullyindemnifiedagainstanycosts,expenses,lossesanddamageswhenanyofPartyB’sinterestshereinareaffectedorprejudicedbysuchtransfereeorthirdparty.4.6甲方应负责根据中国法律法规所定因本楼宇租赁而产生的一切税务(涉及但不限于房产税，所得税和营业税)和法定费用(涉及但不限于土地使用费)，并必须将该些税务和法定费用直接向有关税局缴付。TheLandlordshallberesponsibleforandpaydirectlytotherelevanttaxauthoritiesallapplicabletaxes(includingbutnotlimitedtoRealEstateTax,IncomeTaxandBusinessTax)andothergovernmentcharges(includingbutnotlimitedtoLandUseFee)requiredbyChineselaworanyrelevantregulationsarisingfromtheleasingofthePremises.4.7在乙方遵守本协议的条款及交付租金的前提下，乙方有权于租赁期内拒绝甲方或其别人骚扰而安静享用出租房屋。ProvidedthatPartyBpayingtherentalandperformingandobservingpartyB’stermsandconditionshereincontainshallpeaceablyholdandenjoythePremisesthroughoutthetermofthisContractwithoutanyinterruptionbyPartyAorotherpersons.4.8租期为一年,如若任何一方提前解约，支付违约金为一年的租金(人民币______元)。LeasingTermisoneyear.Ifanysideterminatestheagreementaheadoftime,mustpaythepenaltyisoneyearrent(RMB78000.00yuan).五、承租人的责任 Tenant’sResponsibilities5.1乙方应准时支付协议中规定的保证金、租金及水、电、煤气、电话费,宽带费等公用事业费。PartyBshouldpromptlypaythedeposit,rentalandwater,broadband，electricity,gas,telephonechargeetc.未经甲方书面批准，乙方不得将该物业转租或分租给第三方。PartyBshallnottransferorsub-leasethesaidpremisestoanythirdpartywithoutPartyA’swrittenconsent.乙方应爱惜使用租赁的房屋，如因乙方的过失或过错致使房屋及设施受到损坏（正常损耗除外），乙方应负补偿责任。PartyBshalltreattheleasedpropertywithcare.If,asaresultofPartyB’snegligenceormisconduct,theleasedpropertyandtherelatedfacilitiessufferanydamage(fairwearandtearexcepted),PartyBshallberesponsibleforcompensatingPartyAforsuchdamages.除在物业内已有的装饰和设施外，乙方如要增长设备或装修，须征得甲方的批准，甲方不得无理拒绝或延误；租赁期满必须恢复原状（正常损耗、磨损除外），并承担其费用，经甲方验收认可后归还甲方。甲方批如期满前两个月告知乙方其所需拆除的在物业内的任何改变及改善的设施。Inadditiontothedecorationandequipmentalreadyintheproperty,ifPartyBwishestomakeanyalterationsorimprovementstotheproperty,PartyBmustgetPartyA’sconsent.Anysuchconsentshallnotbeunreasonablywithheldordelayed.Onexpiryofthetenancy,PartyBmusthandoverthepropertytoPartyAinitsoriginalcondition(fairwearandtearexcepted).AllfeesarisingfromsuchworktodosoaretobebornebyPartyB.PartyAagreestoprovidePartyBwithtwomonths’noticepriortotheexpiryofthecontract,intheeventPartyArequiresdemolitionofanyalterationorimprovementcarriedouttothepropertybyPartyB.5.5 若乙方、乙方雇员或任何其他经乙方许可的人员进入该物业，对甲方或其他住户导致损失，不管故意或过失，乙方皆应对导致的所有损失予以补偿。IncaseofPartyB,employeesofPartyBoranyotherpersonpermittedbyPartyBtoenterthepropertycausingdamagestoPartyAorothertenants,whetherintentionallyornegligently,PartyBshallcompensateforallthelossescausedbysuchdamages.5.6 乙方不得携带任何违禁危险物品进入该物业，严禁从事任何违反中华人民共和国法律法规的活动；如因此发生损害，乙方应承担所有责任。 PartyBshallnotbringanythingdangerousorforbiddenintheleasedproperty,andnotbehaveagainstthelawsorregulationsofthePeople’sRepublicofChina,andshallbefullyresponsibleforanydamagesorlossesasaresultthereof.5.7在本协议期满前一个月内，乙方应允许甲方或其指定的代理人经与乙方预约后，在合理的时间内陪同其他有爱好租住该楼宇的人士参观TheTenantshallpermittheLandlordoritsdesignatedagenttoenterthePremiseswithotherpotentialtenantstoseethePremises,atreasonabletimeanduponpriorappointmentwiththeTenantwithinonemonthbeforetheexpirationofthisContract.5.8租期为一年,如若任何一方提前解约，支付违约金为一年的租金(即人民币_______元)。LeasingTermisoneyear.Ifanysideterminatestheagreementaheadoftime,mustpaythepenaltyisoneyearrent(RMB78000.00yuan).六、违约解决BreachofContract6.1甲、乙任何一方如未按本协议的条款履行，构成违约，应承担相应的违约责任，双方批准违约方应补偿受害方之直接损失（间接和结果性损失除外）。甲方若有违约并在七日内未予补救，乙方则有权延付租金和管理费或做相应的扣除。IfeitherPartyAorPartyBfailstoperformitsobligationshereunder,itshallconstituteabreachofthisContractandthedefaultingpartyshallundertaketheliabilitiesforsuchbreach.Thepartiesagreethatthepartyinbreachshallpaytheotherpartythedirectlossesanddamage(excludingindirectandconsequentiallossanddamages).IfPartyAisinbreachofthisContractanddoesnotrectifywithin7days,thenPartyBisentitledtowithholdordeducttherentalaswellasmanagementfee.6.2甲方有下列行为之一的，乙方有权中止本协议，甲方除应退还乙方保证金和已支付但未居住的租金外，还应支付乙方两个月的租金的金额作为补偿。PartyBshallhavetherighttoterminatetheContractandhaverecoursetoarefundofthetwomonth’ssecuritydepositandrentalalreadypaidtogetherwithacompensationsumequivalenttotwomonthsrentalifpartyAcommitsoneofthefollowing:(a)未经乙方批准，在租赁期间收回该物业。Duringtheleaseterm,takepossessionofthePremiseswithoutParty’sBconsent.本协议开始三十天后，仍未向乙方移交该物业。FailtohandoverthePremisestoPartyBwithinthirtydaysafterthecommencingdateoftheContract.6.3乙方有下列行为之一的，甲方有权中止本协议，收回该房屋并且保证金不予退还。PartyAshallhavetherighttoterminatethisContract,re-possesstheleasedpropertyandforfeitthesecuritydepositifPartyBcommitsoneofthefollowings.(a)将承租的房屋擅自转租，但转租给乙方本公司人员除外。SubletstheleasedpropertytoanotherpersonwithoutPartyA’sconsent,butassociatedpersonofPartyBexcepted.(b) 未得甲方批准，将承租的房屋擅自拆改结构或改变用途的。Altersthestructureofthepremiseswithoutauthorizationorusesthepremisesotherthanthepurposestatedherein.(c)无端拖欠租金超过三十天。Failtopayrentalwithoutanyreasonformorethan30daysaftertheduedate.七、不可抗力ForceMajeure若由于不可抗拒的自然灾害（涉及但不限于火灾、洪水、地震、施工、战争、暴动、敌队等行为等）或其它非双方过错所导致的对本物业的损毁致使其无法居住或使用本物业，双方有权中止本协议，甲方必须退还乙方所有保证金和已支付但未居住的租金。届时协议双方将不再承担进一步的任何责任。Iftheleasedpropertyisdestroyed,damagedandrendereduninhabitableandunusableduetoforcemajeure(includingbutnotlimitedtofires,flood,earthquake,accidents,strikes,wars,insurrections,publicenemyetc.)oractionsthatarenottheresultofPartyAorPartyB’sfault,eitherpartyhastherighttoterminatetheContractandproratedbalanceofalrentalprepaid,aswellasthedeposit,shallbereturnedtoPartyB.Thereafter,thebothpartiesshallnothaveanyresponsibilitiestoeachother.八、争议的解决 DisputeResolution凡因本协议条款、翻译、任何协议相关事宜所引起的一切争议,双方应和谐协商解决；协商不成，应提交上海市仲裁委员会，按其仲裁原则和中华人民共和国仲裁法在上海进行仲裁，仲裁裁决是终局的，对双方都有约束力。AnydisputeordifferencethatarisebetweenPartyAandPartyBrelatingtoanyclau
