被租赁物业:LeasedProperty:1.物业名称:NameofProperty:2.物业房号:NumberofUnit:3.物业地址:Address:4.物业面积:Size:二、租期和租金:LeasingPeriodandRent:租期:年LeasingPeriod:year起租日期CommencementDate:终止日期TerminationDate:月租金:人民币(包括)MonthlyRent:RMB(inclusiveof)首月租金应于入住前缴清。PartyBshouldpay1stmonth’srenttoPartyAbeforecommencementdate.租金押金:人民币,乙方须于合同签定后三个工作日内交付甲方租赁押金。押金不可用于抵付房租。Deposit:RMB,partyBshouldpaythedepositinfulltopartyAwithin3daysuponsigningofthecontract.Thedepositcannotbebalancedoutastherent.甲方应提前10日发付款通知给乙方,乙方须将租金按时汇入甲方指定账户。PartyAshallsendinvoicetoPartyB10daysinadvance.PartyBshallpaytherentaltoPartyA’sdesignatedaccountontime。付款方式meansofpayment:以美金/人民币月付/季付USD/RMBpaymenteverymonth/quarter.甲方指定账号名称:PartyA’sdesignatedaccountname:银行名称:Nameofbank:银行账号(美金/人民币):AccountNo:(USD/RMB):地址:BankAdd:三、约定事项:Agreedon:1.租赁用途:乙方向甲方承租上述物业(以下简称单元)作为之用。乙方不得将该单元用于本条款限定之外用途。Useofproperty:PartyBisleasingfromPartyAtheabove-mentionedproperty(hereinaftercalledasthePremises)foruse.ThePremisesshallnotbeusedinwaysotherthanthoseprescribedinthisclause.2.费用支付:租用单元之水,电,煤气,电话费,网络费,有线电视费由乙方支付。PartyBshallpaychargesofwater,electricity,gas,internet,cabletelevisionandtelephonefeesofthepremises.3.家具及电器配置:家具清单详见本合同后附件一。Furnitureandelectricalappliances:PartyAshallsupplyPartyBwithfurnitureandelectricalappliancesofthepremises.Thelistisattachedtothiscontract.(SeeAnnex1).4.乙方如未续租则应在到期当日搬出该单元。甲方在乙方付清由乙方支付的所有费用(含水,电,煤气及电话费)后,在7天内全部退还乙方承租押金(不计利息)。如甲方延迟退还,应按日加付滞纳金0.5%给乙方。PartyBshallvacatethePremisesonexpiredateofthisContract.Ifeitherpartydoesn’twishtorenewthisContractuponitsexpiry,PartyAshallreturnthedepositinfull(withoutinterest)withinsevendaystoPartyBafterPartyBhaspaidinfullfortherent,includingutilityfeestelephoneexpenseswhichshallbebornebyPartyB.IfPartyAdelaythepaybackthedeposit,thenapenaltyof0.5%perdaywillbeaddedtoPartyB.5.乙方若需续租该单元,应提前两个月书面通知甲方。在同等条件下,乙方有优先续租权;续租租金视当时市场价格而定。IfPartyBwishestochoosetorenewtheLeaseContractattheendoftheterm,itshallnotifyPartyAinwritingtwomonthsinadvance.PartyBshallbegiventhepriorityoftenancyoverthePremiseswhiletherentshallbedependentonthemarketstandardbythen.四、双方责任Responsibilities1.甲方责任:PartyA’sresponsibilities:甲方应保证该物业的合法性及出租该物业的合法权利。PartyAshouldguaranteethelegalityoftheleasedpropertyanditslegalrighttoleasetheproperty.(2)甲方须按时交房,因未及时交房而引起的损失由甲方承担。PartyAshallgivethepossessionofthePremisestoPartyBontheeffectivedayofthisContract.PartyAshallbearallliabilitiesforthedelay.(3)合同期内,甲方不得将该单元出租给任何其他第三方。PartyAshallnotrentthePremisesorpartofittoanythirdpartywithinthevalidterm.(4)如果该单元的内部结构,属甲方的家具电器设备由于非乙方原因而是由于自然损耗原因引起损坏,致使乙方无法正常生活,甲方须及时安排修理。IftheinteriorstructureofthePremisesoritsfurnitureandapplianceswhichbelongstoPartyAaresubstantiallydestroyedordamagedwhichmakesitimpossibleforPartyBtolive,andnotowingtothedefaultorneglectofPartyB,thenPartyAshallarrangetorepairitimmediatelytoensureitsuse.(5)甲方应尽力督促管理公司提供充分的保安及消防工作。PartyAshallberesponsibletodohisbesttoprocuretheestatemanagertoprovideadequatesecurity&fireprevention.(6)甲方应遵守政府部门所规定的有关该房屋的任何法律规定。PartyAshallcomplywithanylawsregulationsofgovernmentauthority.(7)甲方应支付由政府机构规定的应由业主所承担的各项税费。TopaytheapplicabletaxesandchargespayableonthesaidpremisesasdesignatedbyanyrelevantgovernmentauthorityorotherlawfulauthoritytobepayableonlybythePartyA.2.乙方责任PartyB’sresponsibilities:(1)乙方须按上述付款日期支付各项费用,因乙方延期付款而引起的损失由乙方承担。PartyBshallpaythefeesinaccordancewiththeprovisionsofthisContract.PartyBshallbearalltheliabilitiesforthedelayofthepayment.(2)乙方应正确维护使用单元内属甲方的家具电器设备,因乙方的故意或过失损毁甲方物品,由乙方承担赔偿责任。乙方需更换单元内属甲方物品须有同甲方协商解决。PartyBshallproperlyuseandmaintainthefurnitureandequipmentbelongingtoPartyAinthePremises.PartyBshallbeliableforcompensatinganydamagecausedbyitsimproperorwrongfuluse.PartyBshallconsultPartyAifithastochangethefurnitureofequipmentbelongingtoPartyAinthePremises.(3)非经甲方及物业管理公司书面许可,乙方不得在单元内搭建,增减建筑物,不得将单元内建筑结构及装修予以改变,但允许乙方在墙上安装钉子挂相片等物品,否则,乙方将承担由此产生的一切责任。PartyBmaynot,withoutthepermissionofPartyAandthebuildingmanagementcompany,erect,addorremoveanystructuresanddecorationinorfromthePremises.ItmaynotchangethestructuralconstructionofPremises,exceptfornailinguppictures,etc.Itshallbeliableforexpensesincurredtherefrom.(4)入住前提供护照复印件、照片等,并保证本合同期内其个人在京签证及工作签证为有效签证。Providepassportcopy,photoetcbeforemoveinandmaketheworkpermitandthevisainBeijingisall-validduringtheleaseterminthispremises.(5)在甲方预先通知的情况下,租赁期最后两个月,允许甲方或其代理人带领有意租赁或购买房屋的客人视察房屋。WithPartyA’spriornotice,PartyAshallhavetherighttoshowtheleasedpropertytoprospectivetenantsorpurchasersduringthelasttwomonthsoftenancy.(6)乙方应遵守政府部门及物业管理公司所规定的有关该房屋的任何法律规定。如违反规定造成甲方遭受经济损失的,乙方应全额赔偿,甲方有权单方面解除合同并没收押金并保留追索欠款及索赔的权利。PartyBshallcomplywithanyrulesrelatingtogovernmentauthorityandManagementOffice.PartyBshallpayforallPartyA’slossinfullduetoileagalactionsforPartyB.PartyAhastherighttoterminatethecontractandforfeitthedepositandhastherighttogetbackthepaymentinarrearsandcompensation.五、违约责任LiabilitiesofDefault甲乙方提前退约:在定约期内,因甲方原因提前终止合同,甲方除应全额退还乙方租赁押金外,须支付乙方相等押金额作为违约金;反之,如乙方提前终止合同,则甲方没收押金。IfPartyAwishestoterminatethisContractbeforeexpiry,PartyAshallreturnthedepositinfullandinadditiontopaythedefaultfeethatisequaltotheamountofthedeposit.Inopposite,PartyBterminatesthecontractthenPartyBshallforfeitthedeposit.2.乙方延付费用:乙方应按合同规定支付上述费用,若逾期5日未付,除应及时支付所欠费用外,还应每天支付甲方月租金的0.5%滞纳金;延期超过10天,甲方有权单方面解除合同并没收押金及保留追索欠款及索赔的权利。PartyBshallpaytheaboverentandallotherfeesinaccordancewiththeprovisionsofthisContract.Iftherentisnotpaidwithinfivedaysfromtheduedate,PartyBshall,inadditiontopaytherentinarrears,payPartyAlatepaymentchargeof0.5%ofmonthlyrentperdayoflatepayment.Ifthepaymentofrentisoverduebymoretendays,PartyAshallhavetherighttounilaterallyterminatethisContractandconfiscatethefullamountofdepositpaidbyPartyBandhavetherighttogetbackthepaymentinarrearsandcompensation.六、不可抗力:Miscellaneous:房屋由于火灾、恶劣天气、战争或其它甲方不可抗拒因素,而不是因为乙方直接或间接的疏忽及故意行为造成房屋毁坏而不能被正常使用及居住时,乙方从该日起停止支付租金,直至房屋可再被使用及居住为止,如该房屋因任何不能归因乙方的原因不能正常使用超过20天,乙方有权终止合同并无需承担任何责任,甲方应退还全部押金及预付租金。甲方根据自己的意愿及经济、实际意义等原因,没有义务必须修缮复原房屋。若此情况发生,甲方应书面通知乙方,并在做出上述通知的十天之内将押金及预付租金全部退还乙方。Iftheleasedpropertyaresubstantiallydestroyedordamagedbyfire,badweather,war,forcemajor,orothercausesbeyondthecontrolofPartyAnotattributabledirectlyorindirectlytothenegligenceormaliceofPartyBorareotherwiserenderedunfitforuseoroccupation,therentshallceasetobepayablefromthedatetheleasedpropertybecomeunfitforuseoccupationuntiltheleasedpropertyshallagainberenderedaccessibleandfitforuse,ifthelesson’spropertycannotbeproperlyusedforanyreasonsbeyond20days,PartyBhastherighttoterminatetheagreementwithoutanyliabilities,thereof,PartyAshallrefundthedepositandthepre-paidrent,however,thatthePartyAshallbeundernoobligationtorepairtheleasedproperty,wheninPartyA’sopinion,itisnotreasonablyoreconomicallyorpracticallytodoso.Ifsuchaneventoccurs,PartyAshallgiveawrittennoticetoPartyB,andthedepositpaidbyPartyBandthepre-paidrent.七、适用法及争议的解决:Legislation&ArbitrationoftheDispute:本租约受中华人民共和国法律的约束,如发生与本租约有关的争议,由双方友好协商解决,协商不成,提请设在北京的中国国际经济贸易仲裁委员会,依该委员会在仲裁申请提出时有效的仲裁规定进行仲裁,仲裁在北京进行,仲裁语言为汉语,仲裁裁决是终局的,对双方当事人均有约束力。ThisLeaseAgreementisunderthelegalauthorityofPRC.Incaseanydisputearisesoverthisagreement,thetwopartiesshallnegotiatefriendly,iffailed,shallsubmittothechina
