EachMemberStateshallgrantECcomponenttype-approvalforanytypeofheadlampwhichfunctionsasamain-beamand/ordipped-beamheadlampandforanytypeoflightsource(filamentlamp(s)andother(s))foruseinapprovedlampunitswhichsatisfytheconstructionandtestingrequirementslaiddownintherelevantAnnexes.▼B2. TheMemberStatewhichhasgrantedEECcomponenttypeapprovalshalltakethemeasuresrequiredinordertoverifythatproductionmodelsconformtotheapprovedtype,insofarasthisisnecessaryandifneedbeincooperationwiththecompetentauthoritiesintheotherMemberStates.Suchverificationshallbelimitedtospotchecks.▼M3Article2MemberStatesshall,foreachtypeofheadlampwhichfunctionsasamain-beamand/ordipped-beamheadlamporforeachtypeoflightsource(filamentlamp(s)andother(s))foruseinapprovedlampunitswhichtheyapprovepursuanttoArticle1,issuetothemanufactureranECcomponenttype-approvalmarkconformingtothemodelshowninAnnexI,Appendix5.MemberStatesshalltakeallappropriatemeasurestopreventtheuseofmarksliabletocreateconfusionbetweenheadlampswhichfunctionasmain-beamand/ordipped-beamheadlampsandlightsource(s)(filamentlamp(s)andother(s))foruseinapprovedlampunitswhichhavebeentype-approvedpursuanttoArticle1,andotherdevices.Article31.NoMemberStatemayprohibittheplacingonthemarketofheadlampswhichfunctionasmain-beamand/ordipped-beamheadlampsandlightsource(s)(filamentlamp(s)andother(s))foruseinapprovedlampunitsongroundsrelatingtotheirconstructionormethodoffunctioning,iftheybeartheECcomponenttype-approvalmark.共90页第7页1976L0761—中文—2004年5月1日—007.001—4▼B鉴于关于汽车的本国相关法律使得各成员国相互承认按照共同要求进行的检测，欧洲共同体委员会采用本指令：▼B第一条1.对于符合有关附件中规定的结构及测试要求的任何型式的远光和/或近光前照灯以及已获认证的车灯组件所使用的光源（白炽灯及其它），成员国应发放欧共体部件型式认证。2.已发放欧洲经济共同体部件型式认证的成员国，应根据要求采取措施，证明该产品型号符合已获认证的型式，并且在需要时应与其他成员国主管当局合作。此类证明应仅限于抽检。▼M3第二条对于成员国依据第一条认证的各种型式的远光和/或近光前照灯以及已获认证的车灯组件所使用的光源（白炽灯及其它），成员国应向制造商发放与附件I，附录5中所示型号一致的欧共体部件型式认证标志。成员国应采取适当措施，避免使用易混淆依据第一条认证的远光和/或近光前照灯以及已获认证的车灯组件所使用的光源（白炽灯及其它）及其它装置的标志。第三条1. 对于带有欧共体部件型式认证标志的远光和/或近光前照灯以及已获认证的车灯组件所使用的光源（白炽灯及其它），任何成员国不得基于与其制造或性能方法有关的理由禁止其投放市场。共90页第8页1976L0761—EN—01.05.2004—007.001—52.AMemberStatemayprohibittheplacingonthemarketofheadlampswhichfunctionasmain-beamand/ordipped-beamheadlampsandlightsource(s)(filamentlamp(s)andother(s))foruseinapprovedlampunitsbearingtheECcomponenttype-approvalmarkwhichconsistentlyfailtoconformtotheapprovedtype.ThatStateshallforthwithinformtheotherMemberStatesandtheCommissionofthemeasurestaken,specifyingthereasonsforitsdecision.Article4ThecompetentauthoritiesoftheMemberStatesshallinformeachother,bymeansoftheprocedurespecifiedinArticle4(6)ofDirective70/156/EEC,ofeachapprovalwhichtheyhavegranted,refusedorwithdrawnpursuanttothisDirective.▼BArticle51.►M3IftheMemberStatewhichhasgrantedECcomponenttype-approvalfindsthatanumberofheadlampswhichfunctionasmain-beamand/ordipped-beamheadlampsorlightsource(s)(filamentlamp(s)andother(s))foruseinapprovedlampunitsbearingthesame▼BECcomponenttype-approvalmarkdonotconformtothetypewhichithasapproved,itshalltakethenecessarymeasurestoensurethatproductionmodelsconformtotheapprovedtype.MThecompetentauthoritiesofthatStateshalladvisethoseoftheotherMemberStatesofthemeasurestaken,whichmay,wherethereisconsistentfailuretoconform,extendtowithdrawalofEECcomponenttype-approval.ThesaidauthoritiesshalltakethesamemeasuresiftheyareinformedbythecompetentauthoritiesofanotherMemberStateofsuchfailuretoconform.2.ThecompetentauthoritiesofMemberStatesshallwithinonemonthinformeachotherofanywithdrawalofEECcomponenttype-approval,andofthereasonsforsuchameasure.Article6►M3AnydecisiontakenpursuanttotheprovisionsadoptedinimplementationofthisDirectivetorefuseorwithdrawECcomponenttype-approvalforamain-beamoradipped-beamheadlamporforalightsource(s)(filamentlamp(s)andother(s))foruseinapprovedlampunitsorprohibittheirplacingonthemarketoruseshallsetoutindetailthereasonsonwhichitisbased.MSuchdecisionshallbenotifiedtothepartyconcerned,whoshallatthesametimebeinformedoftheremediesavailabletohimunderthelawsinforceintheMemberStatesandofthetimelimitsallowedfortheexerciseofsuchremedies.共90页第9页1976L0761—中文—2004年5月1日—007.001—52. 但是，若带有欧共体部件型式认证标志的远光和/或近光前照灯以及已获认证的车灯组件所使用的光源（白炽灯及其它）一贯不符合已获认证的型式，成员国可禁止其投放市场。该成员国应立即将采取的措施通报其他成员国和委员会，说明做出此决定的理由。第四条对于其依据本指令发放、拒绝发放或已撤销的认证，各成员国主管当局应通过指令70/156/EEC第四条（6）规定的程序相互通报。▼B第五条1. 倘若已发放欧共体部件型式认证的成员国发现某些带有该欧共体部件型式认证标志的远光和/或近光前照灯以及已获认证的车灯组件所使用的光源（白炽灯及其它）与认证的型式不符，则应当采取必要的措施确保这些产品型号与其认证的型式相符。该成员国主管当局应就采取的措施向其他成员国的主管当局提出建议，若始终不能相符，应采取措施直至撤销该欧共体部件型式认证。该主管当局在接到另一成员国主管当局关于此类不相符的通知时，应采取相同的措施。2.各成员国主管当局应在一个月内相互通报对欧洲经济共同体部件型式认证的撤销以及采取此措施的理由。第六条对于该指令实施过程中，依据所采用的条款作出的拒绝发放或收回远光或近光前照灯或已获认证的车灯组件所使用的光源（白炽灯及其它）的欧共体部件型式认证或禁止其投放市场及使用的决定，都应详细说明该决定所基于的理由。该决定应通知有关各方，同时应告知当事方依据成员国现行法律可以使用的补救办法以及运用此类补救办法的时效。共90页第10页1976L0761—EN—01.05.2004—007.001—6▼M3Article7NoMemberStatemayrefusetograntECtype-approvalornationaltype-approvalofavehicleongroundsrelatingtoitsheadlampswhichfunctionasmain-beamand/ordipped-beamheadlampsortothelightsource(s)(filamentlamp(s)andother(s))foruseinapprovedlampunitsifthesebeartheECcomponenttype-approvalmarkandarefittedinaccordancewiththerequirementslaiddowninDirective76/756/EEC.Article8NoMemberStatemayrefuseorprohibitthesaleorregistration,entryintoserviceoruseofavehicleongroundsrelatingtoitsheadlampswhichfunctionasmain-beamand/ordipped-beamheadlampsortothelightsource(s)(filamentlamp(s)andother(s))foruseinapprovedlampunitsifthesebeartheECcomponenttype-approvalmarkandarefittedinaccordancewiththerequirementslaiddowninDirective76/756/EEC.Article9ForthepurposesofthisDirective,'vehicle'meansanymotorvehicleintendedforuseontheroad,withorwithoutbodywork,havingatleastfourwheelsandamaximumdesignspeedexceeding25km/h,withtheexceptionofvehicleswhichrunonrailsandofagriculturalandforestrytractorsandallmobilemachinery.Article10AnyamendmentsnecessarytoadjusttherequirementsoftheAnnexestotakeaccountoftechnicalprogressshallbeadoptedinaccordancewiththeprocedurelaiddowninArticle13ofDirective70/156/EEC.Article11MemberStatesshalladoptandpublishtheprovisionsnecessaryinordertocomplywiththisDirectivebefore1July1977andshallforthwithinformtheCommissionthereof.Theyshallapplytheseprovisionsfrom1October1977atthelatest.OncethisDirectivehasbeennotified,theMemberStatesshallalsoensurethattheCommissionisinformed,insufficienttimeforittosubmititscomments,ofanydraftlaws,regulationsoradministrativeprovisionswhichtheyproposetoadoptinthefieldcoveredbythisDirective.Article12ThisDirectiveisaddressedtotheMemberStates.共90页第11页1976L0761—中文—2004年5月1日—007.001—6▼M3第七条若汽车上的远光和/或近光前照灯以及已获认证的车灯组件所使用的光源（白炽灯及其它）带有欧共体部件型式认证标志并且其安装遵照了指令76/756/EEC规定的要求，任何成员国不得基于与上述前照灯相关的理由拒绝向该汽车发放欧共体型式认证或国内型式认证。第八条若汽车上的远光和/或近光前照灯以及已获认证的车灯组件所使用的光源（白炽灯及其它）带有欧共体部件型式认证标志并且其安装遵照了指令76/756/EEC规定的要求，任何成员国不得基于与上述前照灯相关的理由拒绝或禁止该汽车的销售、注册、投入运行或使用。第九条本指令中，“车辆”指的是符合下述特征的车辆：用于道路行驶；装有或未装车体；至少有四个车轮；最大设计车速超过25公里/小时。在铁路上行驶的车辆、农用拖拉机、林业拖拉机以及机动机械设备除外。▼B第十条对于因考虑到技术的进步，为了调整附件中的要求而进行的必要的修正，应按照指令76/756/EEC第十三条规定的程序加以采用。第十一条1.
