NoMemberStatemayprohibittheplacingonthemarketofreflexreflectorsongroundsrelatingtotheirconstructionormethodoffunctioningiftheybeartheEECcomponenttype-approvalmark.2. Nevertheless,aMemberStatemayprohibittheplacingonthemarketofreflexreflectorsbearingtheEECcomponenttype-approvalmarkwhichconsistentlyfailtoconformtotheapprovedtype.▼M2ThatStateshallforthwithinformtheotherMemberStatesandtheCommissionofthemeasurestaken,specifyingthereasonsforitsdecision.Article4ThecompetentauthoritiesoftheMemberStatesshallinformeachother,bymeansoftheprocedurespecifiedinArticle4(6)ofDirective70/156/EEC,ofeachapprovalwhichtheyhavegranted,refusedorwithdrawnpursuanttothisDirective.共42页第7页1976L0760—中文—2004年5月1日—006.001—4▼M2第二条依据第一条对反光器型式进行了认证后，各成员国应给相应的制造商发予欧共体零部件型式认证标记，该标记与附件I附录3所示式样相符。▼B各成员国应采取适当措施，防止按照第一条之要求取得型式认证后的反光器标记，在使用时与其它装置产生混淆。第三条1. 如果反光器上带有欧共体零部件型式认证标记，则各成员国不得以其结构或者运行方式为理由禁止上述反光器投放市场。2. 然而，如果带有欧共体零部件型式认证标记的反光器一贯与经过认证的型式不符，则各成员国可以禁止上述反光器投放市场。该成员国应即刻将其采取的措施通知其它成员国和委员会，详细说明有关理由。▼M2第四条各成员国主管当局应利用《指令70/156/EEC》第四条第（6）款中的规定程序，相互通知其依据本指令准予、拒绝或者撤消的各个认证。共42页第8页1976L0757—EN—01.05.2004—006.001—5▼M2Article51. IftheMemberStatewhichhasgrantedEECcomponenttype-approvalfindsthatanumberofreflexreflectorsbearingthesameEECcomponenttype-approvalmarkdonotconformtothetypewhichithasapproved,itshalltakethenecessarymeasurestoensurethatproductionmodelsconformtotheapprovedtype.ThecompetentauthoritiesofthatStateshalladvisethoseoftheotherMemberStatesofthemeasurestakenwhichmay,wherethereisconsistentfailuretoconform,extendtowithdrawalofEECcomponenttype-approval.ThesaidauthoritiesshalltakethesamemeasuresiftheyareinformedbythecompetentauthoritiesofanotherMemberStateofsuchfailuretoconform.2. ThecompetentauthoritiesoftheMemberStatesshallwithinonemonthinformeachotherofanywithdrawalofEECcomponenttype-approvalandofthereasonsforsuchameasure▼BArticle6AnydecisiontakenpursuanttotheprovisionsadoptedinimplementationofthisDirective,torefuseorwithdrawtype-approvalforareflexreflectororprohibititsplacingonthemarketoruseshallsetoutindetailthereasonsonwhichitisbased.Suchdecisionshallbenotifiedtothepartyconcerned,whoshallatthesametimebeinformedoftheremediesavailabletohimunderthelawsinforceintheMemberStatesandofthetimelimitsallowedfortheexerciseofsuchremedies.Article7NoMemberStatemayrefusetograntEECtype-approvalornationaltype-approvalofavehicleongroundsrelatingtoitsreflexreflectorsifthesebeartheEECcomponenttype-approvalmarkandarefittedinaccordancewiththerequirementslaiddowninDirective76/756/EEC.共42页第9页1976L0760—中文—2004年5月1日—006.001—5▼M2第五条1. 如果准予欧共体零部件型式认证的成员国发现很多带有欧共体零部件型式认证标记的反光器与认证过的型式不符，则该成员国可以采取必要措施保证生产模型与得到认证的型式相符。该成员国的主管当局应该告知其它成员国的主管当局所采取的措施，如果这些反光器始终不能与经过认证的型式相符，可以撤销这些反光器的欧共体型式认证。上述成员国的主管当局，在接到发生此类情况的成员国主管当局的通知后，应采取同样的措施。2. 各成员国的主管当局应在撤销欧共体零部件型式认证之后一个月之内通知其它成员国主管当局，同时告知采取此类措施的理由。▼B第六条凡是依据本指令执行过程中采用的规定条款而采取的拒绝、撤消反光器的欧共体零部件型式认证决定，或者禁止这些反光器上市销售或使用的决定，均应详细列明其依据的理由。应将上述决定通知有关方面，同时应通知后者按照成员国正在实施中的法律其可以采取的补救措施，以及实施上述补救措施的时间期限。第七条如果反光器附着有欧共体零部件型式认证标记，并且其安装符合《指令76/756/EEC》中的规定要求，则各成员国不得以与反光器有关的理由，拒绝给相关车辆发予欧共体型式认证或国家型式认证。共42页第10页1976L0757—EN—01.05.2004—006.001—6▼BArticle8NoMemberStatemayrefuseorprohibitthesale,registration,entryintoserviceoruseofanyvehicleongroundsrelatingtoitsreflexreflectorsifthesebeartheEECcomponenttype-approvalmarkandarefittedinaccordancewiththerequirementslaiddowninDirective76/756/EEC.▼M2Article9ForthepurposesofthisDirective,‘vehicle’meansanymotorvehicleintendedforuseontheroad,withorwithoutbodywork,havingatleastfourwheelsandamaximumdesignspeedexceeding25km/h,anditstrailers,withtheexceptionofvehicleswhichrunonrailsandofagriculturalandforestrytractorsandallmobilemachinery.▼BArticle10AnyamendmentsnecessarytoadjusttherequirementsoftheAnnexestotakeaccountoftechnicalprogressshallbeadoptedinaccordancewiththeprocedurelaiddowninArticle13ofDirective70/156/EEC.Article111.MemberStatesshalladoptandpublishtheprovisionsnecessaryinordertocomplywiththisDirectivebefore1July1977andshallforthwithinformtheCommissionthereof.Theyshallapplytheseprovisionsfrom1October1977atthelatest.2. WhereECcomponenttype-approvalisrequestedforatypeoflightingandlight-signallingdevicecomprisingaretro-reflectorandotherlamps,asingleECcomponenttype-approvalnumbermaybeassignedprovidedthattheretro-reflectorcomplieswiththerequirementsofthisDirectiveandthateachoftheotherlampsformingpartofthelightingandlight-signallingdeviceforwhichECcomponenttype-approvalisrequestedcomplieswiththeseparateDirectiveapplyingtoit.共42页第15页1976L0760—中文—2004年5月1日—006.001—8▼M22. 标记2.1. 提交用于欧共体零部件型式认证的装置上必须标附有：2.1.1. 制造商商品名称或者标记；2.1.2. 标记“顶端（TOP）”，如果需要明确判定制造商规定的旋转角度或者角度时，应在照明表面顶端呈水平状标出此标记。2.2. 这些标记应该附着在装置的照明表面上或者某个照明表面上，并且清晰易读，不易擦除。装置装配到车辆上之后，这些标记应从外部可以看到。2.3. 各装置上应有足够的空间来附着这些零部件认证标记。应在附录I中提及的图纸上注明该空间。3. 欧共体零部件型式认证的发放3.1. 如果满足有关要求，应依据《指令70/156/EEC》第四条第（3）款以及第四条第（4）款（如果适用）之规定发予欧共体型式认证。3.2. 附录2给出了欧共体型式认证证书式样。3.3. 应给各种反光器型式指定一个认证编号，该编号与《70/156/EEC指令》附录VII之要求一致。同一个成员国，不得给另一反光器型式指定同一个认证编号。3.4. 需要对某型包含反光器及其它车灯的照明和光信号装置进行欧共体零部件型式认证时，倘若其中的反光器符合本指令要求，并且作为照明和光信号装置组成部分的其它各车灯（这些车灯也需要进行欧共体型式认证）符合可适用的独立指令，则可以单独指定一个欧共体零部件认证编号。共42页第16页1976L0757—EN—01.05.2004—006.001—9▼M24.
