租赁合同LEASECONTRACT出租方:(下列简称甲方):Lessor(hereinafterreferredtoasPartyA):承租方:(下列简称乙方):Tenant(hereinafterreferredtoasPartyB):乙双方通过和谐协商一致订立本合同,以资共同恪守。PartyAandPartyB,havinghadfriendlydiscussion,herebyagreetoenterintothefollowingcontracttobeabidedbybothparties.一、物业地址:甲方将其全部的位于上海市的房屋及附属设施在良好状态下出租给乙方使用。AddressofBuilding:PartyAshallleasethehouseofitsownanditsaccessoryfacilitieswhichisingoodconditionandlocatedatDistrict,ShanghaitoPartyBfor.二、房屋面积:出租房屋的建筑面积为平方米。Floorageofhouse:Theconstructionfloorageofthehousetoletisspuaremeters.三、租赁期限:租赁期自年月日起至年月日止为期年个月。甲方应于年月日以前将房屋腾空交给乙方使用。LeaseTerms:Theleasetermshallbefrom(mouth)(day)(year),to(month)(day)(year).AndPartyAshouldvacatethehouseandturnitovertoPartyBforusebefore(month)(day)(year).四、定金1、乙方应付的定金为元整,乙方于年月日以前支付给甲方定金累计元整。2、在本合同签定之后至租期开始之前如甲方违约,则上述定金由甲方双倍返还乙方,如乙方违约则定金由甲方没收。定金的赔偿不影响违约金的索赔。3、租期开始之后,上述定金全额自动转化为:。EarnestMoney:1、PartyBwillpayasanearnestmoney.TheearnestmoneyshouldbepaidtoPartyAbefore(month)(day)(year).2、Afterthecontractissignedandbeforetheleasetermbegins,incasePartyAbreachesthecontract,itshouldpaydoubleamountoftheearnestmoneybacktoPartyB.IncasePartyBbreaches,PartyAwillconfiscatetheearnestmoney.Thecompensationoftheearnestmoneywillnotaffectclaimsagainstbeachofthecontract.3、Aftertheleasetermbegins,theabove-mentionedearnestmoneywilltranslateintoautomatically.五、租金1、数额:双方议定租金为每月元整,乙方以形式支付给甲方。汇率按支付当天中国人民银行公布之外汇官方牌价中间价计。2、租金调节省定:。3、支付方式:租金按个月为壹期支付,第一期租金于年月日以前付清,后来每期租金于的日前缴纳,先付后住(若乙方以划帐形式支付租金,则汇出日为支付日,汇费由汇出方承当),甲方收到租金后应予以书面签收。4、如乙方逾期支付租金,则须支付每天相称于月租金百分之一的滞纳金;若逾期且在经甲方正式告知后仍未付租金总计超出拾个工作日,则视为乙方自动退租,构成违约,甲方有权收回房屋,并追究乙方违约责任。Rental:1、Amount:Therentalagreeduponbybothpartiesshallbepermonth.BytransferringtheamountofsuchrenttoabankaccountdesignatedbyPartyAinAccordingtotheofficialstandardrateatpaymentday.2、Agreementofrentaladjustment:3、Paymentofrental:Thepaymentofrentalshallbemadeeverymonths.ThefirstPaymentshallbemadebefore(month)(day)(year).Eachsuccessivepaymentshallbemadebeforeateverypaymentmonth.PartyBshallpaytherentalbeforeitmovesintothehouse.(IfPartyBpaystherentalintheformofremittance,thedateofremittingshallbedayofrentalpayment.Theremittancefeeshallbebornebytheremitter.)PartyAshouldsignawrittenreceiptaftereachpaymentofrentalisreceived.4、IfPartyBdelayssuchrentalpayment,theinterestwouldbeimposedonoverdueaccountatadailyrateof1%ofmonthrental.AfterformalinformingbyPartyA,ifPartyBstilldelaysintheexcessoftenworkingdays,itshalldeemedasautomaticallyquittingtenancy,whichshallconstituteofcontract.六、确保金为确保房屋及其附属设施之安全与完好及租赁内有关费用之如期结算,乙方同意于年月日之前支付给甲方元整。作为乙方确保合同之确保金。甲方在收到确保金后应予以书面签收。除合同另有商定之外,甲方应于租赁关系消除且乙方迁空、点清、并付清全部应付费用后,当天将确保金全额无息退还乙方。因乙方违反本合同的规定,而产生的违约金、损害赔偿以及应付租金及有关费用,甲方可在确保金扣抵,局限性部分乙方必须在接到甲方付款告知后十天内补足。DepositofSecurity:1、Toensurethatthehouseanditsaccessoryfacilitiesaresafeandingoodconditionandthataccountsofrelevantfeesaresettledonscheduleduringthetermoflease,PartyBagreestopaytoPartyAbefore(month)(day)(year)asadepositofsecurityforfulfillingtoContract.Afterreceivingthedeposit,PartyAshouldsignawrittenreceipt.2、Unlessotherwiseagreedupon,PartyAshouldreturntoPartyBthefullamountofdepositofsecurityinterestfreeonthedayleaseisdissolvedandPartyBhasvacatedthehouse,lefteverythinginthehouseintactandpaidupallexpensesdue.Anypenaltyforbreachofcontract,compensationfordamageandrentalandotherrelevantfeespayablearisingfromPartyB’sviolationoftheprovisionsoftheContractmaybemadeupforbyPartyBwithintendaysofthereceiptofthenoticeofpaymentissuedbyPartyA.七、其它费用乙方应承当租赁期内的水费、电费、煤气费、通讯费和其它由乙方实际使用而产生的费用,并按单如期缴纳。地租、房产税、租赁所得税、房屋维修费、物业管理费等原由甲方支付的费用,仍由甲方承当。OtherFee:PartyBshouldbearthewater,electricity,gasandcommunicationfeesandallotherfeesincurredbyPartyBinactualuseandpaythebillsonscheduleduringthetermoflease.Thelandrent,housetax,incometaxandhousemaintenancefee,managementfeesthatwereoriginallypayablebyPartyAshallcontinuetobepaidbyPartyA.八、甲方的义务:甲方须准时将房屋及附属设施交付乙方使用。房屋设施如因质量因素,自然损耗或灾害而受到损坏时,甲方有修缮的责任并承当有关的费用。甲方应确保所出租的房屋享有出租的权利,如在租赁期内,该房屋发生全部权全部或部分的转移、设定他项物权或其它影响乙方权益的事情时,甲方应确保全部权人,他项权利人或其它影响乙方权益的第三者能继续恪守本合同全部条款,反之如乙方权益因此而遭受损害,甲方应负赔偿责任。ObligationsofPartyA:PartyAshallturnoverthehouseandaccessoryfacilities(seetheappendixfordetail)onscheduletoPartyBforuse.PartyAshallberesponsibleforrepairinganydamageofthehouseduetopoorquality,naturaltearandwearorcalamitiesandbeartheexpensesthereof.PartyAshouldensurethatthehouseletoutisentitled,tothelease.Ifallorpartoftheownershipofthehouseistransferred,otherrightsitemaresettled,oranyotherhappeningaffectstherightsandinterestsofPartyBduringtheleasehold,PartyAshouldguaranteethattheowner,persontotherightsitemoranyotherthirdpartythataffectstherightsandinterestofPartyBcontinuetoabidebyallthearticlesoftheContract.Otherwise,PartyAshallbeliableforcompensatingtolosstotherightsandinterestssufferedbyPartyBtherefrom.九、乙方的义务:乙方应按合同的规定,准时支付租金、确保金及其它各项应付费用。乙方经甲方同意,可在承租用房内进行装修及添置设备。租赁期满后,乙方可将添置的可拆动的动产部分自行拆运,并确保不影响房屋的完好及正常使用。未经甲方同意,乙方不得将承租的房屋转租或分租,并爱惜使用租赁的房屋。如因乙方的过失或过失致使房屋及设施受到损坏,乙方应负赔偿责任。乙方应按本合同的商定正当使用租赁房屋,不得私自变化使用性质,不应寄存危险物品,如因此发生损害,乙方应承当全部责任。ObligationsofPartyB:PartyBshouldpaytherental,depositofsecurityandotherfeespayableonscheduleaccordingtotheprovisionsofthecontract.PartyBmay,uponapprovalbyPartyA,fituptherentedhouseandaddequipmentthereinduringtheleasehold.Uponexpirationoftheleasedhold,PartyBmayremovetheaddedpartofpropertythatisremovable,butitmustensurethatthehouseisingoodconditionfornormaluse.PartyBmustnottransfertheleaseofthehouseithasrentedorsubletitwithouttheapprovalbyPartyA.PartyBshouldtakegoodcareofthehouserented.PartyBshallbeliableforcompensatingforanydamagecausedtothehouseandfacilitiesduetoPartyB’sfaultormisuse.PartyBshouldusetherentedhouselawfullyaccordingtotheprovisionsoftheContract.Itmusttonotchangethenatureoftheuseofthehousewithoutauthorization.Nohazardousmaterialsandgoodsshallbeallowedtobekeptinthehouse.Ifanydamageisattributabletosuchuse,PartyBshallfullyliable.十、合同终止及解除的规定:乙方在租赁期满后,乙方有优先承租权,如需续租,应提前两个月告知对方,由双方另行协商续租事宜。租赁期满后,乙方应在天内将承租的房屋交还甲方,如有留置的任何物品,在未获得甲方谅解之下,均视为放弃,任凭甲方处置,乙方决无异议。本合同一经双方签字后立刻生效,未经双方同意,不得任意终止,如有未尽事宜,甲、乙双方可另行协商。TerminationandDissolutionoftheContract:IfPartyBintendstorenewtheleasedholduponitsexpiration,itshouldnotifyPartyAofsuchintentiontwomonthinadvance.Then,thetwopartiesshalldiscussmatterovertherenewalofleasehold.Upontheexpirationoftheleasehold,PartyBshouldturntherentedhousebacktoPartyAwithindays.Anybelongingsleftbehindinthehouseshall,withoutobtainingpreviousunderstandingofPartyA,bedeemedasthingsgivenupbyPartyBandshallbedisposedofbyPartyAatitsdiscretion,towhichPartyBshallraisenoobjection.Thiscontractshallgointoeffectthemomentitissignedbybothparties.Itmustnotbeterminatedatwillwithouttheapprovalofbothparties.AnythingnotcoveredintheContractshallbediscussedseparatelybyPartyAandPartyB.十一、违约解决:1、甲乙任何一方如未按合同的条款推行,造成半途终止合同,并且过失方在未征得对方谅解的状况下,则视为违约,双方同意违约金为元整。若违约金局限性弥补无过失方之损失,则违约方还需就局限性部分支付赔偿金。凡在执行本合同或与本合同有关的事情时双方发生争议,应首先和谐协商,协商不成,可向有管辖权的人民法院提起诉讼。HandingofBreachofContact:1、IffailureofeitherPartyAorPartyBtofulfilthearticlesoftheContractbeforeitsexpiration,thePartyatfaultshallbedeemedasviolatingtheContractwithoutobtainingtheunderstandingoftheotherParty.Thetwopartiesagreethatthepenaltyforbreachofcontractshallbe.Incasesuchpenaltyisnotsufticienttomakeupforthelosssufferedbythefaultlessparty.ThepartythathasviolatedtheContractshallpayadditionalcompensation.AnydisputearisingfromexecutionoftheContractorinconnectionwiththeContractshouldbesettlethroughfriendlydis
