40.0019,200.00Basement5480.00lm40.0019,200.002.6ParkingSlotNumbersBasement148.00Pcs100.004,800.00Basement248.00Pcs100.004,800.00Basement348.00Pcs100.004,800.00Basement448.00Pcs100.004,800.00Basement548.00Pcs100.004,800.002.7DirectionalArrowsBasement116.00pcs150.002,400.00Basement216.00pcs150.002,400.00Basement316.00pcs150.002,400.00Basement416.00pcs150.002,400.00Basement516.00pcs150.002,400.00Sub-totalTrafficPaintingLaborOnlyP916,259.84Three(3)coatSemiglossLatexonAdminOfficeCeiling/WallsCeiling(Labor&Materials)76.08sqm150.0011,412.00Walls(Labor&Materials)337.88sqm150.0050,682.00Sub-totalLabor&Materials62,094.00GRANDTOTALAMOUNTP1,293,203.60TheLABORCONTRACTORshallassignhisrepresentativesandengineerfulltimeonsiteduringthecontractedworksandrelatedworks.Upondeliveryofmaterialstotemfacilarea,theLABORCONTRACTORshouldimmediatelystarttheexternalpaintingworks,atafasterspeed,soastoreducethestockpileattemfacilareatocreatemorespace.TheLABORCONTRACTORshouldberesponsiblefororganizingthestockpileofmaterialsproperly,andmaketheworkingareacleanandtidy.Afterthepaintingworksarefinished,theLABORCONTRACTORshouldcleantheworkingareaandhandovertotheGENERALCONTRACTORinagoodorder.TheLABORCONTRACTORisalsorequestedtosubmitadeliveryscheduleofneededmaterialsfifteen(15)daysinadvance.TheGENERALCONTRACTORwillissueweeklyconstructionscheduletotheLABORCONTRACTOR.TheLABORshallsubmitamanpowerscheduleinaccordancewiththeweeklyconstructionschedulewithintwo(2)daysuponacceptanceoftheweeklyconstructionschedule.Thescopeofworkalsoincludescleaningpreparation,andotherrelatedpreparationworks.Allheavyequipment,liftingmachines,haulingtruckwillbeprovidedbytheGENERALCONTRACTORfreeofcharge.ARTICLEIII–TERMSOFPAYMENT30%DOWNPAYMENTshouldbemadeinthiscontract.AtotalamountofPESOS:EIGHTYTHOUSAND(Php80,000.00)asaMOBILIZATIONFEEshouldbemadeonthiscontractaftertheLaborContractordeliversitsownequipmenttothejobsite.TheWeekly(everysixworkingdays)ProgressBillingshallbebasedontheactualaccomplishmentascertifiedbytheProjectEngineer,oranyrepresentativeassignedbytheGENERALCONTRACTORandtheagreedunitprice.Thepaymenthereofshallbepaidafterseven(7)calendardaysuponacceptanceoftheWeeklyProgressBillingandsubmissionofsupportingdocumentsandissuanceofOfficialReceipt.Cut–offofsubmissioniseveryWednesdayandpaymentwillbeeveryFridayofthefollowingweek.AllthebillingshallcompliedwiththebillingformatandrequirementmarkedasAnnex“C”,anymissingsupportingdocumentsandunformattedbillingwillaffectthereleaseofpayment.Thebillingamountshouldbeevaluatedbytheactualaccomplishment(exclusiveofthewindowopeningandPTAC).RETENTION–TheGENERALCONTRACTORshalldeductandwithholdaretentionequivalenttofivepercent(5%)ofeveryprogressbillingamount.ThisshallbereleasedtotheLABORCONTRACTORaftersix(6)monthsfromthefinalacceptanceoftheworkcoveredbythisAgreement,aftertheGENERALCONTRACTORhasascertainedtoitsfullsatisfactionthattheAgreementwasfullycompliedwithassoonasSuretyBondissubmitted.AlltheProgressBillingissubjecttotwopercent(2%)deductionofWithholdingTax.Incaseofrectificationorrepairworks,theLABORCONTRACTORwillberesponsibletothedefectduetoitsmistakeofpoorworkmanshipthatmaycausewasteofmaterials.TheLABORCONTRACTORshallrepairsuchdefectitemsinhisowncostimmediately.TheLABORCONTRACTORwillnotshoulderallothercorrectionofsurfaceduetomasonryimperfection.ReworkduetopoormasonrysurfacesshallbeontheaccountoftheGENERALCONTRACTOR.PaymentforworksbilledshallnotbeconstruedasanadmissionbytheGENERALCONTRACTORthattheLABORCONTRACTORhassatisfactorilyperformedorissatisfactorilyperformingtheworksinaccordancewiththeplans,specificationsandgeneralconditionsandbiddocuments,orthattheworkisfreefromdefectsofanykind,hiddenorotherwise,orthattheLABORCONTRACTORisnotviolatingoriscomplyingorhascompliedwiththeprovisions,termandconditionsofthisAgreementoranyoftheLABORCONTRACTOR’sobligationhereunder.ARTICLEIV–CONTRACTTIME/COMPLETIONDATE/TIMEEXTENSIONTheGENERALCONTRACTORwillissuetheconstructionscheduletoLABORCOTNRACTORbeforethestartofworks.Contractscheduleshallcommenceonthe16thofMay2009.TheLABORCONTRACTORshallcompleteandturn-overalltheworksassignedasperconstructionscheduleunderthisAgreement.ARTICLEV–LIQUIDATEDDAMAGESForfailuretocompletetheContractWorksatthespecifieddate,theLABORCONTRACTORshallpaytheGENERALCONTRACTOR,liquidateddamagesequivalenttoonetenthofonepercent(0.10%)ofthetotalcontractamountpercalendardayofdelay.However,innocasetheliquidateddamagesshallnotexceedtenpercent(10%)ofthetotalcontractamount.However,thedelaycausedbyotherSubcontractor,lackofmaterials,etc.theSubcontractorshallnotshouldertheliquidateddamages.PaymentordeductionofsumsdueonaccountofassessmentforliquidateddamagesshallnotrelievetheLABORCONTRACORofitsobligationtocompleteworks.AnysumwhichmaybepayablebytheLABORCONTRACTORforsuchlossmaybedeductedfromtheamountsretainedunderArticle4.6orretainedbytheGENERALCONTRACTORwhentheworkscalledforunderthisAgreementhavebeenfinishedandcompleted.ARTICLEVI–ASSIGNMENTThisAgreementand/oranyofthepaymentstobeduehereundershallnotbeassignedinwholeorinpartbytheLABORCONTRACTORnorshallanypartoftheworkbesubletbytheLABORCONTRACTOR.ARTICLEVII–ARBITRATIONAnydisputearisinginthecourseoftheexecutionandperformanceofthisAgreementbyreasonofdifferenceininterpretationoftheContractDocumentssetforthshallberesolvedamicablybetweenthemorshallbesubmittedbyeitherpartytoaBoardofArbitratorscomposedofthree(3)memberschosenasfollows:One(1)membershallbechosenbytheLABORCONTRACTORandone(1)membershallbechosenbytheGENERALCONTRACTOR.Thesaidtwo(2)members,inturnshallselectathirdmemberacceptabletobothofthem.ThedecisionoftheBoardofArbitratorsshallberenderedwithten(10)daysfromthefirstmeetingoftheboard,whichdecisionwhenreachedthroughtheaffirmativevoteofatleasttwo(2)membersoftheboardshallbefinalandbindingupontheGENERALCONTRACTORandtheLABORCONTRACTOR.However,thisprovisiondoesnotpreventanyaggrievedpartytoseekjudicialrecourseforanyvalidcauseofactionarisingfromorinconnectionwiththisagreement.ARTICLEVIII–COMPLETION&FINALACCEPTANCEIftheworkdonebytheLABORCONTRACTORisfullycompletedandinaccordancewiththisagreement,ascertifiedbytheProjectEngineer,theGENERALCONTRACTORshallwithinfifteen(15)daystherefore,causetheissuanceofawrittencertificateofacceptance,thebalancefoundtobeduetheLABORCONTRACTORshallbecomepayable,subjectonlytotheretentionprovidedforunderArticle4.6andthewithholdingtaxprovidedforunderArticle4.7.Beforetheissuanceofthecertificateofacceptance,theLABORCONTRACTORshallsubmitaswornstatementcertifyingtotheGENERALCONTRACTORthatallpayrollsandotherindebtednessoftheworkhavebeenpaid.AnyclaimfiledbyanypartyarisingfromthisAgreementwillbesufficientreasonfortheGENERALCONTRACTORtowithholdthepaymentduetheLABORCONTRACTOR.ARTICLEIX–GENERALPROVISIONDISPUTES–AnyactionbasedonthisAgreement,includingdisagreement,disputesregardingthetermsandconditions,allegedbreachesofcontract,remediesundercontract,shallbegovernedbythelawsoftheRepublicofthePhilippinesandshalladjudicatedexclusivelybyacourtofcompetentjurisdictioninPasigCity;ThefailureoftheGENERALCONTRACTORtoinsistuponthestrictperformanceofanyofthetermsandconditionshereofshallnotbedeemedanrelinquishmentorwaiverofanyrightsorremedythattheGENERALCONTRACTORmayhave,norshallitbeconstruedasawaiverofanysubsequentbreachordefaultofthetermsandconditionshereof,whichtermsandconditionsshallcontinuetobeinfullforceandeffect.NowaiverbytheGENERALCONTRACTORofanyofitsrightsunderthiscontractshallbedeemedtohavebeenmadeunlessexpressedinwritingandsignedbytheGENERALCONTRACTOR;Therightsofthepartyunderthisagreementarepersonalandcannotbeassignednortransferredtoanyotherperson,firm,corporation,oranyotherentitywithouttheproperwrittenconsentoftheotherparty;IfanyoftheprovisionsofthisAgreementisheldinvalidorunenforceable,suchinvalidityorunenforceabilityofthewholeagreement.Intheeventthatanyprovisionisheldinvalidorunenforceable,thepartiesheretoshallattempttoagreeonavalidandenforceableprovisionwhichshallbethesubstitutefortheinvalidorunenforceableprovisionandinsoagreeing,shallincorporatesuchsubstituteprovisioninthisagreement.LABORCONTRACTORshallexertitsbesteffortstocomplywithandperformallitsobligationsherein.Anyexpense,lossordamagetoGENERALCONTRACTORduetoLABORCONTRACTOR’sfailuretoperformitsobligationhereinshallbefortheaccountoftheLABORCONTRACTOR.Incaseofdefectsinworkmanshipormaterialswhichmaybecomeapparentinthecourseofconstruction,theLABORCONTRACTOR,upontherequestofGENERALCONTRACTORshallbeathisownexpense,withinThree(3)day,starttorepairand/orreplacesuchportionoftheworkdoneand/ormaterialsinstalledthataredefectiveornotinaccordancewithplansandspecifications.ExpensesincurredbyGENERALCONTRACTORtocorrectdefectsonGENERALCONTRACTORsuppliedmaterialsoranydamagesresultingfromdefectsinworkmanshipoftheSubcontractorshallbechargetotheSubcontractorandshallbedeductedfromanyamountduehim/her.IftheLABORCONTRACTORfailstomakeacceptableprogressinhisworks,orabandonhisworksorpersistentlyneglectshisobligations,heshall,uponRequestofGENERALCONTRACTOR,takenecessarymeasures,includingmobilizemoremanpowertocatchupwiththeschedule.IftheLABORCONTRACTORfailstocomplywiththerequirementinregardtotheconstructionschedule,GENERALCONTRACTORmay,aftergivingThree(3)daysofnoticeinwritingtotheLABORCONTRACTOR,underhiscontract,havetherighttotakeoverhisworksandmayitselfcompletethework,ormayemployanyotherindependentcontractortocompletetheworks.Ineitherevent,anyadditionalcostsanddamagesthatmaybeincurredbyGENERALCONTRACTORtocompletetheprojectinaccordancewiththespecificationsinthiscontractwillbechargedtotheLABORCONTRACTOR.TheworkerswhomaybeassignedtothesaidworksshallbesolelytheLABORCONTRACTOR’sownemployeesandtheirassignmentheretoshallnotcreateanyemployer-employeerelationshipbetweenGENERALCONTRACTORandthem.TheLABORCONTRACTORshallassignengineersorhisdesignatedrepresentativetosupervisetheworksandemployees.TheircompensationshallbetheLABORCONTRACTOR’sexclusiveresponsibility.TheLABORCONTRACTORholdsGENERALCONTRACTORfreefromanyliabilitytothesaidemployeesandtothirdpartiesforanydamagesorinjury,sicknessordeathcausedbytheperformanceoftheworkshereinspecified.TheLABORCONTRACTORshallobeytherulesandregulationsofthecompanyofGENERALCONTRACTOR,BESCandlocalgovernmentlaws.AnypermitforoutofworkingareashallbeappliedbythemselvesandatnochargetotheGENERALCONTRACTOR.Alltheinsurancerequiredbythegovernmentagencies,ProjectConsultantsandGENERALCONTRACTORshallbeappliedandshoulderedbytheLABORCONTRACTOR(CompleteGeneralLiabilityInsurance–CGLI).SuchinsurancedocumentsshallbesubmittedtotheGENERALCONTRACTOR.Allworkersshallbeuniformed.TheGENERALCONTRACTORshallprovidetheuniform,safetyhatandsafetybeltuponrequestandcostwillbechargedtotheLABORCONTRACTOR.ElectricandwaterforfieldofficewillbeprovidedbytheGENERALCONTRACTORfreeofcharge.TheLABORCONTRACTORshallcomplywithallexistingrules,safetymeasuresandfuturelaws,decrees,orders,rulesandregulationspromulgatedbytheauthoritiesandshallholdGENERALCONTRACTORfreefromanyobligationsorliabilitythatmayarisefromitsviolations.TheLABORCONTRACTORshallproperlyarrangeandstoreallthematerialsatsiteinanorderlyandneatmanner,soasnottoaffecttheproperimplementationoftheworks.TheLABORCONTRACTORisliablefortheitemswithdrawn/borrowedfromtheGENERALCONTRACTOR.TheLABORCONTRACTORagreesthatthecostofborrowedhandtools,machinesandotherequipmentswillbechargedtotheiraccountif
