We are ready to provide you with perfect managing services, and a fortable and pleasing environment of life.For your reference, this Manual explains the rules of management and introduces all available services, facilities and security conditions of this munity, to ensure that all owne
6、rs and residents shall be well informed of and be able to follow the rules.This Manual es into effect on the day when it is published. The purpose of this Manual is to promote the value of your property, to create a beautiful and fortable environment for your life, and is by no means to make any inc
7、onvenience to you. Therefore, please read this Manual and the Management Convention carefully. When necessary, this Manual is subject to revision by the Managing Party. In the event that this Manual contradicts the Management Convention in any aspect, the latter shall take the priority.Introduction
8、to PropertyHuashi Zaoyuan Garden is located in Chongwen District of Beijing, ranging between Nan Xiaoshikuo in the east, Wenqumennei Avenue in the south, Beijing Zhan Nan Street in the west and Dong Huashi Avenue in the North, covering an area of 82 thousand square meters, with a building area of 25
9、8730 square meters. The property is developed by Beijing Chenghe Real Estate Development General Co., Ltd. and constructed by Beijing Municipal Construction Group.Property ManagementRights and Obligations of Property ManagementThe Property Management Department under Beijing Huashi Zaoyuan Garden Pr
10、operty Management pany is in full charge of managing all affairs within the property of Huashi Zaoyuan Garden. Taking it as its responsibility to provide owners with high quality managing services, the Managing Party is entitled to hire employees, consultants, attorneys, construction units and worke
11、rs, etc. for purpose of management, and entitled to negotiate with relevant governmental departments on general issues concerning this property in behalf of the owners. The Property Managing Party has the absolute right to managing all the public facilities and public places of this property, and ha
12、s the right to caution against and correct customers acts of breach, and also has the right to proceed against any serious wrongdoers.Rights and Obligations of OwnersAny owner has the right to reside in and use his private premises, and holds the liability for interest of neighbors and the Managing
13、Party. Any owner shall be liable for injuries, damages or losses to others caused by default, breach, negligence or other undisciplined acts of such owner or any of his family member, employee or tenant. As stipulated by the Property Management, all owners and their family members and employees shal
14、l be obligated to provide their true personal information to the Managing Party.Managing StaffFor managing the munity of Huashi Zaoyuan Garden, Beijing Huashi Zaoyuan Garden Property Management pany has hired the managing staff, including but not limited to security guards, sanitation workers, equip
15、ment maintenance workers and gardeners. All members of this staff shall work under sole instructions by the Managing Party and shall not provide any private service to any owner. It is strictly forbidden for any member of this staff to receive any gift or other interests from any owner, for which we
16、 invite cooperation of your owners.Management FeesAs agreed, owners shall pay management fees, which are fully for management expenses for this property and include, but are not limited to:Security feePayments to security guards and their agentFees for life waste disposal and sanitationFees for offi
17、cesCharges for maintenance of public facilitiesFees for sanitation and planting of public placesFees for septic tank discharge and high-pressure pumpPayment to professional consulting paniesRemuneration for the Management panySalaries for staffOther feesThe rate of management fees are subject to adj
18、ustment at times, for increase or decrease, by the Managing Party in correspondence with factual level of expenses, revisions of state policies and price index fluctuations. Such adjustment is based on annual budget, and a notice in writing about the adjustment will be delivered to owners a month pr
19、ior to the adjustment.Date and Manner of PaymentInitial day of management fees is the sixteenth day after the developer delivers the handover notice. For each month after the initial day, payment should be made on or before the fifth day of the month, including the charges for water, power, gas, hea
20、ting and management fees, all in lump sum. (The amount will be specified in the Payment Notice delivered to owners by the Managing Party.) Payment can be made, either in cash or by check, directly to Financial Department of the Managing Party, with a receipt returned to the payer. Please note that,
21、as stipulated by the Managing Party, nobody shall aept any payments except Financial Department, which is the sole agent to handle payments.Late Payment PenaltyOwners are required to make their payments in time. Please be aware that our daily managing services survive on and are supported by such pa
22、yments. For any late payment, the Managing Party will charge the payer corresponding late fee and interest and, in such case, the Managing Party has the right to stop relating services a week after issuing a Notice of Payment, without any further notice. Also, when necessary, the Managing Party is e
23、ntitled to reveal the name of the default person, and reserves the right of legal action.Service Claim and plaintThe Managing Party is ready to recognize and acknowledge all well-founded service claim or plaint, which we deem as important stimulus to promote our management. Please deliver your plain
24、t/proposal in writing to the Managing Party.Property TransferIn the event of any change or transfer of property right, the original owner shall notify the Managing Party in writing about the change or transfer within a month after the date of such change or transfer, or otherwise the original owners
25、 payment liability shall be continued. Once the transfer is pleted, all rights and liabilities, including default payment, of the original owner are also transferred to the transferee. The new owner and his legal counsel are liable to confirm payment status of the original owner, and the Managing Pa
26、rty is willing to offer the new buyer relevant information about due payment of management fees, if any. Anyhow, once the transfer is pleted, all unpaid fees shall be at the new owners expenses.Addition and Modification to PropertyGovernmental ApprovalThe existing structure and layout of this proper
27、ty is approved by relevant department of Beijing municipal government, and any addition and/or modification to private property shall be determined not to contradict any of such governmental approval and shall be approved in writing by such relevant governmental department. Should any operations are
28、 conducted without such approval, the relevant owner shall be liable for all consequence or cost herein caused.Approval Procedure of Managing PartyOf any addition or modification, the design shall be presented for review and approval, before the operations start, to the Managing Party, which shall p
29、lete such review and approval in fifteen work-days (excluding the time necessary for governmental review and approval). The Managing Party reserves the right to terminate any unapproved operations.Circuit ModificationConsidering general safety of the property, please use a pany or person of professi
30、onal electric installation for any modification of your indoor circuits or electric appliances, and please follow all regulations concerning civil power utility issued by Power Supply Bureau. The Managing Party reserves the right to inspect such modifications in times to ensure general safety.Thief-
31、Proof Door and Thief-Proof Window GratingTo ensure the appearance integration, all thief-proof doors shall be of the style designated by the Managing Party, and all window gratings shall be installed at consent of the Managing Party and all other owners.Indoor FitmentAll modifications for fitment sh
32、all be confirmed not impacting the general structure of the property and shall be approved in writing by relevant departments and the Managing Party. Any modifications without necessary approval are subject to reconversion satisfying relevant authority, and any cost herein ours shall be at expenses
33、of the owner involved. The modifying owner shall be liable for all damages to public facilities caused by operation of such modifications. The rate of relating pensation shall depend on quotation by the Managing Party, or otherwise the owner shall, at his own option, repair it to a standard recogniz
34、ed by the Managing Party.Deposit and Fees for FitmentTo protect public facilities and equipments from being damaged by operations of any additions, modifications or fitting, and considering mon interest and safety of all owners, a necessary amount of deposit shall be paid for operations of such addi
35、tions or modifications. This deposit will be returned to the payer on pletion of the operations or, in the event of any damages to public facilities or equipment due to the operations, shall be partially or wholly used by the Managing Party for necessary repair.As stipulated by the Managing Party, a
36、ny construction team engaged shall pay an amount of deposit and cost for the temporary passes for the participating members of the team. On pletion of the operations, such construction team shall return the temporary passes, all together, to Administrative Office, from where the team shall get the a
37、mount of deposit back.Construction TeamAny construction team engaged on certain owners fitting job shall fill in a Form of Work Application, applying for temporary passes and vehicle entrance permits from the Managing Party, or otherwise no entrance to this property shall be allowed. Such constructi
38、on team shall abide by the following procedures and rules set by the Managing Party:The construction team shall inform the Managing Party of its starting date.Owner and construction team shall take necessary measures to protect public facilities and public places from any damage.Measures shall be ta
39、ken to protect the environment to prevent other owners from any harm such as dusts and noises.A first aid box shall be ready at the work site.Fire fighting equipment, fire extinguishers for example, shall be prepared at the work site. (At least two extinguishers of or above 5 kilograms.)All wastes g
40、enerated from the operations shall be moved away from the work site everyday.Work time shall be from 8:00 am to 6:00 pm on workdays from Monday to Friday. Operations are forbidden on such work days at the time of from 12:00 to 14:00 and of from 18:00 to 8:00 the next day, and on Saturdays, Sundays a
41、nd all statutory holidays. All overtime work must be approved in advance by the Managing Party.No construction refuses shall be located at any public roads or passages.Fire-fighting water outlets shall be used only for fighting fires, not for any other purposes.All members of the construction team s
42、hall ware proper clothes and shoes.All members of the construction team shall ware their temporary passes issued by the Managing Party.After work, all members of the construction team shall leave the work site immediately, and shall not wander about in the resident area, or the wanderer is subject t
43、o inquiry. The construction team shall inform the Managing Party in advance of any articles to move in or out. All equipment or articles moving out of this resident area shall be declared. The Managing Party reserves the right to inspect any person who goes out with any articles.All belongings of th
44、e construction team shall be in its own custody, and the Managing Party shall not be liable for any of such belongings.In operations, the construction team shall follow all safety and fire-control regulations set by Municipal Public Security Bureau and Municipal Fire Control Bureau.After work and be
45、fore leaving everyday, the construction team shall make sure, and assign someone to inspect, that all doors and windows well closed and that all water and power lines are well turned off.Should any events of fighting, or of insult to the security guard of the Managing Party while they are on normal
46、duty, are aroused within the above mentioned area by any members of the construction team, the Managing Party has the right to claim against the construction team and/or such members involved for any damages thus caused and the right to proceed against same.All members of the construction team shall
47、 absolutely neither steal any property from this resident area nor deliberately ruin any public facilities of this real estate, and any violators shall pensate those thus stolen or ruined at their real value, and all such violators who have brought any serious consequences shall be subject to punish
48、ment by law.Smoking and littering flammables are strictly forbidden at work site. When open fire or electric/acethlene welding are needed in operations, the construction team shall file for such open-fire operations in advance at Security Department of the Managing Party and shall follow the regulat
49、ions for open-fire operation. After each open-fire operation, the work site shall be cleared up, eliminating any hidden hazard.The fire control agent and Security Department are entitled to inspect fire-control conditions of the work site.Other Obligations of OwnerNoiseThe period of time between 8:0
50、0 am and 10:00 pm is the best for playing any music instruments or using any sound equipment, to keep a good environment for living and working and to avoid any interference to neighbors. The Managing Party is entitled to reasonable negotiation at other owners plaints.InsuranceThe Managing Party rem
51、ends that all owners/customers to cover insurances for their unit property or indoor belongings.Pet Raising (Including Poultry or Birds)Aording regulations set by Public Security Bureau, any pet raiser must holds permit. A copy of such permit shall be filed at the Managing Party. Customer shall not
52、raise any pets without prior consent in writing by the Managing Party. Any permitted animals walking within this munity must be leashed and led and limited within designated period of time, and shall not make any interference or inconvenience to others. Raising any poultry or birds is forbidden.Vehi
53、cles and TrafficAll owners shall follow the traffic regulations for this resident area. Each unit property can be granted with maximum two vehicle-entrance permits, which shall be shown at the front windshield of vehicle. Public Facilities and Public PlacesAll public facilities and public places are
54、 for owners public uses. For your mon interest, we request for your cooperation in keeping same clean and tidy and avoiding the following:Ruin to public facilities;Damage to public plants;Random litter;Random posting or graffito;Violent playing, cycling, rolling or any other activities liable to inj
55、ure others;Littering or keeping any articles at public places.Owners Servants and EmployeesAording regulations set by Public Security Bureau, all servants, including maids, teachers, drivers, cooks and employees, shall register at Public Security Bureau and the Managing Party, carrying with their re
56、levant ID.Water Supply OffDuring water supply intermit, be sure to turn off all water taps lest waste of water or unexpected waterlogging should happen when water supply is resumed. Owner shall be liable for any damages thus caused.Forbidden ActsAll acts dangerous to this property are forbidden. No
57、entrance to this munity shall be allowed for all inflammables, explosives, violent toxicants, effluvial substances, pollutants or any other prohibited articles.To avoid air pollution, all bustion generating thick smoke, effluvia or poisonous gas shall be forbidden.Water Supply and DrainageThe water
58、supply system of this property is designed to sanitary standard ensuring safety for this munity, therefore, please do not modify or add to any external water pipelines. Any modification to indoor water lines shall be approved in advance by the Managing Party and shall be performed by qualified profe
59、ssional pany, without impacting the entire water supply system within this munity.All the drainage system of this munity is of hidden type, for which dredging is plex and of high cost. Therefore, please be careful not to let any refuses or hard stuffs enter toilet bowl, bathtub, hand basin or sink.
60、In the event of any obstruction caused by carelessness, the owner concerned shall be liable for cost for relating repair.Security and Fire ControlGuardsSecurity guards are on sentry duty at all main entrances and patrol duty within this munity 24 hours everyday.
