2、eLawofthePeoplesRepublicofChinaonRoadTrafficSafetyChapterI.GeneralProvisionsArticle1ThepresentRegulationisformulatedinaccordaneewiththeLawofthePeoplesRepublicofChinaonRoadTrafficSafety(hereinafterreferredtoastheLRTS).Article2Allvehicledrivers,pedestrians,passengers,roadtrafficactivity-relatedentitie

3、sandindividualswithintheterritoryofthePeoplesRepublicofChinashallabidebythepresentLaw.Article3Thelocalpeoplesgovernmentsatthecountyleveloraboveshallestablishandperfecttheroadsafetycoordinationmechanism,organizetherelevantdepartmentstoevaluatetheimpactofurbanconstructionprojectsonthetraffic,formulate

4、anadministrativeplanningonroadtrafficsafety,determineanadministrativetargetandmakeanimplementationplan.ChapterIIVehiclesandDriversSection1MotorVehiclesArticle4Theregistrationsofmotorvehiclesshallbeclassifiedintoinitialregistration,modificationregistration,transferregistratomortgageregistrationandcan

5、cellationregistration.Article5Whenapplyingfortheinitialmotorvehicleplateordrivingpermit,anapplicantshallfileanapplicationtothetrafficadministrativedepartmentofthepublicsecurityorganwherethedomicileoftheownerofthemotorvehicleislocated.Whenapplyingfortheinitialmotorvehicleregistration,anapplicantshall

6、havethemotorvehiclecheckedandshallsubmitthefollowincertificatesandvouchers:Theidentificationproofoftheownerofthemotorvehicle;Thepurchaseinvoiceandotherproofsoftheprovenanceofthemotorvehicle;Theconformitycertificateissuedwhenthewholemotorvehicleleavesthefactoryortheimportdocumentationoftheimportemoto

7、rvehicle;Theproofofpaymentofvehiclepurchasetaxortax-exemptiondocumentation;Theproofofmandatorymotorvehiclethirdpartyliabilityinsuranee;Otherproofsandcertificatesprescribedbyanylaworadministrativeregulationtobesubmittedfortheregistrationofthemovehicle.Ifthetypeofthemotorvehicleisntonethatisexemptedfr

8、omsafetytechnicalinspectionaccordingtotheprovisionsoftheadministrativedepartmentformotorvehicleproductsoftheStateCouncil,theapplicantshallprovideaqualitycertificateofsafetechnicalinspectionapartfromtheabove-mentionedcertificationandproofs.Article6Wherearegisteredmotorvehicleisunderanyofthefollowingc

9、ircumstances,theownerofthemotorvehicleshallfileaapplicationtothetrafficadministrativedepartmentofthepublicsecurityorgan,inwhichthismotorvehiclehasbeenregistered,modifyingtheregistration:Thecolorofitsbodyischanged;Itsengineischanged;Itsbodyorframeischanged;Thewholemotorvehicleischangedbythemanufactur

10、erduetoanyqualityproblem;Thecommercialoperatingmotorvehicleischangedtonon-commercialoperatingmotorvehicleorviceversa;orTheownerofthemotorvehiclehasmovedintooroutofadomicilewithinthejurisdictionofthetrafficadministrativedepartmofthepublicsecurityorgan.Whenapplyingformodificationregistrationofamotorve

11、hicle,theapplicantshallsubmitthefollowingcertificatesandproofs.IfmotorvehicleisunderanyofthecircumstancesaslistedinItertterough5)oftheprecedingparagraph,theapplicantshallhavethemotorvehiclecheckedapartfromsubmittingthefollowingcertificatesandproofs;ifthemotorvehicleisunderthecircumstanceaslistedinIt

12、ei2)(or(3)oftheprecedingparagraph,theapplicantshallsimultaneouslysubmittheconformitycertificateuponsafetytechnicalinspectionaswell:Theidentificationproofoftheownerofthemotorvehicle;Themotorvehicleregistrationcertificate;andThemotorvehicledrivingpermit.Wheretheownerofamotorvehiclechangeshisdomicilewi

13、thinthejurisdictionofthetrafficadministrativedepartmentofthepusecurityorgan,thenameoftheowner(entity)orcontactway,heshallreporttothetrafficadministrativedepartmentofthepublisecurityorgan,inwhichthemotorvehiclehasbeenregistered,forarchivalpurposes.Article7Wheretheownershipofaregisteredmotorvehicleisc

14、hanged,thepartiesconcernedshalldulygothroughthetransferregistrationformalities.Whenapplyingfortransferregistration,thepartiesconcernedshallhavethemotorvehicleinspectedbythetrafficadministrativedepartmentofpublicsecurityorganwherethemotorvehicleisregistered,andshallsubmitthefollowingcertificatesandpr

15、oofs:Theidentificationproofsofthepartiesconcerned;Thecertificateorproofofthetransferoftheownershipofthemotorvehicle;Themotorvehicleregistrationcertificate;andThemotorvehicledrivingpermit.Article8Wheretheownerofamotorvehiclemortgagesthemotorvehicle,he(she)shallfileanapplicationformortgageregistration

16、tothetrafficadministrativedepartmentofthepublicsecurityorganwherethemotorvehiclehasbeenregistered.Article9Wherearegisteredmotorvehiclemeetsthemandatorydiscardstandardsofthestate,thetrafficadministrativedepartmentofthepublicsecurityorganshallinformtheownerofthemotorvehiclethatheshallgothroughtheforma

17、litiesforcancellationregistrationtwomonthsbeforethediscardperiodexpires.Theownerofthemotorvehicleshallsellthemotorvehicthecorrespondingrecyclingenterprise,whichshallsubmitthediscardedmotorvehicleregistrationcertificate,plate,drivingperrtothetrafficadministrativedepartmentofthepublicsecurityorganforc

18、ancellation.Iftheownerofthemotorvehiclefailstogothroughtheformalitiesforcancellationregistrationwithinthetimelimit,thetrafficadministrativedepartmentofthepublicsecuriorganshallannouncethattheregistrationcertificate,plateanddrivinglicenseofthismotorvehiclearenullandvoid.Whereanapplicationforcancellat

19、ionregistrationduetolossordamagetothemotorvehicle,theownerofthemotorvehicleshasubmithis(her,its)ownidentificationprooftothetrafficadministrativedepartmentofthepublicsecurityorganaswellasthemovehicleregistrationcertificate.ArticlelOWheretheproofsandcertificatessubmittedbyanapplicantformotorvehiclereg

20、istrationarecompleteandvalid,theformalitiesforregistrationshallbecompletedbythetrafficadministrativedepartmentofthepublicsecurityorganonthespot.Withregardtoamotorvehicleseizedordetainedbythepeoplescourt,peoplesprocuratorateoradministrativelawenforcemedepartment,thetrafficadministrativedepartmentofth

21、epublicsecurityorganshallrefusetoregisterthemotorvehicle.Article11Wheretheownerofmotorvehicleappliesforanewregistrationcertificate,plateordrivingpermitbecausetheformeroneislostordestroyed,heshallsubmithisidentificationproofandapplicationmaterialstothetrafficadministrativedepartmentthepublicsecurityo

22、rgan.Uponverifyingagainsttheregisteredfilesofthismotorvehicle,thetrafficadministrativedepartmentothepublicsecurityorganshallissueanewregistrationcertificate,plate,drivingpermittotheapplica5tckayisiifromthedaywhentheapplicationisreceived.Article12Thetaxdepartmentorinsuranceinstitutionmay,inacentraliz

23、edway,handlethemotor-vehicle-relatedtaxpaymentsorconclusionofinsurancecontractsattheofficeofthetrafficadministrativedepartmentofpublicsecurityorgan.Article13Theplateofamotorvehicleshallbefixedatthespecifiedplacesofthefrontandbackofthemotorvehicle,andshallkeptclearandcomplete.Anenlargedplatenumbersha

24、llbepaintedatthebackofthebodyorcontainerofaheavylorry,medium-typetruckortractoranditstrailer,thelettersshallbestandardandclear.Themotorvehicleconformityinspectionmarkandtheinsurancesignshallbestuckontheuppercorneroftherightofthefrontwindowofthemotorvehicle.Anymark,sign,oradvertisementpaintedonthebod

25、yofamotorvehicleshallnotaffectthesafetyofdriving.Article14Aroadpassengerautomobile,heavylorryorsemi-trailertractorshallbeequippedwithoruseadrivingrecordinstrumentthatmeetsthestandardsofthestate.Thetrafficpolicemayexaminethedrivingspeed,consecutivedrivingtimeancotherdrivinginformationofmotorvehicles.
