1、合同订立原那么平等原那么：根据?中华人民共和国合同法?第三条：“合同当事人的法律地位平等，一方 不得将自己的意志强加给另一方的规定，平等原那么是指地位平等的合同当事人， 在充分协商达成一致意思表示的前提下订立合同的原那么。这一原那么包括三方面内 容：合同当事人的法律地位一律平等。不管所有制性质，也不问单位大小和经济 实力的强弱，其地位都是平等的。合同中的权利义务对等。当事人所取得财产、 劳务或工作成果与其履行的义务大体相当；要求一方不得无偿占有另一方的财产， 侵犯他人权益；要求禁止平调和无偿调拨。合同当事人必须就合同条款充分协 商，取得一致，合同才能成立。任何一方都不得凌驾于另一方之上，不得把

2、自己的 意志强加给另一方，更不得以强迫命令、胁迫等手段签订合同。自愿原那么：根据?中华人民共和国合同法?第四条：“当事人依法享有自愿订立合同的权 利，任何单位和个人不得非法干预的规定，民事活动除法律强制性的规定外，由 当事人自愿约定。包括：第一，订不订立合同自愿；第二，与谁订合同自愿，；第 三，合同内容由当事人在不违法的情况下自愿约定；第四，当事人可以协议补充、 变更有关内容；第五，双方也可以协议解除合同；第六，可以自由约定违约责任， 在发生争议时，当事人可以自愿选择解决争议的方式。公平原那么：根据?中华人民共和国合同法?第五条：“当事人应当遵循公平原那么确定各方 的权利和义务的规定，公平原那

3、么要求合同双方当事人之间的权利义务要公平合理 具体包括：第一，在订立合同时，要根据公平原那么确定双方的权利和义务；第二， 根据公平原那么确定风险的合理分配；第三，根据公平原那么确定违约责任。 老实信用原那么：根据?中华人民共和国合同法?第六条：“当事人行使权利、履行义务应当遵 循老实信用原那么的规定，老实信用原那么要求当事人在订立合同的全过程中，都要 老实，讲信用，不得有欺诈或其他违背老实信用的行为。设备维修效劳协议接受效劳方甲方：提供效劳方乙方：一、设备细目及合同期内的维修效劳费用设备名称品牌型号数量维修服务合计合计二、合同期限以先到为准自年月日始，至年月日止；三、付款方式1效劳费用按年度支

4、付，先付费，后效劳2合同期内发生的其它费用在乙方提供效劳完毕后5 个工作日内，由甲方向乙方一次性支付。四、效劳内容1乙方应甲方要求对甲方的设备进行维护保养；每壹个月 壹次。2合同期内，乙方接到甲方的维修呼叫后及时上门修复合 同设备在正常使用情况下所发生的一般故障。3乙方以对合同用户的优惠价格向甲方提供合同设备所需 使用的耗材及零配件，并免费送货。五、除外责任以下情况乙方向甲方提供满意的效劳，需照章收费：1甲方违反操作标准所造成的机器及附件的故障；2甲方在运输、保管本机及附件时方法不当造成的震动损 伤、受潮、受热引起的故障；3由于火灾、水灾，地震、电网电压不稳定及其它自然灾 害等非人为原因造成的

5、设备损坏；4甲方自行拆卸机体及部件造成的设备损坏；5因非乙方提供的消耗材料、零部件等而造成的设备损坏；6甲方未能出示本效劳合同的有效原件。六、违约处理1因乙方不能及时履行合同所规定的效劳条款，并对甲方 工作造成严重延误时，甲方有权终止合同。2因乙方工作失误导致甲方设备损坏，乙方应赔偿甲方相 应零件并负责修复工作。3甲方未能按本合同条款 3 的规定及时付款时，乙方可解 除合同并保存追缴甲方欠款的权利。4甲方允许非乙方技术人员维修、维护、拆卸设备及附件 或造成设备损坏，本合同自行作废。七、说明1本合同中所述的“工作小时是指法定工作日的9： 00-17：00 时段内的每一小时。2甲方的名称、地址、

6、、指定设备负责人等资料如有 变更，请及时通知乙方否那么将会造成甲方利益的损失。3如甲方所在地非 市区且乙方上门效劳时发生差旅费、高速费、过桥费等费用时，上述费用由甲方支付。4如甲方将设备转与他人，本效劳合同中乙方对该设备的 效劳承诺既告无效。5如有未尽事宜，甲乙双方应在合同签字前进行协商，达 成一致后一式两份填写在附加条款中，填写内容与本合同具有同等效 力。6本维修合同效劳费用只涵盖本合同第 4 款' 效劳内容 ' 所 涉及的劳务，并不包括维修过程中发生的零配件及消耗品费用。八、附加条款双方已就本合同的上述条款完全达成共识，任何一方的口头 要求均不能影响本合同条款的效力。甲方：

10、nce， but payment should becharged correspondingly ：1Disobey the direction of operation manual by the users ；2Damages in transportation and preservation by customer himself ；3Damages caused by fire ， water flood ， earthquakes ， unsteady of power and other natural disasters4Party A disassembles the ma

11、chine and spare parts by himself ；5Breakdown caused by fake consumable and spare parts provided by other companies ；6Party A failed to provide effective original of this contract.6Breach1Party A has the right to terminate the contract and claim the Service Fee back in the condition Party B fails to

12、execute this contract and influence the normal work of Party A ；2Party B should compensate and repair the equipment due to the damage caused by himself；3Party B has the right to terminate the contract and claim the payment owed by Party A if Party A does not fully execute the Clause 3 of this contra

13、ct；4This contract would be automatically terminated in the condition the damages caused of repair ， maintenance ， dissemble etc. by the third party permitted by Party A.7Note1'Working Hours' mentioned above means any hour during 9 ：00am-17： 00pm in every legal working day；2Any information al

14、ternation of Party A， such asname， address ， telephone ， contact ， etc. should inform Party B in time ， otherwise the benefit of Party A would be damaged；3Party A should afford all expenses occurred on the way when Party B provides service outside Shanghai downtown；4The warranty made by Party B in t

15、his contract would become ineffective if Party A transfer the equipment to any other third party；5Other issues which should be negotiated before signature added as appendix in Clause 9， the appendix hasthe same effectiveness to the other conditions of this contract ；6The Service Fee mentioned above only includes the serviced in Clause 4， not include the cost of sparep
