53、单位履行合同的主要依据监理单位如何履行监理合同,如何落实业主委托监理单位所承担的各项监理服务工作,作为监理的委托方,业主不但需要而且应当了解和确认监理单位的工作。同时,业主有权监督监理单位全面、认真执行监理合同。而监理规划正是业主了解和确认这些问题的最好资料,是业主确认监理单位是否履行监理合同的主要说明性文件。2建筑工程监理规划编写的依据监理规划是在项目总监理工程师和项目监理机构充分分析和研究建筑工程的目标、技术、管理、环境以及参与工程建设的各方等方面的情况后制定的。监理规划要真正能起到指导项目监理机构进行监理工作的作用,监理规划中就应当有明确具体的、符合该工程要求的工作内容、工作方法、监理措

54、施、工作程序和工作制度,并应具有可操作性。(1)工程建设方面的法律、法规工程建设方面的法律、法规具体包括三个层次:一是国家颁布的有关工程建设的法律、法规和政策,这是工程建设相关法律、法规的最高层次;二是工程所在地或所属部门颁布的工程建设相关的法规、规定和政策;三是工程建设的各种标准、规范,工程建设的各种标准、规范也具有法律地位,也必须遵守和执行。(2) 政府批准的工程建设文件政府批准的工程建设文件包括两个方面:一是政府工程建设主管部门批准的可行性研究报告、立项批文;二是政府规划部门确定的规划条件、土地使用条件、环境保护要求、市政管理规定。(3) 建筑工程监理合同在编写监理规划时, 必须依据建筑

56、监理的内容要求。建筑工程监理的主要内容是控制建筑工程的投资、工期和质量,进行建设工程合同管理,协调有关单位间的工作关系。这些内容无疑是构成监理规划的基本内容。归纳起来,监理规划基本构成内容应当包括:目标规划、项目组织、监理组织、目标控制、合同管理和信息管理。施工阶段监理规划统一的内容要求应当在建设监理法规文件或监理合同中明确下来。(2)具体内容应具有针对性监理规划基本构成内容应当统一,但各项具体的内容则要有针对性。这是因为,监理规划是指导某一个特定建筑工程监理工作的技术组织文件,它的具体内容应与这个建筑工程相适应。由于所有建筑工程都具有单件性和一次性的特点,也就是说每个建筑工程都有自身的特点,而且,每一个监理单位和每一位总监理工程师对某一个具体建设工程在监理思想、监理方法和监理手段等方面都会有自己的独到之处,因此,不同的监理单位和不同的监理工程师在编写监理规划的具体内容时,必然会体现出自己鲜明的特色。(3)监理规划应当遵循建筑工程的运行规律监理规划是针对一个具体建筑工程编写的, 而不同的建筑工程具有不同的工程特点、工程条件和运行方式。这也决定了建筑工程监
