上海市房屋租赁合同商品房预租Lease Agreement本合同双方当事人:Two Parties of this agreement: 出租方(甲方): Lessor (party A): 承租方(乙方):Lessee (party B):根据中华人民共和国合同法、上海市房屋租赁条例(以下简称:条例)的规定,甲、乙双方在平等、自愿、公平和诚实信用的基础上,经协商一致,就乙方承租甲方可依法 出租 的 房屋 事宜,订立本合同。 According to The Contract Law of Peoples Republic of China, and the Regulation of Shanghai municipality on lease of Urban House (hereinafter referred to as: Regulation), Party A and Part B through negotiation, have executed this Contract in the matters of leasing the Premises legally owned by Party A to Party B. This Contract is based upon the principles of equality willingness, equity and good faith. 一、出租或预租房屋情况One、The situation of leasing or pre-leasing Premises:1-1 甲方出租给乙方的房屋座落在本市水城路16弄8号楼302室。该房屋出租(【出租】实测)建筑面积为 平方米,土地用途为 居住 ,房屋类型为 、结构为 。该房屋的平面图见本合同附件(一)。1-1 The Premises leased to Party B by Party A locate at Room302 , Building 8 , Lane 16 Shui Cheng Road , Shanghai .The building area of the Premises (leasing) actual measure is square meters, the usage of the land is for residential purposes, the type of the Premises is , the construction is . The floor plan of the Premises is attached have as appendix (one). 1-2甲方作为该房屋的 与乙方建立租赁关系。签定本合同前,甲方已告知乙方该房屋 设定抵押。1-2 Party A regards as builds up the relationship of leasing with Party B. Before signing the contract Party A has already informed Party B the Premises set collateralize.1-3该房屋的公用或合用部位的使用范围、条件和要求;现有装修、附属设施、设备状况和甲方同意乙方自行装修和增设附属设施的内容、标准及需约定的有关事宜,由甲、乙双方分别在本合同附件(二)、(三)中加以列明。甲、乙双方同意该附件作为甲方向乙方交付该房屋和本合同终止时乙方向甲方返还该房屋的验收依据。1-3 The use range condition and requirement Premises common places; the present decoration、attached facilities、the decoration and the content standard and other relevant of the decoration and attached facilities increased by Party B, which is agreed by Party A, shall be listed in appendix (2), (3) by Party A and Party B. Party A and Party B both agree that this appendixes shall be considered as the inspection record when Party A hands over the Premises to Party B and when Party B returns the Premises to Party A upon completion of this leasing term in accordance with this Contract.二、租赁用途Two、Usage of The Premises2-1乙方向甲方承诺,租赁该房屋作为 居住 使用,并遵守国家和本市有关房屋使用和物业管理的规定。2-1 Party B promises to Party A that the Premises is only for residential purposes , and shall obey the relevant state and local regulations about use and the management of the housing.2-2乙方保证,在租赁期内未征得甲方书面同意以及按规定须经有关部门审批而未核准前,不擅自改变上述约定的使用用途.2-2 Party B promises that it shall not change the usage of the Premises without getting the written consent of Party A and the approval of the related department according to the terms herein during the Leasing term. 三、交付日期和租赁期限Three、Delivery date and leasing term3-1甲乙双方约定,甲方于 年 月 日前且合同补充条款第一条规定的首月租金和保证金到达甲方指定账户后向乙方交付该房屋。【出租】房屋租赁期自 年 月 日起至 年 月 日止。甲方需在房屋交付日前做好各项整修及清洁工作。3-1 Both Parties agree that Party A shall hand over the Premises to Party B before after Party A received the first monthly rental and deposit. Leasing the leasing Term is commenced from to . All maintenances and cleaning works have to be finished before the Check-in Day.3-2租赁期满,甲方有权收回该房屋,乙方应如期返还。乙方需继续承租该房屋的,则应于租赁期满前两个月,向甲方提出续租书面要求,经甲方同意后签订租赁合同。3-2 Party A shall have the right to take back the Premises from Party B and Party B shall return the Premises to Party A on time upon the expiration of leasing term. Party B shall apply for extension in writing to Party A two (2) months before the expiration if Party B intends to continue the lease, the new lease contract shall be signed after getting Party As approval.四、租金、支付方式和期限Four、Rent, Payment Method and term4-1甲、乙双方约定,该房屋每日每平方米建筑面积租金为( / 币) / 。【出租】月租金总计为( 人民 币) 元(大写: / 万 / 仟 / 佰 / 拾元 / 角整)。4-1 The two Parties agree that the rent of one square meter for one day is ( / ) / . Leasing the monthly rent is ( RMB ) .该房屋租金 1 年内不变。自第2 年起,双方可协商对租金进行调整。有关调整事宜由甲、乙双方在补充条款中约定. The rent shall not be changed within one years. The rent should be increased or decreased from the second year. The relevant matters on adjusting shall be specified in the supplementary clause by both parties. 4-2乙方应于每月 15日前向甲方支付租金。逾期支付的,每逾期一日,则乙方需按月租金的 0.5 %支付违约金。4-2 Party B shall pay the rent before the 15th day of each month to Party A. Party B shall pay the overdue payment fine equivalent to 0.5 % of the monthly rent, payable for each day from the date on which the amount was due until the fulfillment of the payment.4-3乙方支付租金的方式如下: 详见补充条款。 4-3 The payment method of the rent is as follows: Refer to Appendix. 五、保证金和其他费用Five、Security Deposit and other Fees5-1甲乙双方约定,甲方交付该房屋时,乙方应向甲方支付房屋租赁保证金,保证金为 贰 个月的租金,即( 人民 币) 元5-1Both Parties agree that Party B shall pay Party A security deposit when Party A handing over Premises. The security deposit is two(2) months rent ( RMB ) .5-2租赁期间,使用该房屋所发生的水、电、天然气、通讯、等费用由 乙方 承担。5-2 During the leasing term, Party B shall be responsible for the full payment of the Premises of the costs water, electricity, natural gas and communication. 5-3 乙方 负责支付的上述费用,计算或分摊办法,支付方式和时间:详见补充条款。5-3 The count, way of the share, payment method and date of the paid fee are: Refer to Appendix. 六、房屋使用要求的维修责任Six、The responsibilities on Repair of the Premises6-1租赁期间,乙方发现该房屋及其附属设施有损坏时,应及时通知甲方修复;甲方应在接到乙方通知后 叁 日内进行维修。逾期不维修的,乙方可代为维修,费用由甲方承担。6-1 During the leasing term, Party B shall inform Party A to repair in the event that the damage to the Premises or facilities is occurred. Party A shall repair it within three(3) day after receiving the notice. In Case Party A fails to repair the damage on time, Party B can repair it instead of Party A and the Party A shall be responsible for the fees. 6-2 租赁期间,乙方应合理使用并爱护该房屋及其附属设施。因乙方使用不当或不合理使用,致使该房屋及其附属设施损坏或发生故障的,乙方应负责维修。乙方拒不维修,费用由乙方承担。6-2 Party B shall take good care of and reasonably use the Premises and attached facilities during the leasing team. Party B shall be responsible for the immediate repair or compensation for the damage to the Premises or facilities due to Party Bs improper use.6-3租赁期间,甲方督促物业管理公司保证该房屋及附属设施处于正常的使用和安全的状态。甲方对该房屋进行检查、养护,应提前 壹 日通知乙方。检查养护时,乙方应予以配合。甲方应减少对乙方使用该房屋的影响。6-3 Party A shall guarantee that the Premises shall be under the condition of usable and safety during the leasing term. Party A shall notice Party B one (1) day in advance while repairing maintenance Premises. Party B shall assist or cooperate with Party A . Party A shall reduce the influence of Party Bs using of the Premises.6-4 除本合同附件(三)外,乙方另需装修或者增设附属设施和设备的,应事先征得甲方的书面同意,按规定须向有关部门审批的,则还应由 甲方委托乙方 报请有关部门批准后,方可进行。乙方增设的附属设施和设备归属及其维修责任由甲、乙双方另行书面约定. 6-4 If Party B intends to make renovations or changes to the original facilities apart from the appendix (3) of this contract, Party B shall do so only after obtaining the written consent of Party A. Party B shall be able to carry out the said project only after going through the application formalities to the related department in accordance with the relevant regulations. The ownership and responsibilities of repairing the accessory equipment shall be stipulated at some other time by Party A and Party B.七、房屋返还时的状态Seven、The state of the returned Premises7-1 除甲方同意乙方续租外,乙方应在本合同的租期满后的 当 日内返还该房屋,未经甲方同意逾期返还房屋的,每逾期一日,乙方应按 / 元平方米(币)向甲方支付该房屋占用费。(详见补充条款)7-1 Except that Party A agrees Party B extends this contract, Party B shall return the Premises at the expiration of the leasing term. In case Party B fails to do, so Party B shall pay / per day per meter square meter for the occupation fee of the Premises.(Refer to Appendix.)7-2 乙方返还该房屋应当符合正常使用后的状态。返还时,应经甲方验收认可,并相互结清各自应当承担的费用。7-2 The Premises shall be in the normal statement. While returning, the Premises shall be checked for acceptance and the two parties shall pay up the charges ought to be borne by each other.八、转租、转让和交换Eight、Subletting, transfer and exchange8-1除甲方已在本合同补充条款中同意乙方转租外,乙方在租赁期内,需事先征得甲方的书面同意,方可将该房屋部分或全部转让给他人。但同一间居住房屋,乙方不得部分或同时转租给二个或二个以上的承租人。8-1 Party B shall be allowed to sublet the premises in part or in whole to third Party only after getting Party As written consent during the leasing term unless Party A authorizes Party B to sublet the Premises in the Supplementary Agreement made by Party A and Party B. Party B shall not sublet the same Premises in part or sublet the Premises to more than two other Persons.8-2乙方转租该房屋,应按规定与受租方订立书面合同的转租合同并按规定向该房屋所在区、县房地产交易中心或农场系统受理处办理,登记备案。8-2 When Party B sublets the Premises, Party B shall conclude written subleasing Contract with the sub lessee and register in the premises transaction center of district/country or acceptance bureau of farm system where the premises locate in accordance with regulations.8-3在租赁期内,乙方将该房屋转让给他人承租或与他人承担的房屋进行交换,必须事先征得甲方书面同意。转让或交换后,该房屋承租权的受让人或交换人应与甲方签定租赁主体变更合同并继续履行本合同。8-3 During leasing term, Party B shall not sublease the premises to third Party or exchange it with third Party unless a written consent from Party A has be granted. After subletting, the successor of the lease right of the Premises shall execute a principal part alteration contract with Party A and continue to fulfill this contract.8-4在租赁期内,甲方如需出售该房屋,应提前三个月通知乙方。乙方放弃优先购买权。转让后,甲方应保证受让人与乙方签定租赁主体变更合同并继续履行本合同。8-4 During leasing term, Party A shall inform Party B three(3) months in advance , Party B gives up the right of preemption. After property transaction, Party A shall guarantee the successor of the property shall execute a principal part alternation contract with Party B and continue to fulfill this contract九、解除本合同的条件Nine、 conditions to terminate the Contract9-1甲、乙双方同意在租赁期内,有下列之一的,本合同终止,双方互不承担责任。9-1 During the leasing term, the contract shall be terminated when any of the following condition occurs and two parties shall not be responsible for each other.(一)该房屋占用范围内的土地使用权依法提前收回的;(a) The right to the use of land on which the Premises locate be legally taken back in advance;(二)该房屋因社会公共利益或城市建设需要被依法征用的;(b) The Premises be taken back for the need of public interest or the citys construction;(三) 该房屋毁损、灭失或者被鉴定为危险房屋的;(c) The Premises be damaged, missing or be authenticated as dangerous Premises;9-2甲、乙双方同意,有下列情形之一的,一方可书面通知另一方解除本合同。违反本合同的一方,应向另一方按月租金的 两 倍支付违约金;给对方造成损失的,支付的违约金不足抵付一方损失的,还应赔偿造成的损失与违约金的差额部分:9-2The both sides agree that One Party shall inform the other Party in written to terminate the Contract under the following conditions. The defaulting Party shall pay to the other Party the liquidated damages equivalent to two(2) times of the monthly rent. If the financial losses incurred to the other Party exceed the amount of the liquidated damages, the defaulting Party shall compensate the deficiency.(一)甲方未按时交付该房屋,经乙方催告后 拾伍 日内仍未交付的;(a) Party A fails to deliver the Premises on schedule and fails to do so within fifteen(15) days after reception of Party Bs summon exhortation. (二)甲方交付的该房屋不符合本合同的约定,致使不能实现租赁目的的;或甲方交付的房屋存在缺陷,危及乙方安全的。(b) The Premises Party A delivered be not in accordance with the agreement of Contract which leads to fail to fulfill the aim of the rent. Or the Premises be defective to endanger the safety of Party B.(三)乙方未征得甲方书面同意改变房屋用途,致使房屋损坏的;(c) Party B transforms the usage of the Premises without the written agreement of Party A which damaged the Premises;(四)因乙方原因造成房屋主体结构损坏的;(d) The damage of main structure of the Property caused by Party B;(五)乙方擅自转租该房屋、转让该房屋承租权或与他人交换各自承租的房屋的;(e) Party B sublets the Premises or the right of the tenancy or exchange the Premises with others without Party As consent;(六)乙方逾期不支付租金累计超过 壹 个月的; (f) Party B fails to pay the rent on schedule for longer than one(1) month; 十、违约责任Ten、Liabilities for Breach of contract10-1该房屋交付时存在缺陷的,甲方应自交付之日起的 拾 日内进行修复,逾期不修复的,甲方同意减少租金并变更有关租金条款。 10-1 if the Premises has defect when delivering, Party A shall repair the Premises within ten(10) days. If Party A fails to repair it, Party A agree to reduce the rent and change the related items of the rent clause.10-2因甲方未在本合同中告知乙方,该房屋出租前已抵押或产权转移已受到限制,造成乙方损失的,甲方应负责赔偿。10-2 Party A shall be fully responsible for any damages or losses to Party B if Party A has not informed Party B the Premises had been pledged or the transfer of the property right had been limited in the contract.10-3租赁期间,甲方不及时履行本合同约定的维修、养护责任,致使房屋损坏,造成乙方财产损失或人身伤害的,甲方应承担赔偿责任。 10-3 during leasing term, Part A shall pay for the loss or any bodily harm to party B caused by the damage of the Premises resulting from Party A failing to perform the responsibilities for repair and maintenance stipulated in the contract.10-4租赁期间,非合同的情况甲方擅自解除本合同,提前收回该房屋的,甲方应按提前收回天数租金的 两 倍向乙方支付违约金。若支付的违约金不足抵付乙方损失的,甲方还应负责赔偿。10-4 If Party A terminates the contract and takes back the Premises in advance for causes other than contract during leasing term, party A shall pay the liquidated damages equivalent to two(2) times of the daily rental left of the Premises to Party B. should the liquidated damages not to be enough to pay for Party Bs loss, Party A shall be responsible for the deficiency.10-5乙方未征得甲方书面同意或者超出甲方书面同意的范围和要求装修房屋增设附属设施的,甲方可以要求乙方恢复房屋原状。10-5 If Party B renovates and installs additional facilities in the leased Premises without the approval of Party A, Party A has the right to request Party B to restore the Premises to its original state.10-6租赁期间,非本合同规定的情况,乙方中途擅自退租的,甲方可没收乙方的保证金,不足抵付甲方损失的,乙方还负责赔偿。10-6 If Party B terminates the contract and gives back the Premises in advance for causes other than Contract during leasing term, Party A shall seizure the security deposit and if the security deposit not to be enough to pay for Party As loss, Party B shall be responsible for the deficiency.十一、其他条款Eleven、Others terms11-1租赁期间,甲方需抵押该房屋,应当书面告知乙方。11-1 During leasing term, if Party A needs to mortgage the Premises, Part A shall inform Party B with written notice. 11-2本合同未尽事宜,经甲、乙双方协商一致,可订立补充条款。本合同补充条款及附件均为本合同不可分割的一部分,本合同及其补充条款和附件内空格部分填写的文字与铅印文字具有同等效力。11-2 Party A and B shall make the supplementary agreements for the unaccounted term of this agreement through negotiation between Party A and B. all supplementary terms in the agreement and attachment shall be integral parts of the contract the written words filled in the blank of supplementary terms and attachments in the contract shall be of equally authentic with the printed words of the original lease contract.11-3甲、乙双方在签署本合同时,对各自的权利、义务、责任清楚明白,并愿按本合同规定索赔。如一方违反本合同,另一方有权按本合同规定索赔。11-3 Party A and B shall be totally aware of his rights, duties, and responsibilities when signing the contract. If any party breaches the contract, the other party shall have the right to claim for damages in accordance with the terms of this contract.11-4甲、乙双方就履行本合同发生纠纷,应通过协商解决;协商解决不成的,双方同意选择下列第 (二) 种方式解决:11-4 Any dispute arising out during the performance of the contract shall be resolved by friendly consultations, if an amicable agreement cannot be reached, Party A and Party B agree to solve the dispute by the way (b).(一)、提交 / 仲裁委员会仲裁;(a). Submit the dispute to / Arbitration Commission(二)、依法向人民法院起诉。(b)Submit the dispute to People s Court.11-6本合同连同附件一式 三 份。其中:甲方执一份、乙方执一份, 一份,均具有同等效力。11-6 this Contract together with the attachment has three (3) originals among which each party keeps one or two, shall keep one. All the originals have the same effect. 本合同自签字生效。The contract shall come into effect subject to signing 补 充 条 款Appendix1. 在本合同签订后的 拾 天内,乙方应向甲方支付首月租金及相当于 贰 个月租 金的保证金,合计为RMB (大写:人民币 )。其中保证金为RMB (大写:人民币 元整);首月房屋租金RMB (大写:人民币 元整),包括双人俱乐部卡, 物业管理费,宽带安装费。在乙方支付上述首月租金及保证金后,甲方向乙方交付该房屋。若上述首月租金及保证金到达甲方指定账户时间迟于合同第3-1条规定的房屋交付时间的,甲方实际交付房屋时间为上述首月租金及保证金到达甲方指定账户后第二日。 1. Within ten (10) days of the signing of this Formal Tenancy Agreement, Party B shall pay to Party A a security deposit equivalent to an amount of two (2) months rental and the first Rental, the total is RMB . The Security Deposit is RMB Only and the first Monthly Rental is RMB ; including Mgt. Fee, ADSL installation fee, couple club membership card. And Party A shall hand over the Premises to Party B after Party A received the first monthly rental and deposit. In case of delaying of above payments later than the date stated in Clause3-1, the actual date when the premises being handed over from Party A to Party B should be the second day after the payments being transferred to Party As designed bank account.上述款项中保证金、首期租金,合计为RMB (大写:人民币 圆整)支付到甲方指定的空房租金帐号。租金包含会所使用费,垃圾清运费,虫害管理及其他相关管理费用。Party B shall pay the security deposit,the first Monthly Rental in total of RMB120000 to House Rental Account. The rental should include club facility, trash management, pest control, and other management fees.2. 乙方以人民币方式支付该房屋租金。人民币租金帐号收 款 人: 人民币帐号: 开户银行:2. Party B shall pay the Rental to Party A in Ren Min Bi:In Favor of: RMB Account Number: Bank Name: 乙方应支付给甲方的上述保证金及租金,系为实际到达甲方帐户的金额。甲方在收到乙方支付的上述保证金及房屋租金后应于10日内向乙方开具房屋保证金收据、空房租金、家具租赁费正式发票及甲方指定的物业管理公司开具的物业管理费正式发票。The real sum paid by Party Bs account should be same with the rental regulated in contract.After Party A received the security deposit and the Rental from Party B, within 10 days Party A shall issue the security deposit receipt, House Rental invoice, the Furniture Rental invoice and the property management company designated by Party A shall issue the official Management Fee invoice and to Party B.3.乙方在租赁期限内,房屋内使用的水、电、天然气及通讯等费用每月按实际使用帐单支付,按帐单规定的时间和地点支付给相对应的部门或公司,或委托物业管理公司代办。Party B shall pay the Water, Electricity, Gas and Communication fee to related department according to the bill. Or ask Property Management Company to do it.4.本合同7-1条内容增补、修改后为:“除甲乙同意乙方续租外,乙方应在本合同的租期届满后的 当 日内返还该房屋,未经甲方同意逾期返还房屋的,每逾期一日,乙方应向甲方支付原日租金 1.5 倍的违约金。若支付的违约金不足抵付甲方损失的,乙方还应负责赔偿。移交该房屋时,甲、乙双方应共同对该房屋进行检查,确认乙方未损毁房屋结构及其附属设施(包括家具、家电)。4. Changes and additions to Clause 1 in Article 7 of the Agreement: Party B shall return the Premises to Party A in time
