劳 动 合 同Labor Contract甲方(用人单位):Party A (employer) :性质:有限责任公司Property : Limited Liability Company地址:Address:乙方Party B(劳动者Laborer)姓名Name_性别Gender_年龄Age_身份证号ID No._家庭住址Home Add._联系电话Contact No._根据劳动合同法和国家有关规定,甲乙双方经平等协商一致,自愿签订本合同,共同遵守本合同条款:According to the labor contract law and the relevant provisions of the state, through equal consultation between both parties agreement, sign this contract voluntarily, abide by the terms of this contract一、劳动合同期限Term of the Labor Contract本合同期限类型为_期限合同The type of the contract is _ contract(填“有固定或无固定”其中一项)( Fulfill terminable or dateless )。本合同期限为_年The term of the contract is _ years,自_年_月_日起至_年_月_日止。from _ to _. 双方约定的试用期至_年_月_日止,期限为3个月。The two sides agreed probation period ends on _, 3 months duration. 表现优异者,甲方可缩短试用期,但不能少于1个月。For the outstanding laborer, the probation period can be shortened by Party A, but no less than 1 month.以完成一定工作为期限:Based on a fixed working term: 从_年_月_日起,到任务完成时止。starting from _ until the task is finished.二、工作内容和义务Job Content and Responsibility1、乙方同意根据甲方工作需要, According to Party As demand, 在部门,从事_(管理、销售、技术、生产、后勤等)工作,并遵守岗位工作制度与合理的工作安排(包括但不限于工作内容、工作地点)。Party B agrees to engage in _ (management/sales/technology/manufacture/logistics etc.) work in the department and abide by the work system and reasonable work arrangement. (Included but unlimited to job content & working place.)2、乙方应当按照甲方岗位职责要求,保质保量完成工作任务;According to Party As post responsibility requirement, Party B should finish working task with quality and quantity guaranteed.3、甲方本着“一专多能、一职多岗”的用人原则,可以根据经营需要及乙方的工作能力调整乙方的工作职务和岗位,乙方应服从安排。Based on the principle of “one skill with multiple ability, one post with multiple work”, and according to the business demand and Party Bs competence, Party A may adjust Party Bs duty and post, while Party B should obey the adjustment. 三、劳动保护和劳动条件Labor Protection & Labor Condition1、甲方根据国家有关安全生产、劳动保护、职业卫生的规定,为乙方提供必要的工作条件和劳动保护设施,保障乙方的安全与健康;According to the related stipulation of safety manufacture/labor protection/occupational health from the state, Party A provides necessary working condition and labor protection facilities, insuring Party Bs safety and health.2、甲方根据国家有关规定制定工时制度,乙方确因生产经营需要延时的,甲方应当依法安排乙方补休或支付相应的加班费;若乙方实行的是级别工资,则在当月的绩效考核中体现;According to the relevant regulations of working hour system,if Party B needs to extend the working hours due to the need of production and operation, party A shall arrange party B compensatory time off or pay overtime salary in accordance with the law; If party B is implemented wage levels, the compensation should be reflected in the performance appraisal for the month.3、甲方根据国家有关规定为孕期、产期、哺乳期的女职工提供劳动保护;Party A should provide protection for women workers in pregnancy, childbirth, breastfeeding, in accordance with the relevant provisions of the State.4、甲方负责对乙方进行政治思想、职业道德、业务技术、劳动安全卫生及有关规章制度的告知、教育和培训。Party A is responsible to provide political ideology, professional ethics, business technology, labor safety and hygiene, and related rules, education and training for Party B.四、劳动报酬 Labor remuneration根据“按劳分配”原则,实行同工同酬,乙方的报酬不得低于当地最低工资标准。具体薪酬标准、支付方式以及支付时间按公司制定的薪酬管理制度执行。According to the principle of distribution, and equal pay for equal work, remuneration of Party B shall not be lower than the local minimum wage standard. Specific compensation standards, payment, and time is set by the “the system of compensation management” by the company 五、社会保险 Social Insurance甲方应按照国家有关社会保险的法律、法规和政策为乙方缴纳基本养老、基本医疗、失业、工伤、生育保险费用;社会保险费个人缴纳部分,甲方从乙方工资中代扣代缴。In accordance with national laws, regulations and policies relating to social insurance, Party A shall pay the basic pension, basic medical, unemployment, work injury and maternity insurance costs, for the Party B; social insurance premiums paid by individuals part is withhold wages from Party B.六、劳动纪律和规章制度 Labor discipline and regulations1、甲方依法制定的劳动纪律和规章制度,乙方有义务遵守;Labor discipline and regulations legally stipulated by party A, party B shall have the duty to abide by it.2、签订本合同前,甲方已对乙方进行了劳动纪律、操作规程、管理制度等相应的培训;Before signing this contract, Party A has to provide party B the labor discipline, operating procedures, management system and the corresponding training3、乙方应当遵守甲方的工作操作规程,服从工作安排;Party B shall abide by the working procedures, obey the work arrangement of party A.4、乙方违反劳动纪律或规章制度,甲方有权按本单位的规章制度,给予纪律处分,直至解除本合同。If Party B violates labor discipline or regulations, Party A is entitled by the rules of the unit to give Party A disciplinary action, up to terminate this contract.七、劳动合同的变更 The change of labor contract订立本合同所依据的客观情况发生重大变化,致使本合同无法继续履行的,经双方协商同意,予以变更劳动合同相关内容。If the objective situation this contract based on, changes significantly, to result the contract unable to perform, by mutual consent, related content in labor contracts shall be changed.八、劳动合同的解除The remove of labor contract(一)双方协商一致,劳动合同可以解除。The two party may terminate the labor contract with mutual agreement.(二)乙方有下列情形之一的,甲方可以即行解除劳动合同:Of any of the following circumstances, party A may immediately terminate the labor contract.1、在试用期内被证明不符合录用条件的;Been proven not to meet the conditions of employment during the trial period.2、采取欺诈手段订立本合同的;Adopted fraudulent means to enter into this contract.3、严重违反劳动纪律或规章制度给甲方造成重大损害的;Seriously violated labor discipline or regulations to cause significant harm to the Party A.4、严重失职、营私舞弊,或泄露甲方商业秘密,给甲方利益造成重大损失的;Gross negligence, malpractice, or disclosure of trade secrets Party A, to cause heavy losses to the interests of the Party A.5、乙方同时与其他用人单位建立劳动关系,对完成本单位的工作任务造成严重影响,或者经用人单位提出,拒不改正的;Party A built labor relationships with other unit, to cause a serious impact on the completion of the tasks of the unit, or refused to correct the rules made by the employer 6、被依法追究刑事责任的。Be investigated for criminal responsibility according to law(三)有下列情形之一的,甲方可以提前30日以书面形式通知乙方解除劳动合同:Of the following circumstances, Party A can give notice to inform Party B to terminate the labor contract ahead of 30 days.1、乙方不能胜任工作,经培训或调整工作岗位仍不能胜任工作的;Party B is not competent for work, after training or adjustment of jobs.2、乙方患病或者非因工负伤,医疗期满后,不能从事原工作,也不能从事甲方另行安排工作的;Party B was ill or injured due to non-work relation, after completion of medical, Part A is not competent for his original work, or alternative arranged jobs.3、劳动合同订立时所依据的客观情况发生重大变化,致使劳动合同无法履行,双方协商不能就变更劳动合同达成协议的。If the objective situation this contract based on, changes significantly, to result the contract unable to perform, mutual consent can not be reached, in change of this labor contracts.(四)有下列情形之一的,甲方可以提前30日通知工会,经工会同意后,与乙方解除劳动合同:Of the following circumstances, Party A can give notice ahead of 30 days, to inform the Labor Union, after agreement, Party A may terminate the labor contract.1、甲方依照企业破产法规定进行重整的;Party A restructured pursuant to the Enterprise Bankruptcy Law2、甲方生产经营发生严重困难的;Production and business operation of Party A met serious difficulties.3、甲方转产、重大技术革新或者经营方式调整,经变更劳动合同后,仍需裁减人员的;production, technological innovation or business method of Party A adjusted, after the change of labor contracts, still needed to reduce staff.4、其他因劳动合同订立时依据的客观经济情况发生重大变化,致使劳动合同无法履行的。If other objective situation this contract based on, changes significantly, to result the contract unable to perform.(五)乙方有下列情形之一的,甲方不得解除劳动合同:Of any of the following circumstances, party A can not terminate the labor contract.1、在本单位患职业病或者因工负伤并被确认丧失或者部分丧失劳动能力的;Injured due to occupational disease or work-related reasons, and was confirmed as having lost or partially lost the ability to work.2、患病或者非因工负伤,在规定的医疗期内的;Illness or non-work related injury within the prescribed period of medical treatment.3、女职工在孕期、产期、哺乳期的;women workers in pregnancy, childbirth, breastfeeding.4、在本单位连续工作满十五年,且距法定退休年龄不足五年的;Worked continuously for 15 years and less than five years away from his legal retirement age In this unit.5、法律、行政法规规定的其他情形。Other circumstances stipulated by laws and administrative regulations.(六)乙方解除劳动合同,应当提前三十日(试用期内提前三日)以书面形式通知甲方,甲方在乙方完成业务以及清理完债权债务的情况下,可以解除劳动合同。Of the following circumstances, Party B shall give notice to inform Party A to terminate the labor contract ahead of 30 days after cleaning up the credits and debts.(七)有下列情形之一的,乙方可以通知甲方解除劳动合同: Of the following circumstances, Party B may give notice to inform Party A to terminate the labor contract.1、在试用期内的;During the trial period.2、甲方以暴力、威胁或者非法限制人身自由的手段强迫劳动的;Party A forced Party A to labor by violence, threat or illegal restriction of personal freedom. 3、甲方未按劳动合同约定提供劳动保护和劳动条件的;Party A failed to provide the labor protection and labor conditions.4、甲方未按照劳动合同的约定支付工资报酬的;Party A failed to pay wages in accordance with the labor contract.5、法律、行政法规规定劳动者可以解除劳动合同的其他情形。Other circumstances stipulated by laws, administrative regulations by which employee may terminate the labor contract.九、劳动合同的终止Termination of labor contracts(一)有下列情形之一的,劳动合同即行终止:Of any of the following circumstances, the labor contract may be immediately terminate1、劳动合同期满的;The labor contract expired.2、劳动者开始依法享受养老保险待遇的;Workers began to enjoy endowment insurance treatment lawfully.3、劳动者死亡,或者被人民法院宣告死亡或者宣告失踪的;Laborer died, or was declared dead or missing by the peoples court.4、甲方被依法宣告破产的;Party A was declared bankrupt by the peoples court5、甲方被吊销营业执照、责令关闭、撤销或者提前解散的;Business license of Party B was revoked, ordered to close, cancellation or early dissolution of.6、法律、行政法规规定的其他情形。Other circumstances stipulated by laws, administrative regulations.(二)乙方应在劳动合同期满前30天通知甲方,甲方同意续订,乙方应及时申请办理续订手续;若甲方不同意续订,到期即办理终止合同手续。乙方未办理终止合同手续而离职的,甲方保留追究其法律责任的权利。Party B shall give notice to inform Party A to renew the labor contract ahead of 30 days. If Party A disagreed to new a lease, the labor contract would go expire. If Party B left without the termination procedures, Party A would retain right to pursue its legal responsibility.十、违反劳动合同的责任Breach of duty of the labor contract(一)赔偿经济损失Compensation for economic losses甲方有下列情形之一,给乙方造成经济损失的,应当承担赔偿责任:Of any the following circumstances, party A shall be liable for compensation of the economic losses of party B.1、由于甲方制定的劳动合同条款无效的;Since Labor Party established the terms of the invalid contract;2、违反劳动合同法规定的条件解除劳动合同的。Conditions in violation of the provisions of the “Labor Contract Law “to terminate the labor contract.乙方有下列情形之一,给甲方造成经济损失的,还应当承担赔偿责任:Of any the following circumstances, party B shall be liable for compensation of the economic losses of party A.1、乙方违反劳动合同法规定的条件或者劳动合同的约定解除劳动合同,给甲方造成经济损失的,应当按照损失的程度,承担赔偿责任;Party B violated the conditions in the Labor Contract Law or terminated the labor contract to cause the economic losses of party A, Party B shall be liable for compensation of the economic losses of party A.2、乙方违反劳动合同约定的保密事项,给甲方造成经济损失的,应当依法承担赔偿责任;Confidential matters Party violations of labor contract, causing economic losses to the Party shall be liable for compensation according to law.3、乙方在合同期内严重违反甲方的有关规章制度、操作规程给甲方造成损失或致甲方聘用的其他劳动者人身损害的,由乙方根据责任的大小负责赔偿。In the contract period, if Party B caused serious violations of relevant rules and regulations of the Party, procedures, or caused losses, or causes personal injury of other workers employed by the Party A. Party B shall pay compensation in accordance with the size of the responsibility.(二)违约金 Penalty1、甲方为乙方提供专项技能培训,乙方违反培训协议,须向甲方支付违约金;Party A shall provide special skills training for Party B. If Party B violated training protocol, Party B shall pay liquidated damages to Party A.2、甲方对乙方实施了竞业限制,乙方违反竞业限制条款,须向甲方支付违约金。Party A implemented the non-competition for the Party B. If it is violated, Party B shall pay liquidated damages十一、双方约定条款 Agreed Terms by two Parties(一)甲方采取了保密措施保护的商业秘密,乙方负有保密义务;Party A has taken measures to protect the confidentiality of trade secrets, Party B has the confidentiality obligations.(二)甲方可以就保密的内容、范围和地点,双方的权利义务,保密期限,违约责任以及竞业限制条款等与乙方签订协议;Party A can sign with Party on confidentiality in content, scope and location of the rights and obligations of both parties, the confidentiality period, and breach of contract and non-compete clause.(三)若乙方在甲方是从事过管理、经营、技术工作的,在离开甲方两年以内,不得在本行业内其它企业工作,不得泄露甲方的生产、经营秘密;If Party B is engaged in the management, operation, technical work. After leaving the party in less than two years, Party B can not work in other companies in this industry, and shall not divulge production, business secrets of Party A.
