Schedule 光明高新园区公共服务平台建筑工程设计招标具体步骤和时间安 排如下： The schedule of tendering for architecture design of Guangming Hi-tech Park Public Service Platform is as follows: 12010 年 12 月 27 日发布公告，接受设计单位（含联合体，下同） 报名，截止时间：2011 年 1 月 10 日 17：00（北京时间，下同）。 8.1 An announcement shall be made on December 27, 2010 to receive the application by the design units (including unities, the same below), the deadline of the application shall be at (Beijing time, the same below) 17:00 on January 10, 2011. 22011 年 1 月 12 日，主办单位原则上挑选不超过 10 家自愿自费 参加本次咨询活动的报名设计单位（含联合体），并以传真或邮件方式 通知。 8.2 On January 12, 2011, the sponsor shall in principle select no more than 10 design unit applicants (including the unities) making inquiries voluntarily at their own cast, the selected ones shall be notified by fax or email. 32011 年 1 月 14 日召开发标会，发放招标文件和相关资料，并 组织初步现场踏勘。自招标文件发出后一周内，通过传真或邮件的形 式组织答疑。 8.3 On January 14, 2011, hold the tender invitation meeting, distribute the tender invitation document and relevant materials, organize the initial site survey. Qualification requirements 1本次招标接受联合体报名，要求联合单位不超过两家，且其中 一家为在深圳市注册的常设机构，并具有建筑设计甲级资质并可在深 圳市出具施工图； 9.1 The unity may be the applicant for tendering, the unity shall consist of no more than 2 units, one of which shall be a permanent body registered in Shenzhen with qualification A for architecture design and can issue the construction drawing in Shenzhen; 2国外设计单位必须具有同类项目经验，并要求在中华人民共和 国境内具有独立的办事机构； 9.2 The foreign design unit shall have experience in similar projects, and have independent working body in PRC; 3参与本次活动的设计人员应为设计单位的在册人员，主创设计 师必须由设计单位主持过多项同类型设计项目的人员担任，该设计师 必须直接参与设计全过程；设计团队中应包含绿色建筑方面设计人员。 9.3 The designers of this project shall be the registered staff member of the design unit, the main designer shall be the staff member of the design unit who has led several similar design projects, shall directly participate in the whole design process, the design staff shall include those for green architecture. 十、投十、投标标文件的要求文件的要求 10. Requirements for tender documents 1设计方案必须符合有关城市规划与建筑设计规范的规定，满足 本项目设计任务书要求，表达方式必须做到完整、清晰、准确； 10.1 The design must agree with relevant laws and regulations on city planning and architecture design, meet the requirements of design task document of this project, the expression of the design must be complete, clear, and accurate; 2投标文件必须按招标文件要求进行签章方为有效； 10.2 The tender documents must be sealed pursuant to the requirements of the tender invitation documents to be effective; 3所有参加招标的设计机构只能报送一个方案； 10.3 10.3 All the design units tendering for this project shall submit only one proposal; 4投标文件必须按时一次交齐，并满足招标文件对投标文件的要 求，但有下列情形之一者，视为不合格投标文件： 10.4 The tender documents shall be submitted fully once on time, and meet the requirements of the tender invitation documents for the tender documents, the following tender documents shall be deemed unqualified: （1）投标文件逾期送达或者分次提交； （2）投标文件交付后，更改投标文件的内容； （3）投标文件没有按要求签字、盖章； （4）投标文件不符合招标文件要求，包括成果内容不全、字迹模糊、 粗制滥造等； （5）投标作品非原创、已经发表过或 2/3 以上评委认为与其它同类 设计方案雷同的； （6）将设计任务转包或私拉其他机构设计人员完成的设计方案； (1) Tender documents overdue or submitted by several times; (2) Tender documents the content of which is altered after the submission of the same; (3) Tender documents without the required signature or seal; (4) Tender documents disagreeing with the requirements of the tender invitation documents, such as incomplete content, illegible writing, or design work prepared in a rough and slipshod way; (5) The design product not prepared originally, or having been published, or deemed by more than 2/3 of the judges to be similar to other similar designs; (6) Design proposal prepared by subcontracting the design task or by the designers of other units secretly employed without approval; 5不合格的投标文件，主办方不予支付任何费用 10.5 The sponsor shall pay no fee for the unqualified tender documents. 十一、十一、评审办评审办法法 11. Evaluation method 1专家评审采取暗标的形式，评审专家委员会对投标文件进行系 统的评审和比较，评审基本内容为招标文件和设计任务书中要求的内 容。 11.1 The tenders to be evaluated by the experts shall be sealed, the evaluation expert committee shall evaluate and compare the tender documents systematically, the content of the evaluation shall be that specified in the tender invitation documents and design task document. 2评审工作由评审委员会负责。评审委员会将安排多媒体方案介 绍和专家讨论。评审委员会在认真研究每个设计单位的投标文件和充 分讨论比较的基础上，以投票方式进行评选。 11.2 The evaluation committee shall be responsible for the evaluation, and arrange multimedia proposal introduction and expert discussion, and after seriously studying and fully discussing and comparing the tender documents of each design unit, make evaluation by vote. 3. 评审专家委员会将采用两轮投票方式评选出三个优选方案，第 一轮投票每位评委限投六张选票，选出票数最多的前六名，第二轮再 对已选出的六个方案进行投票，每位评委限投三张选票，以票数最多 的前三名为优选方案。若出现因票数相同而不能选出前六名或前三名 的情况时，则对相同票数的两（多）个方案进行第二（多）轮的投票，得 票数多者胜出。 11.3 The Evaluation expert committee shall select 3 optimum proposals by 2 votes, in the first vote, each judge is limited to 6 votes, the top 6 vote winners shall be left for the second vote; in the second vote, each judge is limited to 3 votes, the top 3 vote winners shall be the optimum proposal. If the top 6 or 3 winners can not be selected due to the same vote number, the 2 or more proposals with the same vote number shall go through a vote or votes again, the one getting more votes shall win. 4主办单位将评审专家委员会评选出的三个优选方案上报深圳 市光明新区管理委员会，由深圳市光明新区管理委员会最终确定中标 方案并由主办单位正式对外公布。中标方案一旦确定，原则上初步设 计、施工图设计将不再另行招标，直接由中标方案的投标单位承接。 11.4 The sponsor shall submit the 3 optimum proposals selected by the evaluation expert committee to Shenzhen Guangming District Administration Committee, which shall finally determine the successful tender which shall then be published by the sponsor officially. Upon the determination of the successful tender, the initial design and construction drawing design shall not be subject to tender invitation separately, but shall be directly done by the tenderer with the successful proposal. 十二、十二、奖奖金及成本金及成本费费用用 12 Prize and cost 1本次建筑方案设计征集活动采用一次性评审确认的方式，从符 合成果内容要求的方案中评出三个优选方案，三个优选方案不分名次， 奖金均为 20 万元； 12.1 The architecture design determination through evaluation shall be made once, 3 optimum proposals shall be selected from the proposals agreeing with the content requirement of the design, such 3 proposals shall be in the same order, a prize of 200 thousand yuan shall be granted for each proposal; 2被邀请的投标单位所提交的设计成果符合成果要求的，可获得 15 万元人民币的设计成本费作为工作补偿，提交的成果文件不符合要 求的，不能获得设计成本补偿费； 12.2 If the design product submitted by the tenderer specifically invited agree with the requirements of the design, such tenderer may get a design compensation of RMB 150 thousand yuan, otherwise it shall not get such compensation; 3非邀标单位没有设计成本补偿费，在自愿自费参加本次活动的 前提下，投标发生的各类费用自理，但与其他单位具有同等的机会获 得相应的奖金； 12.3 The units invited generally shall not be entitled to the design compensation, if it participates in this project voluntarily, it shall bear the various fees and expenses for the tendering, but shall have the equal opportunity to get the corresponding prize; 4本次招标的奖金及设计成本补偿费将在主办方正式公布评审 结果后 30 个工作日内支付； 12.4 The prize and the design compensation of this project shall be paid within 30 business days after the sponsor has published the evaluation result officially; 5设计单位人员的差旅费、设计费等费用自理，以上奖金的税金 自理； 12.5 The travel fee and expense fee of the staff of the design unit, and the tax on the above prize shall be borne by the design unit; 6以上由主办单位支付的奖金和费用均以人民币方式支付。 12.6 The above prize and compensation payable by the sponsor shall be paid in RMB. 十三、版十三、版权问题权问题及法律及法律 13. Copyright and law 1.所有参加本次招标的设计成果的设计署名权归投标单位所有， 版权归主办单位所有，主办单位有权在设计审定后公开展示设计成果， 并通过传播、媒介、专业杂志、书刊及其它形式介绍、展示、评价设计 方案。所有投标文件在评审后不退回投标单位； 13.1 The right of signature on the design product of this project shall belong to the tenderer, the copyright of the same shall belong to the sponsor which shall after the determination of the design be entitled to display the design product publically, and introduce, display, and evaluate the design proposal by distribution, media, professional magazines, books etc. Any tender documents shall not after evaluation be returned to the tenderer; 2.主办单位有权无偿使用招标的设计成果，有权使用设计成果中 的合理要素，有权在评审结束后公布评审成果，并通过传媒、专业杂志、 专业书刊或其它形式介绍、展示设计作品及评价设计作品； 13.2 The sponsor shall be entitled to use the design product of this project free, use the reasonable factors of such product, publish the evaluation result after evaluation, and introduce, display and evaluate the design product by media, professional magazines, books, etc. 3.设计成果中的所有内容均由参与设计单位原创，不得包含任何 侵犯第三者知识产权的材料。如发生侵权行为，将由侵权方承担一切 后果并取消侵权方参加本次招标活动的资格； 13.3 All the content of the design product shall be created by the design unit originally, and shall not infringe the IPR of any third party. Any person shall not without authorization copy, adapt, distribute, publish, lend, or transfer the same, legal responsibilities shall be borne by the violator if any; 5.公证：本次招标活动将在公开、公正、公平的原则下进行； 13.5 Notarization: this tendering shall be open, fair, and just; 6.使用法律：本次招标规则受中华人民共和国法律管辖，咨询工作 和所有文件使用中国法律。若发生争议，经协商不成时，双方同意提交 中国国际经济贸易仲裁委员会深圳分会按照其仲裁规则在深圳对争议 进行仲裁。仲裁结果为最终裁决，对双方当事人均有约束力； 13.6 Governing laws: this tendering, the consultation on and documents for the same shall be governed by laws of PRC.
