中英文借款协议一、协议双方出借人（Lender）：姓名：[出借人姓名]地址：[出借人地址]联系方式：[出借人电话/邮箱]借款人（Borrower）：姓名：[借款人姓名]地址：[借款人地址]联系方式：[借款人电话/邮箱]二、借款金额与用途1.借款金额（LoanAmount）出借人同意向借款人提供借款，借款金额为人民币[大写金额]元整（小写：￥[具体金额]）。InthisAgreement,theLenderagreestoprovidealoantotheBorrowerintheamountof[amountinChinesecapitalletters]Yuan(infigures:￥[specificamount]).2.借款用途（PurposeoftheLoan）借款人承诺将该借款用于[具体用途]，不得挪作他用。TheBorrowerundertakestousetheloanfor[specificpurpose]andshallnotuseitforanyotherpurposes.三、借款期限1.借款期限（LoanTerm）本借款期限自[起始日期]起至[到期日期]止，共计[借款期限时长]。Thetermofthisloanshallmenceon[startdate]andendon[duedate],withatotaldurationof[loantermduration].2.借款展期（LoanExtension）如借款人需要延长借款期限，应在借款到期日前[X]个工作日书面通知出借人。出借人有权根据自身情况决定是否同意展期。如同意展期，双方应另行签订展期协议。IftheBorrowerneedstoextendtheloanterm,itshallnotifytheLenderinwriting[X]workingdayspriortotheduedateoftheloan.TheLenderhastherighttodecidewhethertoagreetotheextensionaccordingtoitsowncircumstances.Iftheextensionisagreed,thetwopartiesshallenterintoaseparateextensionagreement.四、借款利息与还款方式1.借款利息（LoanInterest）本次借款的利息为年利率[X]%。利息从借款发放之日起计算，按[付息周期]支付。Theinterestrateforthisloanis[X]%perannum.Theinterestshallbecalculatedfromthedateofloandisbursementandpaidinaccordancewiththe[interestpaymentperiod].2.还款方式（RepaymentMethod）借款人应按照以下方式还款：TheBorrowershallrepaytheloaninthefollowingmanner:在借款期限届满时，一次性偿还全部借款本金及利息。Upontheexpirationoftheloanterm,theBorrowershallrepaytheentireprincipalandinterestoftheloanatonetime.具体还款账户信息如下：Thespecificrepaymentaccountinformationisasfollows:开户银行：[开户银行名称]BankName:[nameofthebankwheretheaccountisopened]账户名称：[账户持有人姓名]AccountName:[nameoftheaccountholder]账号：[银行账号]AccountNumber:[bankaccountnumber]五、双方权利与义务1.出借人权利与义务（RightsandObligationsoftheLender）权利（Rights）有权按照本协议约定收取借款本金、利息及其他相关费用。TheLenderhastherighttocollecttheprincipal,interestandotherrelevantfeesinaccordancewiththeprovisionsofthisAgreement.有权对借款人的借款使用情况进行监督和检查。TheLenderhastherighttosuperviseandinspecttheuseoftheloanbytheBorrower.义务（Obligations）按照本协议约定的时间和方式向借款人提供借款。TheLendershallprovidetheloantotheBorroweratthetimeandinthemannerstipulatedinthisAgreement.对借款人提供的相关信息予以保密，但法律法规另有规定或因履行法定职责需要披露的除外。TheLendershallkeepconfidentialtherelevantinformationprovidedbytheBorrower,exceptasotherwiseprovidedbylawsandregulationsorasrequiredfortheperformanceoflegalduties.2.借款人权利与义务（RightsandObligationsoftheBorrower）权利（Rights）有权按照本协议约定使用借款。TheBorrowerhastherighttousetheloaninaccordancewiththeprovisionsofthisAgreement.义务（Obligations）按照本协议约定的时间、金额和方式偿还借款本金及利息。TheBorrowershallrepaytheprincipalandinterestoftheloanatthetime,amountandinthemannerstipulatedinthisAgreement.向出借人提供真实、准确、完整的身份信息、财务状况信息及其他相关信息。TheBorrowershallprovidetheLenderwithtrue,accurateandpleteidentityinformation,financialstatusinformationandotherrelevantinformation.如借款用途发生变更，应提前书面通知出借人，并取得出借人的书面同意。Ifthereisachangeinthepurposeoftheloan,theBorrowershallnotifytheLenderinwritinginadvanceandobtainthewrittenconsentoftheLender.六、违约责任1.若借款人未按照本协议约定的时间和方式偿还借款本金及利息，应按照未偿还金额的每日[X]%向出借人支付逾期违约金。逾期超过[X]天的，出借人有权采取以下措施：IftheBorrowerfailstorepaytheprincipalandinterestoftheloanatthetimeandinthemannerstipulatedinthisAgreement,itshallpayoverdueliquidateddamagestotheLenderatarateof[X]%perdayoftheoutstandingamount.Iftheoverdueperiodexceeds[X]days,theLenderhastherighttotakethefollowingmeasures:宣布借款提前到期，要求借款人立即偿还全部借款本金及利息。DeclaretheloantobedueinadvanceandrequiretheBorrowertoimmediatelyrepaytheentireprincipalandinterestoftheloan.通过法律途径追讨借款，由此产生的一切费用（包括但不限于诉讼费、律师费、差旅费等）由借款人承担。Recovertheloanthroughlegalmeans,andallexpensesarisingtherefrom(includingbutnotlimitedtolitigationfees,attorneyfees,travelexpenses,etc.)shallbebornebytheBorrower.2.若出借人未按照本协议约定的时间和方式向借款人提供借款，应按照未提供金额的每日[X]%向借款人支付违约金。IftheLenderfailstoprovidetheloantotheBorroweratthetimeandinthemannerstipulatedinthisAgreement,itshallpayliquidateddamagestotheBorroweratarateof[X]%perdayoftheamountnotprovided.七、争议解决如双方在本协议履行过程中发生争议，应首先通过友好协商解决；协商不成的，任何一方均有权向有管辖权的人民法院提起诉讼。IncaseofanydisputearisingduringtheperformanceofthisAgreementbetweenthetwoparties,theyshallfirstresolveitthroughfriendlynegotiation.Ifthenegotiationfails,eitherpartyhastherighttoinitiatelegalproceedingsinthepeople'scourtwithjurisdiction.八、其他条款1.本协议自双方签字（或盖章）之日起生效，一式两份，双方各执一份，具有同等法律效力。ThisAgreementshalleintoforceasofthedateofsignature(orseal)ofbothparties.Itismadeintwocopies,witheachpartyholdingonecopy,andbothcopieshavethesamelegaleffect.2.本协议未尽事宜，可由双方另行签订补充协议。补充协议与本协议具有同等法律效力。FormattersnotcoveredinthisAgreement,thetwopartiesmayenterintoasupplementaryag
