Witheffectfrom26January2005,MemberStatesshallnot,ongroundsrelatingtodevicesforindirectvision,— refusetograntECtype-approvalornationaltype-approvalofavehicleoradeviceforindirectvision,— prohibitthesale,registrationorentryintoserviceofvehiclesordevicesforindirectvision,ifthevehiclesordevicesforindirectvisioncomplywiththerequirementsofthisDirective.2. Witheffectfrom26January2006,MemberStatesshallrefusetograntECtype-approvalforanynewtypeofvehicleongroundsrelatingtothedeviceforindirectvisionorforanynewtypeofdeviceforindirectvision,iftherequirementsofthisDirectivearenotfulfilled.However,thisdateshallbepostponedby12monthsasregardstherequirementsconcerningaclassVIfrontmirrorasacomponentanditsinstallationonvehicles.3. Witheffectfrom26January2006,MemberStatesshallprohibitthenationaltype-approvalforanynewtypeofvehicleongroundsrelatingtothedeviceforindirectvisioniftherequirementsofthisDirectivearenotfulfilled.Howeverthisdateshallbepostponedby12monthsasregardstherequirementsconcerningaclassVIfrontmirrorasacomponentanditsinstallationonvehicles.4. Witheffectfrom26January2010forvehiclesofcategoriesM1andN1,andwitheffectfrom26January2007forallvehiclesofothercategories,MemberStates:— shall consider certificatesof conformitywhichaccompanynewvehiclesinaccordancewiththepro-visionsofDirective70/156/EECtobenolongervalidforthepurposesofArticle7(1)ofthatDirective,(1)Directive2001/85/ECoftheEuropeanParliamentandoftheCouncilof20November2001relatingtospecialprioritiesforvehiclesusedforthecarriageofpassengerscomprisingmorethaneightseatsinadditiontothedriver’sseat(OJL42,13.2.2002,p.1).共120页第5页中文OfficialJournaloftheEuropeanUnion2004年1月29日欧洲共同体委员已采用本指令：第1条本指令的目的是为了协调间接视野装置以及安装了这些装置的车辆的型式认证。本指令的附件包含这些条例。对于本指令，“车辆”指的是指令70/156/EEC的附件II第A部分所定义的任一机动车。第2条1. 从2005年1月6日生效之日起，成员国不应以用于间接视野的装置为理由，— 拒绝为车辆或用于间接视野的装置发放欧共体型式认证或国内型式认证。— 禁止车辆或间接视野装置的销售、登记或投入运营，如果车辆或间接视野装置符合本指令的要求。2. 从2006年1月26日起，如果不满足本指令的要求，成员国可以以间接视野装置或间接视野为理由，拒绝为任一新型装置发放欧共体型式认证。但是，考虑到作为组件的VI级前视镜及其在车辆上的安装要求，可以将该日期向后推迟12个月。3. 从2006年1月26日起，如果不满足本指令的要求，成员国应该以间接视野装置为理由，禁止对任一新型车辆发放国内型式认证。但是，考虑到作为组件的VI级前视镜及其在车辆上的安装要求，可以将该日期向后推迟12个月。4. Notwithstandingparagraphs2and5,forthepurposesofreplacementparts,MemberStatesshallcontinuetograntECtype-approvalandtopermitthesaleandentryintoserviceofcomponentsorseparatetechnicalunitsintendedforuseonvehicletypeswhichhavebeenapprovedbefore26January2007,pursuanttoDirective71/127/EECand,whereapplicable,subsequentextensionstothoseapprovals.7. Notwithstandingparagraph3,MemberStatesmaycontinuetograntnationaltype-approvalforanynewtypeofarticulatedvehicleofcategoryM2andM3,classI,asdefinedinAnnexI,point2.1.1.1toDirective2001/85/EC(1),composedofatleastthreearticulatedrigidparts,whichdonotcomplywiththeprovisionsofthisDirective,providedthattherequirementsforthedriver’sfieldofvisionarerespectedasreferredinAnnexIII,point5tothisDirective.8. TheprovisionslaiddowninthisDirectiveshallalsocontributetoestablishingahighlevelofprotectioninthecontextoftheinternationalharmonisationoflegislationinthisarea.Therefore,assoonaspossibleaftertheadoptionofthisDirective,theCommissionshallsubmitaproposaltotheUnitedNationsEconomicCommissionforEuropewiththeaimofaligningtheprovisionsofUNECERegulation46withtheprovisionsofthisDirective.共120页第7页中文OfficialJournaloftheEuropeanUnion2004年1月29日— 禁止车辆的销售、登记或投入运营，如果车辆不符合本指令的要求，则可以以间接视野装置为理由。5.
