条所认证的溅射抑制设备，成员国应该为厂商或气授权代表发表一份符合附录3，附件II中类型的欧共体组件型式认证标识。成员国应该采取适当措施来防止使用会在已经按照第一条认证的溅射抑制设备与其它设备之间发生混淆的标识。第三条如果溅射抑制设备佩戴了EEC组件认证标记，则任何成员国均不得以结构和性能为利用禁止其销售。然而，该规定允许成员国采取措施禁止标有欧共体组件型式认证标识却始终不符合认证型号的溅射抑制设备的销售。共72页第6页1991L0226—N—01.05.2004—002.001BTheMemberStateconcernedshallforthwithinformtheotherMemberStatesandtheCommissionofthemeasurestaken,specifyingthereasonforitsdecision.TheprovisionsofArticle5shallalsoapply.Devicesshallbedeemednottoconformtotheapprovedtype,withinthemeaningofthesecondparagraph,iftherequirementsofAnnexIIhavenotbeenrespected.Article4ThecompetentauthoritiesofeachMemberStateshall,withinonemonth,sendthecompetentauthoritiesoftheotherMemberStatescopiesoftheEECcomponenttype-approvalcertificatesissuedforeachtypeofspray-suppressiondevicewhichtheyapproveorrefusetoapprove.Article51.IfthecompetentauthoritiesofaMemberStatewhichhasgrantedEECcomponenttype-approvalfindthatspray-suppressiondevicesaccompaniedbycertificatesofconformitytoasingletypedonotconformtothetypeapprovedbythatMemberState,theyshalltakethenecessarymeasurestoensurethattheconformityofproductionmodelstotheapprovedtypeisrestored.TheyshalladvisethecompetentauthoritiesoftheotherMemberStatesofthemeasurestaken,whichmayextendtowithdrawalofEECcomponenttype-approval.ThesaidauthoritiesshalltakethesamemeasuresiftheyareinformedbythecompetentauthoritiesofanotherMemberStateofsuchfailuretoconform.2.ThecompetentauthoritiesoftheMemberStateshall,withinonemonth,informeachotherofawithdrawalofEECcomponenttype-approval,byforwardingacopyofthecomponenttype-approvalcertificate,signedanddatedandbearinginlargelettersthewords‘EECTYPE-APPROVALWITHDRAWN’,andadducingreasonsforanysuchmeasure.3.IftheMemberStatewhichhasgrantedtheEECcomponenttype-approvalchallengestheallegedlackofconformity,theMemberStatesconcernedshallendeavourtosettlethedisagreement.TheCommissionshallbekeptinformed.Wherenecessary,itshallarrangeforappropriatediscussionswithaviewofarrivingatasolution.共72页第7页1991L0226——2004年5月1日—002.001B相关成员国应立即将采取的措施通知其它成员国以及委员会，说明做此决定的理由。也应采用第五条中的规定。如果未考虑附录II的要求，则可认为该设备不符合第二段定义的认证型式。第四条各成员国的主管当局应该在一个月内将发布的欧共体组件型式认证证书副本发送给另一个成员国的主管当局，该证书包括经其认证或拒绝认证的各种溅射抑制设备。第五条1.如果授权欧共体组件型式认证的成员国主管当局发现随同符合单一类型合格证的溅射抑制设备不符合成员国的认证类型，则他们应采取必要措施以确保交还符合认证类型的产品型号。他们应该为另一个成员国的主管当局提供所采取的建议措施，这样可能取消欧共体组件型式认证。如果另一个成员国主管当局通知他们无法符合时，则上述管理机构应采取相同措施。2.成员国的主管当局应该在一个月内彼此发送一份组件类型认证证书的副本，通知有关对欧共体组件型式认证的撤消，该证书有前面和日期，并用大写字母注明'EECTYPE-APPROVALWITHDRAWN'（取消欧共体型式认证），并举出采取此措施的理由。3.如果授权欧共体组件型式认证的成员国对不符合陈述提出质疑，则相关成员国应尽力解决分歧。并应同种委员会。必要时应安排相关讨论以得出解决方案。共72页第8页1991L0226—N—01.05.2004—002.001BArticle6AnydecisiontakenpursuanttotheprovisionsadoptedinimplementationofthisDirectivetorefuseorwithdrawEECcomponenttype-approvalforspray-suppressiondevicesorprohibittheirplacingonthemarketoruseshallsetoutindetailthereasononwhichitisbased.Suchdecisionshallbenotifiedtothepartyconcerned,whoshallatthesametimebeinformedoftheremediesavailabletohimunderthelawsinforceintheMemberStatesandofthetimelimitslaiddownforavailinghimselfofsuchremedies.Article7ForthepurposesofthisDirective,‘vehicle’meansanymotorvehicleincategoryNandanytrailerincategoryOasdefinedinAnnexItoDirective70/156/EEC.Article8NoMemberStatemayrefusetograntEECtype-approvalornationaltype-approvalforvehicles,orrefuseorprohibittheirsale,registration,placinginserviceoruseongroundsrelatingtotheirspray-suppressionsystemifthesearefittedinaccordancewiththerequirementsofAnnexIIIandifthespray-suppressiondeviceswithwhichthevehiclesareequippedbeartheEECcomponenttype-approvalmark.Article9AnyamendmentsnecessaryinordertoadapttherequirementsoftheAnnexestothisDirectivetotakeaccountoftechnicalprogressshallbeadoptedinaccordancewiththeprocedurelaiddowninArticle13ofDirective70/156/EEC.Article101.MemberStatesshallbringintoforcetheprovisionsnecessaryinordertocomplywiththisDirectiveby10April1992.Theyshallforth-withinformtheCommissionthereof.2.MemberStatesshallcommunicatethemainprovisionsofnationallawwhichtheyadoptinthefieldcoveredbythisDirectivetotheCommission.3.WhenMemberStatesadopttheprovisionsreferredtoinparagraph1,theyshallcontainareferencetothisDirectiveorbeaccompaniedbysuchreferenceontheoccasionoftheirofficialpublication.ThemethodsofmakingsuchareferenceshallbelaiddownbytheMemberStates.Article11ThisDirectiveisaddressedtotheMemberStates.共72页第9页1991L0226——2004年5月1日—002.001B第六条按照该指实施指令中采用的规定而做出的拒绝或撤消对溅射抑制设备的欧共体组件型式认证或禁止其销售或使用决定，应详细阐述它的理由基础。应将此决定正式通知当事人，并且同时将可采取的补救措施给予通知，该措施应该基于成员国的有效法律，并在有效期限内。第七条根据本指令，“车辆”指的是指令70/156/EEC的附录I中所定义的种类N中的任一机动车以及种类O中的任一挂车。第八条如果溅射抑制系统的安装符合附录III的要求，并且汽车溅射抑制设备标有欧共体组件型式认证标记，则任何成员国不可拒绝对车辆进行欧共体型式认证或国内类型认证授权，或者拒绝或禁止其销售、注册、投入运营或在地面使用。第九条考虑到技术进展，符合本指令附录要求的任一必要修正应按照指令70/156/EEC的13条中的流程。第十条1.成员国应该使所需规定生效以便从1992年4月10日其执行该指令。并应直接通知委员会。2.成员国应该就采用的涵盖本指令的本国法的主要规定与委员会进行沟通。3.当成员国采用了段落1中参照的规定时，该规定包含对本指令的参考，或公报中随附该参考。应该由成员国给出指定本参考的方式。第十一条本指令通过寄送方式发给各成员国。共72页第10页1991L0226—EN—01.05.2004—002.001▼BLISTOFANNEXESANNEXI:DefinitionsANNEXII:RequirementsrelatingtotheEECcomponenttype-approvalofspray-suppressiondevicesAppendix1:Testsonspray-suppressiondevicesoftheenergyabsorbertypeAppendix2:Testsonspray-sup 采用物理原理以降低喷射（吸收水能、气/水分离器），— 材料，— 外形，—
