rtheECcomponenttype-approvalmark.共66页第5页1976L0758—中文—2004年5月1日—007.001鉴于协调各成员国与关于机动车相关的本国法律近似可以使得各成员国相互承认其他成员国在按照共同要求的基础上所进行的检验测。，M2欧洲共同体委员会于是采用纳本指令：第一条▼M31.对于满足符合有关附件中规定的结构及测试要求的任何一型式的示廓灯、前位置（侧）灯、后位置（侧）灯、制动灯、日间行车灯和示宽灯，各成员国应批准该EC零发放欧共体部件型式认证。▼B2.批准EEC零部件已发放欧洲经济共同体部件型式认证的成员国，应在必要的范围内根据要求采取必要措施，以，证明验证该产品与型号符合经认证的型式的一致性，并且在如有需要，时应与也可以和其他成员国主管当局合作。上述验证此类证明应仅限于抽检。▼M3第二条对于成员国依据第一条对认证的各种型式的示廓灯、前位置（侧）灯、后位置（侧）灯、制动灯、日间行车灯和示宽灯进行认证之后，各成员国应给向相应的制造商发放EC零部件型式认证标志。该标志应与附件I，附录3中所示式样相符型号一致的欧共体部件型式认证标志。各成员国应采取适当措施，防止避免使用易混淆依据按照第一条之要求取得型式认证后的示廓灯、前位置（侧）灯、后位置（侧）灯、制动灯、日间行车灯和示宽灯在使用型式认证标志后与及其它其他装置的标志产生混淆。第三条1.对于带有欧共体EEC零部件型式认证标志的示廓灯、前位置（侧）灯、后位置（侧）灯、制动灯、日间行车灯和示宽灯，各任何成员国不得以基于与其制造结构或者性能功能方法有关的为理由禁止其投放市场。共66页第6页1976L0758—N—01.05.2004—007.001M32.Nevertheless,aMemberThatStateshallforthwithinformtheotherMemberArticle4ThecompetentauthoritiesoftheMemberStatesshallinformeachother,bymeansoftheprocedurespecifiedinArticle4(6)ofDirective70/156/EEC,ofeachapprovalwhichtheyhavegranted,refusedorwithdrawnpursuanttothisDirective.▼BArticle5▼M31.IftheMemberStatewhichhasgrantedECcomponenttype-approvalfindsthatanumberofend-outlinemarkerlamps,frontposition(side)lamps,rearposition(side)lamps,stoplamps,daytimerunninglampsandsidemarkerlampsbearingthesameECcomponenttype-approvalmarkdonotconformtothetypewhichithasapproved,itshalltakethenecessarymeasurestoensurethatproductionmodelsconformtotheapprovedtype.ThecompetentauthoritiesofthatStateshalladvisethoseoftheotherMemberStatesofthemeasurestaken,whichmay,wherethereisconsistentfailuretoconform,extendtowithdrawalofECcomponenttype-approval.ThesaidauthoritiesshalltakethesamemeasuresiftheyareinformedbythecompetentauthoritiesofanotherMember▼B2.ThecompetentauthoritiesofMemberStatesshallwithinonemonthinformeachotherofanywithdrawalofEECcomponenttype-approval,andofthereasonsforsuchameasure.▼M3Article6AnydecisiontakenpursuanttotheprovisionsadoptedinimplementationofthisDirective,torefuseorwithdrawECcomponenttype-approvalforend-outlinemarkerlamps,frontposition(side)lamps,rearposition(side)lamps,stoplamps,daytimerunninglampsandsidemarkerlamps,orprohibittheirplacingonthemarketoruseshallsetoutindetailthereasonsonwhichitisbased.Suchdecisionsshallbenotifiedtothepartyconcerned,whoshallatthesametimebeinformedoftheremediesavailabletohimunderthelawsinforceintheMemberStatesandofthetimelimitsallowedfortheexerciseofsuchremedies.共66页第7页1976L0758——2004年5月1日—007.001M32.但是然而，若如果带有欧共体EEC零部件型式认证标志的示廓灯、前位置（侧）灯、后位置（侧）灯、制动灯、日间行车灯和示宽灯与一贯不符合经已认证的型式持续不符，则成员国可有权禁止上述其灯具投放市场。该成员国应立即即刻将其采取的措施通报知其他成员国和委员会，说明并详述其做出此决定的理由。第四条对于其依据本指令发放、拒绝发放或已撤销的认证，各成员国主管当局应通过依据指令70/156/EEC指令第4四条（6）款中规定的程序，相互通报知其按本指令批准、拒绝或者撤销的各个认证。▼B第五条▼M31.倘若如果批准EC已发放欧共体零部件型式认证的成员国发现某些带有该欧共体EC零部件型式认证标志的示廓灯、前位置（侧）灯、后位置（侧）灯、制动灯、日间行车灯和示宽灯与已认证的型式不符，则该成员国应当采取必要的措施以保证确保这些生产产品型号与其已认证的型式相符的一致性。该成员国的主管当局应该通知就采取的措施向其他成员国的主管当局提出建议其所采取的措施，若如果这些灯具始终不能与经过认证的型式相符，应采取措施直至可以撤销该欧共体这些灯具的EC部件型式认证。其他该各成员国的主管当局在接到另一成员国主管当局关于此类不相符符合的通报知后时，应采取同样相同的措施。▼B2.各成员国的主管当局应在撤销EEC零部件型式认证之后一个月内，相互通报对欧洲经济共同体部件型式认证的撤销以及通知其他成员国主管当局，同时告知采取此类措施的理由。▼M3第六条对于该在执行本指令实施过程中，依据规定所采用的条款而作出采取的拒绝发放或、撤销示廓灯、前位置（侧）灯、后位置（侧）灯、制动灯、日间行车灯和示宽灯的欧共体EC零部件型式认证或禁止其投放市场上市销售或及使用的决定，都均应详细列明说明该决定所基于其依据的理由。应将上述决定该决定应通知相关制造商有关各方，同时应告通知知当事方后者依据按照成员国现行法律可以使用采取的补救办法措施，以及运用实施上述此类补救办法措施的时效时间期限。共66页第8页1976L0758—N—01.05.2004—007.001M3Article7NoMemberStatemayrefusetograntECtype-approvalornationaltype-approvalofanyvehicleongroundsrelatingtoitsend-outlinemarkerlamps,frontposition(side)lamps,rearposition(side)lamps,stoplamps,daytimerunninglampsandsidemarkerlampsifthesebeartheECcomponenttype-approvalmarkandarefittedinaccordancewiththerequirementslaiddowninDirective76/756/EEC.Article8NoMemberStatemayrefuseorprohibitthesale,registration,entryintoserviceoruseofanyvehicleongroundsrelatingtoitsend-outlinemarkerlamps,frontposition(side)lamps,rearposition(side)lamps,stoplamps,daytimerunninglampsandsidemarkerlampsifthesebeartheECcomponenttype-approvalmarkandarefittedinaccordancewiththerequirementslaiddowninDirective76/756/EEC.Article9ForthepurposesofthisDirective,‘vehicle’meansanymotorvehicleintendedforuseontheroad,withorwithoutbodywork,havingatleastfourwheelsandamaximumdesignspeedexceeding25km/h,anditstrailers,withtheexceptionofvehicleswhichrunonrailsandofagriculturalandforestrytractorsandallmobilemachinery.BArticle10AnyamendmentsnecessarytoadjusttherequirementsoftheAnnexestotakeaccountoftechnicalprogressshallbeadoptedinaccordancewiththeprocedurelaiddowninArticle13ofDirective70/156/EEC.Article111.MemberStatesshalladoptandpublishtheprovisionsnecessaryinordertocomplywiththisDirectivebefore1July1977andshallforthwithinformtheCommissionthereof.Theyshallapplytheseprovisionswitheffectfrom1October1977atthelatest.2.OncethisDirectivehasbeennotified,theMemberStatesshallalsoensurethattheCommissionisinformed,insufficienttimeforittosubmititscomments,ofanydraftlaws,regulationsoradministrativeprovisionswhichtheyproposetoadoptinthefieldcoveredbythisDirective.Article12ThisDirectiveisaddressedtotheMemberStates.共66页第9页1976L0758——2004年5月1日—007.001M3第七条若机动车上的如果示廓灯、前位置（侧）灯、后位置（侧）灯、制动灯、日间行车灯和示宽灯带有EC欧
