coststo“roachmotel”,whereauserexperienceseemseasyandintuitiveatthestart,butturns

Ina2019studyof53,000productpagesand11,000websites,researchersfoundthatabout

onein10employsthesedesignpractices.Thoughwidelyprevalent,theconceptofdarkpatterns

isstillnotwellunderstood.Businessandnonproftleadersshouldbeawareofdarkpatternsand

trytoavoidthegrayareastheyengender.

Whereisthelinebetweenethical,persuasivedesignanddarkpatterns?Businessesshould

engageinconversationswithIT,compliance,risk,andlegalteamstoreviewtheirprivacypolicy,

andincludeinthediscussionthecustomer/userexperiencedesignersandcodersresponsiblefor

thecompany,suserinterface,aswellasthemarketersandadvertisersresponsibleforsign-ups,

checkoutbaskets,pricing,andpromotions.Anyoralltheseteamscanplayaroleincreating

oravoiding“digitaldeception.”

Lawmakersandregulatorsareslowlystartingtoaddresstheambiguityarounddarkpatterns,

mostrecentlyatthestatelevel.InMarch,theCaliforniaAttorneyGeneralannouncedtheapproval

ofadditionalregulationsundertheCaliforniaConsumerPrivacyAct(CCPA)thatuensurethat

consumerswillnotbeconfusedormisledwhenseekingtoexercisetheirdataprivacyrights.n
