2、ompanyfunds;斗殴、赌博、恐吓:走私、疏于职守、不听从上级合法指示、损害船舶财产、盗窃公司财物;Drug/alcoholabuse;吸毒、酗酒;Violationlawsoflocalport;违反港口国当地法律;Otherbreachesofprinciplesormisbehavior.其他违纪或不法行为。Date,timeandplaceforaformalinvestigationofthechargesagainsttheseafarerconcerned.对相关违规船员正式调查的日期、时间和地点。TheMasterorhisauthorizedrepresentative
3、shallconducttheinvestigationorhearing,givingtheseafarertheopportunitytoexplainordefendhimselfagainstthecharges.Theseproceduresmustbedulydocumentedandenteredtotheshipslogbook.B.船长或其授权的代理人应该进行调查或聆听、给予被指控船员就所指控事件进行自我解释和辩护机会。这些程序必须进行记录和记入船舶航海日志。Ifaftertheinvestigationorhearing,themasterisconvincedthatim
4、positionofapenaltyisjustified,theMastershallissueawrittennoticeofpenaltyandthereasonsforittotheMaster,withcopiesfurnishedtotheManningAgent.C.如果经过调查或聆听后,船长相信对违纪船员实施处罚是正当的,船长应该向违规船员签署一份列明该项处罚理由的书面处罚通知,书面处罚通知复印件应该抄送该船员派遣公司。DismissalforjustcausemaybeeffectedbycompanyortheMasterwithoutfurnishingtheseafar
5、erwithanoticeofdismissalifthereisaclearandexitingdangertothesafetyofthecreworthevessel.TheMastershallsendacompletereporttothemanningagencysubstantiatedbywitnesses,testimoniesandanyotherdocumentsinsupportthereof.D.如果有明确和现存对船舶和船舶人员安全构成危险的情况下,公司或船长有权不通知违纪船员本人的情况下开除该船员。船长应该向船员派遣公司提供一份完整的报告,该报告应该包含有见证人、证
6、词和对此事有关的其他支持材料。SECTION15.TERMINATIONOFEMPLOYMENT第十五部分合同终止Theemploymentoftheseafarershallceasewhentheseafarercompleteshisperiodofcontractualserviceaboardthevessel,signs-offfromthevesselandarrivesatthepointofhire.A,船员完成合同后离船到达雇佣地,船员雇佣合同即告终结。Theemploymentoftheseafarerisalsoterminatedwhentheseafarerarri
7、vesatthepointofhireforanyofthefollowingreasons:B.船员因以下原因到达雇佣地后也定义为船员雇佣合同终结。Whentheseafarersigns-offandisdisembarkedformedicalreasonspursuanrtoSection17(b)(4)ofthisContract.1.船员根据本合同第17部分(b)(4)的规定病原因从船上离船。Whentheseafarersign-offduetoshipwreck,shipsscale,lay-upofvessel,discontinuanceofvoyageorchangeof
8、vesselprincipalinaccordancewithofthisContract.船员根据本合同的规定由于海难,船舶拆解,封存,航次终结或船舶改换船东从船上离船。Whentheseafarer,inwriting,voluntarilyresignsandsignsoffpriortoexpirationofcontractpursuanttoSection16(f)ofthisContract.3.船员根据本合同第16(f)部分的规定以书面形式在合同终结前自愿辞职从船上离船。3.Whentheseafarerisdischargedforjustcauseasprovidedfor
9、inSection14ofthisContract.4.船员由于本合同第14部分的规定以正当的理由被解雇离船。REPATRIATION第十六部分休假Upontheexpirationofthecontract,thecompanyshallarrangeseafarersdisembark.Ifcouldnotarrangecrewdisembarkatthisportcompanymayarrangesameatnextconvenientport.Theseafarershallbeentitledtoearnedwagesandbenefitsasprovidedinhiscontrac
10、t.A.如果合同到期公司必须安排船员休假,而港口无法安排,可以安排在下一个方便港口,船员应该继续按该合同进行并获得相应的薪水和享受相关福利。Ifthevesselarrivesataconvenientportbeforetheexpirationofthecontract,theMaster/Employermayrepatriatetheseafarerformsuchport,providedtheun-servedportionofthecontractiswithinmutualagreeoptionrange.Theseafarershallbeentitledonlytohise
11、arnedwagesandearnedleavepay.B.如果合同到期前船舶到达一个方便港口并且未完成合同的合同部分在双方同意的选择期限内,船长/雇主可以在这种港口让船员休假。船员只能获取他已经赚取的薪酬和已经赚取的休假带薪。Whentheseafarerisdischargedforduetocrewindividualsseriousderelictionofduty,theemployershallhavetherighttorecoverthecostsofhisreplacementandrepatriationfromtheseafarerswagesandotherearnin
12、gs.C.雇主因船员个人的严重失职而解聘船员,雇主有权从船员工资和其他收入中追回安排船员休假和安排接班船员所产生的费用。Theseafarer,whendischargedandrepatriatedasdirectedbytheemployer/master/agencyshallbeentitledtobasicwagesfromdateofsigningoffuntillarrivalatthepointofhireexceptwhenthedischargeisinaccordancewiththeaboveorfordisciplinaryreasons.D.除了是由于前述船员违规原
13、因,对于在船长/雇主/代理人安排下进行的休假船员享有从离船到达雇佣地领取基本工资的权利。Aseafarerwhorequestsforearlyterminationofhiscontractshallbeliableforhisrepatriationcostaswellasthetransportationcostofhisreplacement.Theemploymentmay,incaseofcompassionateground,assumethetransportationcostoftheseafarersreplacement.E.申请提前公休的船员除了要负责他本人的公休成本也
14、要负责接替他的船员的交通费用。在体恤事件条件下,雇主应该承担接班船员交通费用。Wheretheseafarersemploymentterminatedbecauseoftransferofregistryofownershiporabandonmentofvesselorlossofvessel.Theseafarersshallbeentitledtocompensationequalto1monthsbasewage,orthebasewagesuntiltheexpirationoftheperiodforwhichhewasengaged.Whichevershallbeleast;
15、providedhoweverthattheseamanisnoremployedasaseamanduringsuchperiodandprovidedfurtherthatduringsuchperiodtheseafarerhasnotrefusedsubstantllyeqivalentseagoingemployment.F.当船员合同由于船籍国的变更或者船东的变更或者弃船或者船损而终止,如果该船员在这个期间不能再次被雇佣上船,或者该船员不能获得与海上雇佣期大致相同的收入,该船员有权获得相当于1个月的基本工资的补偿,或者直到他的雇佣合同期满为止的基本工资补偿,两者取小者。Themin
16、imumnoticeperiodtobegivenbytheseafarersandcompanyfortheearlyterminationofacrewagreementshallnotbeshorterthensevendays.Companyallowsseafarerstoterminatethecrewagreementasshorternoticeorwithoutnoticewithoutpenaltyforcompassionateorotherurgentreason.IncasethereisconflictwithterminationclauseasperCBAthe
17、ntheterminationclauseaspercontractwillprevailprovidinganadvantageoussituationtotheseafarer.G.海员和公司提前终止海员就业协议发出预先通知的最短期限为不短于7天。公司允许海员处于值得同情的原因或其他紧急原因提前较短时间或不通知不被处罚就终止就业协议。如果与谈判协议中的终止条款有冲突,则有利于海员的终止条款优先。COMPENSATIONANDBENEFITS第十七部分赔偿和福利A.COMPENSATIONANDBENEFITSFORDEATHA.死亡赔偿和福利Incaseofwork-relateddeat
18、hoftheseafarer,duringthetermofhiscontract,theemployershallpayhisbeneficiariesasperPeoplesRepublicofChinalaws.一旦海员在合同期间因工作死亡,雇主要根据中华人民共和国相关法律对海员的受益人进行赔偿。Itisunderstoodaridagreedthatthebenefitsabove-mentionedshallbeseparateanddistinctfrom,andwillbeinadditiontowhateverbenefitswhichtheseafarerisentitled
19、tounderPeoplesRepublicofChinalawsfromthesocialsecuritysystemetc.,ifapplicable.除了以上来自雇主的补偿外,双方一致同意根据中华人民共和国法律体系下的社会保险等而获取的补偿也一并归入船员补偿。Theotherliabilitiesoftheemployerwhentheseafarerdiesasaresultofworkrelatedinjuryorillnessduringthetermofemploymentareasfollows:船员在合同期间因工作原因导致的疾病和伤害而死亡时,雇主所要承担的其他赔偿责任:a.
20、Theemployershallpaythedeceasedsbeneficiaryalloutstandingobligationduetheseafarerunderthiscontract.雇主应该根据本合同向死亡船员受益人转付所有归属于死亡船员的应有的福利补偿。HeemployershalltransporttheremainsandpersonaleffectsoftheseafarertotheChinaatemployersexpenseexceptifthedeathoccurredinaportwherelocalgovernmentlawsorregulationsdono
21、tpermitthetransportofsuchremains.Incasedeathoccursatsea,thedispositionoftheremainsshallbehandledordealtwithinaccordancewiththemastersbestjudgment.Inallcases,theemployer/mastershallcommunicatewiththemanningagencytoadvisefordispositionofseafarersremains.b.除死亡发生港口当地法律或法规要求不得转运遗骸外,雇主应将死亡船员遗骸及个人物品转运回中国,所
22、有因此而产生的费用有雇主承担。如果死亡发生在海上,应根据船长良好职业判断处理过世船员遗骸。但无论如何,船长/雇主应该向过世船员的代理公司通报有关船员遗骸处理事宜。B.COMPESATIONANDBENEFITSFORINJURYORILLNESSB.工伤或因工作所导致疾病赔偿及福利C.Theabilitiesoftheemployerwhentheseafarersufferswork-relatedinjuryorillnessfuringthetermofhiscontractareasfollow:C.船员在合同期内因工作而导致的疾病或伤害,雇主应该承担以下责任:1.Theemploye
23、rshallcontinuetopaytheseafarerhiswageshiswagesduringthetimeheisonboardvessel.船员受伤或生病后仍然在船期间,雇主应该继续支付船员工资。Iftheinjuryorillnessrequiresmedicaltreatmentinaforeignport,theemployershallbeliableforthefullcostofsuchmedical,surgicalandhospitaltreatmentaswellasboardandlodginguntiltheseafarerisdeclaredfittowo
24、rkortoberepatriated.However,ifafterrepatriation,theseafarerwillrequiresmedicalattentionarisingformsaidinjuryorillness,heshallbesoprovidedatcosttotheemployeruntilsuchtimeheisdeclaredfitorthedegreeofhisdisabilityhasbeenestablishedbythecompany-designatedphysician/hospital.如果工伤或疾病需要在国外港口进行治疗,雇主要承担所有药品,手
25、术和住院费用也包括食宿费用到船员被宣布适合工作或返回雇佣地。如果返回雇佣地后船员还需要继续治疗的,雇主依旧要承担其医疗费用到船员痊愈或由雇主指定医生/医院宣布其残疾程度为止。Uponsign-offfromthevesselformedicaltreatment,theseafarerisentitledtosicknessallowanceequivalenttohisbasicwageuntilheisdeclaredfittoworkorthedegreeofpermanentdisabilityhasbeenassessedbythecompany-designatedphysicia
26、n/hospitalbutinnocaseshallthisperiodexceedsixth(16)weeks.Forthispurpose,theseafarershallsubmithimselftoapost-employmentmedicalexaminationbyacompany-designatedphysician/hospitalwithinthreeworkingdaysuponhisreturnexceptwhenheisphysicallyincapacitatedtodoso,inwhichcase,awrittennoticetotheagencywithinth
27、esameperiodisdeemedascompliance.Failureoftheseafarertocomplywiththemandatoryreportingrequirementshallresultinhisforfeitureoftherighttoclaimtheabovebenefits.因病治疗离船从离船开始,船员享有等同于其基本工资的疾病补助,疾病补助发放时间到疾病补助治愈或雇主所指定医生/医院宣布其残疾程度为止,但无论如何疾病补助发放时间不得超过16周。为了有效实施以上目的,船员应该于到达雇佣地后3日内由雇主所指定医生/医院签发合同终结后的体检报告,一旦船员客观上无
28、法做到,船员以书面的方式通知其代理机构也可看作对以上要求的遵从。船员没能按上述要求执行可视为对获取上述权利的放弃。Uponsign-offtheseafarerfromthevesselformedicaltreatment,theemployershallbearthefullcostofrepatriationintheeventtheseafarerisdeclared(1)fitforrepatriation;or(2)fittoworkbuttheemployerisunabletofindemploymentfortheseafareronboardhisformervesselo
29、ranothervesselortheemployerdespiteearnestefforts.船员离船就医后雇主要对一下情况为船员提供前往雇佣地交通费用:(1)船员在国外就医后打到了返回雇佣地就以的条件而要返回雇佣地;(2)船员就医后已经适合重返工作岗位,但经过雇主全面努力后,船员已经不能返回原船或也没有合适的另一条船可供船员服务而需要返回雇佣地。Incaseofpermanenttotalorpartialdisabilityoftheseafarercausedbyeitherinjuryorillnesstheseafarershallbecompensatedinaccordanc
30、ewiththescheduleofbenefitsenumeratedinP&IClubterms&seafarersocialsecurityinChina.Computationofhisbenefitsarisingfromanillnessordiseaseshallbegovernedbytheratesandtheruledofcompensationapplicableatthetimetheillnessordiseasewascontracted.5.一旦由于工伤或者疾病导致船员永久或部分残疾,船员应该根据保赔协会和船员在中国的社会保险项目获取赔偿。赔偿标准和赔偿额是以工伤
31、和疾病发生时的保赔协会和社保相关项目标准进行计算。Nocompensationandbenefitsshallbepayableinrespectofanyinjury,incapacity,disabilityordeathoftheseafarerresultingformhiswillfullyorcriminalactorintentionalbreachofhisduties,providedhowever,thattheemployercanprovethatsuchinjury,incapacity,disabilityordeathisdirectlyattributablet
32、otheseafarer.D.如果雇主能够证明因为船员本人故意行为、故意违反其工作职责而直接导致船员受伤、残疾和死亡的,船员不享有赔偿权利。Aseafarerwhoknowinglyconcealsanddoesnotdisclosepastmedicalcondition,disabilityandhistoryinthepre-employmentmedicalexaminationconstitutesfraudulentmisrepresentationandshalldisqualifyhimfromanycompensationandbenefits.Thismayalsobeav
33、alidgroundforterminationofemploymentandimpositionoftheappropriateadministrationandlegalsanctions.E.船员明确知悉在上船前体检中隐瞒过往病史构成欺骗性误述,该类误述会取消其所有赔偿和补贴权利。该类误述也是有效终止该合同的条件,也是实施合适管理和法律制裁的依据。NocompensationandbenefitsshallbepayableinrespectofInjuryincurredotherwisethanintheserviceoftheship.船舶服务之外发生的其它受伤,船员不享有赔偿权利
34、。Whenrequested,theprincipalshallfurnishtheseafareracopyallpertinentmedicalreportsoranyrecordsatnocosttotheseafarer.G.当需要时,雇主应该为船员免费提供所有船员本人相关的医疗报告和记录。SECTION18.TRADINGAREA第十八部分航行区A.SeafareracknowledgesthattheVesselmaytradeworldwideatemployersolediscretion.船员确认知道在雇主的决定下船舶可以进行全球区域内航行Ifthevesselsailsto
35、awarproneareapromulgatedbyP&Icluborwarriskunderwriters,theEmployershallinformSeafarerandmanningagentinadvanceandensureSeafarer,ManningAgentagreeonthat.如果船舶驶往经过保赔协会公布的战争或者战争高风险区,雇主要提前通知海员及海员的代理机构,并确保得到海员和海员的代理机构同意海员随船前往上诉区域。Awarbonus,ifany,willbepaidtoSeafarerdirectlybytheEmployerC.如果有战区奖应该由雇主直接支付给海员
36、本人。SECTION19.LOSSOFDAMAGETOCREWSPERSONALEFFECTSBYMARINEPERIL第十九部分由于海难事故导致船员个人物品的损坏和丢失TheseafarershallbereimbursedbytheemployerthefullamountoflossordamagetohispersonaleffectsbutinnocaseshallbeamountexceedtotheamountofTwoThousandUSdollars(US$2000)ifhispersonneleffectsarelostordamagedasaresultofthewrec
37、korlossorstrandingorabandonmentofthevesselorasaresultoffire,flooding,collisionorpiracy.A.由于海盗、碰撞、火灾、搁浅、沉没、弃船所导致的船员个人物品丢失或损坏,雇主应该对船员就此产生的全部财产损失进行赔偿,但最高赔偿额度不得超过2000美元Incaseofpartialloss,theamountshallbedeterminedbymutualagreementofbothpartiesbutinnocasetoexceedtotheamountofTwoThousandUSdollars(US$2000
38、)如果只是部分损失,赔偿总额由双方共同商定,但中的赔偿额度不得超过2000美元Reimbursementforlossordamagetotheseafarerspersonaleffectsshallnotapplyifsuchlossordamageisdueto(a)theseafarersownfault(b)larcenyortheftor(c)robberyC.因以下原因所导致的船员个人物品丢失或损坏雇主不进行赔偿(a)船员本人过错(b)盗窃(c)抢劫SOCIALSECURITYFORSEAFARER第二十部分船员社会保险Onbehalfofemployer,manningagen
39、cyshallparticipateinworkinjuryinsurance,medicalinsurance,oldageinsurance,unemploymentinsuranceaswellasothersocialinsuranceinaccordancewiththerelevantprovisionsoftheState,andshallpaypremiumsontimeandinfullforseafarer.Abovefeealreadyincludeleavesubsistenceinmonthlywage.船员派遣公司代表雇主应当按照国家法律法规的规定为其招募的船员办理
40、养老保险、医疗保险、工伤保险、失业保险、及其他国家法律规定的社会保险项目,并按时足额为船员缴纳其应当缴纳的各项费用。上述费用已包含在工资组成社保金部分。GENERALSAFETY第二十一部分总体安全要求Theseafarershallobserveandfollowanyregulationorrestrictionthatthemastermayimposeconcerningsafety,drugandalcoholandenvironmentalprotection.A.船员要遵从船长为实施安全管理、毒品和酒精政策和环保政策而制定相关规章制度或限制。Theseafarershallmakeuseofallappropriatesafetyequipmentprovided
