2、mine field , and so on.第一条本合同由 (单位)与工会根据劳动法、 安全生产法、职业病防治法等法律法规以及省、市有 关条例规定,结合本企业实际情况,经企业代表和职工代表 协商一致签订。Article 1 The contract is established between and theTrade Union of in accordance with “Labor Law ” “SafeProduction Law , " a Occupational Disease Prevention and Cure Law" and related pro

3、vincial and municipal regulations , based on the actual situation and subject to the equal consultation between Company ' s representative and employees ' representative.1 .企业依照国家有关法律法规,加强安全生产管理。建 立健全安全生产责任制,劳动安全卫生制度;组织编制安全生产规章制度、安全操作规程及岗位操作规程,组织制定实 施安全生产事故应急救援预案。Company must strengthen the

4、production safety management according to relevant laws and regulations. Company should set up the system of job responsibility and the system of safe production and hygiene , organize to work out internal rules and regulation , operational instructions , post operation rules as well as the emergenc

5、y solution for production accident.2 .企业应不断改善劳动条件。有计划地进行安全设施的 更新改造,提供资金保证,确保专款专用。Company should gradually improve the working environment. It should designedly modify the facilities for safe production and hygiene , afford fund and insure its special use.3 .企业应对职工进行劳动安全卫生教育和培训,未经培 训合格不得上岗作业。特殊工种作业人员

6、必须经过国家有关 部门培训,取得相应资格操作证后,方可安排其从事作业。Company should organize education and training on safe production and hygiene while people who fail or have not attended the safety training are not allowed for operation. Operators designed to special positions can start work only after obtaining the related quali

7、fication.4 .企业根据各工种的岗位需要,为职工提供符合国家标 准及行业标准的劳动保护用品。对不按规定穿戴和不正确使 用劳动保护用品和违反操作规程的职工,有权查处。Company should provide personal protective equipment of national and industry standards, according to different position requirements. Company is entitled to give opinions and investigate the liabilities of the emp

8、loyees who don ' t dress or use the protective equipment according to the requirements.5 .企业对直接从事有毒有害岗位的职工,进行上岗前、 离岗时的健康检查,每年定期进行健康检查,并建立职业卫 生健康档案。对其他岗位的职工,也应定期进行体检。并及 时向工会通报职业病检查情况。Company should organize the employees directly engaged in toxic and hazardous operations to take the health checku

9、p before and after the related work , and individual health files are archived for operators of this nature. Scheduled health checkup should also be carried out for the employees of other positions. The result of occupational disease checkup should be announced to trade union.6 .企业依法按国家、省、市规定要求和时限为职

10、工办理 工伤保险,并按时足额缴纳工伤保险费用。职工因患职业病 或因工受伤的工资和医疗费,按国家和省、市有关规定执行。Company should cover the employees with industrial injury insurance in accordance with the law by national , provincial and municipal requirements and time limits , as well in full and on time pay the cost of industrial injury insurance. Medi

11、cal expenses and wages for workers suffering from occupational diseases or work-related injuries should be paid according to the national , provincial and municipal implementation of the relevant provisions.7 .在生产过程中发生工伤事故和严重职业危害时,企业 应及时报告工会,工会有权依法参加事故调查,提由处理意 见并要求追究有关人员的责任。The occurrence of industr

12、ial injury and serious occupational hazard during production process should be reported timely to Trade Union ; Trade Union is entitled to inquire into the case and give opinions , and furthermore investigate the liabilities of people in charge.8 .企业在研究制定和修改劳动安全卫生规章制度、安全 技术措施时,工会应参加,涉及职工劳动安全卫生健康的重 大

13、问题,须经职工代表大会(职工大会)讨论审议通过。The Trade Union should take pert in the studying and amending rules and regulations on labor health and safe production , as well as safety techniques; any major issues concerning employees' safety and health should be consulted and approved by the Employees Representativ

14、e Convention.9 .工会支持企业加强安全生产管理,积极协助行政落实 企业安全卫生规章制度,监督国家劳动安全卫生法规的执 行。工会有责任教育职工严格遵守企业的各项安全生产规章 制度和操作规程,教育和组织职工接受安全技术培训和管 理。Trade Union should support the Company to strengthen production safety management, actively assist the Company in the implementation of health and safe production rules and regula

15、tion. Trade union has the responsibility of educating workers to strictly abide by the rules and regulations related to industrial safety , the responsibility of educating and organizing employees to receive safety techniques training and management.10 .工会有权纠正违章指挥,对强令工人冒险作业行为或当发现明显事故隐患和职业危害时,有权停止作业并

16、提由解 决的建议,行政应当及时研究答复;当发现危及职工生命安 全的情况时,有权组织职工撤离危险场所。Trade Union is entitled to correct improper instruction and stop the operation and proposes the solutions when workers take the risk or apparent danger or occupational hazards are observed; the Company should make the decision and action thereafter.

17、Trade Union is authorized to evacuate employees out of the dangerous places when their lives are expected to the hazard.11 .其他由企业、职工提由要求协商的与劳动安全卫生有 关的问题。Other issues regard to health and labor safety put forward by Company and employees for further consulting.第二条本合同由集体合同监督检查小组负责监督,企业 应每年不少于一次向职工代表大会

18、(职工大会)报告劳动安 全卫生协议履行情况。Article 2 The supervision group of the collective contract is responsible for superintending the execution of the present contract. Company should report the implementation of the contract to the Employees Representative Convention at least once every year.第三条本合同有效期为年,自年月日起至年月日止,并 于期满前三个月内进行下一轮劳动安全卫生集体协商。Article
