2、gisteredAddress):甲、乙双方就甲方愿意出租、乙方自愿承租物业事宜,以双方协商一致,同意签订本房产租赁合约。AnAgreementmadeBETWEENPartyAoftheonepartandPartyBoftheotherpartWHEREBYITIS:一、租赁物业名称(以下称“该物业”)NameaddressofPropertytoberented:(hereinaftercalled“thesaidpremises”):二、用途:该物业只供作住宅使用。Usage:fordomesticuseonly.三、面积:该物业建筑面积为平方米。Area:squaremeter.四、
3、租约期限(TermsofTenancy):年固定租约由FormalTenancy:租赁期租金:每月人民币xx元整。此租金已经包含该房屋每月的出租税金。六、付租条款(PaymentTerms):1、.五、租金(Rent):2、付款方式:乙方须以银行自动转帐方式在支付。PaymentMethod:PartyBshalldeposittherenttoPartyBsbankaccountbelow:受益人(BeneficiaryName):银行(Bank):帐号(BankA/CNO):七、管理费:租赁期内管理费由xx支付。ManagementFee:八、公用事业费:电费,水费,煤气费,和电话费等等,
4、均由xx支付。PublicUtilityFees:electricityfee,waterfee,gasfee,andtelephonefee,etc,shallberesponsibleby九、保证金(Deposit):签订本房产租赁合约时,乙方须付甲方保证金人民币xx元整.OnthesigningofthisFormalTenancyAgreement,PartyBshallpaytoPartyAasecuritydepositin十、其它条约(OtherTerms):1、乙方须按上述规定交付保证金于甲方,于租约终止或期满时,甲、乙双方不再续约,乙方在付清全部租金及公用事业费后,保证金(不
5、计利息)得凭原收据领回。Thesaiddeposit(nointerestwillbecounted)shallberepayableforthwithfromPartyAtoPartyBattheexpirationordeterminationofthetenancywithoutanyrenewal,subjecttoPartyBhadcompletedfullpaymentoftheentirecontractperiodandpaidallPublicUtilityFeesoranyotherfeesrelated.2、甲方按每日1%交付滞纳金。如乙方超过15天不支付租金,则视为乙方

7、ditionstothesaidpremiseswithouthavingfirstobtainedthewrittenconsentofPartyA.4、乙方不得在该物业之内任何地内存放违反危险品条例之物品,例如军械、火药、璜硝、汽油,有爆炸危险性的物品及挥发性之化工原料等等,另乙方不得在该物业内做任何违反中国法律行为。否则,一切后果,由乙方负责。PartyBshallnotstorearms,ammunitionorunlawfulgoods,gun-powder,saltpeter,keroseneoranyexplosiveorcombustiblesubstance,etc.inan
8、ypartofthesaidpremises,thetenantorinmateshallnotusethesaidpremisesforanyillegalpurposes,forviolationagainstthelawofPeoplesRepublicofChinainanypartofthesaidproperty,PartyBshallbeanswerableandresponsibleforanyconsequenceofanybreachoflocalordinance.5、乙方须正确维护该物业内甲方所提供之家具、电器、装置及设备、该物业之原来一切设备如有因非正当使用造成的损坏
9、,乙方须负责修理或赔偿。Tokeeptheinteriorofthesaidpremisesandfurniture,fixturesandfittingsprovidedbyPartyAinconditionofnormalusethroughoutthetenancy,ifanydamagesmadebyanyabnormaluse,PartyBisresponsiblefortherepairorreimbursement.6、乙方不得拒绝甲方派谴之人员,在适当时间入屋检视该单位近况或进行任何修理工程。PartyBshallpermitPartyAanditsagentswithorwi
10、thoutworkmenorothersandwithorwithoutappliancesatallreasonabletimestoenteruponthesaidpremisesandtoviewtheconditionthereofandtotakeinventoriesofthefixturesthereinandtocarryoutanyrepairstothepremiseswhichPartyAconsidersnecessaryorpropertobedone.7、当租约期满或终止前X个月,甲方有权在不骚扰原则下,张贴招租告示于该单位外,乙方亦应准许甲方/代理人在合理时间内,
11、带同新租客进入该物业视察。DuringtheXmonthimmediatelyprecedingthedeterminationofthesaidtermoftenancy,PartyAshallbeatlibertytoaffixandretainwithoutinterferenceormolestationonthedoorortheexternalpartsofthesaidpremisesanoticeforlettingthesaidpremisesandthePartyBshallpermitandallowallpersonswithwrittenororalauthority
12、frompartyAoritsagentoragentsatallreasonablehoursofthedaytoviewthesaidpremisesoranypartorpartthereof.8、租约期满,乙方如需延长租约,须在租约期满X个月前以书面方式通知甲方,经甲方同意,乙方可以新订租金和租约继续入住该物业。Xmonthwrittennoticebeforetheexpirationisrequiredforanytenancyrenewal;newtenancyagreementwillbegeneratedundertheconsentofbothparties.9、乙方须自行
13、投买风灾,水灾,火灾,盗窃,意外保障等等,乙方如在该单位内有任何损失,甲方不负任何责任。PartyBshallhimselfcoverinsuranceforhisownbelongingsagainstTyphoon,Depression,Storm,Flood,Fire,Theft,Accidents,etc.inrelationtothisTenancy.PartyAshallnotberesponsibleforanydamageorlossunderallcircumstances.10、乙方不得于单位内制造或容许制造噪音,异味或任何滋扰邻居或业主安宁之举动,其中包括拖欠租金。经警告
14、后仍未有所改善,甲方有权终止租约。PartyBshallnotpermitanynoiseorallowanymusictobeproducedinthepremisessoastogivecauseforreasonablecomplaintfromtheoccupantsofneighboringpremises,otherwise,PartyAhastherighttoterminatethetenancyimmediatelyifcasecontinuedafteradvised.11、12、甲方须承担该物业的房产税、土地使用税。PartyAshallpayallpropertytax
15、,landtaxandanyothertaxorchargeofthesaidpremises.租约期内,甲方有权将该物业出售给第三者,本合约对购得该物业之新业主仍然有效,所有适用于甲、乙双方的条款,同样无条件适用于新业主和乙方。Duringtermoftenancy,PartyAshallhavetherighttosellthesaidpremisestothethirdparty.ThetermsandconditionshereincontainedwhichapplicabletoPartyAandPartyBmustbeapplicabletothenewlandlordandPa
16、rtyBwithoutnegotiation.13、本合约之附件,包括:家具装置设备清单、房屋所有权证副本,租赁协议书,均为本合约不可分割的成部分。Theattachments,includingFurnitureFixture,AppliancesListTitleCertificate.,PropertyCertificateandOfferletterformsanintegratepartoftheagreement.14、本租约适用中华人民共和国法律、自甲、乙双方签章后,双方均应遵守本租约规定的各项条款,如发生争议,双方不能完满解决,将依照中华人民共和国有关法律仲裁解决。Theagr
17、eementisconstruedinaccordancewithlawsofPeoplesRepublicofChina(PRC).Bothpartiesshallperformandobservethestipulationhereincontaineduponsigning.AnydisputedshallbereferredtoarbitrationinaccordancewiththearbitrationofPRC.TheapplicablelawshallbePRClaw.15、本租约各有中、英文版本。英文版本为中文版本之译本,如英文版本与中文版本在翻译上有所不同,以中文版本为准

20、pmentthereinarecleanedandintenantableconditionstoPartyB.2、签订本合同之前,甲方必须向乙方出示有关物业的房地产产权证。产权证编号:_如不能提供该文件,甲方必须提供相关有效的可证明其物业所有权的文件。若该物业产权证上所有权人的名称与此合同中甲方名称不一致。则必须提供甲方与物业所有权人的合法租赁协议的复印件。Priortotheexecutionofthisagreement,PartyAshallprovidetoPartyBtheRealEstateOwnershipnotavailable,PartyAshallprovideanalt

22、yleasedforatermof_3.5_months,commencingOn_xx312,andexpiringon_xx627_.2、在租期开始一日前,出租房屋及其家俱电器应已装修或安装布置完毕,处于可供租赁的良好状态。Theabovepropertyanditsequipmentandfurnitureshallbefullyrenovatedorinstalledandintenantableconditionsonedaysbeforethecommencementofthelease.3、租期届满,甲方有权收回出租房屋及全部家俱、电器,乙方亦应如期交还(附件1);乙方如要求续租
23、,则享有优先续租权,但必须在本租约固定期满前1个月向甲方提出书面申请,租金双方另行协商;如乙方不再续租,甲方有权向新租客展示该房。Onexpiryofthislease,PartyAhastherighttotakebacktheleasedpropertyinfull,andPartyBmustdelivertheleasedpropertyonthedateofexpiry(AppendixI).IfPartyBwishestorenewtheleaseafterthetenancyperiod,PartyBshallhavetheprioritytorenewtheleasewithon
24、emonthsadvancewrittennoticetoPartyA.Therevisedrentalshallbenegotiatedbetweenthetwoparties.IfpartyBnotrenewtheleasecontract,PartyAhaverightsshowthepropertytonewtenant.第三条:租金Rent:1、租金标准澳币:_140_元/每周。Rent:AUD_140_/Perweek.2、付款方式:押_560_付_2_周,押金不得充抵房屋租金。Paymentmethod:asmuchas_560_rentasdepositand_2_week(s

26、ringthetermofthisTenancyAgreement.第四条押金Deposit:1、本租约押金计_。租约期满,乙方如不再续租,甲方应在租赁期结束前叁日内将押金退还(不计利息)。ThedepositisAUD_560_intotal.Oncompletionofthetenancycontract,ifPartyBwillnotcontinuetorenttheleasedproperty,PartyAmustreturnthedepositinfulltoPartyB(withoutinterest)withinthreedaysbeforetheterminationofthe
27、contract。2、甲方因乙方违反本合同的规定而受的损失,可在保证金中扣抵合理数目,在甲方作出该种抵扣前,需通知乙方将被抵扣的金额和理由,乙方有权拒绝不合理或不公正的抵扣,不足部分乙方必须在接到甲方付款通知后7天内补足。PartyAmaydeductareasonableamountfromthesecuritydeposittowardspaymentofanyactualdamagesPartyAmayhaveincurredorsufferedasaresultofPartyBsbreachofthisAgreement.Priortomakingsuchdeductions,Part
28、yAshallinformPartyBoftheamount,andthereasonformakingsuchdeductions.PartyBshallbeentitledtoobjecttosuchdeductionsifPartyBbelievesthatsuchdeductionsareunreasonableorunjustified.Ifthesecuritydepositisnotsufficienttocoversuchamounts;PartyBmustpaythedeficiencywithinseven(7)daysofthereceiptofademandfromPa
29、rtyA.第五条:其它费用OtherCharges:1、乙方的租金已经包括租赁期内的水,电,煤气,电视,网络,等一切费用。2、乙方所用电话,按电信局标准收费,每月根据实际用量结算,乙方按单缴付。AlltelephonechargesshallbepaidbyPartyBandbasedontheactualusageaccordingtotheTelecommunicationBureaustandardtariffsonreceiptofthebills.3、甲方承担在租赁期内的物业管理费,供暖费。Duringtheperiodoftenancy,PartyAshallpayproperty
30、managementfee,heatingfee.第六条:甲方的责任LandlordsResponsibilities:1、本租约签订后,甲方不得无故收回房屋。租赁期内,甲方需提前收回该房屋的,应提前30日通知乙方,将已收取的租金余额退还乙方并按月租金的_100_%支付乙方违约金。PartyAisnotpermittedtotakebacktheleasedpropertyduringthetermofcontractwithoutanyreason.Duringthetermofcontract,PartyAshallinformPartyB30daysinadvanceincasePart
31、yAneedstoreclaimthepremiseinadvanceandPartyAshallreturnthebalanceofthecollectedrenttoPartyBandpaydefaultfineequalto_100_%ofthemonthlyrenttoPartyB.2、甲方应保证物业公司向乙方提供足够的服务,如冷水、热水、电的供应及各种设备的正常工作。甲方应负责租赁期内房屋及其设备的正常维修,并承担维修房屋及设备的正常磨损而产生的费用。PartyAshallensurethattheestatemanagementofficeprovidessufficientand
32、timelyservicetoPartyB,suchassupplyofcoldwater,hotwater,electricityandensurethepropermaintenanceofallkindsofequipment.PartyAshallberesponsibleforallnormalmaintenanceoftheleasedpropertyandequipmentduringthetermlease,andPartyAshallbearallmaintenancecharges.3、甲方应对甲方的固定设施,包括该物业的结构、屋顶、管道、设施、排污、管道和缆线(包括电力及
33、电话)等进行维护,使之处于完好状态;如果对上述各项的造成的损坏或破坏,不是由乙方的疏忽或不良行为造成的,则甲方在收到乙方发出的通知后7天内修理或修缮该损坏处。TomaintainandkeepPartyAsfixtures,includingthestructure,roof,sanitaryandplumbingfacilities,drains,pipesandcables(includingelectricityandtelephone)ingoodconditions.PartyAshouldpromptlyrepairorremedyanydefectsthereinafterbei
34、ngnotifiedofsuchdefectsbyPartyB,providedallsuchdefectsarenotasaresultofthePartyBscarelessmistakeormisconduct.PartyAshalldothenecessaryrepairsormaintenancewithinsevendaysafterreceivingthenoticefromPartyB.4、甲方谨在此声明及保证甲方为出租房屋的合法拥有人并有合法地位出租此房屋于乙方。PartyAherebyrepresentsandwarrantsthatPartyAisthelegalowne
35、roftheleasedpropertyandhasthenecessarylegalcapacitytoleasethepropertytoPartyB.5、所有权变动:租赁期内该房屋所有权发生变动的,本合同在乙方与新所有权人之间具有法律效力。Transferingoftheownership:Incasetheownershipofthepremisechangesduringtheleaseperiod,theContractshallbekepteffectivebetweenPartyBandthenewowner.第七条:乙方责任TenantsResponsibilities:1、
36、乙方应按本租约第三、五条约定,按期交纳租金及其他费用。如乙方迟延支付,超过期限五个工作日,则甲方有权收取滞纳金48澳币。PartyBshouldpromptlypaytherent,depositandotherchargesassetoutinClauses3and5oftheAgreement.IntheeventthatPartyBdelaystopaytherentforfiveworkingdays,PartyAhastherighttorequireBtopaylatecharge$48.2、未经甲方书面同意,乙方不得将所租房屋分租或转租给第三方及与第三方以任何方式共用该房屋;若出
37、现上述情形,则甲方有权解除本租约,房客的家庭成员及朋友的不超过3天的短暂居住或拜访除外。DuringtheperiodofTenancy,unlesswithwrittenconsentfromPartyA,PartyBshallnottransferorsubleasethePropertyinwholeorinpartorinanymannerwhatsoeversharetheusethereofincommonorjointlywithanythirdparty.OtherwisePartyAhastherighttoterminatetheAgreement.Thisexcludes
38、thestayingoffamilyandfriendsforshortterm(nomorethan3days).3、乙方应爱护房屋及其设备,如因使用不当而导致损坏,乙方应负责赔偿。PartyBmusttakegoodcareofthepropertyanditscontents,otherwisePartyBshouldpaycompensationtoPartyAforhisimproperuseoftheproperty.4、除房内已有的装饰和设施之外,乙方如要增加设备或其他装修须征得甲方同意。租赁期满,乙方向甲方交还房产时,必须恢复其原状(正常磨损除外)。Inadditiontoth
39、edecorationandequipmentalreadyintheproperty,ifPartyBwishestomakeanyalterationsordecorationtotheproperty,PartyBshouldgettheconsentofPartyA.OncompletionoftheLease,PartyBmusthandoverthepropertytoPartyAinitsoriginalcondition(exceptforitsnormalweartear).5、在未经甲方书面同意下,乙方不得擅自设立、安装或移动设施及设备,不能擅自设立隔断,不得擅自对房屋的结
40、构改动或增加。Nottoerect,installorremoveanyfixturesorpartitioning,ortomakeanystructuraladditionsandalterationswithoutthepriorwrittenconsentofPartyA.6、租赁房屋过程中,乙方必须遵守澳大利亚的有关法律、细则、规章及法令的规定,禁止利用房屋进行违反法律及不道德的行为。PartyBmustcomplyandadhereintheuseoftheleasedpropertyaccordingtoalllaws,regulationsanddecreesoftheAust
41、ralia.Theleasedpropertyisnottobeusedforanypurposethatisunlawfulorimmoral.7、房屋除供乙方居住之外,未经甲方书面同意,房屋不可作办公或协议未曾说明之用。Theleasedpropertyisonlyforresidentialuse.PartyBshallnotusetheleasedpropertyasofficeorsomeotherpurposeswithoutthewrittenagreementofPartyB.8、租赁期内,乙方需提前退租,应提前30日通知甲方,并按月租金的支付甲方违约金。Duringthete
42、rmofcontract,IfpartyBterminatestheTenancyAgreement,PartyBshallinformParty第八条:房屋不能居住时Whenthepropertyisunfitforuseoroccupation:房屋由于火灾、恶劣天气、战争或其它甲方不可抗拒因素,而不是因为乙方直接或间接的疏忽及故意行为造成房屋毁坏而不能被正常使用及居住时,乙方从该日起停止支付租金,直至房屋可再被使用及居住时为止。Iftheleasedpropertyaresubstantiallydestroyedordamagedbyfire,badweather,war,forcem
